Avtal med Internationella institutet för
demokrati och fria val (IDEA) om immunitet och privilegier för Internationella institutet för demokrati och fria val och dess tjänstemän
Stockholm den 14 mars 2012
Regeringen beslutade den 16 februari 2012 att underteckna avtalet. Regeringen be- slutade den 7 juni 2012 att underrätta IDEA om godkännande av avtalet. Avtalet trädde i kraft den 1 juli 2012 efter notväxling.

The Government of Sweden and the Inter- national Institute for Democracy and Electoral Assistance
NOTING that the International Institute for Democracy and Electoral Assistance was es- tablished as an international intergovernmental organization at a conference held in Stockholm on 27 February 1995;
NOTING that Statutes of the Organization as amended were adopted at an Extraordinary Council meeting of the Institute on 24 January 2006;
NOTING that according to Article X of the Statutes of the Organization, the status, privileges and immunities of the Organization and of its Officials in the host country shall be specified in a Headquarters Agreement;
FURTHER NOTING that the two Parties have entered into a Headquarters Agreement on the 10 and 16 October 1995 and have agreed to amend that Agreement;
DESIRING to lay down modified conditions concerning the immunity and privileges of the Institute and its officials,
HAVING thus agreed to enter into a new Agreement to replace the Agreement of 10 and 16 October 1995,
have agreed as follows:
Article I
Definitions
Whenever used in this Agreement, the fol- lowing words and expressions shall have the meaning assigned to them hereunder.
a) ”Government” means the Government of Sweden;

som beaktar att organisationens förändrade stadgar antogs vid ett extraordinarie rådsmöte den 24 januari 2006,
som beaktar att enligt stadgarnas artikel X ska organisationens och dess tjänstemäns ställ- ning, immunitet och privilegier specificeras i ett högkvartersavtal,
som vidare beaktar att de båda parterna ingått ett högkvartersavtal den 10 och 16 ok- tober 1995 och kommit överens om att ändra det avtalet,
som önskar fastställa nya villkor gällande immunitet och privilegier för Institutet och
dess personal.
som följaktligen har kommit överens om att ingå ett nytt avtal som ersätter avtalet av den 10 och 16 oktober 1995,
har kommit överens om följande.
Artikel I
Definitioner
I detta avtal ska följande ord och uttryck ha här angiven innebörd:
a) regering: Sveriges regering,

b) ”Organisation” means the International Institute for Democracy and Electoral Xxxxx- xxxxx;
c) ”Secretary-General” means the Secre- tary-General of the Organisation and, during his or her absence, any other official specially designated to act on his or her behalf;
d) ”Officials” means persons employed by the Organisation for its regular tasks who are not paid hourly rates;
e) ”Experts” means persons, other than Of- ficials of the Organisation, appointed for one or several specific tasks by the Organisation;
f) ”Emoluments” means all sums in respect of employment by the Organisation paid to, vested in or accruing to an Official or Expert in any form whatsoever;
g) ”Taxes being charges for public services” means such taxes which are paid in connection with the provision by a state or municipal au- thority of a particular service in direct relation to providing such a service;
h) ”Family members or Members of Fam- ily” means:
i) the spouse of the person concerned;
ii) the partner of the same sex, if the two persons have officially registered their rela- tionship;
iii) a person comparable to a spouse, i.e. a person who continuously shares a household- and cohabits in a relationship resembling mar- riage with the person concerned; the sex of the cohabitant is of no relevance;
iv) children of the person in question and of his/her spouse or a person as defined in point ii and iii, who are under the age of 18 years or dependent on his/her care.
Article II
Legal status
The Organisation shall possess full legal personality in accordance with article I.3 of its Statutes.
b) organisation: Internationella institutet för demokrati och fria val,
c) generalsekreterare: organisationens gene- ralsekreterare eller i hans eller hennes frånvaro en annan tjänsteman som särskilt utsetts att handla i hans eller hennes ställe,
d) tjänstemän: personer som är anställda av organisationen för dess normala uppgifter och inte betalas per timme,
e) experter: andra personer än organisatio- nens tjänstemän, tillsatta av organisationen för att utföra en eller flera särskilda uppgifter,
f) ersättningar: alla summor som hänför sig till anställning vid organisationen, vilka i någon form utbetalas till, tillkommer eller tillfaller en tjänsteman eller en expert,
g) skatter som är avgifter för allmännyttiga tjänster: sådana skatter som betalas i samband med tillhandahållande från en statlig eller kommunal myndighet av en särskild tjänst i direkt anslutning till tjänsten,
h) familjemedlemmar:
i) den berörda personens make eller maka,
ii) partner av samma kön, om de två perso- nerna har registrerat sitt förhållande officiellt,
iii) en person som kan jämställas med make eller maka, det vill säga en person som kon- tinuerligt delar hushåll och bor tillsammans med den berörda personen under äktenskaps- liknande former, varvid sambons kön saknar betydelse,
iv) barn till personen ifråga och till hans el- ler hennes maka eller make eller till sådan person som avses i ii) eller iii) som är under 18 år eller som är beroende av personen ifråga för sin försörjning.
Artikel II
Rättslig ställning
Organisationen ska vara en självständig ju- ridisk person i enlighet med artikel I.3 av dess stadgar.

