SUPPLEMENTAL AGREEMENT ON THE ADDITION OF PROVISIONS TO THE BANKING SERVICES AGREEMENT

(Fiziki Altın Dönüşüm Destekli TL Katılma Hesabı)/

(Physical Gold Conversion-Supported TL Participation Account)

İşbu Ek Sözleşme aşağıda adı soyadı yazılı Müşteri ile Kuveyt Türk Katılım Bankası A.Ş. (Banka) arasında akdedilen Bankacılık Hizmetleri Sözleşmesinin (BHS) ayrılmaz bir parçası ve eki olup, işbu Ek Sözleşmede düzenlenmeyen sair hususlarda, taraflar arasındaki ilişkiye hesabın niteliğine aykırı olmamak kaydıyla BHS ve 14.03.2022/31778 Resmi Gazete’ de yayımlanan 2022/11 Altın Cinsinden Fiziki Varlıkların Finansal Sisteme Kazandırılması Hakkında Tebliğ (Tebliğ) ile Altın Cinsinden Fiziki Varlıkların Finansal Sisteme Kazandırılması Hakkında Tebliğe İlişkin Uygulama Talimatı (Talimat) hükümleri uygulanacaktır.

1. Amaç

İşbu Sözleşmenin amacı, Tebliğ hükümleri uyarınca yurt içi yerleşik gerçek ve tüzel kişi Müşteri’nin altın hesabına yatırdığı fiziki altının Türk Lirası katılma hesaplarına dönüşmesi halinde, Müşteriye sağlanacak destekle ilgili olarak Banka nezdinde açacağı katılma hesabı mahiyetindeki Fiziki Altın Katılma Hesabı’na ilişkin usul ve esasları belirlemektedir.

2. Tanımlar

Altın kabul sistemi (AKS): Yetkili rafineriler tarafından oluşturulmuş, yetkili kuyumcular ve bankalar tarafından kullanılan tüm bilişim sistemleri ile banka şubelerinde yetkili rafineriler tarafından atanan eksperler aracılığıyla gerçekleştirilen altın toplama sistemlerini,

BİST: Borsa İstanbul A.Ş.’ yi,

Dönüşüm fiyatı: Merkez Bankası tarafından saat 10:00, 11:00,12:00, 13:00, 14:00 ve 15:00’de ilan edilen ve işlem saati itibarıyla en son açıklanmış olan 995/1000 veya 1000/1000 saflıktaki gram altının Türk lirası karşılığı alış fiyatını,

Fiziki altın: Yetkili kuyumcular veya bankalar tarafından teslim alınan ve 11/8/1989 tarihli ve 20249 sayılı Resmî Gazete’ de yayımlanan Türk Parası Kıymetini Koruma Hakkında 32 sayılı Kararda tanımlanan standart işlenmemiş altınlardan 1 kilogram ve altındaki külçe ve bar şeklindeki altınlar, standart dışı işlenmemiş altınlardan hurda şeklindeki altınlar ile işlenmiş altınları,

This Supplemental Agreement is an inseparable part and addition of the Banking Services Agreement (BSA) concluded between Customer, whose name and surname are stated below, and Kuveyt Türk Participation Bank Inc. (Bank), and the provisions of BSA and Notification on Bringing Gold-Denominated Physical Assets into the Financial System (Notification) no. 2022/11 published in Official Gazette on 14.03.2022/31778 and Implementation Instruction Regarding the Notification on Bringing Gold-Denominated Physical Assets into the Financial System (Instruction) will be implemented for the other matters that are not issued in this Supplemental Agreement, provided that it is not against the relation between the parties and the nature of the account.

1. Objective

The purpose of this Agreement is to determine the procedures and principles of the Physical Gold Participation Account in the nature of the participation account within the Bank regarding the support to be provided to the Customer in case of the conversion of the physical gold, that the resident natural and legal person Customer deposits to the gold account, into the Turkish Lira participation accounts in accordance with the provisions of the Notification.

