Regler för hälsa, säkerhet och miljö för entreprenörer

Dessa regler för hälsa, säkerhet och miljö är obligatoriska för ENTREPRENÖRER som arbetar med Air Liquides installationer, på anläggningar som ägs/drivs av Air Liquide och/eller av Air Liquides kunder (”AIR LIQUIDE-anläggning”). Dessa regler kan kompletteras med ytterligare och anläggnings-/installationsspecifika ämnen som uttrycks i någon anläggningsspecifik säkerhetsorientering. Specifika ämnen kan också innefatta ämnen relaterade till kvalitet, livsmedelssäkerhet och medicinska gaser. Genom att acceptera en beställning, förbereda för och/eller utföra något arbete för Air Liquide godtar ENTREPRENÖREN att reglerna nedan uttryckligen ingår i varje kontrakt som ingås med Air Liquide.

Följande data ska lagras och visas upp på AIR LIQUIDEs begäran:

1. Generella principer

1.1 Säkerhetspolicy

Säkerhet är ett kärnvärde hos AIR LIQUIDE. Att skydda människors hälsa och säkerhet, oavsett om de är anställda, entreprenörer eller någon som arbetar med oss, och miljön är vår absoluta prioritet. ENTREPRENÖREN förväntas ha kunskap om AIR LIQUIDEs HSEQ-policy.

1.2 Efterlevnad av gällande lagar och förordningar

ENTREPRENÖREN måste hålla sig uppdaterad om tillämpliga lagbestämmelser och måste följa dem. De är skyldiga att lämna in nödvändiga juridiska meddelanden till auktoriserade myndigheter och måste ha de nödvändiga tillstånd som krävs enligt lokala bestämmelser.

1.3 Överensstämmelse med AIR LIQUIDE-reglerna

Varje individ som arbetar för Air Liquide, både anställda och entreprenörer, förväntas känna till "Life Saving Rules" (”LSR”), följa dem och alltid ingripa om det finns risk för osäkra beteenden eller tillstånd.

Följande 12 LSR gäller på alla AIR LIQUIDE-anläggningar och för alla kontrakt som implementeras för AIR LIQUIDE. AIR LIQUIDE har en nolltoleranspolicy med avseende på dessa 12 LSR. Överträdelse av någon av dessa regler, eller bristande överensstämmelse, kan resultera i åtgärder inklusive avlägsnande från AIR LIQUIDE-anläggningen. Det kan anses vara ett avtalsbrott.

”Jag bär fallskyddsutrustning när jag arbetar på hög höjd.” ”Jag går inte under hängande laster.”

”Jag använder alltid säkerhetsbälte när jag befinner mig i ett fordon under färd.” ”Jag säkrar lasten på fordon.”

1.4 Åtagande från ENTREPRENÖRENS ledning

ENTREPRENÖREN är alltid skyldig att vidta alla åtgärder som syftar till att öka säkerheten för sina anställda, även om sådana åtgärder inte uttryckligen tas upp i detta dokument. ENTREPRENÖREN åtar sig att kommunicera dessa riktlinjer till sin personal och till personalen hos eventuella underleverantörer och åtar sig att se till att de efterlevs.

2. Organisation och resurser

2.1 AIR LIQUIDES och ENTREPRENÖRENS roller och kontakter

ENTREPRENÖREN har utsetts eftersom de är experter på innehållet i de arbeten som de är anlitade för att utföra.

ENTREPRENÖREN ska utse en ”arbetsledare” på plats för att säkerställa god kommunikation och samordning med AIR LIQUIDE. ”Arbetsledaren” övervakar arbetena på plats för att säkerställa att de utförs i enlighet med kundens interna föreskrifter samt tillämpliga lagbestämmelser och Air Liquides krav.

2.2 ENTREPRENÖRENS bemanning

ENTREPRENÖREN ska säkerställa lämplig bemanning med kompetent personal med all erforderlig certifiering, samt tydlig fördelning av roller och ansvar, för att säkerställa ett säkert utförande av tjänsterna.

ENTREPRENÖREN förklarar att de endast kommer att sätta in arbetare som har ett giltigt arbetstillstånd. ENTREPRENÖREN ska se till att denna skyldighet även efterlevs av dess underleverantörer.

2.3 Personalens kompetens

ENTREPRENÖREN kommer att se till att allt arbete utförs av lämplig och kunnig personal med tiLSRäcklig teknisk kompetens och erfarenhet enligt kraven för den art av arbeten som utförs.

ENTREPRENÖREN måste lämna information om utbildning och certifiering när AIR LIQUIDE begär det.

