The subject of the contract is to define the rights and obligations of the Parties and the conditions for the provision of electricity sales. 2. Lotników Polskich 1, do sieci którego jest przyłączony. 3.Sprzedaż odbywa się za pośrednictwem sieci dystrybucyjnej należącej do OSDn. 4.Odbiorca upoważnia Sprzedawcę do pozyskiwania danych pomiarowo - rozliczeniowych, niezbędnych do realizacji niniejszej Umowy. 5.Ponadto Odbiorca oświadcza, że dysponuje tytułem prawnym do korzystania z obiektów, do których ma być dostarczana energia elektryczna na podstawie niniejszej Umowy. 6.Sprzedawca zobowiązuje się sprzedawać energię elektryczną dla zasilania obiektów Odbiorcy, a Odbiorca zobowiązuje się do odbioru energii w obiektach. 7. Ilości sprzedanej Odbiorcy energii elektrycznej ustala się w oparciu o udostępnione Sprzedawcy dane pomiarowo – rozliczeniowe dla miejsc dostarczania zgodnie z Umową o świadczenie usług dystrybucji energii elektrycznej, o której mowa w ust. 2, zgromadzone w systemach pomiarowych OSDn. 8.Dane pomiarowo – rozliczeniowe udostępniane są Sprzedawcy przez OSDn, do którego sieci przyłączony jest Odbiorca na podstawie upoważnienia, o którym mowa ust. 4. §3 Warunki techniczne 1. Sprzedawca zobowiązuje się dostarczać energię przy zachowaniu w miejscu dostarczania energii określonych parametrów jakościowych energii elektrycznej oraz przy zapewnieniu standardów jakościowych obsługi odbiorców zgodnych z obowiązującym prawem. 2. Zmiany mocy umownej dokonuje się na pisemny wniosek Odbiorcy w terminie 30 dni od daty złożenia wniosku z zastrzeżeniem ust. 4. 3. W przypadku wniosku o zmianę mocy umownej, jeśli zajdzie taka konieczność, Odbiorca zobowiązuje się do dostosowania instalacji do zmienionej mocy umownej. 4. Odbiorca zobowiązuje się odbierać energię przy wykorzystaniu mocy określonej dla poszczególnych miejsc dostarczania zgodnych z umową dystrybucyjną zawartą z OSDn. §4 Grupa taryfowa 1.Odbiorca dokonał wyboru grupy taryfowej dla poszczególnych miejsc dostarczania zgodnej z określoną w umowie dystrybucyjnej zawartej z OSDn. 2.Grupa taryfowa może być zmieniona na pisemny wniosek Odbiorcy, raz na 12 miesięcy, po spełnieniu warunków określonych przez Sprzedawcę, uwzględniających postanowienia Taryfy Sprzedawcy i uwarunkowania techniczne. §5 Obowiązki Stron Strony zobowiązują się do: | headquarters in Świdnik, Al. The measurement and billing data are made available to the Seller by the DSOn to whose network the Customer is connected on the basis of the authorization referred to in sec. 4. §3 Technical conditions 1. The seller undertakes to supply energy while maintaining the specified quality parameters of electricity at the place of supply and ensuring quality standards of customer service in accordance with applicable law. 2. Changes to the contracted capacity shall be made at the written request of the Customer within 30 days from the date of submitting the request, subject to paragraph 4. 3. In the event of an application for a change in the contracted capacity, if necessary, the Customer undertakes to adapt the installation to the changed contracted capacity. 4. The Customer undertakes to receive energy using the power specified for individual delivery locations in accordance with the distribution agreement concluded with the DSOn. §4 Tariff group 1. The Customer has selected a compliant tariff group for each delivery destination specified in the distribution agreement concluded with the DSOn. 2. The tariff group may be changed at the Customer's written request, once every 12 months, after meeting the conditions specified by the Seller, taking into account the provisions of the Seller's Tariff and technical conditions. §5 Obligations of the Parties The parties undertake to: |
