1. Ця Публічна оферта щодо укладання електронного Договору/Договору добровільного страхування відповідальності перевізника наземним транспортом (CMR, TTH, CMR + TTH) (надалі

– «Оферта») є офіційною пропозицією Приватного акціонерного товариства «Страхова Компанія «Перша» (надалі – «Страховик»), що адресується невизначеному колу споживачів – дієздатних фізичних осіб/юридичних осіб (надалі – «Клієнти»), укласти зі Страховиком електронний Договір/Договір добровільного страхування відповідальності перевізника наземним транспортом (CMR, TTH, CMR

+ TTH).

2. Реквізити Страховика: повна назва - Приватне акціонерне товариство «Страхова Компанія «Перша», скорочена назва - ПрАТ

«СК «Перша»; адреса: вул. Фізкультури, буд. 30, м. Київ, 03150, Україна; код ЄДРПОУ 31681672; сторінка в інтернет-мережі (веб-сайт): xxxxx://xxxxxx.xx ; адреса електронної пошти: xxxxxx@xxxxxx.xx. Страховик є платником податку на прибуток на загальних підставах, встановлених для страхових компаній відповідно до Податкового кодексу України.

3. Клієнт - дієздатна фізична особа/юридична особа, яка розглядає можливість укладання електронного Договору/Договору добровільного страхування відповідальності перевізника наземним транспортом (CMR, TTH, CMR + TTH) (надалі – Договір) відповідно до умов цієї Оферти.

4. Ця Оферта нумерується та затверджується Страховиком, оприлюднюється та є доступною для ознайомлення на власному веб- сайті Страховика за наступним посиланням: xxxxx://xxxxxx.xx .

5. Ця Оферта є стандартною формою (в розумінні статті 634 Цивільного кодексу України), що може акцептувати Клієнт шляхом приєднання до Договору в цілому. Ця Оферта складена відповідно до законодавства України, в тому числі Закону України «Про страхування», Цивільного кодексу України, Закону України «Про електронну комерцію», Закону України «Про фінансові послуги та державне регулювання ринків фінансових послуг».

6. Страхувальник – Клієнт (дієздатна фізична особа/юридична особа), який уклав зі Страховиком Договір в порядку, визначеному цією Офертою.

7. Сторони Договору – Xxxxxxxxxxxxx та Xxxxxxxxx разом, кожен окремо – Xxxxxxx.

8. Договір, укладений між Страховиком та Страхувальником, складається з цієї Оферти (Публічної частини Договору) та Індивідуальної частини Договору (надалі – ІЧД), що є невід’ємними одна від одної та складають єдиний документ.

9. Договір між Сторонами укладається шляхом підписання Сторонами Індивідуальної частини Договору (шляхом приєднання), підписанням якої Клієнт приєднується до Договору в цілому. Інформація про Страхувальника та Вигодонабувача зазначається в ІЧД. Датою укладення Договору є дата підписання Клієнтом ІЧД за допомогою одноразового ідентифікатора.

10. Договір підписується Страховиком шляхом нанесення на нього факсимільного відтворення підпису уповноваженої особи Страховика

Part 1 of the PPC

1. This Public Offer for the conclusion of an electronic contract/ contract of voluntary motor third party liability insurance (CMR, TTH, CMR + TTH) (hereinafter referred to as the Offer) is an official offer of Private Joint Stock Company “Insurance Company Persha” (the Insurer), addressed to an indefinite number of consumers – capable individuals/legal entities (the Clients), to conclude an electronic contract/ contract of voluntary motor third party liability insurance (CMR, TTH, CMR + TTH) with the Insurer.

2. Insurer's details: full name: Private Joint Stock Company “Insurance Company Persha”, short name: PrAT IC Persha; address: Xxxxxxxxxx Xx., 00, Xxxx, 00000, Xxxxxxx; EDRPOU code 31681672; website: xxxxx://xxxxxx.xx ; E-mail: xxxxxx@xxxxxx.xx. The Insurer is a corporate income tax payer on the general grounds established for insurance companies in accordance with the Tax Code of Ukraine.

3. The Client is a legally capable individual/legal entity considering the possibility of concluding an electronic Contract/ Contract of voluntary motor third party liability insurance (CMR, TTH, CMR + TTH) (hereinafter referred to as the Contract) in accordance with the terms of this Offer.

4. This Offer shall be numbered and approved by the Insurer, published and made available for review on the Insurer's website at xxxxx://xxxxxx.xx .

5. This Offer is a standard form (within the meaning of Article 634 of the Civil Code of Ukraine), which may be accepted by the Client by adhering to the Contract as a whole. This Offer is drawn up in accordance with the legislation of Ukraine, including the Law of Ukraine “On Insurance”, the Civil Code of Ukraine, the Law of Ukraine “On Electronic Commerce”, the Law of Ukraine “On Financial Services and State Regulation of Financial Services Markets”.

6. The Insured shall mean a Client (legally capable individual/legal entity) who has entered into a Contract with the Insurer in accordance with the procedure specified in this Offer.

7. The Parties to the Contract shall be the Insured and the Insurer collectively, each separately a Party.

8. The Contract concluded between the Insurer and the Insured shall consist of this Offer (Public part of the Contract) and Individual Part of the Contract (IPC), which are integral to each other and constitute a single document.

9. The Contract between the Parties shall be concluded by signing the Individual Part of the Contract (by accession), by signing which the Client shall adhere to the Contract as a whole. The information about the Insured and the Beneficiary shall be specified in the IPC. The date of the Contract is the date of signing the IPC by the Client using a one-time identifier.

10. The Contract shall be signed by the Insurer by affixing a facsimile reproduction of the signature of the Insurer's authorized representative and the Insurer's seal imprint applied by means of copying equipment.

11. Безумовним прийняттям (акцептом) умов цієї Оферти Клієнтом вважається підписання ІЧД електронним підписом із застосуванням одноразового ідентифікатора (введення пароля, отриманого на засіб мобільного зв’язку) та сплата у повному обсязі страхового платежу на рахунок Страховика. Датою сплати вважається дата зарахування грошових коштів на рахунок Страховика. Підписання Клієнтом Індивідуальної частини Договору одноразовим ідентифікатором вважається належним підписанням Клієнтом Договору у відповідності до вимог статті 12 Закону України «Про електронну комерцію».

12. Примірник укладеної Індивідуальної частини Договору (з номером, присвоєним Страховиком) та її невід’ємна частина Оферта (Публічна частина Договору – надалі ПЧД) надаються Страхувальнику шляхом направлення її на адресу електронної пошти Страхувальника та/або на засіб мобільного зв’язку із застосуванням контактних даних, зазначених Страхувальником в Індивідуальній частині Договору.

13. Підписанням Індивідуальної частини Договору, Xxxxxxxxxxxxx підтверджує, що:

13.1. Має необхідний обсяг дієздатності/правоздатності для укладання Договору.

13.2. З Правилами та умовами страхування (визначеними в Індивідуальній частині Договору та Публічній частині Договору) ознайомлений, згодний, всі умови страхування є зрозумілими.

13.3. До підписання Індивідуальної частини Договору Страхувальнику надано та належним чином роз’яснено інформацію, що зазначена в частині другій статті 12 Закону України «Про фінансові послуги та державне регулювання ринків фінансових послуг» №2664-ІІІ від 12.07.2001.

13.4. Надає згоду на отримання Договору, пропозицій про внесення змін до укладеного Договору на електронну адресу та/або на засіб мобільного зв'язку.

13.5. Надає згоду на підписання Xxxxxxxxxxx ІЧД та на використання в усіх без виключення договірних відносинах зі Страхувальником, при здійсненні переписки з ним, в тому числі ділової, при посвідченні документів від імені Xxxxxxxxxx особистого підпису уповноваженої на такі дії особи або факсимільного відтворення підпису уповноваженої особи Xxxxxxxxxx та відтворення відбитка печатки Страховика,

нанесених за допомогою засобів копіювання, наведених нижче:

11. Unconditional acceptance of the terms and conditions of this Offer by the Client shall be deemed to be signing the IPC with an electronic signature using a one-time identifier (entering the password received on the mobile communication device) and payment of the insurance premium in full to the Insurer's account. The date of payment shall be the date of crediting funds to the Insurer's account. Signing of the Individual Part of the Agreement by the Client with a one-time identifier shall be deemed to be a proper signing of the Agreement by the Client in accordance with the requirements of Article 12 of the Law of Ukraine “On Electronic Commerce”.

12. A copy of the concluded Individual Part of the Contract (with the number assigned by the Insurer) and its integral part, the Offer (Public Part of the Contract – PPC), shall be provided to the Insured by sending it to the Insured's e-mail address and/or mobile communication means using the contact details specified by the Insured in the Individual Part of the Contract.

13. By signing the Individual part of the Contract, the Insured confirms that:

13.1. He/she has the necessary capacity to enter into the Contract.

13.2. He/she has read and agrees to the Insurance Terms and Conditions (set forth in the Individual Part of the Contract and the Public Part of the Contract), and all insurance terms and conditions are understood.

13.3. Prior to signing the Individual Part of the Contract, the Insured has been provided with and duly explained the information specified in part two of Article 12 of the Law of Ukraine “On Financial Services and State Regulation of Financial Services Markets” No. 2664-III of 12/07/2001.

13.4. He/she agrees to receive the Contract, proposals for amendments to the concluded Contract by e-mail and/or mobile communication.

13.5. He/she agrees to the Insurer's signing of the IPC and to use in all contractual relations with the Insured, without exception, in correspondence with him/her, including business correspondence, when certifying documents on behalf of the Insurer, the personal signature of the person authorized for such actions or a facsimile reproduction of the signature of the Insurer's authorized person and the reproduction of the Insurer's seal applied by means of copying means listed below:

13.6. Відповідно до Закону України «Про захист персональних даних»: ознайомлений із правами, що має Страхувальник відповідно до змісту статті 8 Закону України «Про захист персональних даних», та дає згоду Страховику на обробку та використання персональних даних Страхувальника виключно з метою та в межах виконання вимог законодавства України, посвідчує, що повідомлення про включення даних про Страхувальника до бази персональних даних клієнтів Страховика отримано.

14. Договір укладається на підставі:

14.1. Правил добровільного страхування цивільної відповідальності власників наземного транспорту (включаючи відповідальність перевізника), реєстраційний №1280690, від 17.04.2008, Змін та доповнень №2 до Правил добровільного страхування цивільної відповідальності власників наземного

Pursuant to the Law of Ukraine “On Personal Data Protection”: is familiarized with the rights of the Insured in accordance with Article 8 of the Law of Ukraine “On Personal Data Protection” and gives consent to the Insurer to process and use the Insured's personal data solely for the purpose and within the limits of fulfillment of the requirements of the legislation of Ukraine, certifies that the notification of inclusion of the Insured's data in the Insurer's customer personal data base has been received.

14. The Contract is concluded based on:

14.1. Rules of voluntary insurance of civil liability of owners of land transport (including carrier's liability), registration No. 1280690, dated 17.04.2008, Amendments and additions No. 2 to the Rules of voluntary motor third party liability insurance (including carrier's liability) of 11/03/2019, Annex No. 2 to the Rules of Voluntary Motor Third Party

транспорту (включаючи відповідальність перевізника) від 11.03.2019, Додатку №2 до Правил добровільного страхування цивільної відповідальності власників наземного транспорту (включаючи відповідальність перевізника) «Особливі умови добровільного страхування відповідальності перевізника/експедитора наземним транспортом», реєстраційний

№1281040, від 25.06.2008, зареєстрованих Національною комісією, що здійснює державне регулювання у сфері ринків фінансових послуг.

14.2. Ліцензії з добровільного страхування цивільної відповідальності власників наземного транспорту (включаючи відповідальність перевізника) АЕ №198810, рішення Національної комісії, що здійснює державне регулювання у сфері ринків фінансових послуг від 28.05.2013, №1658, строк дії з 17.04.2008, безстроковий.

15. Фіксація підписання Страхувальником ІЧД здійснюється Страховиком в електронному вигляді та зберігається в ІТС Страховика. Сторони погоджуються, що виписки з ІТС Страховика можуть використовуватись як докази при розгляді спорів, у тому числі в судовому порядку. ІТС (інформаційно-телекомунікаційна система) - сукупність інформаційних та телекомунікаційних систем, що у процесі обробки інформації діють як єдине ціле і використовується Страховиком, або уповноваженою особою Страховика для укладання електронних договорів страхування у відповідності до вимог законодавства у сфері електронної комерції.

16. Страховик є зобов’язаним щодо виконання умов Договору після прийняття (акцепту) цієї Оферти Клієнтом, за умови сплати Клієнтом страхового платежу в порядку і на умовах, визначених ІЧД.

17. Клієнт має можливість відмовитися від укладання Договору в будь-який момент до здійснення ним акцепту цієї Оферти.

18. Зміни до умов цього Договору здійснюються в письмовій формі за згодою Xxxxxx виключно в умови, зазначені в ІЧД. Пропозиції Страховика про внесення змін до укладеного Договору здійснюються шляхом направлення не пізніше 5-ти (п’яти) робочих днів до дня запланованої зміни умов Договору повідомлення у формі, що дає можливість встановити дату відправлення такого повідомлення, в тому числі на електронну адресу Страхувальника та/або засіб мобільного зв’язку.

19. Сторони приймають на себе зобов'язання за необхідності відтворити Договір на паперовому носії. На письмову вимогу однієї зі Сторін, або уповноваженої особи Страховика/Страхувальника Договір виготовляється на паперовому носії протягом 5-ти (п'яти) робочих днів з дати отримання такої вимоги, та у разі необхідності засвідчується підписом уповноваженої особи і печаткою Страховика/Страхувальника (у разі її застосування в діяльності однієї із Сторін).

20. Ця Оферта діє з дати її оприлюднення на веб-сайті Страховика та до дати оприлюднення на веб-сайті Страховика повідомлення про припинення її дії в цілому. Всі Договори, що укладені в період дії цієї Оферти, діють до закінчення строку дії на умовах, визначених в цій Оферті. При цьому строк дії Договору, укладеного з конкретним Страхувальником, визначається в ІЧД.

21. Захист прав споживачів здійснюється відповідно до законодавства про захист прав споживачів та законодавства у сфері ринків фінансових послуг. Реквізити органу, що здійснює державне регулювання, а також захист прав споживачів:

Liability Insurance (including Carrier's Liability) “Special Conditions of Voluntary Insurance of Liability of Carrier/Forwarder by Land Transport”, registration No. 1281040, of 25/06/2008, registered by the National Commission for State Regulation of Financial Services Markets.

14.2. Licenses for voluntary insurance of civil liability of owners of land transport (including carrier liability) AE No. 198810, decision of the National Commission for State Regulation of Financial Services Markets of 28/05/2013, No. 1658, valid from 17/04/2008, unlimited.

15. The Insurer shall record the signing of the ITI by the Insured electronically and store it in the Insurer's ITS. The Parties agree that extracts from the Insurer's ITS may be used as evidence in disputes, including in court. ITS (information and telecommunication system) shall mean a set of information and telecommunication systems that act as a single unit in the process of information processing and are used by the Insurer or an authorized person of the Insurer to conclude electronic insurance contracts in accordance with the requirements of the legislation in the field of electronic commerce.

16. The Insurer shall fulfill the terms and conditions of the Contract after acceptance of this Offer by the Client, provided that the Client pays the insurance premium in the manner and on the terms and conditions stipulated by the IPC.

17. The Client may withdraw from the Contract at any time before accepting this Offer.

18. Amendments to the terms and conditions of this Contract shall be made in writing with the consent of the Parties only in the terms and conditions specified in the IPC. The Insurer's proposals for amendments to the concluded Contract shall be made by sending a notice in a form that allows setting the date of sending such notice, including to the Insured's e-mail address and/or mobile communication means, no later than five (5) business days before the day of the planned amendment to the terms and conditions of the Contract.

19. The Parties undertake to reproduce the Contract in hard copy if necessary. At the written request of one of the Parties or the Insurer's/Insured's authorized representative, the Contract shall be made in paper form within five (5) business days from the date of receipt of such request, and, if necessary, shall be certified by the signature of the authorized representative and the seal of the Insurer/Insured (if used in the activities of one of the Parties).

20. This Offer shall be valid from the date of its publication on the Insurer's website and until the date of publication on the Insurer's website of the notice of termination of its validity in general. All Contracts concluded during the period of validity of this Offer shall be valid until the expiration of the term on the terms and conditions specified in this Offer. In this case, the term of validity of the Contract concluded with a particular Insured shall be determined in the IPC.

