PREAMBLE
Since the phenomenon of trafficking in persons is not episodic but one with profound social and economic implications that affect a considerable number of segments of society, producing millions of human drama, the National Agency against Trafficking in Persons, the National Trade Union Confederation "Cartel Alfa" and the Employers Confederation of Industry of Romania, willing to align to the joint efforts of national and international prevention of this phenomenon, have structured their actions based on its complexity, on the regional specificity and on the legislative initiatives in the field, agreed the following :
Chapter I. General Frame
NATIONAL TRADE UNION CONFEDERATION „Cartel ALFA", hereinafter reffered as CNS „Cartel ALFA”, headquartered in Bucharest, 202A Bd. Splaiul Independenţei, sector 6, legally represented by Mr. Xxxxxx Xxxxx XXXXX, as President,
NATIONAL AGENCY AGAINST TRAFFICKING IN PERSONS, hereinafter referred as ANITP, headquartered in Bucharest, 0 Xxxxx Xxxx xxx., xxxxxx 0, legally represented by Mr. Xxxxxxx XXXXXXXXX, as President,
EMPLOYERS CONFEDERATION OF INDUSTRY OF ROMANIA, hereinafter referred as CONPIROM, headquartered in Bucharest, 00 Xxxxxxxxxx Xxx., xxxxxx 3, represented by Mr. Xxxxxx XXXXX, as President,
hereinafter referred to as the Parties, after identifying common interests in the fight against trafficking in persons, conclude this Memorandum.
The partnership resulted in the signing of this Memorandum shall be conducted in accordance with the law, based on mutual assistance and mutual respect.
Chapter II. Objective of the Memorandum
This Protocol aims:
a. to prevent trafficking in persons, paying special attention to persons involved in activities for profit;
b. to protect and assist victims of trafficking, fully respecting their fundamental rights;
c. to promote cooperation between the parties of this memorandum, on national and international scale, to achieve these goals;
Chapter III. Involvement of the Parties
Article 2. (1) National Trade Union Confederation "Cartel ALFA will ensure:
a. the adoption of measures necessary to identify cases of trafficking in persons;
b. the adoption of measures necessary to identify working places in order to reintegrate the victims of trafficking in persons;
c. the adoption of measures necessary to monitor working conditions;
d. elaboration, together with other parties, of educational materials and organization of joint activities for the prevention of trafficking through labor exploitation;
e. participation in public information campaigns of Romanian citizens concerning the risks of work without legal documents;
f. appointment of a representative who will be in touch with the representatives of ANITP and CONPIROM in order to conduct activities of this Memorandum.
(2) The National Agency against Trafficking in Persons will ensure:
a. the access to special materials, documentary materials, statistical data, according to the law;
b. the invitation of the staff of CNS "Cartel ALFA and of CONPIROM to events involving activity in the field of trafficking in persons;
c. elaboration, together with other parties, of educational materials and organization of joint activities for the prevention of trafficking through
labor exploitation;
d. the development of public information campaigns of Romanian citizens concerning the risks of work without legal documents;
e. the management of its own financial resources necessary to develop joint projects;
f. information of the parties about the existence of trafficked persons who want to be reintegrated on the labor market;
g. appointment of a representative who will be in touch with the CNS "Cartel ALFA and CONPIROM in order to conduct activities in this Memorandum.
(3) Employers Confederation of Industry of Romania will ensure:
a. adoption of measures, necessary to mitigate the effects of work without legal documents, through the development of specific policies;
b. organization of courses and training programs for trafficked victims in order to reintegrate them;
c. participation in public information campaigns of Romanian citizens concerning the risks of work without legal documents;
d. measures, necessary to identify jobs in order to reintegrate the victims of trafficking in persons;
e. appointment of a representative who will be in touch with representatives of ANITP and CNS "Cartel ALFA in order to conduct activities in this Memorandum.
Chapter IV. Special provisions
Article 3. The Parties undertake to co-ordinate statements, taking positions and other public events related to this Memorandum and to consult with other Parties whenever one of them is going to transmit public information related to activities undertaken under this Memorandum.
Article 4. The Parties will be obliged to make known the provisions of this memorandum to the territorial structures with powers in the field.
Article 5. In order to monitor the activities, the parties organize meetings to coordinate joint actions in this Memorandum.
Article 6. The parties have the obligation to ensure confidentiality of personal data of the beneficiaries of activities carried out under the Memorandum.
Chapter V. Terms of cancellation
Article 7. Any lack of correlation or any dispute that may arise between the parties during the progress of this Memorandum will be resolved through amicable settlement, through consultations.
Article 8. If all amicable ways are exhausted, the present Memorandum will be terminated by any of the signatory parties, through written notification of the other party.
Chapter VI. Final provisions
Article 9. Changes to this Memorandum shall be made by amendment, with the agreement of the parties.
Article 10. The parties are free to conclude similar agreements with other state institutions or non-governmental organizations, in order to achieve the objectives set out in this Memorandum.
Article 11. (1) This Memorandum enters into force on the date of signing by the parties.
(2) This Memorandum is valid for a period of 4 years from the date of signing the protocol, with the possibility of extension through agreement of the parties.
This protocol was concluded today, October 17, 2008, in 3 copies, one for each party.