a)aktualizowania wszelkich danych zawartych w Umowie mających wpływ na jej realizację, w formie pisemnej pod rygorem nieważności. W szczególności Odbiorca obowiązany jest poinformować pisemnie Sprzedawcę o zmianie adresu korespondencyjnego. Naruszenie obowiązku powiadomienia Sprzedawcy o zmianie danych korespondencyjnych powoduje, że doręczenie na adres określony powyżej lub adres wskazany później przez Odbiorcę, będzie uznane za skuteczne. b)umożliwienia wglądu do materiałów stanowiących podstawę do rozliczeń, c)zachowania tajemnicy handlowej w zakresie dotyczącym niniejszej Umowy. §6 Obowiązki Sprzedawcy Sprzedawca zobowiązuje się do: a) przestrzegania aktualnie obowiązujących przepisów w zakresie sprzedaży, o których mowa w §1 niniejszej Umowy, b) nieodpłatnego udzielania informacji o zasadach rozliczeń oraz aktualnych Taryfach, o których mowa w §13 Umowy, c) całodobowego przyjmowania reklamacji i zgłoszeń dotyczących warunków realizacji niniejszej umowy, d) rozpatrywania wniosków lub reklamacji Odbiorcy w sprawie rozliczeń i udzielania odpowiedzi nie później niż w terminie 14 dni od daty złożenia wniosku lub zgłoszenia reklamacji, e) informowania z 30-dniowym wyprzedzeniem na piśmie o zmianach warunków niniejszej umowy. §7 Obowiązki Odbiorcy Odbiorca zobowiązuje się do: a) terminowego regulowania należności za energię elektryczną i innych należności związanych ze sprzedażą energii elektrycznej, b) pobierania energii elektrycznej zgodnie z obowiązującymi przepisami i warunkami Umowy, c) niezwłocznego poinformowania Sprzedawcy o okolicznościach mających wpływ na możliwość niewłaściwego rozliczenia za energię elektryczną, d) upoważnienia Sprzedawcy w umowie, o której mowa w § 2 ust. 2 do otrzymywania danych pomiarowo - rozliczeniowych, niezbędnych do realizacji niniejszej Umowy. §8 Rozliczenia i warunki płatności 1. Rozliczenia odbywają się na podstawie odczytów układu pomiarowo- rozliczeniowego lub wskazań szacowanych zgodnie z postanowieniami aktualnych Taryf, o których mowa w §13 ust. 1 Umowy. 2. Odczytów układu pomiarowo- rozliczeniowego dokonuje upoważniony przedstawiciel OSDn i udostępnia je Sprzedawcy lub też odczyty będą | a) updating all data contained in the Agreement affecting its implementation, in writing, otherwise null and void. Violation of the obligation to notify the Seller about the change of correspondence data causes that the delivery to the address specified above or the address indicated later by the Customer will be considered effective. b) enabling access to the materials constituting the basis for settlements, c) maintaining commercial confidentiality in the scope related to this Agreement. §6 Seller's obligations The seller undertakes to: a) compliance with the currently applicable sales regulations, referred to in §1 of this Agreement, b) providing information free of charge on the rules of billing and current Tariffs, referred to in §13 of the Agreement, c) 24/7 receipt of complaints and notifications regarding the terms of the performance of this contract, d) considering the Customert's applications or complaints regarding settlements and providing answers no later than within 14 days from the date of submission of the application or complaint, e) 30 days' notice in writing about changes to the terms of this contract. §7 Duties of the Customer The Customer undertakes to: a) timely payment of electricity and other liabilities related to the sale of electricity, b) collecting electricity in accordance with the applicable provisions and terms of the Agreement, c) immediately inform the Seller about circumstances affecting the possibility of improper billing for electricity, d) the Seller's authorization in the contract referred to in § 2 section 2 to receive measurement and billing data necessary for the implementation of this Agreement. §8 Settlements and payment terms 1. Settlements are made on the basis of readings of the measurement and billing system or indications estimated in accordance with the provisions of the current Tariffs, referred to in § 13 section 1 of the Agreement. 2. The readings of the measurement and billing system shall be made by an authorized representative of DSOn and made available to the Seller or the readings will be made remotely. |