ENTREPRENÖREN ska säkerställa att dess personal kan förstå och tala det språk som används på den plats där underhållsarbetet utförs.

2.4 Arbetstid

Arbetet utförs under normal arbetstid (i linje med arbetsplatsens normala arbetstid) och under normala arbetsdagar. Eventuella avvikelser från normal arbetstid måste godkännas av AIR LIQUIDE i förväg. Den maximala arbetstid som anges i nationell eller regional lagstiftning får aldrig överskridas.

2.5 Underleverantörer

Fullständig underentreprenad av arbetets hela omfattning är inte tillåten. ENTREPRENÖREN kan delvis lägga ut utförandet av arbetet på underentreprenad, vilket måste meddelas innan beställningen görs och kräver AIR LIQUIDEs skriftliga tillstånd. Alla bestämmelser som gäller för ENTREPRENÖREN i detta dokument ska även gälla för alla underleverantörer.

3 Säkerhetsledningssystem

3.1 Säkerhetsgranskning och uppsägning av kontrakt

Under utförandet av arbetena samtycker ENTREPRENÖREN till att respekten för HSE-reglerna kan kontrolleras av AIR LIQUIDE när som helst genom säkerhetsinspektioner, beteendesäkerhetsbesök och revision på plats. För att undvika tvivel minskar inte sådana kontroller av AIR LIQUIDE ENTREPRENÖRENS ansvar enligt dessa regler.

3.2 Rapportering och analys av oönskade händelser

ENTREPRENÖREN ska omedelbart meddela AIR LIQUIDE i händelse av: en incident som påverkar hälsan och/eller säkerheten för någon person på plats och/eller

miljö- eller egendomsskador. ENTREPRENÖREN kommer att samarbeta (och tillse att dess personal samarbetar) med AIR LIQUIDEs utredning av eventuella incidenter/olyckor på begäran (sådant samarbete ska innefatta tillhandahållande av handlingar som begärts).

3.3 Journalföring

i) Certifikationer gällande entreprenörens anställda. (ii) Bevis på utvärdering av företag som används som underleverantörer. (iii) Intyg om överensstämmelse och (rättslig) kontroll av fordon, utrustning, verktyg etc. som används. (iv) Säkerhetsdatablad (SDS) för farligt material som tas med/används på plats (om tillämpligt). (v) Intyg om bortforsling av avfall för (farligt) avfallsmaterial (om tillämpligt). (vi) Eventuell incidentutredningsrapport.

4 Risker och avhjälpande åtgärder

4.1 Faror i samband med de arbeten som ska utföras

Innan arbetet påbörjas ska AIR LIQUIDE förse ENTREPRENÖREN med den information som är relevant för platsen (i den mån AIR LIQUIDE känner till detta) för att hjälpa Entreprenören med förberedelser för ett säkert utförande av arbetet (t.ex. gemensam aktivitet, egenskaper hos installationen, produkter som hanteras på plats, cirkulationsplan etc.), och ENTREPRENÖREN ska dela med AIR LIQUIDE sin plan för utförande av arbetet (metodbeskrivning för att utföra arbetet, identifiering av faror och avhjälpande åtgärder). ENTREPRENÖREN ansvarar för att säkerställa att man från AIR LIQUIDE har erhållit all information som krävs för ett säkert utförande av arbetet. ENTREPRENÖREN ska ansvara för att fullfölja och övervaka alla nödvändiga riskbedömningar och metodbeskrivningar.

4.2 Arbetstillstånd

Ett lämpligt arbetstillstånd (inklusive arbetstillstånd gällande säkerhet/tillstånd att arbeta) krävs för varje ingrepp på en AIR LIQUIDE-anläggning. ENTREPRENÖREN måste bekanta sig med de lokala rutinerna för att erhålla arbetstillståndet och närvara vid all introduktion/orientering eller liknande informationstillfällen som anordnas. Den arbetsledare som utsetts av ENTREPRENÖREN får inte påbörja några arbeten förrän de har ett giltigt arbetstillstånd. Genom att påbörja ett arbete bekräftar ENTREPRENÖREN samtycke med arbetstillståndet och att de till fullo har förstått innehållet i arbetstillståndet, inklusive full förståelse för alla risker förknippade med arbetet och AIR LIQUIDE-anläggningen, och att de har all nödvändig information från AIR LIQUIDE för att kunna utföra arbetet på ett säkert sätt. ENTREPRENÖREN samtycker till att i händelse av att eventuella omständigheter relaterade till arbetet förändras, kommer de att upphöra med arbetet i den utsträckning som krävs och meddela en AIR LIQUIDE-representant om sådana förändringar (vilket kan kräva en översyn och/eller ändring av arbetstillståndet).