2. Definitions

Gold acceptance system (AKS): means all information systems created by authorized refineries, used by authorized jewelers and banks, and the gold collection systems performed at the bank branches through experts appointed by the authorized refineries, BIST: means Borsa Istanbul A.Ş.,

Conversion price: means the purchase price of gram gold of 995/1000 or 1000/1000 purity in Turkish currency, which was announced by the Central Bank at 10:00, 11:00, 12:00, 13:00, 14:00, and 15:00 and was last announced as of the transaction time,

Physical gold: means 1 kilogram and less of standard unprocessed gold bullion and bar-shaped gold, non-standard unprocessed gold in the form of scrap gold and processed gold, received by the authorized jewelers or banks and defined in the Decision No.32 on Protection of the Value of Turkish Currency published in the Official Gazette dated 11/8/1989 and numbered 20249,

Central Bank: means the Central Bank of the Republic of

Türkiye,

Gold fineness value: means the gold fineness values to be used as the minimum criterion for the gold fineness value determined by the Regulation on the Procedures and Principles Related to

Teslim Tesellüm Tutanağı: 22/6/2016 tarihli ve 29750 sayılı Resmî Gazete’ de yayımlanan Bankaların Kıymetli Maden Alım Satımına İlişkin Usul ve Esaslar Hakkında Yönetmeliğin 4 üncü maddesinin ikinci fıkrasında sayılan bilgilerin yer aldığı tutanağı,

Vade sonu fiyatı: Türk lirası mevduat veya katılma hesabının vadesinde saat 11:00’de Merkez Bankası tarafından ilan edilen 995/1000 veya 1000/1000 saflıktaki gram altının Türk lirası karşılığı alış fiyatını,

Yetkili kuyumcu: 14/4/2021 tarihli ve 31454 sayılı Resmî Gazete’ de yayımlanan Kuyum Ticareti Hakkında Yönetmelik uyarınca ‘yetki belgesi’ almış kuyum işletmelerinden yetkili rafineriler ile anlaşması bulunan ve AKS’ ye erişimi olan kuyumcuları,

Yetkili rafineri: BİST Rafineriler Listesinde yer alan, Türkiye’de kurulu ve bankalar ile altın cinsinden fiziki varlıkların finansal sisteme kazandırılması amacıyla anlaşma yapan, AKS’ ye erişimi olan rafinerileri,

Yurt içi yerleşik gerçek kişi: Yurt dışında işçi, serbest meslek ve müstakil iş sahibi Türk vatandaşları dahil Türkiye'de kanuni yerleşim yeri bulunan gerçek kişileri, Yurt içi yerleşik tüzel kişi: Banka ve Merkez Bankasınca belirlenen diğer mali kuruluşlar hariç olmak üzere Türkiye'de kanuni yerleşim yeri bulunan tüzel kişileri, ifade eder.

3. Fiziki altınların Türk lirası katılma hesaplarına dönüşümü:

3.1. Müşteri, sahip olduğu hurda altını Fiziki Altın Katılma Hesabında değerlendirebilmek için Tebliğ ve Talimat uygun olarak aşağıdaki işlem süreçlerini tamamlamayı ve işbu Ek Sözleşme’ de, Tebliğ’de ve Talimat’ta belirlenen özel şartlarla bağlı olarak Fiziki Altın Katılma Hesabını kullanmayı kabul, beyan ve taahhüt eder.

3.2. Türk lirasına çevirme:

3.2.1. Yurt içi yerleşik gerçek ve tüzel kişi Müşteri fiziki altınlarını, milyem değeri üzerinden hesaplanacak gram cinsinden has altın miktarının tespit edilebilmesi için yetkili kuyumcuya veya Banka şubesinde yetkili rafineri tarafından atanan ekspere teslim eder. Eksper veya yetkili kuyumcu tarafından fiziki altınlara ilişkin bilgiler AKS’ ye

the Precious Metal Purchase and Sale of the Banks published in the Official Gazette dated 22/6/2016 and numbered 29750, Standard gold: means a minimum of 1kg of gold bullion with at least 995/1000 purity, bearing the emblem or stamp and serial number of one of the refineries recognized by the Xxxxxx Bullion Market Association (LBMA) or the Precious Metals and Precious Stones Market in the BIST and which is traded as standard gold in these markets,

Delivery Receipt Report: means the report consisting of the information mentioned in Paragraph 2 of Article 4 of the Regulation on the Procedures and Principles Related to the Precious Metal Purchase and Sale of the Banks published in the Official Gazette dated 22/6/2016 and numbered 29750, Maturity date price: means the purchase price of the gram of gold with 995/1000 or 1000/1000 purity in Turkish currency, announced at 11:00 by the Central Bank at the maturity of the Turkish lira deposit or participation account,

Authorized jeweler: means the jewelers who have an agreement with authorized refineries from jewelry businesses that have received an 'authorization certificate' and have access to AKS, in accordance with the Regulation on the Jewelry Trade published in the Official Gazette dated 14/4/2021 and numbered 31454,

Authorised refinery: means the refineries stated in the BIST Refineries List, established in Türkiye and signed agreements with the banks in order to bring gold-denominated physical assets into the financial system, and have access to AKS,

Resident natural person: means natural persons who have a legal place of residence in Türkiye, including Turkish citizens who work overseas as workers, self-employed and independent employers,

Resident legal person: means legal persons who have a legal place of residence in Türkiye, excluding other financial institutions determined by the Bank and Central Bank.

