Definicja Legal Action
Legal Action any action permitted by law undertaken by DelayFix as part of the Service, necessary for obtaining Redress if the Air Carrier in the Complaint Procedure: has not recognised the Complaint or, in spite of recognising the Complaint, has not paid the Redress within the time limit specified in the Complaint to the DelayFix bank account indicated in the Complaint, or has failed to respond to the Complaint and has not paid the Redress to the DelayFix bank account indicated in the Complaint within the time limit specified in the Complaint, including in particular action undertaken after the Complaint Proceedings have ended - irrespective of their outcome - consisting in:
a. a final request to the Air Carrier for payment of the Redress or other action aimed at a conciliatory resolution of the dispute before instituting judicial proceedings,
b. institution and conduct of judicial proceedings,
c. concluding a settlement with the Air Carrier,
d. institution and conduct of enforcement proceedings.
Legal Action necessary and legally justified actions taken by DelayFix as part of the service provided in order to obtain Redress from the Carrier. These actions are taken if the Air Carrier, in the Complaint Procedure: has not acknowledged the complaint or, despite acknowledging the complaint, has not paid the Redress in accordance with the contents of the complaint or has not responded to the complaint and has not paid the Redress in accordance with the contents of the complaint; these are actions taken after the Complaint Procedure - regardless of its outcome - consisting of:
a. a final request to the Air Carrier for payment of the Redress or other action aimed at a conciliatory resolution of the dispute before instituting judicial proceedings,
b. institution and conduct of judicial proceedings,
c. concluding a settlement with the Air Carrier,
d. institution and conduct of enforcement proceedings.