Article III
Property, funds and assets
1. The Organisation, its property and assets shall enjoy immunity from any form of legal proceedings. The property and assets held by the Organisation in order to fulfil its objectives shall be exempt from requisition, confiscation, expropriation and any other form of interferen- ce by an executive, administrative or judicial authority. The Secretary-General has the right to waive this immunity in any particular case.
2. The Organisation, its property and assets, income and revenues, shall be exempt from
a) all direct taxes; the Organisation shall not, however, demand exemption from Taxes being charges for public services,
b) indirect taxes on goods purchased or ser- vices performed for the benefit of the activities of the Organisation, to the extent that Swedish law permits for international organisations in Sweden;
c) payroll taxes, social security contributions and wage taxes for Officials of the Organisa- tion;
d) customs and import charges.
3. The Organisation may possess funds and currencies of all kinds and may have accounts in any currency whatsoever.
4. The Organisation shall not be subject to any legal provisions concerning import and ex- port restrictions with regard to goods imported or exported by the Organisation for official use. Goods thus brought into Sweden may not be disposed of here except on conditions ap- proved by the Government.
Article Iv
Premises and services
1. The Government shall assist the Organisa- tion in obtaining appropriate premises for its office and annually reimburse the Organisation for the office rent.
2. The premises of the Organisation as well as the living quarters of the Secretary-General and of three Directors of the Organisation,
Artikel III
Organisationens egendom, fonder och till- gångar
1. Organisationen, dess egendom och till- gångar ska åtnjuta immunitet mot varje slag av rättsliga åtgärder. Egendom och tillgångar som organisationen innehar för att uppfylla sina mål får inte bli föremål för rekvisition, beslag- tagande, expropriation eller något annat slags ingripande av en verkställande, administrativ eller rättslig myndighet. Generalsekreteraren har rätt att häva denna immunitet i enskilda fall.
2. Organisationen, dess egendom och till gångar, inkomster och intäkter ska vara be- friade från
a) alla direkta skatter; organisationen ska dock inte begära befrielse från skatter som ut- gör avgifter för allmännyttiga tjänster,
b) indirekta skatter på varor som inköpts eller tjänster som utförts för organisationens verksamhet, i enlighet med svensk lagstiftning för internationella organisationer i Sverige,
c) arbetsgivaravgifter, allmänna social- avgifter och löneskatter för organisationens tjänstemän;
d) tull- och importavgifter.
3. Organisationen ska ha rätt att inneha pen- ningmedel och valutor av alla slag och ha konton i vilken valuta som helst.
4. Organisationen ska inte vara föremål för några rättsliga bestämmelser om in- och utför- selbegränsningar i fråga om varor som förs in och ut av organisationen för tjänstebruk. Varor som förs in i Sverige får inte avyttras i Sverige om det inte sker på villkor som har godkänts av regeringen.
Article Iv
Lokaler och tjänster
1. Regeringen ska bistå organisationen med att finna lämpliga lokaler för dess kontor och ska årligen ersätta organisationens kostnad för kontorshyra.
2. Organisationens lokaler och generalse- kreterarens och tre avdelningschefers bostä- der ska, såvitt dessa tjänstemän inte är svenska