Частина 2 ПЧД Part 2 of the IPC

1. ОСНОВНІ ПОНЯТТЯ, ВИЗНАЧЕННЯ ТА СКОРОЧЕННЯ ЗА ДОГОВОРОМ

1. BASIC TERMS, DEFINITIONS AND ABBREVIATIONS UNDER THE CONTRACT

1.1. Дорожньо-транспортна пригода (ДТП) – подія, що сталася під час руху забезпеченого ТЗ, в результаті якої загинули або дістали поранення люди чи завдані матеріальні збитки, настання якої документально зафіксовано та підтверджено правоохоронними органами чи оформлено шляхом заповнення повідомлення про ДТП (європротоколом).

1.2. Вартість вантажу – еквівалент цінності вантажу (товару), виражений у сумі грошей (за кг брутто) у пункті та під час прийомки вантажу до перевезення.

1.3. Стоянка під постійною охороною – безпечна зона для стоянки вантажного автомобільного транспорту, що має надійно огороджену територію, цілодобову охорону, цілодобово працюючу систему відеоспостереження, систему контролю заїзду та виїзду автотранспорту.

1.4. Обставини непереборної сили (форс-мажорні обставини) – надзвичайні та невідворотні обставини, що об’єктивно унеможливлюють виконання Страхувальником своїх зобов’язань, передбачених умовами договору перевезення та/або обов’язків згідно із законодавчими та іншими нормативними актами, а саме: загроза війни, збройний конфлікт або серйозна погроза такого конфлікту, включаючи але не обмежуючись ворожими атаками, блокадами, військовим ембарго, дії іноземного ворога, загальна військова мобілізація, військові дії, оголошена та неоголошена війна, дії суспільного ворога, збурення, акти тероризму, диверсії, піратства, безлади, вторгнення, блокада, революція, заколот, повстання, масові заворушення, введення комендантської години, експропріація, примусове вилучення, захоплення підприємств, реквізиція, громадська демонстрація, блокада, страйк, аварія, протиправні дії третіх осіб, вибух, тривалі перерви в роботі транспорту, регламентовані умовами відповідних рішень та актами державних органів влади, закриття морських проток, ембарго, заборона (обмеження) експорту/імпорту тощо, а також викликані винятковими погодними умовами і стихійним лихом, а саме: епідемія, сильний шторм, циклон, ураган, торнадо, буревій, повінь, нагромадження снігу, ожеледь, град, заморозки, замерзання моря, проток, портів, перевалів, землетрус, блискавка, пожежа, посуха, просідання і зсув ґрунту, інші стихійні лиха тощо, інші обставини поза межами волі Страхувальника (його представників).

1.5. Представники Страхувальника – особи, які знаходяться із Страхувальником у трудових відносинах, повірені, агенти, водії та всі інші особи, послугами яких він користується для виконання перевезення, а також особи, які залучені Страхувальником до виконання договору перевезення та виконують покладені на них обов‘язки у зв’язку із таким перевезенням.

1.6. Треті особи – юридичні або фізичні особи, які не є Страхувальником та його представником, не уповноважені розпоряджатися вантажем, прийнятим на перевезення та не перебувають зі Страхувальником в трудових та договірних відносинах.

1.7. Спеціальна франшиза – сума, на яку зменшується розмір збитку при визначенні розміру страхового відшкодування у випадку втрати або пошкодження вантажів підвищеного ризику.

1.8. Вантажі підвищеного ризику – вантажі, які відносяться до наступного переліку: лікарські засоби, медичні препарати та товари, медичне та наукове обладнання; вино, лікеро-горілчані вироби, пиво; тютюн та тютюнові вироби; хутро, текстиль; продукція целюлозно-паперової промисловості; сировина та вироби, що

1.1. 1.2. Cargo Valueis an equivalent of cargo (goods) value expressed as a sum of money (per kg gross) in the point or during cargo acceptance before transportation.

1.3. Constantly Guarded Parking is a safe area for freight vehicle parking in the securely fenced territory, round-the-clock security, round- the-clock operating video control system, motor transport entry and exit control system.

1.4. Force Majeure is emergency and irreversible circumstances that effectively prevent the Insured from fulfilling its obligations provided in the terms of a carriage contract and/or obligations in accordance with the legislative and other regulatory acts, namely: threat of war, armed conflict or serious threat of such conflict, including but not limited to hostile acts, blockades, military embargo, actions of foreign enemy, general military mobilization, military actions, declared or undeclared war, actions of public enemy, disturbance, acts of terrorism, subversions, acts of piracy, disorders, invasions, blockade, revolution, rebellion, xxxxxx, mass disorders, introduction of curfew restrictions, expropriation, appropriation, plant take-over, requisition, public demonstration, closing measure, strike, accident, illegal actions of third parties, explosion, sustained interruption of traffic flow governed by terms of corresponding decisions and acts of state authorities, closure of sea straits, embargo, prohibition (restriction) of export/import, etc., as well as circumstances caused by unusual weather conditions and natural disasters, namely: epidemic, severe storm, cyclone, hurricane, tornado, twister, flood, snow accumulation, icing, hail, frost, freezing of sea, straits, ports, and mountain crossings, earthquake, lightning, fire, dry weather, soil subsidence and displacement, other natural disasters, etc., other circumstances beyond the Insured control (its representatives).

1.5. Representatives of the Insured are persons being in labour relations with the Insured, authorized representatives, agents, drivers and all other persons whose services are used to carry out transportation, and persons engaged by the Insured in execution of carriage contracts, and discharging duties assigned to them in relation to such transportation.

1.6. Third Parties are legal entities or individuals that are not the Insured and its representative, are not entitled to handle cargo accepted for transportation and do not have labour or contractual relations with the Insured.

1.7. Special Franchise is an amount by which the amount of loss is reduced when determining the amount of insurance indemnity in case of loss or damage of high-risk cargo.

1.8. High-risk Cargoes are cargoes related to the following list: pharmaceutical drugs, medical drugs and goods, medical and scientific equipment; wine, alcoholic beverages, beer; tobacco and tobacco products; fur, textiles; paper-and-pulp industry products; raw materials and products requiring humidity control (salt, sugar, flour, tea, coffee,

2. ПЕРЕЛІК СТРАХОВИХ ВИПАДКІВ 2. LIST OF INSURED EVENTS

2.1. З урахуванням обмежень Розділу 6 Частини 2 ПЧД, страховим випадком є настання цивільної відповідальності Страхувальника за шкоду, заподіяну при виконанні останнім договорів автомобільного перевезення вантажів, зазначених в п.1.3 ІЧД, за умови, що такі перевезення виконуються виключно забезпеченими транспортними засобами, зазначеними в Додатку 1 до Договору, укладених відповідно до положень Конвенції про договір міжнародного автомобільного перевезення вантажів 1956 р. (з доповненнями і змінами, включаючи Протокол до Конвенції 1978 р.) або законодавства України, внаслідок настання страхових ризиків, зазначених в п.2.2 Частини 2 ПЧД.

2.1. Considering the restrictions in Section 6 of Part 2 of the PPC, insured event means incurrence of the civil liability of the Insured for damage caused when the Insured executes contracts of cargo carriage by road specified in par. 1.3 of the IPC provided that such carriage is performed only by provided transport vehicles specified in Appendix 1 to the Contract, which are entered into in accordance with the provisions of the Convention on the Contract for the International Carriage of Goods by Road of 1956 (as amended, including the Protocol to the Convention of 1978) or laws of Ukraine, resulting from occurred insured risks specified in par. 2.2 of the Part 2 of the PPC.

2.2. Страховими ризиками за Договором є: 2.2. Below are the insured risks of the Contract:‌

2.2.1. Секція А (Відповідальність за вантаж) – втрата, зіпсуття або пошкодження вантажу, зазначеного в п.1.3 ІЧД внаслідок:

• Дорожньо-транспортної пригоди за наявності вини водія ЗТЗ;

2.2.1. Section А (Liability for cargo) – loss, spoilage or damage to the cargo specified in par. 1.3 of the IPC resulting from the following:

• Road traffic accident in case of the ITV driver guilt;

• Пожежі з причини несправності ЗТЗ; • Fire resulting from the ITV failure;

• Дії атмосферних опадів на вантаж, що перевозиться, за наявності документально підтверджених механічних пошкоджень кузову або тенту ЗТЗ під час перевезення;

• Псування рефрижераторних вантажів, що перевозяться, внаслідок виходу з ладу під час перевезення обладнання, що забезпечує необхідний температурний режим та/або режим вологості (спеціального обладнання);

• Крадіжки вантажу, що перевозиться, під час стоянки у разі виконання наступних умов:

- Крадіжка відбулася на стоянці, яка зазначена на сайті Міжнародного союзу автомобільного транспорту (International Road Transport Union, IRU) на сторінці «TRANSPark», (xxx.xxx.xxx/xxxx/xxxxxxxxx-xxx ) або

- Крадіжка відбулася на стоянці під постійною охороною на території України, Грузії, країн СНД або

- Крадіжка відбулася на території автозаправної станції (АЗС) за умови, що на такій АЗС встановлена та працює система відеоспостереження, а ЗТЗ був припаркований таким чином, що вантажний відсік знаходився в зоні видимості відеокамер. При цьому, Сторони погодили, що обов’язок доказування того, що ЗТЗ

• Cargo exposure to atmosphere precipitations, if there are documented mechanic damages to the ITV body or canvas cover during transportation;

• Deterioration of refrigerated cargo being transported as a result of failure of equipment ensuring required thermal and/or moisture conditions during transportation (special equipment);

• Theft of cargo being transported during parking if the following conditions are satisfied:

- The theft was made at the parking specified on the web-site of the International Road Transport Union, IRU, on TRANSPark page, (xxx.xxx.xxx/xxxx/xxxxxxxxx-xxx) or

- The theft was made at the constantly guarded parking in the territory of Ukraine, Georgia, and CIS countries, or

- The theft was made in the territory of a fuel filling station (FFS) provided that a video control system is installed and operated at such FFS, and the ITV was parked in such a way that the luggage compartment is in the field of video camera view. Besides, the Parties have agreed that the Insured is responsible for proving the fact that the

• Розбою, грабежу по відношенню до вантажу, що перевозиться, лише у разі виконання наступних умов:

- Факт настання зазначеної події має бути підтверджено відповідними компетентними органами (поліцією), та

- Настання відповідальності Xxxxxxxxxxxxxx за зазначеним випадком має бути підтверджено судовим рішенням, яке набрало законної сили, та

- До судового розгляду справи щодо настання відповідальності Xxxxxxxxxxxxxx за зазначеним випадком останнім було залучено Страховика;

• Військових дій, а саме пошкодження, знищення всього або частини вантажу протягом строку дії Договору страхування внаслідок:

- вибуху боєприпасів до військової зброї;

- ударної хвилі в повітрі або ґрунті, та сейсмічної хвилі внаслідок вибуху боєприпасів до військової зброї;

- осколків при дробленні корпусу боєприпасу/боєприпасів;

- наїзду транспортного засобу, яким перевозиться вантаж, на боєприпаси до військової зброї;

- пожежі (включаючи пошкодження димом, пошкодження сажею, пошкодження корозійним газом; пошкодження заходами пожежогасіння), що виникла внаслідок вибуху боєприпасів до військової зброї;

- падіння на вантаж військово пілотованого/не пілотованого літаючого апарату, його частин, військової зброї (яка знаходилась в цьому літаючому апараті), а також розливу палива, що знаходиться в баках цього літаючого апарату;

2.2.2. Секція В (Відповідальність за помилки та упущення) – нанесення шкоди власнику вантажу внаслідок:

• несвоєчасної доставки вантажу – збитки власника вантажу внаслідок невиконання Страхувальником зобов'язань за договором перевезення щодо строків доставки вантажу у випадку, якщо особа, що вимагає відшкодування шкоди, доведе, що таке невиконання завдало їй шкоди;

• видачі вантажу з порушенням правомірного розпорядження про затримку у видачі;

2.2.3. Секція С (Відповідальність перед третіми особами) – нанесення шкоди вантажем, що перевозиться, життю, здоров'ю та майну третіх осіб;

2.2.4. Секція D (Витрати) – понесення Страхувальником витрат щодо:

• Robbery, abbrochment of the cargo being transported only if the following conditions are satisfied:

- The fact of the specified event occurrence shall be confirmed by corresponding competent authorities (police), and

- Incurrence of the Insured liability for the specified event shall be confirmed by court decision having legal force, and

- The Insured engaged the Insurer into judicial examination of the case related to incurrence of the Insured liability for the above event;

Military operations, in particular, damage, destruction of all or part of the goods during the term of the Insurance Agreement due to:

- explosion of ammunition for military weapons;

- shock waves in the air and soil, and seismic wave due to the explosion of ammunition for military weapons;

- fragments during crushing of the ammunition/ammunition shell;

- runover of the vehicle carrying the goods to the ammunition for military weapons;

- fires (including xxxxx damage, soot damage, corrosive gas damage; fire-fighting equipment damage) caused by the explosion of ammunition for military weapons;

- falling onto the goods of military manned or unmanned flying vehicles, their parts, military weapons (which were in this flying vehicle), as well as spillage of fuel contained in the tanks of this flying vehicle;

2.2.2. Section B (Liability for mistakes and omissions) – infliction of harm to the cargo owner resulting from the following:

• untimely cargo delivery – losses of the cargo owner resulting from non-fulfilment of obligations by the Insured under a carriage contract in relation to the terms of cargo delivery if the person demanding damage indemnity proves that such non-fulfilment has resulted in damage to it;

• cargo handover in violation of a lawful order on delayed handover;

2.2.3. Section С (Liability to third parties) – infliction of harm to life, health and property of third parties by the transported cargo;

2.2.4. Section D (Expenses) – expenses incurred by the Insured in relation to the following:

• розслідування обставин страхового випадку; • insured event investigation;

• захисту інтересів Страхувальника у судових та арбітражних органах (включаючи винагороду експертів) за подіями, відповідальність за які покладається на Страхувальника;

• доцільно проведених витрат на запобігання або зменшення розміру шкоди, відповідальність за яку покладається на Страхувальника (у тому числі сортування, перепакування, реалізація пошкодженого внаслідок страхового випадку вантажу, обґрунтовано здійснені витрати на спеціалізований транспорт (евакуатор, кран, подача іншого транспортного засобу, залученого до збереження вантажу, тощо)) в межах ліміту, передбаченого п.

2.2. ІЧД.

2.3. Інші події, не наведені у п. 2.2 Частини 2 ПЧД, страховими випадками не визнаються, якщо інше не передбачено обраними Додатковими умовами страхування, зазначеними в п.2.3 ІЧД та в Розділі 3 Частини 2 ПЧД.

• protection of the Insured interests in court and arbitration bodies (including payment of remuneration to experts) in relation to events for which the Insured is responsible;

• reasonably incurred expenses to prevent or reduce the extent of damages for which the Insured is responsible (including sorting, repacking, sale of cargo damaged as a result of insured event, reasonably incurred expenses for special transport vehicles (vehicle carrier, crane, provision of another transport vehicle to preserve the cargo, etc.) within the limits provided in par. 2.2. of the IPC.

2.3. Other events not specified in par. 2.2 of the Part 2 of the PPC are not recognized as insured events, unless otherwise provided in certain Additional Insurance Conditions specified in par. 2.3 of the IPC and Section 3 of the Part 2 of the PPC.

3. УМОВИ СТРАХУВАННЯ. ПОКРИТТЯ 3. TERMS OF INSURANCE. COVERAGE ‌

3.1. Якщо в п. 2.3 ІЧД обрано лише опцію «Загальні умови страхування», або не обрано жодної опції, при виконанні Договору Сторони керуються умовами, викладеними в ІЧД та Частині 2 ПЧД без врахування умов, зазначених в п.3.2-3.6 Частини 2 ПЧД в.

3.1. If only “General terms of insurance” option is selected in par.

2.3 of the IPC or no option is selected, the Parties are governed by the terms specified in the IPC and Part 2 of the PPC s when executing the IPC, without regard to the terms specified in par. 3.2–3.6 of the Part 2 of

the PPC.

