1. Promocja „ Weekend in Gdańsk” (‘Promocja’) jest organizowana przez AEROTUNEL Spółka z

ograniczoną odpowiedzialnością, z siedzibą w Warszawie, 00-090, Al. Solidarności 75/26,

wpisaną do Krajowego Rejestru Sądowego pod numerem KRS: 0000821632, NIP: 5252533508 (‘Flyspot’).

2. W ramach Promocji Flyspot oferuje możliwość uzyskania rabatów od cen czasu tunelowego, zgodnie z następującymi zasadami:

Cena za pakiet Weekend in Gdańsk wynosi 4399 zł brutto i obejmuje:

i. 2 godziny czasu tunelowego bez coachingu do wylatania w czasie dziennym i nocnym;

ii. bezpłatne zakwaterowanie we Flyspot dla jednej osoby, przez maksymalnie 2 dni zgodnie z podpunktem 4 poniżej.

3. Czas Tunelowy na warunkach wynikających z Promocji może zostać nabyty w okresie od 6 czerwca 2024 r. do 31 grudnia 2024 r. przez każdą osobę fizyczną, która posiada konto w serwisie Flyspot i jest proflyerem, tzn. potrafi samodzielnie latać w tunelu, bez opieki instruktora ('Użytkownik').

4. Bezpłatne zakwaterowanie podlega następującym zasadom:

i. zakwaterowanie zapewniane jest w obiekcie Flyspot Gdańsk lub hotelach

współpracujących z Flyspot;

ii. zakwaterowanie zapewniane jest dla Użytkownika (jednej osoby);

iii. Flyspot nie zapewnia transportu miedzy tunelem a miejscem zakwaterowania;

iv. Flyspot nie gwarantuje noclegów w pokojach jednoosobowych – jest to uzależnione od dostępności;

v. w celu rezerwacji noclegu prosimy o kontakt na adres xxx@xxxxxxx.xxx z co najmniej 3 dniowym wyprzedzeniem;

vi. z noclegu można skorzystać tylko w okresie, na który zarezerwowany został czas lotu

z pakietu (maksymalnie przez 2 dni).

vii. W dniach od 20 do 24 listopada 2024 rezerwacja noclegów w ramach pakietu jest

niedostępna z powodu odbywających się w tym czasie zawodów X Flyspot Polish Open.

5. Czas Tunelowy może zostać wylatany/wykorzystany:

i. wyłącznie w tunelu aerodynamicznym Flyspot Xxxxxx (Xxxxxx, xx. X. Xxxxxxxxxxx 000X);

ii. wylatany wyłącznie do 31.12.2024 (przy czym decydujące są daty, na jakie zostanie dokonana rezerwacja czasu latania, a nie data, w której Użytkownik dokonuje rezerwacji);

iii. wyłącznie do rezerwacji slotów dla proflyerów zgodnie z dostępnością w systemie

rezerwacji online Flyspot

z zastrzeżeniem, iż pierwszy i ostatni slot przed lub po standardowych godzinach otwarcia/zamknięcia danego tunelu będzie mógł zostać zarezerwowany przy wykorzystaniu godzin Czasu Tunelowego wyłącznie, jeśli – odpowiednio – slot bezpośrednio wcześniejszy lub slot bezpośrednio późniejszy będzie zarezerwowany. W przeciwnym przypadku pierwsze bądź ostatnie pół godziny nie będzie możliwe do zarezerwowania i Użytkownik powinien dokonać wyboru innego slotu. Dla przykładu, jeśli dany tunel będzie czynny od 10.00 do 23:00 od

poniedziałku do niedzieli, a Użytkownik chciałby we wtorek zrobić rezerwację przy wykorzystaniu Czasu Xxxxxxxxxx na godzinę 9:30 rano, to będzie miał taką możliwość tylko, jeśli o godzinie 10:00 rano w systemie będzie widoczna już inna rezerwacja. Analogicznie, jeśli w takiej sytuacji Użytkownik będzie zamierzał dokonać rezerwacji na godzinę 23:30, będzie mógł to zrobić tylko jeśli o 23:00 będzie inna rezerwacja.