insofar as these officials are not Swedish citi- zens or residents of Sweden when appointed, shall be inviolable and shall be exempt from house search. Swedish authorities may not gain access to the same without the consent of the Secretary-General. Such consent may, howev- er, be deemed to have been given in the event of an outbreak of fire or some other severe ac- cident necessitating immediate measures.
3. The Swedish authorities concerned shall take appropriate measures for the safety and protection of the premises and personnel of the Organisation.
4. The archives of the Organisation, in com- mon with all other documents, manuscripts, information for computer storage and retrieval, recordings, photographs and films belonging to the Organisation, whether any or all such items are in physical or digital form or in any other electronic format, shall be inviolable.
5. The Swedish authorities concerned shall take appropriate measures to ensure that the Organisation obtains access to necessary pub- lic services and that these services are provided on reasonable terms. With regard to telephone, radio/telegraph, telex, all other electronic means of communication and postal services, the Organisation shall enjoy the same privi- leges as are usually accorded to diplomatic representations.
Article v
Visa formalities and border control
1. The Government undertakes to issue visas to Sweden without visa charges, in accordance with the Regulation (EC) No 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code), to the following persons for as long as they have business at the Organisa- tion:
a) Members of the Council and the Board of Advisers,
b) Persons appointed by Member States to represent them on official business of the Or- ganisation,
c) Officials of the Organisation and Mem- bers of their Families, if included in their re- spective households,
medborgare eller permanent bosatta i Sverige vid utnämningen, vara okränkbara och får inte bli föremål för husrannsakan. Svenska myn- digheter får inte bereda sig tillträde till dessa utan medgivande av generalsekreteraren. Så- dant medgivande får emellertid ansetts ha läm- nats i händelse av eldsvåda eller annan all- varlig olycka som kräver omedelbara åtgärder.
3. Berörda svenska myndigheter ska vidta lämpliga åtgärder för att ge organisationens lokaler och personal säkerhet och skydd.
4. Organisationens arkiv, tillsammans med alla dokument, manuskript, datalagrad in- formation, ljudupptagningar, fotografier och filmer som tillhör organisationen, vare sig dessa är i fysisk, digital eller annan elektronisk form, ska vara okränkbart.
5. Berörda svenska myndigheter ska vidta lämpliga åtgärder för att säkerställa att orga- nisationen på skäliga villkor har tillgång till de allmännyttiga tjänster som den behöver. I fråga om telefon, radio/telegraf, telex och post ska organisationen åtnjuta samma privilegier som diplomatiska representationer vanligen åtnjuter.
Artikel v
Viseringar och gränskotroll
1. Regeringen förbinder sig att i enlighet med Europaparlamentets och rådets förord- ning (EG) nr 810/2009 av den 13 juli 2009 om införande av en gemenskapskodex om viseringar (viseringskodex) bevilja visering till Sverige utan viseringsavgifter för följande personer för den tid som de har ärenden vid organisationen:
a) Ledamöter av rådet och rådgivande kommittén,
b) Personer som har utsetts av av medlems- staterna att företräda dem vid tjänsteärenden vid organisationen,
c) Tjänstemän vid organisationen och deras familjemedlemmar, om de ingår i deras hushåll,

d) Experts on assignments at the Organisa- tion, and
e) Persons invited to the Organisation by the Secretary-General.
2. The provisions of paragraph 1 shall apply regardless of the relations prevailing between the government of the persons concerned and the Government of Sweden. They shall not preclude the stipulation of reasonable proof that persons claiming the above mentioned rights belong to the categories indicated, nor the reasonable implementation of international rules of quarantine of public health regulations. This provision shall not prejudice immunity under Article VI.
3. The Secretary-General shall, as far as it is possible before their arrival in Sweden, notify the Government of the names of persons in the categories indicated in paragraph 1 of this Ar- ticle, to facilitate implementation by the Gov- ernment of the provisions of this Agreement.
4. Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of per- sons across borders (Schengen Borders Code) is applicable regarding the crossing of the ex- ternal borders and conditions for entry.
Article vI
Immunity and privileges of the Secretary- General, Officials of and Experts engaged by the Organisation
1. Officials of the Organisation who are not Swedish citizens or residents of Sweden immediately prior to the employment by the Organisation shall enjoy:
a) Immunity from legal action of any kind in relation to verbal or written statements which they have made in their official capacity and measures which they have taken in that capac- ity. The immunity shall continue to apply when the persons concerned have left the service of the Organisation.
b) The right to claim inviolability in respect to all papers, documents, manuscripts, infor- mation for computer storage and retrieval, recordings, photographs and films, whether in physical or digital form or in any other elec-