3. Conversion of physical gold to Turkish lira participation accounts:

3.1. Xxxxxxxx agrees, declares and undertakes to complete the following transaction processes in order to evaluate their scrap gold in the Physical Gold Participation Account in accordance with the Notification and Instruction, and to use the Physical Gold Participation Account subject to the special terms specified in this Supplemental Agreement, the Notification and Instruction.

3.2. Conversion to Turkish currency:

3.2.1. The resident natural and legal person delivers their physical gold to the authorized jeweler or the expert appointed by the authorized refinery in the Bank for the determination of the amount of gold in grams to be calculated based on the gold fineness value. The information regarding the physical gold is entered into the AKS by an expert or authorized jeweler, and the

3.2.2. Yetkili kuyumcularda gerçekleştirilen işlemlerde AKS ile mutabakatı sağlanan has altın miktarı veya karşılığı Türk lirası Müşteri’nin Banka’daki hesabına yetkili rafineri aracılığıyla aktarılır.

3.2.3. Banka şubelerinde gerçekleştirilen işlemlerde ise AKS ile mutabakatı sağlanan has altın miktarı Müşterinin altın hesabına aktarılır.

3.2.4. Müşteri hesabına aktarılan gram cinsinden has altın bakiyesi, dönüşüm fiyatı üzerinden Türk lirasına çevrilerek 3, 6 ay(en fazla 180 gün) veya 1 yıl(en fazla 365 gün) vadeli (ve mevzuatın öngördüğü asgari altın miktarı karşılığı) Türk lirası katılma hesabı açılır. Açılan hesaba Merkez Bankasınca, vadesine göre değişen oranlarda, vade sonuna kadar çekilmemek kaydıyla Türk lirası olarak ve peşinen ilave getiri verilir. İlave getiri tutarları, dönüşümü yapılan altın miktarı üzerinden yıllık bazda 6 ay vadeli hesaplar için %1, 1 yıl vadeli hesaplar için ise %2 olarak hesaplanır.Söz konusu miktar ve/veya oranlar, Tebliğ ve Talimat değişikliklerine göre başkaca bir işleme lüzum olmaksızın kendiliğinden değişir.

4. Vade sonu işlemleri:

4.1. Vade sonunda hesap sahibinin talep etmesi durumunda vade başındaki altın miktarı vade sonu fiyatı üzerinden hesap sahibine satılır. Vade sonu fiyatının, dönüşüm fiyatından düşük olması durumunda, hesabın işletilmesinden elde edilen kâr/zarar, birim hesap değeri üzerinden hesaplanır ve bulunacak tutar Banka tarafından Müşteriye ödenir.

4.2. Vade sonu fiyatının dönüşüm fiyatından yüksek olması durumunda ve fiyat farkı üzerinden hesaplanan tutar Banka tarafından hesabın işletilmesinden elde edilen kâr payından da yüksek ise; Banka tarafından hesabın işletilmesinden elde edilen kar payı tutarına, Tebliğ kapsamında Merkez Bankasınca üstlenilen ve katılma hesabı sahibine ödenmek üzere Bankaya aktarılacak olan destek miktarı ilave edilir.

4.3. Hesabın yenilenmesine ilişkin kapsam, usul ve esaslar Merkez Bankasınca belirlenir ve yenilenen hesaplar anılan usul ve esaslar ile işbu Sözleşme hükümlerine göre işletilmeye devam edilir. Buna göre vade sonunda şayet Müşterinin aksine bir talimatı yoksa ve mevzuatın öngördüğü asgari altın miktarı bulunuyorsa hesap kendiliğinden yenilenir. Yenilenen hesaplara ilave getiri ödenmez. Müşteri yenilenen hesap kapsamında en fazla vade sonundaki Türk lirası bakiyenin vade sonu fiyatı

delivery receipt report is issued as two copies and one of the copies is given to the Customer. The other copy is kept by the expert or authorized jeweler.