W przypadku braku dostępu do układu pomiarowo rozliczeniowego lub jego uszkodzenia należności mogą być obliczane szacunkowo na podstawie średniego dobowego zużycia z poprzedniego okresu rozliczeniowego. 3. Rozliczenia za sprzedaż energii elektrycznej przeprowadza się w jedno miesięcznym okresie rozliczeniowym 4. Odbiorca zobowiązuje się do zapłaty należności za otrzymaną energię elektryczną, na podstawie otrzymywanych faktur VAT, w terminie 14 dni od daty wystawienia faktury VAT. Dniem zapłaty jest dzień uznania rachunku bankowego Sprzedawcy. 5. W przypadku nie dotrzymania terminu płatności Sprzedawca ma prawo do obciążenia Odbiorcy odsetkami ustawowymi za opóźnienie w zapłacie. Odsetki przysługują za każdy dzień opóźnienia lub zwłoki. 6. Wniesienie reklamacji nie zwalnia Odbiorcy z obowiązku terminowej zapłaty należności w wysokości określonej na fakturze. 7. W przypadku powstania w wyniku rozliczeń nadpłaty, zostanie ona zaksięgowana na poczet przyszłych należności, o ile Odbiorca nie zażąda jej zwrotu. 8. Sprzedawca nie ponosi odpowiedzialności za ewentualne skutki wpłat dokonanych przez Odbiorcę na inny numer konta bankowego niż wskazany na fakturach wystawionych przez Sprzedawcę. 9. Sprzedawca może przekazywać osobom trzecim dokumenty, dotyczące wierzytelności przysługujących mu wobec Odbiorcy, w przypadku zbycia tych wierzytelności w drodze umowy przelewu. 10.Sprzedawca dokonuje korekty uprzednio wystawionych faktur w przypadku stwierdzenia błędów w pomiarze lub odczycie wskazań układu pomiarowo-rozliczeniowego, które spowodowały zawyżenie należności za pobraną energię elektryczną. §9 Warunki rozwiązania umowy 1. Odbiorcy przysługuje prawo wypowiedzenia Umowy, z zachowaniem miesięcznego okresu wypowiedzenia, ze skutkiem na koniec miesiąca kalendarzowego. Wypowiedzenie wymaga dla swej skuteczności zachowania formy pisemnej. Strony dopuszczają możliwość rozwiązania Umowy w innym, wzajemnie uzgodnionym terminie. 2. Sprzedawcy przysługuje prawo rozwiązania Umowy za uprzednim 30-dniowym wypowiedzeniem w przypadku, gdy Odbiorca nie uregulował płatności za sprzedaż energii przez co najmniej miesiąc po upływie terminu płatności, pomimo uprzedniego powiadomienia Odbiorcy na piśmie o zamiarze | In the case of lack of access to the metering and billing system or its damage, the receivables can be estimated based on the average daily consumption from the previous billing period. 3. Filing a complaint does not release the Customer from the obligation to pay the amount due on time in the amount specified in the invoice. 7. In the event of an overpayment as a result of settlements, it will be credited towards future receivables, unless the Recipient requests its return. 8. The Seller shall not be liable for any consequences of payments made by the Customer to a bank account number other than that indicated on the invoices issued by the Seller. 9. The Seller may provide third parties with documents relating to the receivables due to him against the Customer in the event of sale of these receivables by way of a transfer agreement. 10. The Seller shall correct the previously issued invoices in the event of errors in the measurement or reading of the measurement and billing system indications, which resulted in overstating the amount due for the electricity taken. §9 Terms of agreement termination 1. The Customer has the right to terminate the Agreement with one month's notice, effective at the end of the calendar month. To be effective, the termination must be in writing. The Parties allow the possibility of terminating the Agreement at a different, mutually agreed date. 2. The Seller has the right to terminate the Agreement with a 30-day notice in the event that the Customer has not paid for the sale of energy for at least one month after the payment deadline, despite prior written notice to the Customer of the intention to terminate the Agreement and |
wypowiedzenia Umowy i wyznaczenia dodatkowego dwutygodniowego terminu do zapłaty zaległych i bieżących należności. 3. Sprzedawcy przysługuje prawo rozwiązania Umowy, w przypadku: a)traty przez Odbiorcę tytułu prawnego do obiektu; b)nie wyrażenia zgody na zainstalowanie licznika przedpłatowego w przypadkach określonych w §12 Umowy. 4. Sprzedawca dopuszcza rozwiązanie umowy po przekazaniu obiektu nowemu użytkownikowi i dostarczeniu Sprzedawcy protokołu zdawczo- odbiorczego z podanymi wskazaniami układu pomiarowo- rozliczeniowego. Rozwiązanie Umowy następuje z chwilą podpisania Umowy z nowym użytkownikiem. Do chwili podpisania nowej Umowy Odbiorca zostanie obciążony należnościami wynikającymi z realizacji Umowy. Dodatkowo Strony ustalają, że dostarczenie przez następcę prawnego (nowego użytkownika) protokołu zdawczo- odbiorczego podpisanego przez Odbiorcę i nowego użytkownika, stanowi podstawę rozwiązania Umowy bez zachowania okresu wypowiedzenia. §10 Odpowiedzialność Sprzedawcy za niedotrzymanie warunków Umowy 1. Za niedotrzymanie standardów jakościowych obsługi odbiorców, Odbiorcy na jego pisemny wniosek przysługują bonifikaty w wysokości i na zasadach, o których mowa w Przepisach wskazanych w §1 Umowy. Sprzedawca zobowiązuje się rozpatrzyć wniosek Odbiorcy w terminie 14 dni od jego złożenia. 