3.2. ДОДАТКОВІ УМОВИ СТРАХУВАННЯ І 3.2. ADDITIONAL TERMS OF INSURANCE I‌

Якщо в Договорі обрано опцію «Додаткові умови страхування І» (розширення переліку страхових ризиків), Сторони погодили зазначені нижче пункти Договору змінити та викласти у наступній редакції:

3.2.1. Підпункт 2.2.1 пункту 2.2 Частини 2 ПЧД викласти у наступній редакції:

If “Additional terms of insurance I” (extension of the list of insured risks) option is selected in the Contract, the Parties have agreed that the following paragraphs of the Contract should be revised to read as follows:

• Road traffic accident through any person’s fault (including

unidentified person);

• Пожежі, окрім пожежі в зв’язку з форс-мажорними обставинами; • Fires, except for fires related to force majeure;

• Дії атмосферних опадів на вантаж; • Cargo exposure to atmosphere precipitations;

• Псування рефрижераторних вантажів, що перевозяться, внаслідок виходу з ладу під час перевезення обладнання, що забезпечує необхідний температурний режим та/або режим вологості (спеціального обладнання);

• Крадіжки вантажу, що перевозиться, під час стоянки у разі виконання наступних умов:

- Крадіжка відбулася на стоянці під постійною охороною на території України, Грузії, країн СНД або

- Крадіжка відбулася на території автозаправної станції (АЗС) або на території іншої зони для стоянки вантажного автомобільного транспорту, за умови, що на такій території встановлена та працює система відеоспостереження, а ЗТЗ був припаркований таким чином, що вантажний відсік знаходився в зоні видимості відеокамер. При цьому, Сторони погодили, що обов’язок доказування того, що ЗТЗ було припарковано відповідно до вимог цього пункту, покладається на Страхувальника, а доказом, що підтверджує виконання вимог цього пункту, є відеозапис з місця паркування ЗТЗ;

• Розбою, грабежу по відношенню до вантажу, що перевозиться, лише у разі виконання наступних умов:

- Факт настання зазначеної події має бути підтверджено відповідними компетентними органами (поліцією), та

- Настання відповідальності Страхувальника за зазначеним випадком має бути підтверджено судовим рішенням, яке набрало законної сили, та

- До судового розгляду справи щодо настання відповідальності Страхувальника за зазначеним випадком останнім було залучено Страховика;

- The theft was made in the territory of a fuel filling station (FFS) or in the territory of another area intended for cargo motor vehicle parking provided that a video control system is installed and is operated at such FFS, and the ITV was parked in such a way that the luggage compartment is in the field of video camera view. Besides, the Parties have agreed that the Insured is responsible for proving the fact that the IVT was parked in accordance with the requirements of this paragraph, and a video record of the ITV parking constitutes a proof of compliance with the requirements of this paragraph.

• Robbery, abbrochment of the cargo being transported only if the following conditions are satisfied:

- The fact of the specified event occurrence shall be confirmed by corresponding competent authorities (police), and

- Incurrence of the Insured liability for the specified event shall be confirmed by court decision having legal force, and

- The Insured engaged the Insurer into judicial examination of the case related to incurrence of the Insured liability for the above event;

3.2.2. виключити п.9.2 Частини 2 ПЧД. 3.2.2. Exclude par. 9.2 of the Part 2 of the PPC.

3.3. ДОДАТКОВІ УМОВИ СТРАХУВАННЯ ІІ 3.3. ADDITIONAL TERMS OF INSURANCE II

Якщо в Договору обрано опцію «Додаткові умови страхування ІІ» (зняття обмежень з експлуатації ЗТЗ), Сторони погодили п. 6.1.7 Частини 2 ПЧД доповнити абзацом наступного змісту:

«Зазначені вище умови цього пункту щодо строку експлуатації спеціального обладнання не застосовуються по відношенню до договорів міжнародного перевезення, які виконуються із застосуванням ЗТЗ, які мають чинний на момент настання страхового випадку сертифікат відповідності ЗТЗ вимогам Угоди про міжнародні перевезення швидкопсувних харчових продуктів та про спеціальні транспортні засоби, які призначені для цих перевезень (УПШ) 1970 р.».

If “Additional terms of insurance II” (lifting of restrictions on the ITV operation) option is selected in the Contract, the Parties have agreed to supplement par. 6.1.7 of the Part 2 of the PPC with a paragraph with the following content:

“The above terms of this paragraph related to special equipment operation do not apply to international contracts of carriage executed using the ITV for which a valid certificate of the ITV compliance with the requirements of theContract for International Transport of Perishable Foods and Special Transport Vehicles Intended for These Types of Carriage (ATP) of 1970” is available as of the date of the insured event occurrence.

3.4. ДОДАТКОВІ УМОВИ СТРАХУВАННЯ ІІІ 3.4. ADDITIONAL TERMS OF INSURANCE III‌

Якщо в Договорі обрано опцію «Додаткові умови страхування ІІІ» (покриття фрахту), Сторони погодили виключити п. 6.9.4 Частини 2 ПЧД.

If “Additional terms of insurance III” (freight coverage) option is selected in the Contract, the Parties have agreed to exclude par. 6.9.4 of the Part 2 of the PPC.

3.5. ДОДАТКОВІ УМОВИ СТРАХУВАННЯ ІV 3.5. ADDITIONAL TERMS OF INSURANCE IV‌

Якщо в Договорі обрано опцію «Додаткові умови страхування ІV» (дорожнє покриття поганої якості), Сторони погодили частину 1 підпункту 2.2.1 пункту 2.2 Частини 2 ПЧД змінити та викласти у наступній редакції:

If “Additional terms of insurance IV” (poor road pavement) option is selected in the Contract, the Parties have agreed to replace Part 1 of subpar. 2.2.1 of par. 2.2 of the Part 2 of the PPC with the following:

«2.2. Страховими ризиками за Договором є: “2.2. Below are the insured risks of the Contract:

• Дорожньо-транспортної пригоди за наявності вини водія ЗТЗ, а також дорожньо-транспортної пригоди, причиною якої є незадовільний стан дорожнього покриття або екстрене гальмування ЗТЗ. Зазначена останньою причина ДТП не потребує обов’язкового підтвердження компетентними органами. Ліміт відповідальності Страховика за випадком ДТП з причини незадовільного стану дорожнього покриття або екстреного гальмування ЗТЗ за наявності документального підтвердження такої події компетентними органами становить суму, зазначену в п. 2.2. ІЧД, за відсутності документального підтвердження такої події компетентними органами – 3000 (три тисячі) одиниць валюти Договору, зазначеної в п. 2.1 ІЧД. Страховик проводить виплату страхового відшкодування за таким випадком один раз протягом дії Договору, при цьому Страхувальник зобов’язаний надати представнику Страховика можливість провести огляд пошкодженого вантажу, розміщеному в ЗТЗ, до початку його вивантаження.

2.2.1. Section А (Liability for cargo) – loss, spoilage or damage to the cargo specified in par. 1.3 of the IPC resulting from the following:

• Road traffic accidents through the ITV driver's fault and road traffic accidents resulting from poor road pavement or emergency brake application of the ITV. The last reason for the road traffic accident does not require obligatory confirmation by competent authorities. The Insurer's responsibility for the road traffic accident due to poor road pavement or emergency brake application of the ITV if such event is documented by competent authorities is limited to the amount specified in par. 2.2. of the IPC, and if such event is not documented by competent authorities, it is equal to 3,000 (three thousand) monetary units of the Contract specified in par. 2.1 of the IPC. The Insurer pays for insurance indemnity for such event once within the Contract validity. Besides, the Insured shall provide the Insurer with an opportunity to examine the damaged cargo placed in the ITV before its unloading.

3.6. ДОДАТКОВІ УМОВИ СТРАХУВАННЯ V 3.6. ADDITIONAL TERMS OF INSURANCE V

Якщо в Договорі обрано опцію «Додаткові умови страхування V» (Вантаж з оголошеною вартістю), при визначенні розміру відповідальності Страхувальника та розміру страхового відшкодування застосовуються положення ст. 24 Конвенції КДПВ та не застосовуються обмеження відповідальності перевізника, зазначені в ч.3 ст. 23 Конвенції КДПВ. Зазначені Додаткові умови застосовуються виключно у випадках міжнародних перевезень вантажів.

3.7. ДОДАТКОВІ УМОВИ СТРАХУВАННЯ VІ

Якщо в ІЧД обрано опцію «Додаткові умови страхування VІ» (Коефіцієнт пропорційності), при визначенні розміру страхового відшкодування не застосовуються обмеження передбачені п.9.1.1. Частини 2 ПЧД.

If “Additional terms of insurance V” (Cargo with declared value) option is selected in the Contract, the provisions of Article 24 of the Convention on the Contract for the International Carriage of Goods by Road apply when determining the extent of the Insured responsibility and amount of insurance indemnity. Restrictions of the carrier's responsibility specified in Part 3 of Article 23 of the Convention on the Contract for the International Carriage of Goods by Road do not apply. The above Additional terms apply exclusively in cases of international cargo carriage.

3.7. ADDITIONAL INSURANCE TERMS AND CONDITIONS VІ

If the Option ‘Additional Insurance Terms and Conditions VI’ (Proportionality Factor) is selected in the IPC, the restrictions provided for in paragraph 9.1.1 Part 2 of the PPC shall not apply when determining the insurance indemnity.

4. РОЗМІРИ СТРАХОВИХ ПЛАТЕЖІВ. СПЕЦІАЛЬНА 4.

INSURANCE PAYMENT AMOUNTS. SPECIAL FRANCHISE.

ФРАНШИЗА. ФРАНШИЗА FRANCHISE

4.1. Страхові платежі, що обчислюються на підставі затверджених

страхових тарифів Страховика, зазначаються в п. 4 ІЧД.

4.2. За кожним страховим ризиком, зазначеним в п. 2.2 ІЧД встановлюється франшиза (частина збитку, що не відшкодовується Страховиком) щодо перевезень звичайних вантажів, окрема франшиза щодо перевезень вантажів підвищеного ризику (спеціальна франшиза), а також окремі франшизи за випадками крадіжки вантажу, грабежу, розбою (якщо такі ризики застраховані) та пожежі. Розміри франшиз зазначено в п. 2.2 ІЧД.

4.1. Insurance payments calculated on the grounds of approved

insurance rates of the Insurer are specified in par. 4 of the IPC.

4.2. Franchise (amount of loss not indemnified by the Insurer) is set for each insured risk specified in par. 2.2 of the IPC in relation to conventional cargo carriage. A certain franchise (special franchise) is set in relation transportation of high-risk cargoes and certain franchises are set in relation to cargo thefts, robbery, abbrochment (if such risks are insured), and fire. The franchise amount is specified in par. 2.2 of the IPC.

5. ПРАВА ТА ОБОВ’ЯЗКИ СТОРІН 5. RIGHTS AND OBLIGATIONS OF THE PARTIES

5.1. Страхувальник має право: 5.1. The Insured is entitled to do the following:

5.1.1. отримувати від Страховика будь-яку інформацію, що стосується умов Договору;

5.1.1. receive any data related to the terms of the Contract from the Insurer;

5.1.2. ініціювати зміни та доповнення до Договору; 5.1.2. initiate amendments to the Contract;

5.1.3. подавати заяву на виплату страхового відшкодування; 5.1.3. submit an application to pay the insurance indemnity;

5.1.4. оскаржити відмову Страховика у виплаті страхового відшкодування або розмір виплаченого страхового відшкодування;

5.1.5. вести претензійно-позовну роботу із залученням представника Страховика;

5.1.4. appeal against the Insurer's refusal to pay insurance indemnity or against the amount of paid insurance indemnity;

5.1.5. review claims engaging the Insurer's representative;

5.1.6. ініціювати дострокове припинення дії Договору; 5.1.6. initiate early termination of the Contract;

5.1.7. змінювати транспортні засоби, вказані в реєстрі транспортних засобів, що міститься у Додатку 1 до Договору, під час перевезення, попередньо повідомивши Страховика.

5.1.7. change transport vehicles specified in the register of transport vehicles in Appendix 1 to Contract during carriage notifying the Insurer thereof in advance.

5.2. Страховик має право: 5.2. The Insurer is entitled to do the following:

5.2.1. запитувати й одержувати від Страхувальника інформацію й документи, які необхідні для визнання події страховим випадком та необхідні для розрахунку розміру збитків;

5.2.2. визначати дії Страхувальника щодо з’ясування обставин події, що має ознаки страхового випадку, встановлення розміру збитків, права третіх осіб на отримання відшкодування заподіяних збитків. Інструкції Страховика щодо конкретного страхового випадку є обов'язковими для виконання Страхувальником. У випадку виникнення суперечок, судових спорів, обов'язок доведення неможливості або недоцільності виконання інструкцій Страховика покладено на Страхувальника;

5.2.3. визначати свою позицію щодо заявлених Страхувальнику претензій;

5.2.4. відмовити у виплаті страхового відшкодування з підстав, встановлених Договором та чинним законодавством;

5.2.5. вимагати від Страхувальника повернення виплаченого страхового відшкодування (його частини), якщо з‘ясується, що Страхувальник не мав права на його отримання або якщо збитки за страховим випадком відшкодовані третіми особами;

5.2.6. після виплати страхового відшкодування застосувати право зворотної вимоги (регресу) до третьої сторони, відповідальної за заподіяння збитків;

5.2.7. направити своїх представників для огляду пошкодженого або зіпсованого вантажу та участі у визначенні розміру збитків;

5.2.8. у разі необхідності надати Страхувальнику письмові інструкції щодо з’ясування обставин події, що має ознаки страхового випадку, встановлення розміру збитків, права третіх осіб на отримання відшкодування, порядку отримання страхового відшкодування;

5.2.1. request and obtain data and documents from the Insured required to recognize an event as an insured event and calculate the loss amount;

5.2.2. determine actions of the Insured in relation to establishing event circumstances bearing signs of insured event, determining loss amounts, rights of third parties to receive the loss indemnity. The Insurer's instructions related to a certain insured event are binding for the Insured. In case of disputes, judicial disputes, the Insured is responsible for proving that it is impossible or inappropriate to execute the Insurer's instructions.

5.2.3. define own position in relation to claims filed to the Insured;

5.2.4. refuse to pay the insurance indemnity on the grounds established herein and applicable laws;

5.2.5. demand from the Insured to return the paid insurance indemnity (its part) if it is found that the Insured was not entitled to receive it or if losses related to the insured event were indemnified by third parties;

5.2.6. when the insurance indemnity is paid, apply the right of contribution (regress) to the third party responsible for losses;

5.2.7. send its representatives to inspect the damaged or deteriorated cargo and participate in defining loss amounts;

5.2.8. if the Insured shall be provided with written instructions for establishing the event circumstances bearing signs of insured event, determining the loss amount, rights of third parties to receive the loss indemnity, and the procedure for receiving the insurance indemnity;

5.2.9. достроково припинити дію Договору. 5.2.9. early terminate the Contract.

5.3. Страхувальник зобов’язаний: 5.3. The Insured shall do the following:‌

5.3.1. у разі здійснення перевезення вантажу, не зазначеного в п.

1.3 ІЧД, повідомити Страховика про таке перевезення до його початку з метою внесення відповідних змін до Договору. Несвоєчасне повідомлення Страховика щодо такого перевезення та невнесення відповідних змін до Договору звільняє останнього від обов’язку сплати страхового відшкодування;

5.3.2. повідомити письмово Страховика про переобладнання ЗТЗ до початку здійснення перевезення. Несвоєчасне письмове повідомлення та/або відсутність реєстраційних документів на ЗТЗ із внесеною до них інформацією про переобладнання ЗТЗ звільняє Страховика від обов’язку сплати страхового відшкодування при настанні страхового випадку під час здійснення перевезення таким ЗТЗ;

5.3.3. ознайомити під підпис усіх осіб, які допущені до організації перевезень і керування ЗТЗ, з умовами Договору, вимогами Інструкції для водіїв (Розділ 15 Частини 2 ПЧД), забезпечити її виконання, а також наявність Інструкції для водія в кабіні кожного ЗТЗ або іншого транспортного засобу, який виконує перевезення вантажів у зчепленні із ЗТЗ;

5.3.4. повідомити Страховика про настання події, що має ознаки страхового випадку у строк, встановлений Договором;

5.3.5. забезпечити доступ представників Страховика до огляду пошкодженого, зіпсованого вантажу до початку або під час розвантаження ЗТЗ та забезпечити їх участь у визначенні розміру збитків та надати їм копії документів, що супроводжують вантаж. Якщо з об’єктивних причин неможливо забезпечити доступ представників Страховика до місця розвантаження – діяти відповідно до п. 7.1.4 Частини 2 ПЧД. Порушення Страхувальником умов п. 5.3.5 та 7.1.4 Частини 2 ПЧД звільняє Страховика від обов’язку сплати страхового відшкодування;

5.3.6. виконувати інструкції Страховика щодо визначення обставин події, що має ознаки страхового випадку, встановлення розміру збитків, права третіх осіб на отримання відшкодування;

5.3.7. надати Страховику інформацію й документи, передбачені Розділом 8 Частини 2 ПЧД, які необхідні для визначення події

5.3.1. if the cargo which is not specified in par. 1.3 of the IPC is transported, notify the Insurer about such carriage before its commencement to make corresponding changes herein. Untimely notification of the Insurer about such carriage and failure to make corresponding changes in the Contract relieve the Insurer of its duties to pay the insurance indemnity;

5.3.2. notify the Insurer in writing about the ITV retrofitting before the carriage commencement. Untimely written notification and/or absence of registration documents for the ITV containing information about the ITV retrofitting relieves the Insurer from its duty to pay the insurance indemnity in case of insured event occurrence during carriage by such ITV.