3.2.2. In transactions carried out in the authorized jewelers, the amount of fine gold or its equivalent Turkish lira agreed through AKS is transferred to the Customer's account in the Bank by the authorized refinery.

3.2.3. In transactions carried out at bank branches, the amount of fine gold agreed through AKS is transferred to the Customer's gold account.

3.2.4. The fine gold balance in grams transferred to the Customer account is converted into Turkish currency at the conversion price, and a Turkish lira participation account with a maturity of 3, 6 months (maximum 180 days), or 1 year(maximum 365 days) (and equivalent to the minimum amount of gold stipulated by the legislation) is opened. Additional proceeds are granted in Turkish currency and in advance to the opened account by the Central Bank, at rates varying according to the maturity, provided that it is not withdrawn until the maturity date. Additional proceeds amounts are calculated as 1% for accounts with a maturity rate of 6 months and 2% for accounts with a maturity of 1 year on an annual basis on the amount of converted gold. The amount and/or rates in question change automatically without the need for any other transaction in accordance with the changes in the Notification and Instruction.

4. Maturity date transactions:

4.1. If the account owner requests it at the end of the maturity, gold amount at the beginning of the maturity is sold to the account owner at the end of the matury price. If the maturity date price is lower than the conversion price, the profit/loss from the operation of the account is calculated based on the unit account value, and such amount is paid to the Customer by the Bank.

4.2. If the price at the end of the maturity is higher than the conversion price and the amount calculated over the price difference is also higher than the profit share obtained by the Bank from the operation of the account; the amount of support undertaken by the Central Bank within the scope of the Communiqué and to be transferred to the Bank to be paid to the participation account holder shall be added to the profit share amount obtained by the Bank from the operation of the account.

4.3. The scope, procedure and principles regarding the renewal of the account are determined by the Central Bank and renewed accounts continue to be processed in accordance with the said procedure and principles and the provisions of this Agreement. Accordingly, if the customer does not have a request otherwise at the end of the maturity and there is a minimum gold amount stipulated by the legislation, the account is renewed

4.4. Vade sonunda hesap sahibinin talep etmesi durumunda vade başındaki altın miktarı vade sonu fiyatı üzerinden hesap sahibine satılır. Bununla birlikte hesap sahibine yapılacak altın satışlarında vade sonu fiyatının kullanılması, bu kapsamdaki altın satışlarının saat 12:00’ye kadar Banka şubeleri nezdinde tamamlanması ve Bankanın altın satış fiyatı ile vade sonu fiyatı arasında aleyhte oluşan fark bildirimleri için Banka tarafından saat 11:00 altın satış fiyatının kullanılması gerekmektedir. Müşteri tarafından Şube haricinde ya da elektronik bankacılık kanalları üzerinden yapılmak istenecek altın alım işlemlerinde Merkez Bankasının ilan ettiği fiyatlar uygulanmayacak, bu işlemler Banka tarafından işlem anında belirlenen fiyatlar üzerinden gerçekleşecektir.

4.5. Bankanın katılma hesaplarına sağlanacağı getiri, Danışma Komitesi veya Danışma Kurulu tarafından belirlenen ve aşağıda 7. maddede belirtilen sınırlar dahilinde olacaktır. Bu çerçevede Banka hesabı destekleyebilecektir.

5. Xxxxxx Xxxxxxx Xxxx Xxxxxxxx ve Hesabın İşleyişi

5.1. Müşteri, bu hesabı açabilmek için istenecek her türlü bilgi ve belgeyi Bankaya ibraz etmek zorundadır. Hesabın açılışı sırasında bu hesap Müşterinin Banka nezdindeki özel cari hesabı ile ilişkilendirilir. Şayet mevcut bir özel cari hesabı yoksa yeni olarak açılır. Vade sonunda (ya da kapatma/çekme tarihindeki) hesap bakiyesi yukarıdaki esaslarla güncellenerek (varsa kâr paylarıyla birlikte) Müşterinin hesapla ilişkilendirilen bu özel cari hesabına aktarılır. Hesap açma işlemleri, iş günlerinde ve hafta sonu gerçekleştirilebilecektir.

5.2. İş günleri dışında ve iş günlerinde saat 17:00'den sonra ve hesabın vadesinden önce çekim yapılamaz. Vadeden önce çekim yapılması durumunda hesap sahibine sadece 2. maddede tanımlı asgari milyem değerleri üzerinden hesaplanan anapara karşılığı ödenir. Hesap açılışında anaparaya eklenen ilave getiri tutarı ve komisyona esas milyem değerleri farkı hesap sahibine ödenmeyerek Merkez Bankasına iade edilir.