4.3 Personlig skyddsutrustning (PPE)

ENTREPRENÖREN ska förse sina anställda med personlig skyddsutrustning i enlighet med den typ av arbete som utförs. Det är ENTREPRENÖRENS ansvar att tydligt fastställa den nödvändiga och erforderliga personliga skyddsutrustningen och att tillhandahålla den i enlighet med relevant risk för ENTREPRENÖRENS verksamhet/arbete. ENTREPRENÖREN ska säkerställa att relevant personlig skyddsutrustning noteras i riskbedömningarna och/eller metodbeskrivningarna. I händelse av att AIR LIQUIDE specificerar vissa personliga skyddsutrustningar som är unika för vissa aktiviteter ska ENTREPRENÖREN uppfylla sådana krav.

4.4 Första hjälpen och krishantering

ENTREPRENÖRENs anställda ska följa de regler, protokoll och kommunikationsinstruktioner relaterade till första hjälpen och krishantering som är tillämpliga på den plats där underhållsarbetet utförs. ENTREPRENÖRENs anställda ska delta i alla nödsituationsövningar som anordnas medan de är närvarande på AIR LIQUIDE-anläggningen.

5 Utförande av arbetet

5.1 Förberedelse av arbetet

Innan arbetet påbörjas måste ENTREPRENÖREN se till att: en förplanering för arbetet utarbetas,

lämpliga riskbedömningar och metodbeskrivningar har färdigställts och delats med AIR LIQUIDE (AIR LIQUIDE tar inte på sig ansvar på grundval av att de delats),

alla dess anställda har deltagit i AIR LIQUIDE-säkerhetsorienteringen inklusive anläggningsspecifika ämnen,

den försörjning som behövs för att utföra arbetet (dvs. el, tryckluft, tillfällig belysning, etc.) är installerad och redo för säker användning,

ett giltigt arbetstillstånd undertecknat av en auktoriserad AIR LIQUIDE-representant har utfärdats och att innehållet däri har kommunicerats tydligt till de personer som utför arbetet.

5.2 Mänskliga faktorer och befogenhet att stoppa arbete

ENTREPRENÖREN ska aktivt bidra till AIR LIQUIDEs praxis för att stödja ett säkert beteende hos ENTREPRENÖRENS anställda, och särskilt:

säkerhetsrutiner (säkerhetssamtal, verktygslådor, möten etc.), beteendesäkerhetsbesök,

utredning/disciplinär policy vid brott mot säkerhetsregler, erkännande av säkra metoder.

ENTREPRENÖREN ska uppmuntra sina anställda att upptäcka och rapportera osäkra situationer samt att stoppa/avbryta osäkert arbete som utgör en omedelbar fara för människor eller miljö.

5.3 Arbetsmiljö

ENTREPRENÖREN ska alltid hålla sin arbetsplats i ett rent och ordnat skick.

5.4 Samordning under utförandet och vid arbetets slutförande

Samordningsmöten mellan ENTREPRENÖREN (och dess underleverantörer, vid behov) och AIR LIQUIDE hålls med de intervall och i det format som är lämpligt med hänsyn till varaktigheten och komplexiteten av arbetets omfattning. Säkerhet, hälsa och miljö tas systematiskt upp på dagordningen för dessa samordningsmöten.

6 Arbetsmiljö

ENTREPRENÖREN förväntas eliminera eller åtminstone minimera miljöpåverkan (användning av råvaror, avfall, läckage, buller etc.) så mycket som möjligt. Allt avfallsmaterial (fast och flytande) som produceras av ENTREPRENÖRENS verksamhet och/eller genereras av ENTREPRENÖREN måste saneras och avlägsnas av ENTREPRENÖREN i enlighet med lokala bestämmelser.

7 Säkerhet

ENTREPRENÖREN ska följa alla protokoll och dokument som reglerar tillgången till AIR LIQUIDEs eller dess kunders anläggningar. Det är förbjudet att fotografera och/eller filma delar av installationer utan uttryckligt tillstånd från AIR LIQUIDE.

Health, Safety & Environment Rules for Contractors

These Health, Safety and Environment rules are mandatory for CONTRACTORS working on installations of Air Liquide, at sites owned/operated by Air Liquide and/or by Air Liquide's customers (“AIR LIQUIDE facility”). These rules may be supplemented by additional and site/installation specific topics expressed in any site specific safety induction. Specific topics may also include topics related to quality, food safety and medical gasses.