2. Sprzedawca nie ponosi odpowiedzialności, jeżeli szkoda nastąpiła wskutek działania siły wyższej, działania osoby trzeciej, za którą Sprzedawca nie ponosi odpowiedzialności bądź wyłącznie z winy Odbiorcy. 3. Sprzedawca nie ponosi odpowiedzialności za skutki przerw i ograniczeń w sprzedaży energii elektrycznej spowodowanych: a)awarią w sieci elektroenergetycznej przez czas niezbędny do jej usunięcia oraz w wypadku ograniczeń w dostarczaniu energii elektrycznej w związku z zagrożeniem życia, zdrowia, mienia lub środowiska, b)planowanymi przerwami w dostarczaniu energii elektrycznej, c)wstrzymaniem dostarczania energii elektrycznej lub odłączeniem Odbiorcy od sieci dystrybucyjnej zgodnie z zapisami umowy, o której mowa w §2 ust. 2, d)brakiem świadczenia usług dystrybucji przez OSDn. §11 Wstrzymanie sprzedaży 1. Sprzedawca może wstrzymać świadczenie sprzedaży w przypadku, gdy Odbiorca zalega z zapłatą co najmniej | setting an additional two-week deadline for payment. overdue and current receivables. 3. In addition, the Parties agree that the delivery by the legal successor (new user) of the delivery and acceptance protocol signed by the Customer and the new user is the basis for termination of the Agreement without notice. §10 The Seller's liability for failure to comply with the terms of the Agreement 1. For failure to meet the quality standards of customer service, the Customer, upon their written request, are entitled to discounts in the amount and on the terms referred to in the Regulations specified in §1 of the Agreement. The Seller undertakes to consider the Customer's application within 14 days of its submission. 2. The Seller shall not be liable if the damage occurred as a result of force majeure, an action of a third party for which the Seller is not responsible or solely due to the fault of the Customer. 3. The seller is not responsible for the effects of interruptions and limitations in the sale of electricity caused by: a) a failure in the power network for the time necessary to remove it and in the event of limitations in the supply of electricity due to the threat to life, health, property or the environment, b) planned interruptions in the supply of electricity, c) withholding the supply of electricity or disconnecting the Customer from the distribution network in accordance with the provisions of the contract referred to in §2 section 2, d) lack of distribution services provided by DSOn. §11 Suspension of sale 1. The Seller may suspend the provision of sale if the Customer is in arrears with payment at least one month |

Sprzedawca jest obowiązany do bezzwłocznego wznowienia sprzedaży, jeżeli ustaną przyczyny uzasadniające jej wstrzymanie. 3. Przed wznowieniem świadczenia sprzedaży, Odbiorca jest zobowiązany pokryć należności wynikające odpowiednio z Taryf, o których mowa w §13 ust. 1 Umowy. 4. Sprzedawca nie ponosi odpowiedzialności za ewentualne szkody spowodowane wstrzymaniem sprzedaży albo wstrzymaniem dostarczania energii elektrycznej na skutek nie realizowania przez Odbiorcę postanowień Umowy. §12 Przedpłatowy układ pomiarowo-rozliczeniowy 1. Sprzedawca może zainstalować przedpłatowy układ pomiarowo-rozliczeniowy służący do rozliczeń za świadczenie sprzedaży, jeżeli Odbiorca: a) co najmniej dwukrotnie w ciągu kolejnych 12 miesięcy zwlekał z zapłatą za pobraną energię przez okres co najmniej jednego miesiąca; b) nie ma tytułu prawnego do nieruchomości, obiektu lub lokalu, do którego dostarczana jest energia; c) użytkuje nieruchomość, obiekt lub lokal w sposób uniemożliwiający cykliczne sprawdzanie stanu układu pomiarowo-rozliczeniowego. 2. W przypadku zaistnienia okoliczności opisanych w ust. 1, Odbiorca nie ponosi kosztów zainstalowania przedpłatowego układu pomiarowo-rozliczeniowego. 3. W razie braku zgody Odbiorcy na zainstalowanie przedpłatowego układu pomiarowo rozliczeniowego, Sprzedawca może wstrzymać sprzedaż energii lub rozwiązać umowę sprzedaży w trybie określonym w §9 ust. 3 pkt. b) Umowy. § 13 Sposób ustalania cen i warunki wprowadzania ich zmian 1. Wartość należności za sprzedaż energii elektrycznej obliczana będzie w oparciu o ceny energii elektrycznej wynikające z „Taryfy dla energii elektrycznej” wprowadzanej do stosowania decyzją Zarządu Sprzedawcy. 