6. Cena za Czas Tunelowy nie zawiera coachingu. Czas Tunelowy nie może być odsprzedawany osobom trzecim. Czas Tunelowy będzie mógł być wykorzystywany przez Użytkownika samodzielnie bądź z innymi profly’erami, z tym również może być nabywany przez coachów dla potrzeb odbywania lotów z Klientami, z zastrzeżeniem standardowych zasad dotyczących dokonywania rezerwacji dla profyer’ów, w szczególności zasady, iż mnimalna rezerwacja dla jednej osoby w jednym slocie wynosi 10 minut.

7. Z zastrzeżeniem ust. 8 i 9 poniżej, Użytkownik ma prawo odstąpić od umowy zakupu Pakietów w Promocji, bez podania przyczyny i bez ponoszenia kosztów, w ciągu 14 dni od daty zawarcia umowy, tj. zakupu Pakietu w Promocji. Oświadczenie o odstąpieniu może zostać wysłane na adres xxx@xxxxxxx.xxx.

8. Rozpoczęcie realizacji usługi korzystania z Czasu Tunelowego przed upływem terminu do odstąpienia od umowy będzie możliwe jedynie pod warunkiem, iż Użytkownik – zaznaczając odpowiedni check box – złoży wyraźne oświadczenie zawierające takie żądanie. W powyższej sytuacji, jeżeli Użytkownik skorzysta z prawa odstąpienia od umowy po zgłoszeniu żądania, Użytkownik będzie miał obowiązek zapłaty za świadczenia i usługi (tj. loty w tunelu i ew. coaching) otrzymane do chwili odstąpienia od umowy, przy czym cena lotów w tunelu będzie naliczana według cen rynkowych obowiązujących w dniu korzystania z nich przez Użytkownika lub zawarcia umowy, w zależności od tego, która z nich jest korzystniejsza dla Użytkownika. Aktualny cennik dostępny jest na stronie internetowej lub w recepcji lub można go otrzymać pocztą na żądanie wysłane na adres: xxx@xxxxxxx.xxx.

9. W przypadku dokonania rezerwacji lotów przy użyciu Czasu Tunelowego, Użytkownikowi nie przysługuje prawo odstąpienia od umowy (zgodnie z art. 38 pkt. 12 ustawy o prawach konsumenta).

10. Promocja nie podlega łączeniu z innymi promocjami oferowanymi przez Flyspot.

11. Przy zakupie nie obowiązują kody resellerskie.

12. W przypadku dokonania rezerwacji lotów przy wykorzystania Czasu Tunelowego nie będzie możliwości anulowania takiej rezerwacji. Aerotunel, w tym w razie problemów zdrowotnych po stronie Użytkownika i innych tego typu okoliczności, dopuszcza możliwość przeniesienia rezerwacji na inny termin, przy czym taka zmiana rezerwacji musi nastąpić nie później niż do 1 godziny przed terminem zarezerwowanego lotu oraz z zastrzeżeniem, iż taka zmiana jest płatna. Opłaty za dokonanie zmiany wynikają z cennika dostępnego poniżej:

13. Administratorem danych osobowych Użytkownika jest AEROTUNEL Spółka z ograniczoną odpowiedzialnością, z siedzibą w Warszawie (pozostałe dane w ust. 1 powyżej). Dane osobowe będą przetwarzane przez Flyspot dla celów niezbędnych do wykonania umowy, zawartej w ramach Promocji oraz dla celów wynikających z prawnie uzasadnionych interesów realizowanych przez administratora, w szczególności marketingu usług świadczonych przez Flyspot, w tym profilowania danych osobowych dla powyższych potrzeb, przy czym Użytkownik ma prawo w każdym czasie zgłosić sprzeciw wobec przetwarzania jego danych osobowych dla celów marketingowych. Użytkownik ma również prawo do żądania od Flyspot dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania, a także prawo do przenoszenia danych oraz wniesienia skargi do organu nadzorczego. Dane osobowe mogą̨ być powierzane podwykonawcom Flyspot. Dane osobowe będą