2. Bestämmelserna i punkt 1 ska tillämpas oberoende av det förhållande som råder mellan de berörda personernas regering och Sveriges regering. De utgör inget hinder för krav på skäliga bevis för att personer som gör anspråk på de ovan nämnda rättigheterna tillhör de an- givna kategorierna och inte heller för en skälig tillämpning av internationella karantänsbe- stämmelser enligt folkhälsoföreskrifter. Denna bestämmelse ska inte inverka på immuniteten enligt artikel VI.
3. Generalsekreteraren ska om möjligt före ankomsten till Sverige underrätta regeringen om namnen på personer inom de kategorier som anges i punkt 1 i denna artikel, för att underlätta för regeringen att tillämpa bestäm- melserna i detta avtal.
4. Europaparlamentets och rådets förord- ning (EG) nr 562/2006 av den 15 mars 2006 om en gemenskapskodex om gränspassage för personer (kodex om Schengengränserna) är tillämplig när det gäller passage av de yttre gränserna och villkor för inresa.
Artikel vI
Immunitet och privilegier för generalsekrete- raren, organisationens tjänstemän och exper- ter anlitade av organisationen
1. Organisationens tjänstemän som inte är svenska medborgare eller bosatta i Sverige omedelbart före anställningen vid organisatio- nen ska åtnjuta
a) immunitet mot rättsliga åtgärder av varje slag såvitt avser muntliga eller skriftliga utta- landen som de har gjort i tjänsten och åtgärder som de har vidtagit i denna egenskap. Denna immunitet ska fortsätta att gälla när de berörda personerna har lämnat sin tjänst vid organi- sationen.
b) rätt att kräva okränkbarhet för alla hand- lingar, dokument, manuskript, datalagrad information, ljudupptagningar, fotografier och filmer som rör organisationens verksamhet, vare sig dessa är i fysisk eller digital eller an-

tronic format, relating to the activities of the Organisation.

c) Exemption from tax and general social security contributions on emoluments and in- demnities paid by the Organisation.
d) Personal exemptions for themselves and Members of their Families included in their households from immigration restrictions and provisions concerning the registration of aliens.
e) Exemption from Swedish national service obligations.
f) The same currency exchange privileges as are accorded to officials holding correspond- ing positions with diplomatic missions. In particular, Officials of the Organisation shall be entitled, on terminating their employment in Sweden, legally and without hindrance to transfer money from Sweden in the same currency and up to the same amount as they brought into Sweden, together with other money which they can show themselves to be lawfully possessed of.
g) The same protection and opportunities of repatriation for themselves personally and for Members of their Families included in their households as, during international crisis, are accorded to officials holding corresponding positions with diplomatic missions.
h) The right, when taking up their appoint- ment, and without liability for customs and other import dues, to import furniture and other personal belongings, including one vehicle per official and spouse/partner. Importation can be effected in one or more shipments.
2. The Secretary-General and Officials of the Organisation who are Swedish citizens or residents of Sweden immediately prior to the employment by the Organisation shall enjoy the immunities indicated in section 1 a), b), d) and e) of this Article. Furthermore, they shall enjoy exemption from paying general social security contributions.
3. In addition to the privileges and immuni- ties indicated in this Article, paragraph 1, the Secretary-General and three Directors, togeth- er with Members of their Families included in their households, insofar as they are not Swedish citizens or residents of Sweden when appointed, shall enjoy the immunities and priv-

