Avuga ko kugira ngo uru rukiko rukemure icyo kibazo, rukwiye guhuza ibiteganywa n’Itegeko rigenga umurimo mu Rwanda hamwe n’amategeko yayo arimo «Disciplinary procedure» na Delegation Authorities xxxx xxxxxx itegeko hagati y’impande zombi zayagiranye nk’uko biteganywa n’ingingo ya 64 y’Itegeko rigenga amasezerano, rukemeza ko yamwirukanye mu buryo bukurikije amategeko.
[14] Asobanura ko Xxxxx Xxxxxxx Niangoran yakoze ikosa ku wa 14/03/2014, ubwo yandikiraga Umuyobozi we amubwira ko atakwishyira mu kaga ngo ahembe XXXXXXXX Xxxxxxxx ibirarane by’amafaranga asaba kuko binyuranyije n’amategeko y’u Rwanda na éthique ye, ko yamenyeshejwe iryo kosa ku wa 20/03/2014, aryisobanuraho imbere y’Akanama gashinzwe imyitwarire y’Abakozi xx XXXXX Ltd ku wa 04/04/2014, ko nyuma yo kwisobanura, abagize ako Kanama basanze imyiregurire ye igize ikosa rikomeye rituma yirukanwa ku kazi hashingiwe ku cyemezo cy’ako Kanama, ariko ko iyo ENGEN RWANDA Ltd xxxxx imwirukana idakurikije iyo procédure, yabaga inyuranyije na Disciplinary procedure yishyiriyeho.
[15] Yanzura avuga ko kuba ENGEN RWANDA Ltd yarasheshe amasezerano yagiranye na Xxxxx Xxxxxxx Niangoran mu buryo bukurikije amategeko, bituma atahabwa 135.627.212 Frw y’indishyi z’uko yirukanwe nta mpamvu yagenewe n’Urukiko Rwisumbuye rwa Gasabo, ariko ko agomba guhabwa 16.760.694 Frw ya retirement fund yagenewe n’urwo rukiko kubera ko ayafitiye uburenganzira.
[16] Ababuranira Xxxxx Xxxxxxx Niangoran bavuga ko ENGEN RWANDA Ltd xxxxxxxx xxxxxxxxxxx y’akazi xxxxxxxxx hadashingiwe ku ikosa rikomeye kubera ko itahise irimumenyeshwa ngo inamwirukane ku kazi mu gihe cy’amasaha 48 ateganywa n’ingingo ya 28 y’Itegeko nᵒ 13/2009 ryo ku wa 27/5/2009 rigenga umurimo mu Rwanda.

[18] Bavuga ko à titre subsidaire, kuba ENGEN RWANDA Ltd itaramenyesheje Xxxxx Xxxxxxx Niangoran ikosa yakoze mu gihe cy’amasaha 48 ngo inahite imwirukana muri icyo gihe, bigaragara ko atari ikosa rikomeye, ko ahubwo yaba yarakoze ikosa ryoroheje ryashoboraga gutuma umukoresha we amwihanangiriza (avertissement) kuko bwari ubwa mbere arikoze. Ko xxxx xxxxx Xxxxx Xxxxxxx Niangoran atarajuririye icyemezo yafatiwe n’Akanama gashinzwe imyitwarire y’abakozi xx XXXXX RWANDA Ltd, xxx xxx atari yizeye ubutabera bwayo, kuko Xxxx Naidoo wamushinje xxxxxx wasinye ku cyemezo kimwirukana ku kazi.

[20] Bongeraho ko uru rukiko rutashingira kuri Delegations Authoroties no kuri Disciplinary procedure bya ENGEN RWANDA Ltd ku birebana n’uburyo bwo kubara amasaha 48, mu gihe anyuranyije n’Itegeko rigenga umurimo mu Rwanda, riteganya ko umukozi wakoze ikosa rikomeye agomba kurimenyeshwa no kwirukanwa mu gihe kitarenze amasaha 48.