5.3.3. familiarize all the persons permitted to organize carriages and drive the ITV, against signature, with the terms of the Contract, requirements of the Driver’s Instruction (Section 15 of the Part 2 of the PPC), ensure their fulfilment, and availability of the Instructions for Drivers in each ITV cabin or other transport vehicle coupled with the ITV to transport cargoes.

5.3.4. notify the Insurer about occurrence of the event bearing signs of insured event within the term set herein;

5.3.5. provide access to the Insurer's representatives to inspect the damaged, deteriorated cargo before or during the ITV unloading, ensure their participation in defining the loss amount, and provide them with copies of cargo supporting documents. If access to the unloading area may not be provided to the Insurer's representatives for objective reasons, act in accordance with par. 7.1.4 of the Part 2 of the PPC. If the Insured violates the terms of par. 5.3.5 and 7.1.4 of the Part 2 of the PPC, the Insurer is relieved of its duties to pay insurance compensation;

5.3.6. follow instructions of the Insured in relation to establishment of event circumstances bearing signs of insured event, determining extent of losses, rights of third parties to receive loss compensation;

5.3.7. provide the Insurer with information and documents provided in Section 8 of the Part 2 of the PPC required to recognize an event as an

страховим випадком та розрахунку розміру страхового відшкодування;

5.3.8. повідомити Страховика про інші договори страхування, укладені щодо вантажу, що перевозиться (у разі, якщо така інформація відома Страхувальнику), та відповідальності Страхувальника;

5.3.9. вчинити усі необхідні дії щодо реалізації права зворотної вимоги Страховика до винуватців настання страхового випадку;

5.3.10. у разі наявності судової справи щодо настання цивільно- правової відповідальності перевізника виконувати письмові рекомендації Страховика. Залучити Страховика до судового процесу в якості третьої сторони на стороні відповідача за позовами третіх осіб або на стороні позивача за позовами до винуватців настання страхового випадку;

5.3.11. погоджувати зі Страховиком витрати за страховим ризиком D (Витрати);

5.3.12. на обґрунтовану вимогу Страховика протягом 10 (десяти) робочих днів (якщо про інше немає домовленості Сторін) повернути одержане страхове відшкодування (або його частину);

5.3.13. виконувати інші обов’язки, передбачені Законом України

«Про страхування» та умовами інших розділів Договору;

5.3.14. дотримуватись умов Європейської угоди щодо праці екіпажу транспортних засобів, що виконують міжнародні автомобільні перевезення (надалі - ЕПТЗ) та внутрішні перевезення, щодо режиму праці та відпочинку;

5.3.15. під час кожної зупинки ЗТЗ в обов’язковому порядку перевіряти цілісність вантажу (вантажного відсіку та засобів його пломбування, якщо таке пломбування здійснювалося);

5.3.16. на запит Страховика надавати інформацію про рух ЗТЗ по маршруту перевезення (шайбу або роздруківку з тахографа, роздруківку з комп’ютерних систем слідкування за транспортними засобами, які використовуються Страхувальником, тощо);

5.3.17. обладнати ЗТЗ засобами безпеки для запобігання крадіжки вантажу (наприклад: замки, шайби, звукова сигналізація на задні двері, тощо), забезпечити наявність справних замикаючих/закриваючих пристроїв, передбачених виробником ЗТЗ, на дверях вантажного відсіку.

5.3.8. notify the Insurer about other insurance contracts entered into in relation to transported cargo (if the Insured is aware of such information) and responsibilities of the Insured;

5.3.9. execute all the required actions to exercise the Insurer's right to contribution in relation to the person responsible for insured event occurrence;

5.3.10. if a court case alleging civil responsibility of the carrier is brought, follow the Insurer's written recommendations. Engage the Insurer in the judicial proceedings as a third party on the respondent's side under suits of third parties or on the appellant's side under suits against the persons that caused the insured event occurrence;

5.3.11. agree expenses related to the insured risk D (Expenses) with the Insurer;

5.3.12. return the received insurance indemnity (or its part) within 10 (ten) business days (unless otherwise agreed by the Parties) at reasonable request of the Insurer;

5.3.13. fulfil other duties provided of the Law of Ukraine “On Insurance” and terms of other sections of the Contract;

5.3.14. comply with the terms of the European Contract for Transport Vehicle Crew Carrying out International Carriages by Road (hereinafter referred to as the EPTV) and internal carriages in relation to working and recreation conditions;

5.3.15. check obligatorily the cargo integrity during each stop of the ITV (luggage compartment and its sealing equipment if such sealing was performed);

5.3.16. provide information about the ITV traffic on transport route at the Insurer’s request (washer or printout of recording tachometer, printout of computer systems monitoring transport vehicles used by the Insured, etc.);

5.3.17. equip the ITV with safety units to prevent from cargo theft (for example: locks, washers, acoustic alarm installed on rear door, etc.), ensure availability of properly operating locking/closing devices provided by the ITV manufacturer on luggage compartment doors.

5.4. Страховик зобов’язаний: 5.4. The Insurer shall do the following:

5.4.1. ознайомити Страхувальника з умовами Договору та Правилами;

5.4.2. на підставі отриманого повного пакету документів від Страхувальника та інших осіб прийняти рішення щодо визнання або не визнання події страховим випадком;

5.4.3. у випадку визнання події страховим випадком здійснити виплату страхового відшкодування у передбачений Договором строк;

5.4.4. у разі прийняття рішення про відмову у виплаті страхового відшкодування письмово повідомити про це Страхувальника;

5.4.5. не розголошувати відомостей про Страхувальника та його майновий стан, крім випадків, встановлених законодавством України;

5.4.6. вчиняти інші дії, передбачені Законом України «Про страхування».

5.5. У випадку невиконання або неналежного виконання умов Договору та своїх обов’язків Сторони несуть відповідальність згідно із законодавством.

5.4.1. familiarize the Insured with the terms of the Contract and the Rules;

5.4.2. make a decision on recognition or non-recognition of an event as an insured event on the grounds of complete package of documents received from the Insured and other persons;

5.4.3. pay the insurance indemnity within the term provided herein if an event is recognized as an insured event;

5.4.4. if a decision is made to refuse from the insurance indemnity payment, notify the Insured thereof in writing;

5.4.5. do not disclose data on the Insured and its property status, except for cases established by the laws of Ukraine;

5.4.6. perform other actions provided of the Law of Ukraine “On Insurance”.

5.5. The Parties are responsible for non-fulfilment or improper fulfilment of the Contract terms and their obligations in accordance with the laws.

6. ВИКЛЮЧЕННЯ ЗІ СТРАХОВИХ ВИПАДКІВ. ПІДСТАВИ ДЛЯ 6.

EXCEPTIONS TO INSURED EVENTS. GROUNDS FOR

ВІДМОВИ У ВИПЛАТІ СТРАХОВОГО ВІДШКОДУВАННЯ REFUSAL FROM INSURANCE INDEMNITY PAYMENT

6.1. Не визнаються страховими випадками події, що сталися: 6.1. The following events are not recognized as insured events:

6.1.1. через обставини, які згідно із вимогами українського та міжнародного законодавства звільняють Перевізника від відповідальності за втрату, нестачу, псування або пошкодження вантажу, несвоєчасну доставку вантажу, що встановлено рішенням суду, яке набрало законної сили;

6.1.1. events releasing the Carrier from its responsibility for loss, short- delivery, deterioration or damage to the cargo, untimely cargo delivery established by court decision having legal force in accordance with the requirements of Ukrainian and international laws;

6.1.2. внаслідок стихійних лих, протиправних дій третіх осіб (за винятком випадків, зазначених в п.п. 2.2.1 п. 2.2 та Розділі 3 Частини 2 ПЧД), порушення митних процедур;

6.1.3. крадіжки вантажу, що сталася під час руху ЗТЗ в процесі виконання перевезення та у місцях інших, ніж зазначені у п. 2.2 Частини 2 ПЧД (зокрема, біля паркану, будинку, складу, торгівельного, харчового закладу, в зоні митного контролю тощо, на АЗС, на якій відсутня або не працює система відеоспостереження);

6.1.4. через обставини непереборної сили (крім випадків, коли настання відповідальності Страхувальника у разі настання події, віднесеної умовами Договору до обставин непереборної сили, встановлено судовим рішенням, яке набрало законної сили, та за умови, що до судового розгляду справи щодо настання відповідальності Страхувальника за зазначеним випадком останнім було залучено Страховика), а також інші обставини, зазначені в Договорі між перевізником та замовником, які звільняють перевізника від відповідальності за договором перевезення;

6.1.5. внаслідок встановлених судом або правоохоронними органами навмисних дій, співучасті у злочині Страхувальника або його представників;

6.1.6. внаслідок експлуатації технічно несправних транспортних засобів, спеціального обладнання або транспортних засобів та спеціального обладнання, які не відповідають вимогам щодо перевезення певних видів вантажів;

6.1.7. внаслідок поломки будь-яких деталей, вузлів або агрегатів транспортного засобу (крім спеціального обладнання), строк експлуатації яких перевищує 10 років або внаслідок поломки спеціального обладнання, строк експлуатації якого перевищує 12 років. При цьому під терміном «строк експлуатації» Сторони домовилися розуміти строк від документально підтвердженої дати встановлення на транспортному засобі відповідних деталей, вузлів, агрегатів або спеціального обладнання до дати настання страхового випадку. У разі відсутності документів, що підтверджують час встановлення на транспортному засобі відповідних деталей, вузлів, агрегатів або спеціального обладнання, строк експлуатації розраховується з 01 січня року випуску транспортного засобу, зазначеному в реєстраційних документах на нього, до дати настання страхового випадку, якщо інше не передбачено Договором;

6.1.8. під час перевезення вантажу, не зазначеного в п. 1.3 ІЧД або який повністю чи його частину визнано: контрабандним, незаконного виробництва, забороненим для використання у країні настання події, що має ознаки страхового випадку;

6.1.9. через помилки та упущення, службову недбалість, шахрайські дії представників Страхувальника, визнані компетентними органами або правомірним висновком Страховика, не виконання інструкцій Страховика;

6.1.10. під час перевезень вантажу по через регіони громадянської війни (оголошеної чи неоголошеної), вторгнення, ворожих актів, військових дій або маневрів, військових заходів та конфліктів, дії мін, торпед, заколотів, військових або народних повстань, революції, блокади, захвату (узурпації) влади, введення військової влади або військового положення або надзвичайного стану або стану облоги; терористичних актів, у ході контролю, запобігання, придушення або будь-якої операції, пов’язаної з актом тероризму; страйку, бунту, масових (громадських) заворушень, у тому числі трудових заворушень та локаутів; конфіскації, реквізиції, арешту або знищення вантажу на вимогу військових або цивільних влад;

6.1.11. внаслідок прямого або непрямого впливу ядерної енергії, ядерного вибуху, впливу іонізуючого випромінювання, пов’язаних з будь-яким застосуванням атомної енергії або радіоактивних матеріалів, хімічного забруднення;

6.1.2. events resulting from natural disasters, illegal actions of third parties (except for cases specified in subpar. 2.2.1 of par. 2.2 and Section 3 of the Part 2 of the PPC, violation of custom duties;

6.1.3. cargo theft occurred when the ITV was driven during carriage and in areas other than the ones specified in par. 2.2 of the Part 2 of the PPC (in particular, areas near fences, building, warehouse, commodity and foodstuff establishment, in the area of customs control, etc., at the FFS where no video control system is provided or operated);

6.1.4. events resulting from force majeure (except for cases when the Insured liability incurs when events related to the force majeure as per the terms of the Contract are established by court decision having legal force and provided that the Insurer was engaged by the Insured in judicial proceedings on the case related to liability incurrence for the Insured in relation to the above event), and other circumstances specified herein entered into by and between the carrier and the customer which releases the carrier from responsibility under the carriage contract;

6.1.5. events resulting from wilful acts, criminal participation of the Insured or its representative in a crime established by court or law enforcement agencies;

6.1.6. events resulting from operation of technically defective transport vehicles, special equipment or transport vehicles and special equipment that do not meet the requirements for transporting certain types of cargoes;

6.1.7. events resulting from failure of any parts, units or assemblies of transport vehicle (except for special equipment) which life cycle exceeds 10 years, or resulting from failure of special equipment which life cycle exceeds 12 years. Besides, the Parties have agreed to understand the term “life cycle” as the term that begins on the documented date of installation of corresponding parts, units, assemblies or special equipment on a transport vehicle and ends on the date of insured event occurrence. If no documents confirming the time of installation of corresponding parts, assemblies, units or special equipment on a transport vehicle are available, the life cycle is calculated from January 1 of the year of the transport vehicle production which is specified in registration documents for such transport vehicle, until the date of insured event occurrence, unless otherwise provided herein;

6.1.8. during transportation of the cargo which is not specified in par. 1.3 of the IPC, or it is recognized, in whole or in part, as: smuggled, illegally manufactured, prohibited in the country where the event bearing signs of insured event has occurred;

6.1.9. due to errors and omissions, service negligence, fraud of the Insured representatives recognized by competent authorities or justified conclusion of the Insurer; failure to follow the Insurer's instructions;

6.1.10. when transporting the goods through the regions of civil war (declared or undeclared), invasion, hostile acts, military operations or maneuvers, military actions and conflicts, operations of mortar shells, torpedoes, riots, military or popular revolts, revolutions, blockades, power seizure (grab), imposition of military authorities or martial law or state of emergency or state of siege; terrorist acts, in the course of supervision, prevention, suppression or any operation related to the terrorist act; strike, rebel, mass (public) unrest, including labor disturbances and lockouts; confiscation, requisition, seizure or destruction of the goods at the request of military or civil authorities;

6.1.11. events resulting from direct or indirect exposure to nuclear power, nuclear blast, nuclear radiation associated with any use of nuclear power or radioactive materials, and chemical contamination;

6.1.12. внаслідок порушення Страхувальником та/або його представником встановлених в країні настання страхового випадку вимог Правил дорожнього руху щодо:

• проїзду регульованих перехресть та пішохідних переходів (проїзд на сигнал світлофору, що забороняє рух або на забороняючий сигнал регулювальника);

6.1.12. due to violation by the Insured and/or its representative of the requirements of the Traffic Rules established in the country of insured event occurrence in relation to the following:

• driving across regulated crossings and crosswalks (driving when the traffic light signal prohibiting movement is on or when a pointsman sends the restrictive signal);

• руху через залізничні переїзди; • driving across railway-crossings;

• встановлених обмежень швидкості руху (перевищення швидкості більш як на 50 (п’ятдесят) км/год.);

6.1.13. наслідок незаконного заволодіння ЗТЗ третіми особами разом із вантажем, що знаходився у такому ЗТЗ;

6.2. Не визнаються страховими випадками події, що сталися внаслідок ДТП, якщо причиною такого ДТП стало неправильне розміщення вантажу у кузові (на платформі) ЗТЗ, неправильне кріплення вантажу, перевантаження або недовантаження ЗТЗ.

6.3. Не визнаються страховими випадками події, що сталися внаслідок ДТП, якщо причиною такого ДТП стало керування ЗТЗ водієм, який перебував у стані алкогольного, наркотичного чи іншого сп’яніння або перебування під впливом лікарських препаратів, що знижують увагу та швидкість реакції.

6.4. Сторони погодили, що події, які сталися внаслідок крадіжки, не визнаються страховим випадком, якщо ЗТЗ та його спеціальне обладнання прибули до місця призначення (розвантаження) технічно справними, без наявності механічних ушкоджень, при цілісному кузові (цистерні, платформі, тенті), без слідів ушкодження, проникнення всередину вантажного відсіку та зі справними пломбами (у разі, коли при перевезенні здійснювалося пломбування вантажного відсіку ЗТЗ).

6.5. Сторони погодили, що події, що сталися внаслідок ДТП, пожежі, крадіжки не визнаються страховим випадком за відсутності підтвердження факту такої події компетентними органами країни події за виключенням випадків, передбачених в п. 3.5 Частини 2 ПЧД, а також випадків ДТП, коли водії транспортних засобів, причетних до такого ДТП, відповідно до чинного законодавства країни,на території якої вона сталася, мали право спільно скласти повідомлення про дорожньо-транспортну пригоду встановленого зразка (європротокол) без виклику працівників компетентних органів.

• establishing speed restrictions (overspeed by more than 50 (fifty) km/h);

6.1.13. events resulting from illegal occupation of the ITV containing the cargo by third parties;

6.2. Events resulted from a road traffic accident due to incorrect arrangement of the cargo in the body (on the platform) of the ITV, incorrect fixation of the cargo, overloading or underloading of the ITV are not recognized as insured events.