f) samma privilegier i fråga om valutaväx- ling som tillerkänns tjänstemän som innehar motsvarande befattningar vid diplomatiska beskickningar. I synnerhet ska organisationens tjänstemän när de avslutar sin anställning i Sverige ha laglig rätt att utan hinder överföra pengar från Sverige i samma valuta och till samma belopp som de införde till Sverige, till- sammans med andra penningmedel som de kan styrka att de är lagliga innehavare av.
g) samma skydd och möjligheter till repa- triering för egen del och för familjemedlemmar som ingår i deras hushåll som vid internatio- nella kriser tillerkänns tjänstemän som inne- har motsvarande befattningar vid diplomatiska beskickningar,
h) rätt att, då de tillträder sin tjänst, utan tull och andra införselavgifter införa möbler och personliga tillhörigheter, inklusive ett motor- fordon per tjänsteman och make/maka/partner. Införseln kan ske i en eller flera sändningar.
2. Generalsekreteraren och tjänstemän i or- ganisationen som är svenska medborgare eller som är bosatta i Sverige omedelbart före an- ställningen vid organisationen ska åtnjuta den immunitet som anges i punkt 1 a), b), d) och
e) i denna artikel. De ska vidare vara befriade från att betala allmänna socialavgifter.
3. Utöver den immunitet och de privilegier som anges i punkt 1 i denna artikel ska orga- nisationens generalsekreterare och tre avdel- ningschefer tillsammans med de familjemed- lemmar som ingår i hushållet, såvida de inte är svenska medborgare eller bosatta i Sverige vid utnämningen, åtnjuta den immunitet och

ileges usually accorded to diplomatic agents of corresponding status by the Vienna Convention on diplomatic relations. There shall, however, be no immunity in respect of a civil action by a third party for damage arising from an accident caused by a motor vehicle or other means of transport belonging to or driven by them, or in respect of a traffic offence involving such a vehicle and caused by them.
4. Experts engaged by the Organisation who are not Swedish citizens or residents of Swe- den shall enjoy the immunities and privileges indicated in section 1a) – g) of this Article. Experts engaged by the Organisation, who are Swedish citizens or residents of Sweden, shall enjoy the immunities and privileges stated in section 1 a) and 1 b) of this Article.
5. Immunities and privileges under this Agreement are granted solely in order for the aims and purposes of the Organisation to be achieved efficiently. The Secretary-General of the Organisation may waive the immunity of an official if, in his or her opinion, the im- munity would impede the course of justice and can be suspended without detriment to the interests of the Organisation. The Council may waive the immunity of the Secretary-General in corresponding circumstances.
6. All persons enjoying immunity and privi- leges are obliged to respect Swedish law if this does not impinge on the immunities and privi- leges granted under this Agreement.
7. The Government undertakes that it will make a financial contribution to the Organisa- tion, additional to and separate from its other contributions, equaling the amount of tax pay- able by the Secretary-General and officials of the Organisation who are not exempt from tax under this Article, in respect of emoluments and indemnities from the Organisation.
8. For the purposes of this Article, a person shall not be considered as resident of Swe- den, if he or she has immediately prior to the employment by the Organisation been in the employ of any other international organisation in Sweden.
9. On applying paragraph 1c) of this Article on exemption from tax on emoluments and

4. Experter, som anlitas av organisationen och som varken är svenska medborgare eller bosatta i Sverige, ska åtnjuta immunitet och privilegier enligt punkt 1 a) – 1 g) i denna artikel. Experter som anlitas av organisationen och som är svenska medborgare eller bosatta i Sverige ska åtnjuta immunitet och privi- legier enligt punkt 1 a) och b) i denna artikel.
5. Immunitet och privilegier enligt detta avtal tillerkänns endast för att organisationens syften och ändamål ska kunna uppnås effek- tivt. Organisationens generalsekreterare får häva en tjänstemans immunitet om immunite- ten enligt hans eller hennes åsikt skulle hindra rättvisans gång och kan hävas utan förfång för organisationens intressen. Rådet får häva gene- ralsekreterarens immunitet under motsvarande förutsättningar.
6. Alla personer som åtnjuter immunitet och privilegier är förpliktade att följa svensk lag om detta inte inverkar på den immunitet och de privilegier som tillerkänns enligt detta avtal.
7. Regeringen förbinder sig att, utöver och åtskilt från sina övriga bidrag, lämna ett eko- nomiskt bidrag till organisationen uppgående till ett belopp lika stort som den skatt som ska betalas av generalsekreteraren och de tjänste- män i organisationen som inte är befriade från skatt enligt denna artikel med avseende på ersättningar och arvoden från organisationen.
8. Vid tillämpning av denna artikel ska en person inte anses vara bosatt i Sverige om han eller hon omedelbart före anställningen vid organisationen varit anställd av någon annan internationell organisation i Sverige.
9. Vid tillämpning av punkt 1 c) i denna arti- kel om befrielse av skatt på lön och ersättning