In accepting any order, preparing for and/or undertaking any work for Air Liquide the CONTRACTOR agrees the rules set out below are expressly included in each contract entered into with Air Liquide.

1. General principles

1.1 Safety policy

Safety is a core value at AIR LIQUIDE. Protecting the health and safety of people, whether they are employees, contractors or anyone who works with us, and the environment is our absolute priority. The CONTRACTOR is expected to have knowledge about AIR LIQUIDE’s HSEQ Policy.

1.2 Compliance with applicable laws and regulations

The CONTRACTOR must stay up to date on the legal provisions applicable and must adhere to them. He is obliged to submit the necessary legal notices to the authorised bodies and must have the necessary permits required in terms of local regulations.

1.3 Compliance with AIR LIQUIDE rules

Each individual working for Air Liquide, whether employee or contractor, is expected to know the Life Saving Rules (“LSRs”), follow them and always intervene if there is the potential for unsafe behaviour or conditions.

The following 12 LSRs apply at all AIR LIQUIDE Facilities and for all contracts implemented for AIR LIQUIDE. AIR LIQUIDE has a zero tolerance policy with regard to these 12 LSRs. Transgression of any one of these rules could result in action including non-conformance, removal from the AIR LIQUIDE Facility. It may be considered a breach of any contract.

1.4 CONTRACTOR management commitment

The CONTRACTOR is always required to adopt any and all measures aimed at increasing safety for its employees, even if such measures are not expressly addressed in this document. The CONTRACTOR undertakes to communicate these guidelines to its personnel and to the personnel of any subcontractors and undertakes to enforce compliance with them.

2. Organisation and resources

2.1 AIR LIQUIDE and CONTRACTOR roles and contacts

The CONTRACTOR has been appointed as it is an expert in the nature of works it is contracted to undertake.

The CONTRACTOR must appoint an on site “work supervisor” to ensure good communication and coordination with AIR LIQUIDE. The “work supervisor: supervises the works on site to ensure that they are carried out in accordance with the internal regulations of the customer, and the applicable legal provisions and Air Liquide’s requirements.

2.2 CONTRACTOR staffing

The CONTRACTOR shall ensure the appropriate staffing with competent personnel with all required certification, as well as clear assignment of roles and responsibilities, to ensure a safe execution of the services.

The CONTRACTOR declares that he will only deploy workers if they are in possession of a valid work permit. The CONTRACTOR shall ensure that this obligation is also complied with by its subcontractors.

2.3 Worker capabilities

The CONTRACTOR will ensure all work is carried out by suitable and skilled personnel with sufficient technical skills and experience as required for the nature of works being undertaken..

The CONTRACTOR must submit information on training and certification when requested to do so by AIR LIQUIDE.

The CONTRACTOR shall ensure its personnel are able to understand and speak the language used in the location where the maintenance work is executed.

2.4 Working hours

Work is carried out during normal working hours (in line with the normal working hours of the site) and on normal working days. Any deviation from the normal working hours must be approved by AIR LIQUIDE beforehand. The maximum working hours stated in national or regional legislation must never be exceeded.

2.5 Sub-contracting

Complete subcontracting of the scope of work is not allowed. The CONTRACTOR may subcontract in part the execution of the work, which must be expressed before the order is placed and subject to AIR LIQUIDE's written authorization. All provisions applicable to the CONTRACTOR in this document shall also apply to any subcontractor.

3 Safety management system

3.1 Safety performance review and contract termination

During the execution of the works, the CONTRACTOR agrees that the respect of HSE rules can be checked by AIR LIQUIDE at any time through safety inspections, behavioural safety visits and spot audits. For the avoidance of doubt any such checks by AIR LIQUIDE does not lessen CONTRACTORS responsibilities under these rules.

3.2 Reporting and analysis of undesirable events

The CONTRACTOR shall immediately notify AIR LIQUIDE in the event of: an incident affecting the health and/or safety of any person on site; and/or

environmental or property damages. The CONTRACTOR will cooperate (and procure the co-operation of its personelle) with AIR LIQUIDE's investigation of any incidents/accidents upon request (such cooperation shall include the provision of documents as requested).

3.3 Record keeping

The following data shall be stored and produced at AIR LIQUIDE’s request:

(i) certificates of contractors’ employees; (ii) proof of evaluation of companies used as subcontractors; (iii) conformity and (legal) inspection certificates for vehicles, equipment, tools, etc. used; (iv) safety data sheets (SDS) for hazardous materials that are brought/used on site (if applicable); (v) waste removal certificates for (hazardous) waste materials (if applicable); (vi) any incident investigation report.