6.3. Events resulted from a road traffic accident due to the ITV driving by a driver under the influence of alcohol, drug or other intoxication or under the influence of pharmaceutical drugs that impair the concentration and response rate are not recognized as insured events.

6.4. The Parties have agreed that events resulted from of theft are not recognized as insured events, if the ITV and its special equipment have arrived to the point of destination (unloading) in technically good condition, without mechanical damages, with undamaged body (tank, platform, canvas cover), without signs of damage, luggage compartment breaking, and with intact seals (if the ITV luggage compartment was sealed during transportation).

6.5. The Parties have agreed that events occurring as a result of the road traffic accident, fire, theft are not recognized as insured events if such events are not proven by competent authorities in the country where the event has occurred, except for the cases provided in par. 3.5 of the Part 2 of the PPC and cases of the road traffic accident when drivers of transport vehicles accessory to such road traffic accident were entitled to drawn up road traffic accident statement in accordance with standard pattern (European Accident Statement) without calling officers of competent authorities in accordance with the applicable laws of the country where the loss occurred.

6.6. Не визнаються страховими випадками події, якщо: 6.6. The following events are not recognized as insured events:

6.6.1. документально доведено відсутність кріплення вантажу або його невідповідність вимогам, прийнятим у країнах, територією який виконується перевезення, вимогам відправника або замовника перевезення, нормам заводу-виробника вантажу;

6.6.2. вантаж пошкоджено підмоканням внаслідок потрапляння вологи всередину вантажного відсіку через нещільності або пошкодження конструкції ЗТЗ, якщо вантаж було розміщено на підлозі ЗТЗ без використання піддонів чи інших гідро ізолюючих засобів, а також якщо вантаж пошкоджений конденсатом, який утворився внаслідок пакування вантажу додатковими засобами збереження, що привели до утворення конденсату, якщо це було доведено документально;

6.6.3. під час міжнародного перевезення вантажу, який відноситься до переліку швидкопсувних харчових продуктів згідно із Угодою від 01.09.1970 р. про міжнародні перевезення швидкопсувних харчових продуктів (УПШ), відсутнє документальне підтвердження своєчасного проходження перевірки спеціального обладнання ЗТЗ у випадках, якщо такий вантаж зіпсовано внаслідок поломки спеціального обладнання;

6.6.4. псування вантажу сталося через недотримання температурного режиму представниками Страхувальника при справному спеціальному обладнанні;

6.6.5. на ЗТЗ, що перевозить вантаж, який вимагає температурного контролю, станом на момент настання події, що має ознаки страхового випадку, не встановлено або не працює обладнання, яке

6.6.1. lack of cargo attachment or its non-compliance with the requirements established in the countries where cargo is transported, requirements of shipper or transport customer, standards of cargo manufacturing plant have been well documented;

6.6.2. cargo was damaged as a result of wetting due to ingress of moisture into trunk compartment because of leakages and damage of the ITV structure, if the cargo was placed on the ITV floor without trays or other water-proof means, and if cargo was damaged by condensate accumulated as a result of cargo package using preservation means that caused condensate accumulation, if it has been well documented;

6.6.3. documentary proof of timely passing of examination by special ITV equipment is unavailable during international transport of cargo referring to the list of perishable foods in accordance with Contract dated 01.09.1970 for international carriage of perishable foods (ATP) if such cargo has been damaged as a result of special equipment damage;

6.6.4. the cargo was damaged due to failure to maintain temperature conditions by the representatives of the Insured provided that special equipment is serviceable;

6.6.5. equipment recording temperature in trunk compartment within the whole term of transport was not installed or does not function in the ITV transporting cargo and requiring temperature control as of the date of occurrence of event bearing signs of insured event;

здійснює фіксацію температурного режиму у вантажному відсіці протягом усього періоду перевезення;

6.6.6. вантаж (його частина) відноситься до переліку небезпечних вантажів (ADR вантажів), які заборонені до перевезення у країні настання події, що має ознаки страхового випадку, або у перевізника немає ліцензії та необхідних допусків на перевезення небезпечних вантажів забезпеченими транспортними засобами;

6.6.7. вантажі, що перевозяться, несумісні для спільного перевезення;

6.6.8. вантаж відноситься до наступного переліку: зливки дорогоцінних металів та вироби з них; дорогоцінне каміння та ювелірні вироби; банкноти та монети; облігації, платіжні документи або інші цінні папери; витвори мистецтва; предмети антикваріату; племінні тварини;

6.6.9. пошкодження вантажів (наприклад, автомобілів, обладнання тощо) сталося при їх перевезенні без упакування та/або на відкритих платформах/кузовах без тенту внаслідок окислювання, корозії, зміни кольорів, сколів, подряпин або вм’ятин, крім випадків ДТП;

6.6.10. пошкодження та/або втрата вантажу відбулося внаслідок самозаймання вантажу, що відбулося внаслідок тертя або властивості самого вантажу (самозаймання – це мимовільне горіння внаслідок поступового накопичення тепла при протіканні екзотермічних реакцій в матеріалах);

6.6.11. перевезення вантажу на території України здійснювалося з порушенням вимог Постанови Кабінету Міністрів України №30

«Про проїзд великогабаритних та великовагових транспортних засобів автомобільними дорогами, вулицями та залізничними переїздами» від 18 січня 2001 р. або інших чинних нормативних актів, що регулюють перевезення негабаритних вантажів та/або проїзд великогабаритних та великовагових транспортних засобів;

6.6.12. під час міжнародного перевезення вантажу було порушено вимоги перевезення негабаритних вантажів та/або проїзд великогабаритних та великовагових транспортних засобів у країні настання страхового випадку.

6.7. Не визнаються страховими випадками події, які хоча і мають формальні ознаки страхового випадку , але трапилися в один з періодів страхового покриття, які зазначені в п. 5.2 ІЧД, за які Страхувальник вчасно не сплатив черговий страховий платіж за відповідний період страхового покриття. При цьому Сторони погодили, що зазначена умова застосовується у випадках, коли черговий страховий платіж був сплачений Страхувальником після дати, зазначеної в п. 5.2 ІЧД, як термін (кінцева дата) сплати такого платежу, та пізніше, ніж за 48 годин до дати настання події, що має ознаки страхового випадку.

6.8. Не визнаються страховими випадками за ризиком «Секція В

(Відповідальність за помилки та упущення)» події, якщо:

6.8.1. вантаж видано неналежному за договором перевезення одержувачу;

6.8.2.помилки та упущення пов’язані з операціями, що підпадають під дію Митної Конвенції про міжнародне перевезення вантажів із застосуванням книжки МДП (Конвенція МДП 1975 року).

6.6.6. the cargo (its part) refers to the list of hazardous cargoes (ADR cargoes) prohibited in the country where event bearing signs of insured event has occurred, or the carrier has no license and required permits to transport of hazardous cargo by the insured transport vehicles;

6.6.7. transported cargoes are inadequate for combined transport;

6.6.8. cargo refers to the following list: bullions and items made of them; rich stones and jewellery; paper currency and coined money; loan securities or other securities; works of art; antiques; pedigreed animals;

6.6.9. cargo was damaged (for example, motor vehicles, equipment, etc.) during its transport without package and/or on open platforms/bodies without tent due to oxidation, corrosion, discoloration, fractures, scratches or dents, except for the road traffic accidents;

6.6.10. cargo was damaged and/or lost due to cargo spontaneous combustion as a result of friction or features of cargo (spontaneous combustion is a spontaneous burning resulting from gradual heat accumulation during energy-releasing reactions in materials);

6.6.11. carriage of goods on the territory of Ukraine was carried out in violation of the Resolution of the Cabinet of Ministers of Ukraine No.30 “On transportation of large and heavy vehicles by motorways of the roads, streets and railway crossings" of January 18, 2001 or other applicable regulations governing the carriage of out-of-gauge loads and/or passage of large and heavy vehicles;

6.6.12. during the international carriage of cargo, the requirements for the carriage of out-of-gauge loads and/or the passage of large and heavy vehicles in the country of the insured event were violated.

6.7. Events that bear signs of insured events but occur within one of the insurance coverage periods specified in par. 5.2 of the IPC which due insurance payment for a corresponding period of insurance coverage was not paid by the Insured in proper time. Besides, the Parties have agreed that the above contract is used when due insurance payment is made by the Insured after the date specified in par. 5.2 of the IPC as the due date (deadline), and not later than 48 hours before the date of event bearing signs of insured event.

6.8. Events are not recognized as insured events in terms of risk

«Section B (Liability for mistakes and omissions)» if:

6.8.1. cargo was delivered to unsuitable recipient under the carriage contract;

6.8.2. mistakes and neglects are associated with operations falling within the scope of Customs Convention on the International Transport of Goods under Cover of TIR Carnets (TIR Convention of 1975).

6.9. Страховик не відшкодовує: 6.9. The Insurer does not compensate:

6.9.1. немайнову, у тому числі моральну шкоду, непрямі збитки, недоотримані прибутки (упущену вигоду), непрямі податки, у тому числі податок на додану вартість (ПДВ);

6.9.2. збитки, заподіяні навколишньому середовищу (екологічні збитки);

6.9.3. витрати внаслідок заподіяння шкоди життю та здоров’ю потерпілої особи, які покриваються лімітом страхового відшкодування, встановлені за договорами обов’язкового страхування відповідальності власників наземного транспорту країни випадку;

6.9.1. non-pecuniary damage, including moral damage, indirect losses, short-received income (lost profit), indirect taxes including value-added tax (VAT);

6.9.2. harm inflicted to environment (environmental damage);

6.9.3. losses resulting from infliction of harm to health and life of the injured person that are covered by insurance compensation limit established under contracts of mandatory liability insurance of road vehicle owners in the country where the loss has occurred;

6.9.4. наступні витрати: плата за перевезення, мито, інші платежі, пов’язані з перевезенням вантажу (з урахуванням п. 3.4 Частини 2 ПЧД);

6.9.5. не узгоджені зі Страховиком витрати Страхувальника (зокрема, витрати на відрядження, пальне, заробітну платню, проживання, візи, квитки, інші витрати);

6.9.6. збитки, що виникли поза періодом відповідальності Страховика за ІЧД, а також збитки, що виникли під час завантаження або розвантаження, під час зберігання вантажу на складі; якщо завантаження вантажу та його перевезення почалося до моменту укладання договору страхування та/або зарахування страхового платежу (першого страхового платежу) на поточний рахунок Страховика;

6.9.7. збитки, що не підтверджені документально, якщо інше не передбачено Договором;

6.9.8. збитки та витрати, що виникли внаслідок зникнення транспортного засобу з вантажем.

6.10. Підставами для відмови у виплаті страхового відшкодування є:

6.10.1. Підстави, передбачені Законом України «Про страхування»;

6.10.2. Подія настала поза межами періоду відповідальності Страховика відповідно до Розділу 11 Частини 2 ПЧД або місце події знаходиться поза межами території дії, зазначеної ІЧД.

6.10.3. Страхувальник або його представник не виконав своїх обов’язків, передбачених п. 5.3 та Розділом 7 Частини 2 ПЧД, чим унеможливив визначення обставин події, умов перевезення вантажу, визначення розміру збитків та встановлення винних осіб (якщо вони могли бути встановлені);

6.10.4. Ненадання Страхувальником документів, передбачених Розділом 8 Частини 2 ПЧД, що стосуються конкретного страхового випадку впродовж 1 (одного) року з моменту настання страхового випадку. Зазначений пункт не застосовується у випадку надання Страхувальником доказів існування об’єктивних причин неможливості надання вказаних документів протягом зазначеного у цьому пункті строку;

6.10.5. Страхувальник отримав відшкодування збитків від третіх осіб у повному обсязі;

6.10.6. Невиконання Страхувальником та/або його представниками вимог Інструкції для водіїв (Розділ 15 Частини 2 ПЧД).

6.9.4. the following expenses: payment for transport, custom duty, other payments associated with cargo transport (considering par. 3.4 of the Part 2 of the PPC);

6.9.5. expenses of the Insured not agreed with the Insurer (in particular, expenses for business trip, fuel, wages payment, accommodation, visas, tickets, other expenses);

6.9.6. losses that occurred not within the period of the Insurer's responsibility hereunder, and losses that occurred during loading or unloading, storage at warehouse. If cargo loading and transport began before entering into insurance contracts and/or credit of insurance payment (first insurance payment) to the Insurer's current account;

6.9.7. not documented losses except as otherwise provided herein;

6.9.8. losses and expenses that occurred as a result of disappearance of transport vehicle containing cargo.

6.10. Below are the grounds for refusal to pay insurance indemnity:

6.10.1. Grounds provided Law of Ukraine “On Insurance”;

6.10.2. The event has occurred not within the period of the Insurer's responsibility in accordance with Section 11 of the Part 2 of the PPC, or place of event occurrence is located outside the territory of the IPC.

6.10.3. The Insured or its representative have not fulfilled their obligations provided in par. 5.3 and Section 7 of the Part 2 of the PPC, preventing from establishing event circumstances, conditions of cargo transport, defining extent of losses and establishing guilty persons (if they could be established);

6.10.4. Non-provision of documents provided in Section 8 of the Part 2 of the PPC by the Insured in relation to certain insured event within 1 (one) year from the date loss occurrence. The specified paragraph does not apply if the Insured provides proofs of objective grounds for impossibility to submit the specified documents within the term specified in this paragraph;

6.10.5. The Insured has received loss compensation from third parties to the full extent;

6.10.6. Non-fulfilment of the requirements of the Driver’s Instaction (Section 15 of the Part 2 of the PPC) by the Insured and/or its representatives.

7. ДІЇ ПРИ НАСТАННІ СТРАХОВОГО ВИПАДКУ 7. ACTIONS IN CASE OF LOSS OCCURRENCE ‌

7.1. У разі настання події, що має ознаки страхового випадку, Страхувальник та/або його представник зобов'язаний:

7.1.1. впродовж 1 (однієї) години з моменту виявлення такої події повідомити Страховика про обставини події, характер вантажу, місце та час розвантаження (чи місце знаходження ЗТЗ з вантажем) за номерами телефону:

7.1. If an event bearing signs of insured event occurs, the Insured and/or its representatives shall do the following:

7.1.1. Notify the Insurer within 1 (one) hour from the time of such event occurrence about the event circumstances, nature of cargo, place and time of unloading (or location of the ITV with cargo) by the following phone numbers:

+38 (044) 290-39-95 (за кордоном), +38 (044) 290-39-95 (abroad),

0-800-301-001 (по Україні). 0-800-301-001 (in Ukraine).

При цьому повідомлення вважається поданим несвоєчасно, якщо воно отримано після вивантаження вантажу із ЗТЗ;

7.1.2. у разі, якщо пошкодження, нестачу або псування вантажу виявлено під час розвантаження ЗТЗ, призупинити процес розвантаження до прибуття представника Страховика або, на підставі письмового або усного розпорядження Страховика, діяти відповідно до вимог п. 7.1.4 Частини 2 ПЧД;

7.1.3. протягом 5 (п’яти) робочих днів після настання події, що має ознаки страхового випадку, надати Страховику письмове повідомлення за встановленою Страховиком формою;

7.1.4. у випадку, якщо своєчасне прибуття представника Страховика неможливо забезпечити або процес розвантаження ЗТЗ неможливо зупинити, фотографічно зафіксувати стан кріплення та розміщення вантажу у ЗТЗ до початку та в процесі розвантаження. У випадку технічної неможливості здійснити

7.1.2. if damages, short-delivery or deterioration of cargo are detected during the ITV unloading, stop cargo unloading until the Insurer's arrival or act in accordance with par. 7.1.4 of the Part 2 of the PPC based on written or oral order of the Insurer;

7.1.3. send written notification to the Insurer in accordance with the form established by the Insurer within 5 (five) business days after occurrence of event bearing the sings of insured event;

7.1.4. if the Insurer's representative can not arrive in proper time or cargo unloading from the ITV can not be stopped, record state of attachment or placement of cargo in the ITV by making photos before and during cargo unloading; If it is technically impossible to make photos, notify the Insurer about this and act in accordance with its

7.1.5. сприяти діям Страховика та його представників з огляду та обстеження вантажу, його розміщення та кріплення у ЗТЗ, а також стану упакування, технічного стану ЗТЗ та місця події, що має ознаки страхового випадку;

7.1.6. за вказівкою Страховика забезпечити виклик на місце знаходження ЗТЗ з вантажем представників відповідних компетентних органів для документального підтвердження настання заявленої події, її обставин та розміру шкоди.

7.2. Страхувальник або його представник зобов’язані прийняти участь в процесі приймання вантажу Одержувачем за кількістю, якістю та комплектністю.