indemnities paid by the Organisation, the con- cept ”resident of Sweden” shall imply resident of Sweden for tax purposes in accordance with Swedish national legislation.
Article vII
Social security
1. The Organisation shall provide its Of- ficials and Members of their Families forming part of their respective households with appro- priate social security protection.
2. However, Members of the Family of an Official shall be entitled to Swedish social security benefits, if such family members were resident in Sweden immediately prior to the employment of the Official by the Organisa- tion.
3. The provisions of this Article shall not ap- ply to social security benefits related to income from gainful occupation in Sweden outside the Organisation.
Article vIII
Health care
Officials of the Organisation and Members of their Families who are part of their respec- tive households and who are registered in the population registry as residents have access to health care on the same terms as other Swedish residents. Other Officials of the Organisation shall be covered by appropriate arrangements made by the Organisation.
Article IX
Access to municipal pre-school activities and child-care organised by municipalities
The children of an Official of the Organisa- tion, who is registered in the population reg- ister as a resident of Sweden, have access to pre-school activities and school-age child-care organised by Swedish municipalities on the same terms as children in their municipality of residence.

Artikel vII
Social trygghet
1. Organisationen ska svara för att dess tjänstemän jämte familjemedlemmar som ingår i deras hushåll omfattas av ett lämpligt social- försäkringsskydd.
2. En tjänstemans familjemedlemmar ska dock ha rätt till svenska socialförsäkringsför- måner om dessa familjemedlemmar var bosatta i Sverige omedelbart före tjänstemannens an- ställning vid organisationen.
3. Bestämmelserna i denna artikel ska inte gälla för socialförsäkringsförmåner som hänför sig till inkomst från förvärvsverksamhet i Sve- rige vid sidan av organisationen.
Artikel vIII
Hälso- och sjukvård
Tjänstemän i organisationen och deras familjemedlemmar som utgör del av deras respektive hushåll och som är folkbokförda i Sverige har tillgång till hälso- och sjukvård på samma villkor som andra bosatta i Sve- rige. Andra tjänstemän i organisationen ska vara täckta av lämpliga arrangemang gällande hälso- och sjukvård som organisationen svarar för.
Artikel IX
Tillgång till kommunal förskola, pedagogisk omsorg, förskoleklass och fritidshem
Barn till en tjänsteman vid organisationen som är folkbokförd i Sverige, har tillträde till kommunal förskola, pedagogisk omsorg, förskoleklass och fritidshem på samma villkor som övriga barn i hemkommunen.

Article X
Access to the Swedish compulsory education and upper secondary education
The Family Members of an Official of the Organisation, who is registered in the popu- lation register as a resident of Sweden, have access to compulsory education and to upper secondary education in accordance with Swed- ish legislation.
Article XI
Communications
1. The official correspondence of the Or- ganisation shall be inviolable.
2. The Government shall permit and pro- tect unrestricted communication, including electronic communication, on the part of the Organisation for all official purposes. The Or- ganisation may employ all appropriate means of communication, including couriers and mes- sages in code or cipher. However, the Organi- sation may install a wireless transmitter only with the consent of the appropriate authorities.
3. Sealed bags containing documents or articles for official use and bearing external marks of their character shall not be opened or detained.
4. A courier of the Organisation shall be provided with an official document indicating his or her status and the number of packages constituting the sealed bag. The appropriate authorities shall assist him or her in the perfor- mance of his or her functions, in which he or she shall enjoy personal inviolability and he or she shall not be subjected to any form of arrest or detention.
Article XII
General provisions
1. The Organisation shall establish the terms of contract and necessary employment regula- tions for its staff and the contract of employ- ment shall prescribe for a legal mechanism to solve any dispute between the Organisation and its staff regarding the contracts of their employment. Familjemedlemmar till en tjänsteman vid- organisationen, som är folkbokförd i Sverige, har tillträde till obligatorisk skola och gymna- sieskola enligt svensk lag.
Artikel XI
Kommunikationer
1. Organisationens officiella korrespondens ska vara okränkbar.
2. Regeringen ska medge och värna obegrän- sade kommunikationer, inklusive elektronisk kommunikation, för organisationen vad gäl- ler dess officiella verksamhet. Organisationen får bruka alla lämpliga kommunikationsmedel, inbegripet kurirer samt kod- och chiffermedde- landen. Organisationen får dock endast med de behöriga myndigheterna medgivande upprätta och använda radiosändare.
3. Förseglade väskor som innehåller hand- lingar eller föremål för tjänstebruk och som är försedda med yttre kännetecken får inte öpp- nas eller kvarhållas.
4. Organisationens kurir ska medföra en of- ficiell handling som anger hans eller hennes ställning och antalet kollin som ingår i den för- seglade försändelsen. Behöriga myndigheter ska bistå honom eller henne vid fullgörandet av hans eller hennes uppgifter, varvid han eller hon ska åtnjuta okränkbarhet till sin person och inte får utsättas för någon form av frihetsberö- vande eller kvarhållande.
Artikel XII
Allmänna bestämmelser
1. Organisationen ska fastställa kontrakts- bestämmelser och erforderliga anställnings- föreskrifter för sin personal och anställnings- kontraktet ska innehålla bestämmelser om ett rättsligt förfarande för att lösa tvister mellan organisationen och dess personal angående deras anställningskontrakt. Organisationen för- binder sig att verkställa varje beslut som fattas

