EK SÖZLEŞME/ SUPPLEMENTAL AGREEMENT FOR THE ADDITION OF ARTICLES TO THE BANKING SERVICES AGREEMENT

İşbu Ek Sözleşme Kuveyt Türk Katılım Bankası A.Ş. (Banka) ile Ek Sözleşmenin sonunda adı/unvanı yazılı (Müşteri) arasında, arasında akdedilen Bankacılık Hizmetleri Sözleşmesinin (BHS) ayrılmaz bir parçası ve ekidir. Taraflar, BHS’ nin diğer bütün hükümleriyle birlikte aşağıdaki tadil hükmünün de kendileri için aynen geçerli ve bağlayıcı olduğunu gayrikabili rücu kabul, beyan ve taahhüt ederler.

1. Amaç

Taraflar işbu Ek Sözleşme’ yi, BHS’ nin “Katılma Hesaplarıyla İlgili Hükümler” başlığı altındaki 2.2.7. numaralı alt maddenin aşağıdaki şekilde tadil edilmesi için amacıyla imzalamıştır.

2. Tadile Konu Düzenleme

Taraflar, BHS’ nin 2.2.7. maddesini aşağıdaki şekilde tadil etmişlerdir.

“Banka, farklı hesaplardaki fonları gruplar halinde veya ayrı ayrı veya ayrı fon havuzları oluşturmak suretiyle işletme hakkına sahiptir. Her grup/hesap/xxx xxxxxx, kâra katkısı oranında pay alır. Zarar halinde ise her hesap/sermaye sahibi sermayesinin %100’ü oranında zarara katılır. Banka, kullanım amacının dışına çıkmamak kaydıyla, açılan fon havuzlarını birleştirebilir, bölebilir, fon havuzları arasında aktarım yapılabilir ve vade sonunda tasfiye edilebilir.”

This Supplementary Agreement is an integral part and annex of the Banking Services Agreement (BSA) concluded between Kuveyt Türk Katılım Bankası A.Ş. (Bank) and the Customer whose name/title is stated at the end of the Supplementary Agreement (Customer). The Parties irrevocably accept, declare and undertake that the following amendment provision, together with all other provisions of the BSA, is fully valid and binding for them.

1. Purpose

The Parties have signed this Supplementary Agreement for the purpose of amending sub-article 2.2.7. under the heading "Provisions Regarding Participation Accounts" of the BSA as follows.

2. Arrangement Subject to Amendment

The Parties have amended Article 2.2.7 of the BSA as follows.

"The Bank has the right to manage the funds in different accounts in groups or separately or by creating separate fund pools. Each group/account/fund pool receives a share of the profit in proportion to its contribution. In the event of a loss, each account/equity holder participates in the loss at the rate of 100% of his/her capital. The Bank may merge or divide the opened fund pools, transfer between fund pools and liquidate them at the end of maturity, provided that they do not go beyond their purpose of use."