2. Taryfa o której mowa w ust. 1 jest zbiorem cen i stawek opłat oraz warunków ich stosowania. 3. Sprzedawca poinformuje każdorazowo Odbiorcę o zmianie Taryfy, o której mowa w ust. 1 w zakresie cen lub stawek opłat oraz o dniu wejścia w życie zmiany. W takim przypadku Odbiorcy przysługuje prawo rozwiązania umowy bez wypowiedzenia. The Seller may install a prepaid metering and billing system used for settlements for the provision of sales, if the Customer: a) delayed payment for the consumed energy at least twice in the following 12 months for a period of at least one month; b) has no legal title to the real estate, facility or premises to which the energy is supplied; c) uses the property, facility or premises in a way that prevents periodic checking of the condition of the measurement and billing system. 2. In the event of the circumstances described in sec. 1, the Customer shall not bear the costs of installing the prepayment measurement and billing system. 3. If the Customer does not consent to the installation of the pre-payment metering and billing system, the Seller may suspend the sale of energy or terminate the sales contract in the manner specified in §9 sec. 3 points b) Agreements. § 13 Method of determining prices and conditions for introducing their changes 1. The value of receivables for the sale of electricity will be calculated on the basis of electricity prices resulting from the "Electricity Tariff" introduced by decision of the Seller's Management Board. 2. The tariff referred to in sec. 1 is a set of prices and rates of fees and conditions of their application. 3. The Seller shall inform the Customer each time about the change of the Tariff referred to in sec. 1 in terms of prices or rates of fees and the effective date of the amendment. In this case, the Customer has the right to terminate the contract without notice. The change comes into force if the |

Informacje o aktualnej wysokości cen energii oraz wysokości stawek opłat oraz taryf, a także o sposobie dokonania odczytu na dzień wprowadzenia nowych taryf i nowych cen i stawek opłat Odbiorca może uzyskać pod numerem telefonu 00 000-00-00. § 14 Czas obowiązywania Umowy Umowa wchodzi w życie z dniem r. i zostaje zawarta na czas nieokreślony, z możliwością jej wypowiedzenia na zasadach określonych w §9. Z dniem wejścia w życie Umowy następuje rozpoczęcie sprzedaży energii. § 15 Zasady zmiany Sprzedawcy 1. Odbiorca ma prawo do zmiany Sprzedawcy. 2. Odbiorca nie może zawierać jednocześnie kilku umów sprzedaży energii na ten sam okres z więcej niż jednym Sprzedawcą dla jednego miejsca jej dostarczania. 3. Warunkiem koniecznym umożliwiającym zmianę Sprzedawcy przez Odbiorcę jest jednoczesne obowiązywanie umowy sprzedaży energii z nowym Sprzedawcą. 4. Odbiorca dokonując zmiany Sprzedawcy zawiera umowę sprzedaży energii z nowym Sprzedawcą i wypowiada umowę sprzedaży energii zawartą z dotychczasowym Sprzedawcą lub udziela upoważnienia nowemu Sprzedawcy do dokonania jej wypowiedzenia. 5. Po zawarciu umowy sprzedaży energii z nowym Sprzedawcą, Odbiorca oraz nowy Sprzedawca powiadamiają OSDn o zawarciu umowy sprzedaży energii. Odbiorca może udzielić Sprzedawcy upoważnienia do dokonania w jego imieniu powiadomienia OSDn. 6. Umowa sprzedaży energii z nowym Sprzedawcą powinna wejść w życie z dniem skutecznego rozwiązania umowy sprzedaży zawartej pomiędzy Odbiorcą i jego dotychczasowym Sprzedawcą, pod warunkiem zgłoszenia umowy sprzedaży energii z nowym Sprzedawcą do OSDn oraz pod warunkiem jej pozytywnego zweryfikowania. 7. Szczegółowe informacje dotyczące zasad zmiany sprzedawcy energii elektrycznej dostępne są na stronie internetowej OSDn pod adresem: xxx.xxx.xxx.xxxxxxx.xx § 16 Postanowienia końcowe 1. Nie wymagają formy aneksu do Umowy: | Recipient does not terminate the Agreement within 14 days of its receipt. 4. The tariff referred to in sec. 1 of the Agreement is made available to the Customer at his request. 