przechowywane przez Flyspot przez okres realizacji umowy, a po tym czasie – przez okres

wymagany przepisami prawa. Podanie danych jest dobrowolne, przy czym jest ono niezbędne

dla potrzeb zawarcia i realizacji umowy z Flyspot.

14. W kwestiach nieuregulowanych w niniejszym Regulaminie stosuje się: (i) w zakresie

dotyczącym zasad odstąpienia od umowy – postanowienia Regulaminu sklepu internetowego Flyspot (ii) w pozostałym zakresie - w tym zasad świadczenia usług, jakości, przetwarzania danych osobowych – Regulamin świadczenia usług – Flyspot. W pozostałym zakresie stosuje się ̨ obowiązujące przepisy prawa polskiego.

15. Niniejszy Regulamin wchodzi w życie w dniu 6 czerwca 2024 r. i dotyczy Czasu Tunelowego nabytego od tego dnia. Do wszystkich zakupów Czasu Xxxxxxxxxx w ramach poprzedniej edycji Promocji, tj. do dnia 5 czerwca 2024 r. stosuje się postanowienia poprzedniego

Regulaminu Promocji „Weekend in Gdańsk”.

Regulations of the " Weekend in Gdansk " Promotion

1. The " Weekend in Gdansk " promotion (the "Promotion") is organized by AEROTUNEL Spółka z ograniczoną odpowiedzialnością, with its registered office in Xxxxxx, 00-000, Xx. Xxxxxxxxxxxx 00/00, entered into the National Court Register under the KRS number: 0000821632, NIP: 5252533508 ('Flyspot').

2. In the framework of the Promotion, Flyspot offers the opportunity to obtain discounts on tunnel time prices, according to the following rules:

The price for the Weekend in Gdansk package is PLN 4399 gross and includes:

i. 2 hours of tunnel time to use during day and night w/o coaching;

ii. free accommodation at Flyspot for one person, for maximum 2 days as per subsection 4 below.

3. Tunnel Time, under the terms of the Promotion, may be purchased in the period from June 6, 2024 to December 31, 2024 by any natural person who has an account on the Flyspot website and is a proflyer , i.e. can fly in the tunnel independently, without the supervision of an instructor (the 'User').

4. Free accommodation is subject to the following rules:

i. accommodation is provided at Flyspot Gdansk facility or hotels cooperating with Flyspot;

ii. accommodation is provided for User only (one person);

iii. Flyspot does not provide transportation between the tunnel and the hotel;

iv. Flyspot does not guarantee single rooms accommodations – it is a subject to availability;

v. for the purposes of booking accommodation, please contact xxx@xxxxxxx.xxx at least 3 days in advance;

vi. accommodation can be used only during the period for which flying time from the package has been booked (max 2 days).

vii. From November 20 to 24, 2024, accommodation reservations within the package are unavailable due to the X Flyspot Polish Open competition taking place during this time.

5. Tunnel Time can be flown/used:

i. only in Gdansk wind tunnel (Gdańsk, xx. X. Xxxxxxxxxxx 000X);

ii. flown only until December 31, 2024 (the decisive date is the date for which the flight time reservation will be made, and not the date on which the User makes the reservation);

iii. only to book pro-flyers slots only according to availability in Flyspot online booking system

with the proviso that the first and last slot before or after the standard opening / closing hours of a given tunnel may be reserved using the Tunnel Time hours only if - respectively - the slot immediately earlier or the slot immediately later will be reserved. Otherwise, the first or the last half hour will not be bookable and the User should choose a different slot covered by the Promotion. For example, if a given tunnel is open from 10:00 am to 11:00 pm from Monday to Sunday, and the User would like to make a reservation on Tuesday using the Tunnel Time at

9.30 am., he/she will only be able to do so if at 10:00 am another booking will be visible in the system. Similarly, if in such a situation the User intends to make a reservation for 11:30 pm, he/she will only be able to do so if there is another reservation at 11:00 pm.