7.3. За результатами прийомки вантажу складається рекламаційний акт або інший документ, який, зокрема, обов’язково має відображати:

7.1.5. give assistance to the Insurer and its representatives in inspection and examination of cargo, its placement and attachment in the ITV, and examination of package state, technical state of the ITV and place where event bearing signs of insured event has occurred;

7.1.6. at the Insurer's direction, ensure invitation of representatives of corresponding competent authorities to the location area of the ITV with cargo for documentary evidence of occurrence of the specified event, its circumstances and extent of loss.

7.2. The Insurer or its representative shall participate in cargo reception by the Consignee in accordance with the requirements for quality, quantity, and completeness.

7.3. Damage disclosure statement or other document that shall particularly include the following are drawn up based on the results of cargo reception:

• стан тари та упакування; • transport box and package state;

• при нестачі товару – відомості про фактичну нестачу в одиницях виміру, відображених у транспортних документах;

• при невідповідності товару за якістю - опис дефектів, кількість зіпсованого товару, а також зниження рівня якості у відсотках, якщо це можливо.

Також результати приймання вантажу відображаються в товарно- транспортній накладній.

До рекламаційного акту (іншого документу, складеного Страхувальником та Одержувачем вантажу) повинні додаватися транспортні документи, комерційні документи на вантаж (товар), фотографії, опечатані зразки зіпсованого товару разом з актом про вилучення зразків, аналізи незалежних лабораторних досліджень, розрахунки збитків та витрат, документи, що підтверджують особу учасників прийомки, інші документи, передбачені для прийомки відповідного товару.

7.4. Якщо Страхувальник не надав документального (фотографічного) підтвердження стану кріплення та розміщення вантажу у ЗТЗ, фотографії ЗТЗ у разі його пошкодження або не забезпечив Страховику (уповноваженій ним особі) можливість проведення огляду пошкодженого, зіпсованого вантажу до початку або під час розвантаження ЗТЗ або створював йому перешкоди, то вважається, що Страхувальник не виконав свої обов’язки, передбачені умовами Розділу 7 Частини 2 ПЧД, відповідно, Страховик має право відмовити у виплаті страхового відшкодування.

7.5. Страхувальник не повинен сплачувати відшкодування, не підписувати жодних документів, а також не приймати на себе будь- яких прямих чи непрямих зобов’язань по врегулюванню таких вимог без згоди Страховика, крім випадків, коли обов’язок Страхувальника виконати вимоги випливає з Закону або на підставі рішень компетентних органів, які є обов’язковими для виконання на території України.

7.6. Будь-які дії, перелічені у Розділі 7 Частини 2 ПЧД, не означають визнання події страховим випадком.

• in case of goods shortage – data on actual shortage in measurement units specified in shipment documents;

• if goods do not comply in terms of quality – description of defects, quantity of damaged goods, and decrease of quality level in percentage points when applicable.

Besides, the results of cargo reception are specified in shipping document.

Shipment documents, commercial documents for cargo (goods), photos, sealed samples of damaged goods with sample withdrawal act, analyses of independent laboratory researches, calculations of losses and expenses, documents proving identities of acceptance participants, other documents provided for correspondent goods acceptance shall be added to the damage disclosure statement (other document drawn up by the Insured and Recipient of cargo).

7.4. If the Insured has not provided documentary (photographic) evidence of the state of cargo attachment and placement in the ITV, photos of the ITV in case of its damage, or has not granted an opportunity to the Insurer (person authorized by it) to inspect damaged, deteriorated cargo before or during unloading from the ITV, or has created obstacles to it, it is considered that the Insured has not fulfilled its liabilities provided in the terms of Section 7 of the Part 2 of the PPC. Accordingly, the Insurer is entitled to refuse to pay insurance compensation.

7.5. The Insured shall not pay compensation, sign any documents, and accept any direct or indirect obligations related to such requirements regulation without the Insurer's consent, except for cases when the Insured is obliged to fulfil the requirements in accordance with the Law or on the grounds of decisions of competent authorities binding in the territory of Ukraine.

7.6. Any actions listed in Section 7 of the Part 2 of the PPC do not mean recognition of an event as an insured event.

8. ПЕРЕЛІК ДОКУМЕНТІВ З ВИЗНАЧЕННЯ ОБСТАВИН ПОДІЇ, 8.‌

LIST OF DOCUMENTS DETERMINING CIRCUMSTANCES

РОЗМІРУ ЗБИТКІВ, ПРАВОМІРНОСТІ ПРЕТЕНЗІЙ OF THE EVENT, EXTENT OF LOSSES, CLAIM JUSTIFICATION

8.1. Для встановлення та доведення правомірності претензій на

адресу Страхувальника останній зобов’язаний надати Страховику:

8.1.1. майнову претензію до Страхувальника з обґрунтуванням та наданням доказів, що підтверджують таку вимогу.

Правомірність та правильність оформлення поданої претензії (за страховим випадком по «Секції А (Відповідальність за вантаж)») визначається на підставі Глави 5 Конвенції КДПВ та/або Розділу 16 Правил перевезень вантажів автомобільним транспортом в Україні. Особа-нерезидент України, яка подає претензію, має право скласти таку претензію з урахуванням вимог свого національного

8.1. The Insured shall send the following to the the Insurer's address to

establish and prove the claim legitimacy:

8.1.1. property claim to the Insured with justification and provision of evidence acknowledging such demand.

Valid and correct execution of the filed claim (under insured event in

«Section A (Liability for the cargo)») is established on the basis of Chapter 5 of the Convention on CCCG and/or Section 16 of the Rules for Cargo Carriage by Road in Ukraine. A non-resident of Ukraine which files a claim has the right to execute such claim taking into account requirements of the national laws that should not contradict the

8.1.2. висновки експерта, які відповідають вимогам п. 7.3 Частини 2 ПЧД;

8.1.3. акт приймання вантажу, оформлений у відповідності до вимог нормативних актів країни доставки вантажу та за підписом представників Страхувальника (водія);

8.1.4. копії матеріалів листування із заявником претензії;

8.1.5. інвойси з відмітками митниці (рахунки-фактури), специфікація, товарні накладні;

8.1.6. пакувальні листи (відомості), дозвільні документи (сертифікація, дозвіл на негабаритні перевезення по автомобільним дорогам) та інші подібні докумнти;

8.1.7. митні декларації, інші документи, пов’язані із розмитненням вантажу або документи, що підтверджують здійснення процедури митного транзиту;

8.1.8. у випадку прийняття рішення на користь особи, яка подала претензію, судом третьої країни – примірник такого рішення з його легалізацією на території України (легалізація не є обов’язковою у випадках, коли між Україною та такою третьою країною укладено відповідні міжнародні договори);

8.1.9. якщо претензію подано страховою компанією-страховиком вантажу або страховиком відповідальності експедитора, підставою для розгляду такої претензії є надання документу, що підтверджує перехід до такої страхової компанії права зворотної вимоги за подією;

8.1.10. платіжне доручення про сплату потерпілій особі суми збитків у повному обсязі. Надання зазначеного документу не є обов’язковим у випадку, коли в п.7.1 ІЧД обрано опцію «До дати сплати Страхувальником суми збитку у повному обсязі згідно претензії»;

8.1.11. у випадку пожежі довідка та протокол компетентних органів або експертний висновок, що підтверджують факт та визначають причину пожежі. У випадку, коли у цих документах визначено лише ймовірні причини пожежі, Сторони домовились в якості доказів причини пожежі приймати найймовірнішу причину пожежі.

8.2. Для встановлення обставин перевезення Страхувальник зобов’язаний надати Страховику:

8.2.1. накладну на перевезення (CMR або ТТН) з відміткою вантажоодержувача про пошкодження або втрату вантажу;

8.2.2. заявку замовника на перевезення та договір перевезення (за наявності);

8.2.3. реєстраційні документи на ЗТЗ, договір оренди транспортного засобу, оформлений та засвідчений належним чином (за наявності), а також тахошайби або роздруківка з бортового комп’ютеру за весь період перевезення;

8.2.4. документи, що підтверджують наявність договірних або

8.1.4. copies of correspondence materials with the claim applicant;

8.1.5. invoices with customs marks (invoice), specification, and consignment notes;

8.1.6. packing lists (records), permits (certification, permits for oversized transportation by road) and other similar documents;

8.1.7. customs declarations, other documents related to cargo customs clearance or documents acknowledging the customs transit procedure;

8.1.8. in case of decision-making by a court in the third country in favor of the person that filed the claim who complains - a copy of such decision with its legalization in the territory of Ukraine (legalization is not mandatory in cases when Ukraine and such third country enter into relevant international agreements);

8.1.9. if a claim is filed by the insurance company insuring the cargo or the Insurer of the forwarder responsibility, the grounds for such claim consideration is the document confirming transfer of the counter demand under the event to such insurance company;

8.1.10. payment order regarding complete payment of loss amount to the affected party. Provision of the above document is not mandatory if the option “Before the date when the Insurer pays the loss amount in full in accordance with the claim” is selected in par. 7.1 of the IPC;

8.1.11. in case of fire a certificate and a protocol of competent bodies or expert opinions confirming the fact and defining the cause of fire. If these documents specify only probable causes of fire, the Parties agreed to accept the most probable cause of fire as the evidence of the fire.

8.2. The Insured shall provide the following to the Insurer to establish carriage circumstances:

8.2.1. bill of loading (CMR or ТТH) with the mark regarding the cargo damage or loss made by the consignee;

8.2.2. customer’s request for carriage and Carriage Contract (if any);

8.2.3. registration documents for the ITV, lease agreement of the transport vehicle properly executed and certified (if any), as well as tachograph disks or printout of the on-board computer for the entire period of carriage;

8.2.4. documents acknowledging existence of contractual or labour

8.2.7. За відсутності документів щодо розміщення та кріплення вантажу Сторони домовились керуватися нормами, прийнятими в ЄС та Україні, зокрема, стандартами CEN 12195-1:2010, ДСТУ EN 12195-1:2018, вимогами IMO/ILO/UNECE (комісія з оновлення вимог до розміщення та пакування вантажів при дорожньому перевезенні). При перевезенні по Україні до уваги приймаються

8.2.5. photos of damages to the transport vehicle, fixation and arrangement of the cargo in the ITV body, damages to the cargo if the Insurer could not be present during unloading;

8.2.6. documents regarding the rules and the procedure for cargo fixation in the ITV body which are provided by the cargo (goods) manufacturer, and the consignor.

8.2.7. In the absence of documents regarding cargo arrangement and fixation, the Parties have agreed to follow standards accepted in the EU and Ukraine, in particular, CEN 12195 1 2010, DSTU EN 12195 1 2018, requirements of IMO/ILO/UNECE (the commission for updating requirements for cargo arrangement and packing during carriage). The requirements of the Rules for Cargo Carriage by Road in Ukraine,

requirements of the State Standard on cargo palletizing, preparation for

transportation that are in force in the territory of Ukraine;

8.2.8. протокол огляду розміщення та кріплення вантажу у кузові ЗТЗ за узгодженою зі Страховиком формою.

8.3. Також Страхувальник зобов’язаний надати такі документи:

8.3.1. письмові пояснення водія та інших осіб, які володіють інформацією про причини та обставини настання страхового випадку, а також іншою інформацією, що має суттєве значення для розгляду справи;

8.3.2. у випадку дорожньо-транспортної пригоди – протокол поліції або відповідної інспекції або повідомлення про ДТП встановленого зразка (європротокол);

8.3.3. у випадку пожежі – довідку та протокол компетентних органів, що підтверджують факт та визначають причину пожежі;

8.3.4. у випадку крадіжки – документ від офіційних органів країни події, який підтверджує порушення кримінального провадження за фактом крадіжки або іншого кримінально-карного діяння;

8.3.5. у випадку псування рефрижераторного вантажу – висновки спеціалізованих сервісних центрів з ремонту та обслуговування спеціального обладнання про причини несправності;

8.3.6. у випадку дії атмосферних опадів – протокол огляду механічних пошкоджень кузова ЗТЗ (контейнеру, цистерни тощо), підписаний Сторонами;

8.3.7. у випадку порушення проти представників Страхувальника або третіх осіб судової справи про адміністративне правопорушення за фактом події – рішення суду та документи про хід кримінальної справи;

8.3.8. у випадку порушення проти представників Страхувальника за фактом події кримінального провадження – вирок суду або постанова про закриття провадження;

8.3.9. Сторони домовились приймати висновки науково-дослідних установ судових експертиз України та НДЕКЦ МВС України (їх аналогів у країні випадку) про причини події в якості доказів, висновки незалежних експертів – в якості свідчень, що мають змагальний характер;

8.3.10. належним чином оформлені показники тахографа, термографа (датчика температури, вологості тощо) за увесь час перевезення;

8.3.11. за необхідності – довідку ДСНС України (аналогічного органу за кордоном) про оголошення країни/регіону зоною надзвичайної ситуації або довідка ТПП країни події.

8.4. Для визначення розміру збитків Страхувальник зобов’язаний надати Страховику:

8.4.1. при перевезенні вантажів з оголошеною вартістю для визначення вартості вантажу - комерційні документи на вантаж (інвойс з відмітками митниці), індикативні ціни митних органів, прайси (цінові довідки, бюлетені) виробників товару, біржові

котирування, комерційні пропозиції у відкритих джерелах

8.3. The Insured shall also provide the following documents:

8.3.1. written explanations of the driver and other persons who have information about reasons and circumstances of the insured event, as well as other information of importance for the case consideration;

8.3.2. in case of road traffic accident - protocol of the police or relevant inspectorate or the notification about the road traffic accident in accordance with the established sample (European Accident Statement);

8.3.3. in case of fire - certificate and protocol of competent authorities that acknowledge the fact and define the cause of fire.

8.3.4. in case of theft - document of official bodies in the country of event which acknowledges initiation of criminal proceedings regarding theft or another criminal and retaliatory act;

8.3.5. in case of refrigerator cargo deterioration - opinions of specialized service centres for repair and maintenance of special equipment regarding reasons of failure;

8.3.6. in case of atmospheric precipitations - protocol of inspection of mechanical damages to the ITV body (container, tank, etc.) signed by the Parties;

8.3.7. in case of initiation of a lawsuit against representatives of the Insurer or third parties for administrative offence for the event - court decision and documents on the course of the criminal case;

8.3.8. in case of initiation of criminal proceedings against representatives of the Insured – court verdict or resolution on criminal proceeding closing;

8.3.9. the Parties have agreed to accept conclusions of Scientific and Research Institutes for Forensic Examination in Ukraine and Research and Forensic Science Centres of the Ministry of Internal Affairs of Ukraine (their analogues in the country of event) regarding causes of the event as the evidence, opinions of independent experts - as the evidence of competitive nature;

8.3.10. properly executed readings of tachograph, thermograph (temperature, humidity transmitters, etc.) for the entire period of carriage;

8.3.11. if necessary – certificate of the State Emergency Service of Ukraine (similar body abroad) about the announcement of the country/region as the emergency zone or a certificate issued by the Chamber of Commerce and Industry in the country of the event.

8.4. The Insurer shall provide the Insurer the following to define the amount of losses:

8.4.1. when transporting the cargo with declared value to define the cargo cost – commercial documents on the cargo (invoice with customs marks), indicative prices of customs bodies, prices (price certificates, bulletins) of goods manufacturers, exchange quotations, and

commercial proposals in open sources of information (including the

9. ВИЗНАЧЕННЯ РОЗМІРУ СТРАХОВОГО ВІДШКОДУВАННЯ

9. DETERMINATION OF INSURANCE INDEMNITY AMOUNT

9.1. Розмір страхового відшкодування визначається по кожному страховому випадку окремо з урахуванням лімітів відповідальності по страхових ризиках, встановлених в п. 2.2 ІЧД для одного страхового випадку та за Договором в цілому, шляхом зменшення встановленої суми збитків на суму відповідної франшизи залежно від номенклатури вантажу, що перевозиться, та страхового ризику, що настав. Розмір франшизи зазначається в п.2.2 ІЧД.

9.1.1. Якщо на момент настання страхового випадку вартість

9.2. У разі дорожньо-транспортної пригоди з вини кількох учасників пригоди (транспортних засобів), сума страхового відшкодування розраховується як частина встановленої суми збитків, пропорційна частині вини Страхувальника, зменшена на суму франшизи/спеціальної франшизи, та з урахуванням обраних в п. 2.3 ІЧД умов страхування. Ступінь вини Страхувальника встановлюється на підставі отриманих документів за згодою Сторін. У випадку, якщо Сторони не досягли домовленості, рішення про виплату страхового відшкодування відкладається до встановлення ступеня вини Страхувальника відповідно до чинного законодавства країни випадку, але на строк не більше 3 (трьох) місяців з дати відправлення відповідного запиту. За відсутності відповіді на запит протягом зазначеного вище строку частка вини Страхувальника дорівнюватиме одиниці, поділеній на кількість учасників ДТП.