Ayrıca; Xxxxxxx tarafından vade başında getirilen altının azami %10’u bir defaya mahsus kısmi çekim yapılabilir. Kısmi çekim yapılan tutar için verilen ilave getiri hesap bakiyesinden düşülerek Merkez Bankasına iade edilir. Kısmi çekim sonrasında kalan bakiye aynı vade ve oran üzerinden işlemeye devam eder. Yenilenen hesaplarda kısmi çekim yapılmaz.

automatically. Renewed accounts are not paid additional return. The customer continues to benefit from the support over the maturity that they will choose, provided that it is the price of the Turkish lira balance at the end of the maturity and the gold amount corresponding to the maturity date.

4.4. If the account holder requests at the maturity date, the gold amount at the beginning of the maturity is sold to the account holder at the maturity date price. However, the maturity date price must be used in the gold sales to be made to the account holder, gold sales within this scope must be completed by 12:00 at the Bank branches and the gold sales price at 11:00 must be used by the Bank for the notification of the adverse difference between the bank's gold sales price and the maturity date price. The prices announced by the Central Bank shall not be applied to the gold purchase transactions requested by the Customer to be made outside the Branch or through electronic banking channels, and these transactions shall be carried out at the prices determined by the Bank at the time of the transaction.

4.5. The proceeds to be provided to the Bank's participation accounts will be within the limits determined by the Advisory Committee or Advisory Board and specified in Article 7 below. Within this framework, the Bank will be able to support the account.

5. Special Provisions Regarding the Account and the Functioning of the Account

5.1. The Customer is obliged to submit all kinds of requested information and documents to the Bank in order to open this account. In the course of opening the account, this account is associated with the Customer's private checking account within the Bank. If there is no existing private checking account, it will be opened as a new one. The account balance is updated (together with the profit shares, if any) according to the principles above at the maturity date (or at the closing/withdrawal date), and it is transferred to the private checking account of the Customer associated with the account. Account opening transactions can be performed on working days and weekends.

5.2. Money withdrawal can not be performed outside of workdays and on workdays after 17:00 and before the maturity date of the account. In the event of withdrawal before the maturity date, only the amount, which is calculated over the minimum gold fineness values as defined in the article 2, is paid to the account owner for the capital. Additional proceeds amount, which is added to the capital during account opening and gold fineness values based on the commission differences are not paid to the account owner and returned to the Central Bank.

In addition, minimum 10% of the gold which is brought by the Customer at the start of the maturity date can be withdrawn

5.2.1. Çekim yapılan tarihte saat 11:00’de Merkez Bankası tarafından ilan edilen 995/1000 veya 1000/1000 saflıktaki gram altının Türk lirası karşılığı alış fiyatının dönüşüm fiyatından yüksek olması durumunda Merkez Bankasınca fiyat farkına ilişkin ödeme yapılmaz.

5.2.2. Çekim yapılan tarihte saat 11:00’de Merkez Bankasınca ilan edilen 995/1000 veya 1000/1000 saflıktaki gram altının Türk lirası karşılığı alış fiyatının dönüşüm fiyatından düşük olması durumunda hesabın vadeden önce kapatıldığı tarihte saat 11:00’de Merkez Bankası tarafından ilan edilen 995/1000 veya 1000/1000 saflıktaki gram altının Türk lirası karşılığı alış fiyatından hesap bakiyesi güncellenir. Aradaki fark Banka tarafından Merkez Bankasının Türk lirası hesabına aktarılır.

5.3. Hesabın açıldığı gün vadeden önce çekim yapan gerçek veya tüzel kişilerin yaptıkları hesap açma işlemi ve ilave getiri ödemesi iptal edilir. Bankanın, zarar, ziyan ile Tebliğ ve Talimat’ tan kaynaklanan sair hakları saklıdır.

5.4. Merkez Bankası, Bakanlık ve/veya BDDK başta olmak üzere resmî kurumların alacağı kararlar, düzenlemeler ile TKBB Danışma Kurulu kararları/TKBB düzenlemeleri, hesabın işleyişi, yorumu ve uygulaması bakımından öncelikle nazara alınacaktır. Taraflar söz konusu kurum, kurul ve/veya kuruluşlar tarafından alınacak kararların kendilerince de itirazsız kabul edilmiş sayılacağını, gayrikabili rücu kabul, beyan ve taahhüt ederler.