with such legal mechanism. The Organisa- tion shall further be entitled to establish any regulations necessary for the execution of the functions of the Organisation, including rules of international administrative law, and no law of Sweden shall be applicable in respect of the matters to which such regulations refer.
2. This Agreement shall be interpreted with reference to its primary purpose of enabling the Organisation to perform completely and efficiently its duties and achieve its purposes
Article XIII
Settlement of disputes
Any dispute between the Government and the Organisation concerning the interpreta- tion or application of this Agreement or any question affecting the relations between the Government and the Organisation which can- not be settled by negotiation or by some other agreed method shall be referred for final deci- sion to a panel consisting of three arbitrators. One of the arbitrators shall be selected by the Government, one shall be selected by the Or- ganisation, and the third, who shall act as chair of the arbitration panel, shall be chosen by the first two arbitrators. Should they fail to agree upon the choice of the third arbitrator within one year of their first appointment, the third arbitrator shall at the request by either Party be chosen by the President of the International Court of Justice.
Article XIv
Final provisions
1. Consultations on alterations to this Agree- ment shall be held at the request of either Party. Any such alterations shall be made by mutual consent.
2. Either of the Parties may terminate this Agreement at any time by giving twelve months notice to the other Party. In the event of the Organisation being transferred from Swedish territory, the Agreement shall cease to apply after the length of time reasonably required for such relocation and for disposal of the Organisation’s property in Sweden.

Artikel XIII
Tvistlösning
Tvister som uppkommer mellan reger- ingen och organisationen om tolkning eller tillämpning av detta avtal, eller om frågor som rör förbindelserna mellan regeringen och organisationen och som inte kan lösas genom förhandling eller på något annat avtalat sätt, ska hänskjutas till en skiljenämnd med tre skiljemän för slutligt avgörande. En av dessa skiljemän ska utses av regeringen, en ska utses av organisationen och den tredje, som ska vara skiljenämndens ordförande, ska väljas av de två första skiljemännen. Kan de två förstnämnda inte enas om valet av den tredje skiljemannen inom ett år från deras egen utnämning, ska den tredje skiljemannen på begäran av endera parten utses av ordföranden i Internationella domstolen.
Artikel XIv
Slutbestämmelser
1. Samråd i fråga om ändringar i detta av- tal ska äga rum på begäran av endera parten. Sådana ändringar ska göras genom ömsesidigt samtycke.
2. Xxxxxx parten kan när som helst säga upp detta avtal genom att ge den andra parten tolv månaders varsel. För den händelse organisatio- nen flyttas från svenskt territorium, ska avtalet upphöra att gälla efter den tidrymd som skäli- gen krävs för sådan omlokalisering och för av- yttring av organisationens egendom i Sverige.

3. This Agreement shall be approved by the Parties in accordance with their procedures. It shall enter into force at an agreed time when the Parties have notified each other that the requisite procedures have been completed.

3. Detta avtal ska godkännas av parterna i enlighet med deras respektive interna proce- durer. Det träder i kraft vid en överenskommen tidpunkt när parterna har underrättat varandra om att procedurerna har avslutats.