9.3. Сторони погодили, що якщо умовами ІЧД передбачено сплату страхового платежу частинами та у разі настання страхового випадку до моменту повної сплати Страхувальником загального

2.3 of Contract. The extent of the Insured fault is established based on received documents as agreed by the Parties. If the Parties do not reach an agreement, a decision on insurance indemnity payment is postponed until the extent of the Insured fault is established in accordance with the applicable laws in the country of the event, but for the term not exceeding 3 (three) months from the date of relevant request submission. If there is no response to the request within the above term, the share of the Insured fault will be equal to one divided by quantity of road traffic accident participants.

9.3. The Parties have agreed that if the terms and conditions hereof provide for making insurance payment by instalments and if the insured event occurs before full payment by the Insured of the total insurance

При цьому, якщо Страхувальник не сплатив несплачені частини страхового платежу за ІЧД у такий строк, Страховик має право в односторонньому порядку зменшити розмір страхового відшкодування на суму несплачених частин страхового платежу та зарахувати таку суму зменшення як оплату несплачених чергових платежів, про що Страховик повідомляє Страхувальника та робить відповідну відмітку у страховому акті.

9.4. Сума збитку, на підставі якої розраховується розмір страхового відшкодування відповідно до п. 9.1 Частини 2 ПЧД за ризиком

«Секція А (Відповідальність за вантаж)» визначається з урахуванням наступного:

9.4. The amount of losses used to calculate the insurance indemnity amount in accordance with par. 9.1 of the Part 2 of the PPC for risk

«Section A (Liability for cargo)» is defined with due consideration of the following:

9.4.1. in case of full or partial cargo loss the amount of loss is calculated based on the cost of the lost cargo in the place and during its acceptance for carriage, but not more than SDR 8.33 per 1 kg gross of the lost cargo.

У випадку знищення вантажу та ненадання Страхувальником документів, передбачених п. 8.4.5 Частини 2 ПЧД, Сторони домовились, що вантаж буде вважатися пошкодженим і визначення суми збитку буде проводитися відповідно до п. 9.4.2

9.5. Сума збитку, на підставі якої розраховується розмір страхового відшкодування відповідно до п. 9.1 Частини 2 ПЧД за ризиком

«Секція В (Відповідальність за помилки та упущення)», у випадках прострочення доставки розраховується на підставі претензії третьої особи до Страхувальника та доказів, що підтверджують завдання збитків такій особі внаслідок прострочення у доставці та не може перевищувати розмір плати за перевезення (вартість фрахту).

9.6. Сума збитку, на підставі якої розраховується розмір страхового відшкодування відповідно до п. 9.1 Частини 2 ПЧД за ризиком

«Секція С (Відповідальність перед третіми особами)», визначається з урахуванням наступного:

9.6.1. розрахунок розміру збитків здійснюється на підставі чинного законодавства країни випадку з урахуванням положень Конвенції про право, що застосовується до дорожньо-транспортних пригод;

9.6.2. відшкодуванню підлягає лише шкода, яка не відшкодовується за договорами обов’язкового страхування відповідальності власників наземного транспорту, якщо умови таких договорів могли бути застосовані до події, що має ознаки страхового випадку.

«Section C (Liability to third parties)» is calculated with due consideration of the following:

9.6.1. the amount of loss is calculated based on the applicable laws of the country of the event, taking into account the provisions of the Convention on the right applied to road traffic accidents;

9.6.2. indemnity is applied only to the loss which is not indemnified under Contracts of Mandatory Road Carrier Liability Insurance if terms and conditions of such Contracts could be applied to the event bearing signs of the insured event.

9.7. Розмір страхового відшкодування за ризиком «Секція D (Витрати)» визначається з урахуванням наступного:

9.7.1. документально доведені витрати на зменшення збитків (на порятунок вантажу), у тому числі по сортуванню, тимчасовому зберіганню вантажу, судові витрати (у т. ч. оплата послуг експертів) підлягають відшкодуванню, якщо вони здійснені за попереднім погодженням із Страховиком.

9.8. Страховик сплачує страхове відшкодування Страхувальнику згідно з Розділу 7 ІЧД.

9.9. Розмір страхового відшкодування розраховується у гривнях за курсом НБУ до валюти претензії на день надання Страхувальником претензії Страховику. У випадку, коли строк надання Страхувальником Страховику претензії настає на 91 календарний день з дня настання події, що має ознаки страхового випадку, розмір страхового відшкодування розраховується у гривнях за курсом НБУ до валюти претензії на 90 календарний день з дня настання події, що має ознаки страхового випадку. Датою надання Страхувальником Страховику претензії є дата отримання Страховиком оригіналу претензії зі всіма додатками у паперовому вигляді. Страховик не відшкодовує витрати Страхувальника, пов‘язані зі здійсненням валютних операцій.

9.10. Днем виплати страхового відшкодування вважається день списання коштів з поточного рахунку Страховика.

9.11. Сторони домовились, що Страховик, що виплатив страхове відшкодування, має право зворотної вимоги (регресу), яке Страхувальник має до особи, відповідальної за заподіяну шкоду.

9.12. Якщо Страхувальник не забезпечив Страховику права зворотної вимоги (регресу), Страховик має право зменшити суму страхового відшкодування на 50% (п’ятдесят відсотків).

9.13. Якщо причиною настання страхового випадку є порушення Страхувальником та/або його представником встановлених в країні настання страхового випадку вимог Правил дорожнього руху щодо:

9.13. If the insured event is caused by violation by the Insured and/or its representative of the Traffic Rules requirements established in the country of the insured event in relation to:

10. ПРИЙНЯТТЯ РІШЕННЯ ПРО ВИПЛАТУ СТРАХОВОГО 10. MAKING A DECISION ON INSURANCE INDEMNITY

ВІДШКОДУВАННЯ PAYMENT

10.1. Страхове відшкодування виплачується Страховиком згідно з

Договором на підставі письмового повідомлення про подію, письмової заяви на виплату страхового відшкодування і Страхового акту, який складається Страховиком.

10.2. Страхове відшкодування сплачується Страхувальнику тільки після того, коли повністю будуть встановлені причини, обставини страхового випадку та розмір збитку. Страхувальник зобов’язаний надати Страховику усі необхідні документи та/або інформацію, що підтверджують причини та розмір збитку, перелік яких наведено в Розділі 8 Частини 2 ПЧД.

10.3. Після одержання всіх необхідних документів, передбачених Розділом 8 Частини 2 ПЧД, рішення про виплату страхового відшкодування або відмову у виплаті страхового відшкодування приймається Страховиком протягом 10-ти (десяти) робочих днів з дати отримання останнього документа. Протягом 5-ти (п’яти) робочих днів з дати прийняття рішення про відмову у виплаті страхового відшкодування Страхувальнику відсилається відповідне повідомлення з обґрунтуванням причин такої відмови.

10.1. Insurance indemnity is paid by the Insurer hereunder based on a

The Insured is sent a corresponding message within 5 (five) business days from the date of making the decision to refuse to pay the insurance indemnity, with substantiation of such refusal.

10.4. Перебіг зазначеного у п. 10.3 Частини 2 ПЧД строку на прийняття рішення про виплату страхового відшкодування або відмову у його виплаті припиняється у наступних випадках:

10.4.1. Якщо справа щодо настання відповідальності Страхувальника або звільнення його від відповідальності за договором перевезення розглядається у суді у цивільній або господарській справі – до дати отримання Страховиком рішення у такій справі, яке набрало законної сили;

10.4.2. якщо відповідними компетентними органами почато кримінальне провадження у зв’язку з настанням страхової події і ведеться розслідування обставин, які призвели до збитку, – до дати отримання Страховиком вироку суду або постанови про закриття кримінального провадження, які набрали законної сили, але у будь- якому випадку не більше, ніж на 6 (шість) календарних місяців;

10.4.3. коли надані документи суперечать один одному або не дають можливості однозначно з`ясувати обставини, причини, характер страхового випадку та розмір збитку, а також особу, винну в настанні події, – до дати отримання Страховиком пояснень Страхувальника щодо таких суперечностей та/або відповідних документів, але не більше ніж на 3 (три) календарних місяці. У випадку, коли Страховик ініціював перевірку (розслідування) компетентними органами державної влади України дій Страхувальника або його представника під час події, що має ознаки страхової, що впливає на прийняття рішення про визнання випадку страховим, перебіг строку прийняття рішення припиняється до дати отримання Страховиком офіційних результатів такої перевірки (розслідування), але у будь-якому випадку не більше ніж на 6 (шість) календарних місяців.

Про припинення перебігу строку на прийняття рішення про виплату страхового відшкодування або відмову у виплаті страхового відшкодування Страховик повідомляє Страхувальника протягом 5- ти (п’яти) робочих днів з дня виникнення підстав для припинення перебігу такого строку.

10.5. Рішення про виплату страхового відшкодування може бути прийнято на підставі судового рішення, якщо Страховик не буде оскаржувати таке рішення у порядку, встановленому чинним законодавством України. Рішення про виплату страхового відшкодування оформлюється шляхом складання страхового акту.

10.6. Виплата страхового відшкодування здійснюється протягом

10 (десяти) робочих днів після ухвалення рішення про виплату.

10.4.1. if a civil or economic case regarding incurrence of the Insured liability or its release from liability under the Carriage Contract is considered by court – before the Insurer receives a decision on such case that came in legal force;

10.4.2. if relevant competent authorities initiated the criminal proceedings because of the insured event and circumstances that caused losses are investigated – before the date when the Insurer receives a court decision or resolution on termination of the criminal proceedings which came in legal force, but in any case not more than 6 (six) calendar months;

10.4.3. when submitted documents contradict to each other or do not allow to clarify unambiguously circumstances, reasons, nature of the insured event and extent of loss, as well as the person who is guilty of the event – before the date when the Insurer receives explanations from the Insured regarding such contradictions and/or relevant documents, but not more than 3 (three) calendar months. If the Insurer initiates check (investigation) by governmental competent authorities of Ukraine of actions of the Insured or its representative during the event bearing signs of insured event that influences on making a decision on the event recognition as the insured one, the period of decision-making terminates before the date when the Insurer receives official results of such check (investigation), but in any case not more than 6 (six) calendar months.

The Insurer informs the Insured about termination of the term for making a decision on insurance indemnity payment or refusal to pay the insurance indemnity within 5 (five) business days from the date when reasons for such period termination occur.

10.5. The decision on insurance indemnity payment can be made based on a court decision if the Insurer does not appeal against such decision in accordance with the procedure established by the applicable laws of Ukraine. The decision on insurance indemnity payment is drawn up by compiling a claim report.

10.6. The insurance indemnity is paid within 10 (ten) business days after making the decision.

11. СТРОК ДІЇ ДОГОВОРУ 11. TERM OF CONTRACT VALIDITY

11.1. Договір укладається на строк, визначений в Розділі 6 ІЧД. 11.1. This Contract is entered into for the term set in Section 6 of‌

the IPC.

11.1.1. Договір набуває чинності з 00-00 годин дати початку дії Договору, яка вказана в п. 6.1 ІЧД, але не раніше 00-00 годин дня, наступного за днем надходження страхового платежу (першої частини страхового платежу) в обсязі, визначеному в Розділі 5 ІЧД, на розрахунковий рахунок Страховика та діє до 24-00 години дати, що зазначена в ІЧД як дата закінчення строку дії Договору, якщо інші обставини, передбачені Договором, не призвели до дострокового припинення дії Договору.

11.1.2. Якщо Страхувальник не сплатив у повному обсязі черговий страховий платіж до початку чергового періоду страхового покриття, то страхове покриття за Договором припиняється на наступний день, починаючи з 00 год.00 хв. дати, зазначеної в ІЧД як початок такого страхового покриття.

11.1.3. Страхове покриття за Договором поновлюються через дві доби з 00 год. 00 хв. дати надходження страхового платежу в повному обсязі за черговий період дії Договору. При цьому дата закінчення строку дії Договору залишається незмінною.

11.1.4. Страховик не несе відповідальності на період припинення страхового покриття та не сплачує страхове відшкодування за подіями, що сталися впродовж цього періоду.

11.1.1. This Contract comes in force at 00-00 o'clock of the effective date specified in par. 6.1. 11.1.4. The Insurer is not responsible during the period of insurance coverage suspension and does not pay the insurance indemnity for events that occurred during this period.

12. ПОРЯДОК ЗМІНИ ТА ПРИПИНЕННЯ ДІЇ ДОГОВОРУ

12. CONTRACT AMENDMENT AND TERMINATION

13. ПОРЯДОК ВИРІШЕННЯ СПОРІВ	13. DISPUTE SETTLEMENT PROCEDURE

Сторони шляхом підписання Договору відповідно до вимог Закону України «Про захист персональних даних» надають згоду на обробку своїх особистих персональних даних за допомогою інформаційно-телекомунікаційної системи бази персональних даних Сторін з метою здійснення забезпечення економічних, фінансових та податкових відносин відповідно до Податкового кодексу України та чинного законодавства України.

14.5. На виконання вимог Закону України «Про захист персональних даних» представники Сторін, які підписують цю угоду, підтверджують, що вони повідомлені про включення їх власних персональних даних до відповідних баз персональних даних Сторін та їм роз’яснено їх права як суб’єктів персональних даних.

14.6. Листування виконується з використанням засобів електронного зв’язку з адреси Страховика. Під використанням засобів електронного зв’язку у Договорі розуміється листування між Сторонами за електронними поштовими адресами, вказаними у реквізитах Сторін у даному Договорі або погодженими окремо.

Страховик може надавати вказівки та висловлювати зауваження Страхувальнику шляхом, зокрема, надсилання повідомлення з будь-якої електронної адреси з доменним ім’ям persha.ua.

14.7. Договір укладено українською та англійською мовами. Обидва варіанти мають однакову юридичну силу. У разі різночитання юридичну силу має український текст Договору.

14.3. Consumers are protected in accordance with the laws on consumer protection and laws on financial services markets.

14.4. Signing the Contract in accordance with the law of Ukraine “On Protection of Personal Data”, the Parties give their consent to process their personal data using the information and telecommunication system of personal database of the Parties for the purpose of providing economic, financial and tax relations in accordance with the Tax Code of Ukraine and the applicable laws of Ukraine.

14.5. For pursuance of requirements of the law of Ukraine “On Protection of Personal Data” the representative of the Parties signing this Contract confirm that they are notified on inclusion of their personal data into corresponding personal databases of the Parties and that they know their rights as personal data subjects.

14.6. Correspondences is performed using electronic communication equipment from the Insurer’s address. Use of electronic communication equipment in the Contract is understood as correspondence between the Parties to e-mails specified in the details of the Parties herein or agreed individually.

The Insurer may provide instructions and give remarks to the Insured, in particular, by sending a notice from any the e-mail address with domain persha.ua.

14.7. The Contract is drawn up in Ukrainian and English. Both versions have equal legal force. In case of discrepancies, the Ukrainian text of the Contract shall prevail.

15. ІНСТРУКЦІЯ ДЛЯ ВОДІЇВ 15. DRIVER'S INSTRUCTION ‌

15.1. ПРИЙМАЮЧИ ВАНТАЖ ДО ПЕРЕВЕЗЕННЯ ВИ ЗОБОВЯЗАННІ:

15.1.1. Переконатися, що Ви отримали на руки необхідні документи:

- накладна CMR (або ТТН). Пам’ятайте, особа, що передає Вам вантаж, повинна залишити собі одну копію накладної, а інші копії підписати та передати Вам;

- TIR-CARNET (книжку МДП, якщо перевезення здійснюється із застосуванням книжки МДП), заповнену Вашою компанією або експедитором;

15.1. WHEN ACCEPTING A CARGO FOR TRANSPORTATION YOU SHALL:

15.1.1. Make sure that you have received necessary documents:

- CMR (or TTH). Remember that the person handing over the cargo has to keep one copy of the loading bill and sign other copies and hand over to you;

- TIR-CARNET (if carriage is performed using the TIR Carnet), filled in by your company or a forwarding agent;

- комерційний інвойс (рахунок-фактуру); - commercial invoice;

- пакувальний лист (за наявності); - packing list (if any);

- чіткі інструкції щодо доставки вантажу, його кріплення, температурні умови перевезення.

В залежності від виду вантажу до основних документів можуть додаватись ветеринарні, санітарні сертифікати, сертифікати якості, свідоцтва, довідки, паспорти тощо.