5. Information on the current level of energy prices and the amount of fees and tariffs, and The Customer may obtain information on the method of reading as of the day of introducing new tariffs and new prices and rates by calling 00 000-00-00. § 14 Duration of the Agreement The agreement shall enter into force on and is concluded for an indefinite period, with the possibility of termination on the terms set out in §9. The sale of energy commences on the day the Agreement enters into force. § 15 Rules for changing the Seller 1. The Customer has the right to change the Seller. 2. The Customer may not conclude at the same time several energy sale contracts for the same period with more than one Seller for one place of its delivery. 3. The necessary condition for the Buyer to change the Seller is the simultaneous validity of the energy sales contract with the new Seller. 4. By changing the Seller, the Customer concludes an energy sales contract with a new Seller and terminates the energy sales contract concluded with the current Seller or authorizes the new Seller to terminate it. 5. After the conclusion of the energy sale agreement with the new Seller, the Customer and the new Seller notify the DSOn about the conclusion of the energy sale agreement. The Customer may authorize the Seller to notify the DSOn on its behalf. 6. The contract for the sale of energy with the new Seller should enter into force on the effective termination of the contract of sale concluded between the Customer and his current Seller, provided that the contract for the sale of energy with the new Seller is submitted to the DSOn and subject to positive verification. 7. Detailed information on the rules of changing the electricity supplier is available on the DSOn website at: xxx.xxx.xxx.xxxxxxx.xx § 16 Final provisions 1. They do not require the form of an annex to the Agreement: |
a) zmiany adresowe z zastrzeżeniem zapisów §6 niniejszej umowy, b) zmiana siedziby i adresu do korespondencji, numeru rachunku bankowego oraz miejsca dostarczania faktur, c) wymiana/montaż licznika energii elektrycznej (tylko podpisanie protokołu z wymiany/montażu). 2. Wszelkie pozostałe zmiany warunków, nie wskazane w ust.1 wymagają zmiany umowy w formie pisemnej, pod rygorem nieważności. 3. Odbiorca wyraża zgodę na przesyłanie dokumentów zawierających dane osobowe drogą pocztową, w tym listem poleconym i przesyłką kurierską. 4. Ewentualne spory mogące wyniknąć w trakcie realizacji niniejszej Umowy, nie podlegające kompetencji Prezesa Urzędu Regulacji Energetyki, podlegają rozstrzygnięciu właściwego miejscowo i rzeczowo sądu powszechnego. 5. W sprawach nieuregulowanych w niniejszej Umowie zastosowanie mają przepisy aktów prawnych wskazanych w §1 niniejszej Umowy. 6. Umowę sporządzono w dwóch jednobrzmiących egzemplarzach, po jednym dla każdej ze Stron. 7. Odbiorca wyraża zgodę na gromadzenie i przetwarzanie swoich danych osobowych w zakresie niezbędnym dla realizacji powyższej Umowy, zgodnie z USTAWĄ z dnia 29 sierpnia 1997 r. o ochronie danych osobowych (Dz. U. z 2002 r. Nr 101, poz. 926 z późn. zm.). Odbiorca wyraża zgodę na gromadzenie i przetwarzanie jego danych osobowych przez Sprzedawcę oraz podmioty działające na jego rzecz dla celów marketingowych i reklamowych związanych ze sprzedażą energii. Any other changes to the conditions, not indicated in section 1, require a written amendment to the contract, otherwise null and void. 3. The Customer agrees to send documents containing personal data by post, including registered mail and courier. 4. Any disputes that may arise during the implementation of this Agreement, which do not fall within the competence of the President of the Energy Regulatory Office, shall be settled by the competent local and substantive common court. 5. In matters not covered by this Agreement, the provisions of the legal acts specified in §1 of this Agreement shall apply. 6. The contract was drawn up in two identical copies, one for each of the Parties. 7. The Customer agrees to the collection and processing of his personal data to the extent necessary for the implementation of the above Agreement, in accordance with the Act of August 29, 1997 on the protection of personal data (Journal of Laws of 2002, No. 101, item 926 as amended). The Customer agrees to the collection and processing of his personal data by the Seller and entities acting on his behalf for marketing and advertising purposes related to the sale of energy.