6. Tunnel Time price does not include coaching. Tunnel Time may not be resold to third parties. Tunnel Time will be able to be used by the User on his/her own or with other profly'ers; it can also be purchased by coaches for the purpose of flying with Clients, subject to the standard rules for making reservations for proflyers, in particular the rule that the minimum single reservation in one slot for one proflyer is 10 minutes.

7. Subject to section 8 and 9 below, the User has the right to withdraw from the contract for the purchase of Packages in the Promotion, without giving any reason and without incurring costs, within 14 days from the date of the contract, i.e. the purchase of a Package in the Promotion. A declaration of withdrawal may be sent to xxx@xxxxxxx.xxx .

8. The commencement of the service of using Tunnel Time before the expiry of the withdrawal period will be possible only on the condition that the User - by selecting the appropriate check

box - folds clear a statement containing such a request. In the above situation, if The User will exercise the right to withdraw from the contract after submitting the request, the User will be obliged to pay for the benefits and services (i.e. flights in the tunnel and, if applicable, coaching) received until the withdrawal from the contract, the price of the flights in the tunnel will be charged according to the market prices in force on the day of using them by the User or concluding the contract, depending on which of them is more beneficial for the User . The current price list is available on the website or at the reception desk or can be obtained by mail upon request to the following address: xxx@xxxxxxx.xxx .

9. In the case of actual booking of the flights with usage of the Tunnel Time, the User is not entitled to withdraw from the contract (in accordance with Article 38 point 12 of the Act on Consumer Rights).

10. The promotion cannot be combined with any other promotion offered by Flyspot.

11. Reseller codes do not apply.

12. In case of booking the flights using Tunnel Time, the User will not be able to cancel the booking. Aerotunel, including in the event of health problems on the part of the User and other such circumstances, allows the possibility of transferring the booking to another date, however such a change of booking must take place no later than 1h before the date of the booked flight and provided that such change is payable. The fees for making the change result from the price list available below:

13. Data controller of the User 's personal data is AEROTUNEL Spółka z ograniczoną odpowiedzialnoscią with its registered seat in Warsaw (other data in section 1 above). Personal data will be processed by Flyspot for the purposes necessary for the performance of the contract concluded as part of the Promotion and for the purposes resulting from the legitimate interests pursued by the data controller, in particular the marketing of services provided by Flyspot , including profiling of personal data for the above needs, whereas the User has the right to object to the processing of his/her personal data for marketing purposes at any time. The User also has the right to request Flyspot to access his/her personal data, rectify it, delete it or limit processing, as well as the right to transfer data and lodge a complaint with the supervisory authority. Personal data may be entrusted to Flyspot subcontractors. Personal data will be stored by Flyspot for the duration of the contract, and after that - for the period required by law. Providing data is voluntary, but it is necessary for the conclusion and performance of the contract with Flyspot.

14. In matters not regulated herein the following shall apply: (i) in the scope related to withdrawal from the contract – provisions of Terms and Conditions of Flyspot Online Shop, (ii) in the remaining scope – including terms of provision of services, quality, processing of personal data

– provisions of Regulations of Rendering Services by Flyspot and in matters not regulated therein - the provisions of Polish law.

15. These Regulations enter into force on June 6, 2024 and apply to the Tunnel Time acquired from that date. For all purchases of Tunnel Time under the previous edition of the Promotion, i.e. until June 5, 2024, the provisions of the previous Promotion Regulations "Weekend in Gdansk" shall apply.