5.5. Dönüşüm, hesap bakiyesinin işletilmesi, hesabın kapatılması ve vade sonunda geri ödenecek tutarlara ilişkin olarak katılım bankacılığı ilke ve standartları geçerlidir. Bankanın müşteriye herhangi bir biçimde anapara, kâr payı ve/veya getiri garantisi yoktur.

6. Bilgilerin Paylaşılmasına İzin

Müşteri, işbu sözleşmeyi imzalayarak, hesabına ve hesap mevcuduna ilişkin bilgilerin, Merkez Bankası, Bakanlık ve BDDK başta olmak üzere, ilgili diğer kurum ve kuruluşlarla paylaşılmasına izin verdiğini (muvafakat ettiğini) kabul, beyan ve taahhüt eder.

7. Katılım Bankacılığı İlke ve Standartlarına

Uyum

Bankanın işbu sözleşme ve Tebliğ kapsamında açacağı katılma hesaplarına vade sonunda dağıtacağı kâr payı, faizsiz bankacılık ilke ve standartları doğrultusunda hesaplara tahakkuk ettirilecektir. Banka dilerse, kendi kâr

partially for once. The additional proceeds, which are given for the amount partially withdrawn are deducted from the account and returned to the Central Bank. The remaining balance after the partial withdrawal continues to be processed with the same maturity and rate. Partial withdrawal can not be performed from renewed accounts.

5.2.1. In case the purchase price of 995/1000 or 1000/1000 pure gram gold in Turkish currency, announced by the Central Bank at 11:00 on the withdrawal date, is higher than the conversion price, the Central Bank will not pay for the price difference.

5.2.2. In case the purchase price of 995/1000 or 1000/1000 pure gram gold in Turkish currency, announced by the Central Bank at 11:00 on the withdrawal date, is lower than the conversion price, the account balance is updated at the Turkish currency equivalent of the purchase price of 995/1000 or 1000/1000 pure gram gold announced by the Central Bank at 11:00 on the date the account is closed before the maturity date. The difference is transferred by the Bank to the Turkish lira account of the Central Bank.

5.3. The account opening transaction and additional proceeds payment, made by natural or legal persons who withdraw before maturity on the day the account is opened, are canceled. The Bank's other rights arising from the damage, loss, and Notification and Instruction are reserved.

5.4. Decisions and regulations made by the public enterprises especially the Central Bank, the Ministry and/or BRSA, and TKBB Advisory Board decisions/TKBB regulations shall be primarily taken into account in terms of functioning, interpretation, and implementation of the account. The Parties irrevocably agree, declare and undertake that decisions taken by such institution, council, and/or organizations will be deemed to be accepted by them without objection.

5.5. The principles and standards of participation banking apply to the conversion, operation of the account balance, closing of the account and the amounts to be paid back at the maturity date. The Bank has no guarantee of principal, profit shares and/or proceeds to the customer in any form.

6. Permission to Share Information

The customer agrees, declares, and undertakes that they allow (consent for) the information regarding the account and account balance to be shared with the Central Bank, the Ministry, and BRSA, and the other relevant institutions and organizations.

7. Compliance with the Participation Banking Principles and Standards

The profit share, which the Bank will distribute to the participation accounts that it will open within the scope of this agreement and Notification, will be accrued to the accounts in accordance with

the principles and standards of interest-free banking. If the Bank wishes, it can waive its own profit shares in favor of the Customer and can distribute 100% of the profit to the customer. The relevant paragraphs of Article 6 of the Regulation on Procedures and Principles regarding the Acceptance, Withdrawal of the Deposit and Participation Funds, and Past Due Deposits, Participation Funds, Trusts, and Receivables might be applied to the profit sharing to be accrued to the accounts. The provisions, that are contrary to the principles and standards of interest-free banking of the Notification, are not implemented; these provisions become valid only with the decision of the Advisory Committee and/or Advisory Board. The Parties agree to these matters, and mutually and irrevocably waive their rights, which will constitute a violation of the principles and standards of interest-free banking.

Tebliğin faizsiz bankacılık ilke ve standartlarına aykırı hükümleri uygulanmaz; bu hükümler ancak Danışma Komitesi ve/veya Danışma Kurulu kararı ile geçerli hale gelir. Taraflar bu hususları kabul ile faizsiz bankacılık ilke ve standartlarına aykırılık teşkil edecek haklarından karşılıklı olarak ve gayrikabili rücu feragat etmişlerdir.