4 Risks and mitigation

4.1 Hazards associated with the works to be executed

Prior to starting the work, AIR LIQUIDE shall provide the CONTRACTOR with the information relevant to the site (insofar as it is in AIR LIQUIDE knowledge) to assist the Contractor with preparation of a safe execution of the work (e.g. co-activity, characteristics of the installation, products handled on site, circulation plan etc.), and the CONTRACTOR shall share with AIR LIQUIDE his work execution plan (method of statement to execute the work, hazards identification and mitigations). The CONTRACTOR is responsible to ensure it has received from AIR LIQUIDE all information required for the safe execution of the work. The CONTRACTOR shall be responsible for completing and keeping under review all necessary risk assessments and method statements.

4.2 Safe work permit

An appropriate work permit (inc safe work permit/permit to work) is required for every intervention at an AIR LIQUIDE facility. The CONTRACTOR must familiarise itself with the local procedures for obtaining the work permit and attend any induction/orientation or similar briefing provided. The works supervisor nominated by the CONTRACTOR must not start any works until they are in possession of a valid work permit. In starting any works CONTRACTOR confirms agreement with the work permit and that they have fully understood the content of the work permit, including full understanding of all risks associated with the works and the AIR LIQUIDE Facility and that it has all necessary information from AIR LIQUIDE to safely execute the works. XXXXXXXXXX agrees that in the event any circumstances relating to the works changes they will cease works to the extent required and notify an AIR LIQUIDE representative of such changes (which may require a review and/or modification to the work permit).

4.3 Personal protective equipment (PPE)

The CONTRACTOR shall provide its employees with personal protective equipment in accordance with the type of work. It is the responsibility of the CONTRACTOR to clearly determine the necessary and required personal protection equipment and to provide it according to the relevant risk for the activities/works of the CONTRACTOR. CONTRACTOR shall ensure relevant PPE is noted in the risk assessments and/or method statements. In the event AIR LIQUIDE specifies certain PPE unique to certain activities CONTRACTOR shall comply with such requirements.

4.4 First aid and emergency management

The CONTRACTOR’s employees shall follow the rules, protocols and communication instructions related to first aid and emergency management that are applicable on the site where the maintenance work is executed. The CONTRACTOR’s employees shall take part in any emergency exercises organised while they are present on the AIR LIQUIDE site.

5 Execution of the work

5.1 Preparation of the work

Before starting the work, the CONTRACTOR must ensure that: a pre-job planning is prepared;

appropriate risk assessments and method statements have been completed and shared with AIR LIQUIDE (AIR LIQUIDE does not assume responsibility by virtue of the same being shared);

all its employees have attended the AIR LIQUIDE safety induction including site specific topics;

utilities needed to execute the work (i.e. electricity, compressed air, temporary lighting, etc.) are installed and ready for safe use;

a valid safe work permit signed by an authorised AIR LIQUIDE representative has been issued and that the content thereof has been communicated clearly to the people executing the work.

5.2 Human factors and stop work authority

The CONTRACTOR shall actively contribute to AIR LIQUIDE’s practices to support the safe behaviour of the CONTRACTOR’s employees, and especially: safety routines (safety talks, toolboxes, meetings, etc.);

behavioural safety visits;

investigation/disciplinary policy in case of safety rules violation; recognition of safe practices.

The CONTRACTOR shall encourage its employees to detect and report unsafe situations and to stop/suspend unsafe work that presents an immediate danger to people or the environment.

5.3 Working environment

The CONTRACTOR must always maintain its workplace in a clean and tidy state.

5.4 Coordination during the execution and at completion of the works

Coordination meetings between the CONTRACTOR (and its subcontractors as needed) and AIR LIQUIDE are held with a frequency and format appropriate to the duration and complexity of the scope of work. Safety, health and environment are systematically included on the agenda of these coordination meetings.

6 Environment

The CONTRACTOR is expected to eliminate or at least minimise the environmental impact (use of raw materials, waste, leakages, noise, etc.) as much as possible. All waste materials (solid and liquid) produced by the CONTRACTOR’S activities and/or generated by the CONTRACTOR must be cleaned up and removed by the CONTRACTOR in line with local regulations.

7 Security

The CONTRACTOR shall follow all protocols and documents regulating access to the sites of AIR LIQUIDE or its customers. Photographing and/or filming parts of installations is prohibited without the explicit permission of AIR LIQUIDE.