Ви маєте право відмовитись прийняти вантаж, якщо Ви не отримали всіх потрібних документів, що зазначені вище, або Вам не надали чітких інструкцій від Вашої компанії. Якщо у Вас виникли запитання, звертайтесь до Вашого представника компанії.

15.1.2. Перевити стан контейнера, перевірити зовнішній стан вантажу та його упаковку, маркування та нумерацію місць, а також відповідність кількості місць, їх нумерацію у вказаних документах.

15.1.3. У випадках, коли здійснюється перевезення рефрижераторних вантажів, перед початком завантаження забезпечити відповідний температурний режим у вантажному відсіці транспортного засобу, а також перевірити температуру вантажу, який завантажується на відповідність зазначеним у товаросупровідних документах умовам, при цьому перевірка температури має здійснюватися також і в середині вантажних місць (палет, ящиків, коробів, тощо);

- clear instructions for cargo delivery, fixation, and thermal conditions of transportation.

Veterinary, sanitary certificates, quality certificates, licenses, statements, passports, etc. may be attached to basic documents depending on the type of cargo.

You have the right to refuse to accept the cargo if you have not received all the above documents or you have not received clear instructions from your company. If you have questions, please contact your representative of the company.

15.1.2. Check container condition, appearance of the cargo and its packing, marking and piece numbering, as well as correspondence of the quantity of pieces and their numbering to the ones specified in documents.

15.1.3. If refrigerated cargoes are transported, prior to load, ensure the corresponding thermal conditions in a luggage compartment of the transport vehicle and also check temperature of the cargo being loaded for compliance with conditions specified in shipping documents; moreover, temperature should be checked in the middle of cargo pieces (pallets, cases, boxes, etc.);

15.1.4. Зробити зауваження в накладній (CMR або ТТН), якщо: 15.1.4. Make a record in the loading bill (CMR or TTH) if:

Також зробити зауваження, щодо умов завантаження: Also make a remark regarding loading conditions:

- недостатнє кріплення вантажу; - poor fixation of the cargo;

- погодні умови (сильний дощ, спека тощо); - weather conditions (heavy rain, heat, etc.);

- спосіб розміщення місць у вантажному відсіку (важкий вантаж лежить зверху або ззаду тощо);

- хто саме здійснює або керує завантаженням (працівники відправника тощо).

Роблячи зауваження в накладній CMR, пишіть чітко та розбірливо, поставте дату та підпис під тим, що Ви написали.

Ваші зауваження повинні бути внесені у всі екземпляри накладної CMR . Якщо відправник не надав Вам свій екземпляр накладної для внесення зауважень, або не підписав накладну з Вашими зауваженнями, - відмовляйтесь приймати вантаж.

When making remarks in the loading bill CMR, do this in an accurate and legible manner, indicate the date and put your signature under the written text.

Your remarks have to be made in all the copies of the loading bill CMR. If the consignor has not provided you with a copy of the loading bill to make remarks or has not signed the loading bill with your remarks, refuse to accept the cargo.

«Прийнято без перевірки якості, тому що я не був допущений на склад відправником»;

«Прийнято без перевірки маси вантажу»; «Зовнішня упаковка 4 місць пошкоджена»;

«2 місця скла пошкоджені/розбиті»; «На упаковці сліди підмочування»;

«3 місця мають сліди розморожування та повторного заморожування);

«Вантаж завантажено без використання піддонів, можливе відмокання знизу» і т.п.

15.1.5. Перевірити стан пломби і порівняти її номер із номером, вказаним у книжці МДП (TIR-CARNET), якщо перевезення здійснюється із застосуванням книжки МДП. Відмовитись приймати вантаж, якщо пломба зірвана або її номер не відповідає зазначеному в TIR-CARNET.

15.1.6. Заздалегідь потурбуватись про маршрут руху, а також наявність валюти, особистих речей та документів, щоб уникнути зупинок з вантажем в місцях, котрі не охороняються.

15.1.7. Отримати у Вашій компанії, або експедитора конкретні дані щодо адреси доставки вантажу та його одержувача. Перед виїздом подзвоніть по телефону одержувачу вантажу і уточніть всі деталі розвантаження і митного оформлення вантажу.

15.1.8. Якщо у Вас виникли будь-які запитання, зв'яжіться з Вашою компанією або Страховиком.

“The cargo was loaded without use of pallets, wetting is possible underneath”, etc.

15.1.5. Check the seal condition and compare its number with the number specified in the TIR-CARNET if carriage is conducted using the TIR-CARNET. Refuse to accept the cargo if the seal is broken or its number does not correspond to the number specified in TIR- CARNET.

15.1.6. Think in advance about a route and available money, personal belongings and documents to avoid stops with the cargo in unprotected places.

15.1.7. Receive from your company or in the forwarder specific data on the cargo delivery address and its recipient. Before departure, phone to the consignee and clarify all the details of unloading and customs clearance of the cargo.

15.1.8. If you have any questions, contact your company or the Insurer.

15.2. ПІД ЧАС ПЕРЕВЕЗЕННЯ ВАНТАЖУ 15.2. DURING CARGO TRANSPORTATION

15.2.1. Дотримуватися чітко визначеного маршруту перевезення вантажу, а також не залишайте транспортний засіб без догляду.

15.2.2. Під час довготривалої зупинки (більше 20 хвилин) залишити автопотяг/транспортний засіб лише на спеціально обладнаній стоянці для автомобільних перевізників (“TIR Parking”), стоянці під охороною (уважно віднесіться до місця вибору стоянки та отримайте квитанцію) або інших місцях, передбачених Вашим договором страхування відповідальності перевізника (перелік таких місць уточніть у Вашій компанії).

15.2.3. Ставити Ваш транспортний засіб впритул до інших, або до стін будинків, щоб зменшити можливість доступу до вантажу через поріз в тенті. Обов’язково задіяти всі наявні засоби безпеки (сигналізації), закривати всі двері, зберігати ключі від транспортного засобу, документи і цінні речі.

15.2.4. Під час виконання перевезення стежити за технічною справністю Вашого транспортного засобу, під час кожної зупинки перевіряти стан тенту автомобіля, причепа (при рефрижераторному перевезенні перевіряти дотримання

15.2.1. Follow a well-defined route of cargo transportation and do not leave the transport vehicle unguarded.

15.2.2. During a long-term stop (more than 20 minutes) leave the road train / transport vehicle only at a specially equipped parking for transport vehicle carriers (“TIR Parking”), guarded parking ( select carefully the parking and receive a receipt) or other places provided for in your carrier liability insurance contract (clarify the list of such places with your company).

15.2.3. Park your transport vehicle closely to others or to walls of buildings to minimize a possibility of cargo access through a cut in canvas cover. All the available safety equipment (alarm systems) should be used obligatory; close all doors and keep safe transport vehicle keys, documents, and valuable goods.

15.2.4. During carriage, monitor technical condition of your transport vehicle; during each stop, check condition of the transport vehicle canvas cover, and trailer (monitor observance of set thermal conditions if refrigerated cargoes are transported). If you found damages to the

- викликайте представників поліції і залишайтеся біля місця події до їхнього прибуття;

- запишіть координати винної особи, номер полісу по обов’язковому страхуванню цивільно-правової відповідальності власників транспортних засобів;

- прийміть всі міри для збереження засобів митного забезпечення (пломб, пломбувальних тросів, тощо);

- вимагайте складання протоколу про ДТП і отримайте його копію;

- зв’яжіться з Вашою компанією для отримання подальших інструкцій.

15.2.6. Якщо Ваш транспортний засіб пограбували, або Ви виявили втрату (крадіжку) вантажу або провізних документів, то:

15.2.5. If you have a road traffic accident:

- record details of the guilty person, number of the policy of mandatory insurance of civil liability of motor vehicle owners;

- take all measures to keep safe customs means (seals, sealing cables, etc.);

- demand to draw up a road traffic accident protocol and receive its copy;

- contact your company to obtain further instructions.

15.2.6. If your transport vehicle was robbed or you found the loss (theft) of the cargo or travel documents:

- негайно зробіть заяву в правоохоронні органи; - immediately file an application to law enforcement agencies;

- отримайте довідку про порушення кримінальної справи; - receive a certificate of criminal case initiation;

- зв’яжіться з Вашою компанією для отримання подальших інструкцій.

15.2.7. Якщо митниця вимагає огляд вантажу на кордоні: 15.2.7. If the customs demands cargo inspection at the border:

- вимагайте складення протоколу огляду вантажу, який повинен містити наступну інформацію:

- demand to draw up a cargo inspection protocol which has to contain the following information:

а) характер, кількість та стан вантажу; a) nature, quantity and condition of the cargo;

б) номер старої та нової пломб; b) number of old and new seals;

в) прізвище, ім’я, по батькові, підпис та особисту номерну печатку працівника митниці, що проводив огляд.

c) surname, name, middle name, signature and personal numbered stamp of the customs employee who performed the inspection.

15.2.8. Виключіть можливість вивчення документів сторонніми особами, які супроводжують вантаж. Записуйте прізвища і звання посадових осіб (працівників поліції, митниці), які мали доступ до документів. Не обговорюйте зі сторонніми людьми деталі перевезення (характер і вартість вантажу, місце доставки, фірму одержувача і т.п.).

15.2.8. Eliminate any possibility to study documents by third parties accompanying the cargo. Record surnames and ranks of officials (employees of the police, customs who had access to documents. Do not discuss transportation details (nature and cost of the cargo, point of delivery, company of the consignee, etc.) with strangers.

15.3. ДОСТАВКА ВАНТАЖУ ДО МІСЦЯ ПРИЗНАЧЕННЯ 15.3. CARGO DELIVERY TO THE POINT OF DESTINATION

15.3.1. Доставити вантаж тільки в визначене місце розвантаження. 15.3.1. Deliver the cargo only to the defined point of unloading.

15.3.2. Вимагати, щоб одержувач зустрів Вас у визначеному місці розвантаження. Ні в якому разі не погоджуйтесь на розвантаження в іншому місці без спеціального дозволу компанії власника вантажу.

15.3.3. Після прибуття до місця митного оформлення вантажу виконувати встановлені у країні місця доставки вантажу митні правила та процедури, у тому числі щодо порядку оформлення необхідних документів.

15.3.4. Обов'язково бути присутнім при перевірці цілісності пломб та огляді вантажу інспекторами митниці.

15.3.5. Не залишати місця митного оформлення вантажу, поки не отримуєте на руки товарно-супроводжувальних та інших митних документів з відмітками митного органу, що підтверджують доставку товару до митниці призначення.

15.3.6. Перевірити правильність заповнення товарно- супроводжувальних документів.

15.3.7. Виконувати інструкції вантажоодержувача після розмитнення вантажу. Звірити всі документи з оригінальними примірниками, пересвідчитися в правдивості вказаних даних, обов'язково отримати довіреність та звірити її з паспортними даними особи – представника фірми-одержувача! Зберігати

15.3.5. Do not leave the place of customs clearance until accompanying and other customs documents with marks of the customs authority which prove the cargo delivery to the customs of destination are received.

15.3.6. Check correct fill-in of accompanying documents.

15.3.7. Follow instructions of the consignee after passing customs clearance of the cargo. Verify all the documents with originals, make sure of specified data credibility, receive obligatory a power of attorney and verify it with passport data of the person representing the consignee’s company! Keep the consignee’s power of attorney together

15.3.8. Доставка вантажу має бути тільки у місце, що зазначено в накладній та/або у письмових інструкціях, наданих Вам відправником вантажу або експедитором. Дані інструкції повинні містити в собі адресу та реквізити одержувача, а також паспортні дані представника одержувача.

15.3.9. Зробити для себе письмові відмітки про всі деталі розвантаження – опис, імена, паспортні дані осіб, що отримали вантаж, номери транспортних засобів, адреси тощо. 15.3.10.Отримати від вантажоодержувача екземпляр накладної з відміткою про доставку вантажу та зауваженнями (у разі їх наявності). Накладна має бути підписана повноважним представником вантажоодержувача та завірена печаткою (штампом).

15.3.11.У випадку, коли Ви не погоджуєтеся із зауваженнями вантажоодержувача, зазначеними у накладній, негайно зв’яжіться з Вашою компанією та повідомте про це.

15.3.12.Не залишати транспортний засіб з вантажем на тривалий час ні в якому місці, крім пунктів митного контролю, місць, зазначених в п.2.2 цієї Інструкції або місця призначення, зазначеного в накладній!

15.3.13.Після розвантаження зв’язатися з фірмою одержувача, а також з Вашою компанією і повідомити адресу та час розвантаження.

15.3.14.Повідомити одержувача про розвантаження у місці, яке не зазначено в накладній, або про перевантаження на інший транспортний засіб вантажу, і надати інформацію про адресу та час розвантаження, а також державний реєстраційний номер транспортного засобу.

15.3.15.Негайно зв'язатися з Вашою компанією, якщо у Вас виникли проблеми при передачі вантажу одержувачу, а саме:

15.3.8. The cargo has to be delivered only to places specified in the loading bill and/or written instructions provided by the consignor or the forwarder. These instructions shall contain the consignee’s address and details, as well as passport data of the consignee's representative.

15.3.9. Make for itself written remarks about all details of unloading - description, names, passport data of persons that got cargo, numbers of transport vehicles, addresses and so forth.

15.3.10. Receive from the consignee a copy of the loading bill with a mark about cargo delivery and remarks (in case of their existence). The loading bill must be signed by the authorized representative of the consignee and certified by the seal (stamp).

15.3.11. If you do not agree with the remarks of the consignee specified in the loading bill, immediately contact with your company and report about it.

15.3.12. Do not leave the transport vehicle with the cargo for a long time in any place, except for customs checkpoints, places specified in par.

2.2 hereof or in places of destination specified in the loading bill!

15.3.13. After unloading contact the consignee’s company and also your

company and inform about the address and time of unloading.

15.3.14. Inform the consignee about unloading in the place which is not specified in the loading bill or about reloading the cargo onto another transport vehicle and provide information about the address and time of unloading, as well as state registration number of the transport vehicle.

15.3.15. Immediately contact your company if you have problems with cargo hand-over to the consignee, namely:

- ви не можете відшукати адресу одержувача; - you cannot find the consignee's address;

- за зазначеною адресою відмовляються прийняти вантаж, або направляють Вас в інше місце;

- до Вас звернулися з пропозицією розвантажитися на іншому складі, або перевантажитись на інший транспортний засіб;

- Надані Вам письмові інструкції не зрозумілі, або Ви взагалі не маєте письмових інструкцій.

Ні в якому разі не доставляйте вантаж за адресою або особам, не зазначеним в накладній або наданих Вам інструкціях, без спеціального дозволу Вашої компанії.

15.3.16.Якщо одержувач вантажу висуває припущення щодо нестачі або пошкодження вантажу:

- the cargo is refused to be accepted at the specified address, or you are directed to another place;

- you are proposed to unload at another warehouse or reload onto another transport vehicle;

- you do not understand provided written instructions or you have no written instructions at all.

Under no circumstances deliver the cargo to the address or to persons which are not specified in the loading bill or provided instructions without specific permission of your company.

15.3.16. If the cargo consignee makes an assumption of shortage or damage to the cargo:

- припиніть вивантаження; - stop unloading;

- не підписуйте ніяких актів, що підтверджують факт нестачі або пошкодження вантажу без погодження із Вашою компанією;

- зв'яжіться з представниками Страховика, які скоординують Ваші дії та наддадуть Вам необхідні інструкції про подальші дії;

- не допускайте вивантаження пошкодженого вантажу до проведення його огляду та фотографування в кузові транспортного засобу без згоди на це представника Страховика.

15.3.17.Якщо у Вас виникли підозри щодо розвантаження, або Вам погрожували, негайно повідомте Вашу компанію, Вашого Страховика та/або поліцію.

У РАЗІ НАСТАННЯ ВИПАДКІВ, ЩО МОЖУТЬ ПРИЗВЕСТИ ДО ВИНИКНЕННЯ ПРЕТЕНЗІЙ СТОСОВНО ВАНТАЖУ, НЕОБХІДНО ПОВІДОМИТИ ПРО НИХ СТРАХОВИКА ЗА ТЕЛЕФОНАМИ:

- do not sign any acts proving the shortage or damage to the cargo without agreement with your company;

- contact representatives of the Insurer who will coordinate your actions and will give you necessary instructions for further actions;

- do not allow unloading of the damaged cargo without its inspection and photographing in the transport vehicle body without consent of the Insurer 's representative.

15.3.17. If you have suspicions regarding unloading or you are threatened, immediately inform your company, your Insurer and/or police thereof.

УВАГА! При втраті вантажу в результаті крадіжки або грабежу таке повідомлення слід зробити негайно, як тільки така подія була виявлена та не залишаючи місця події.

1.2. Cargo Valueis an equivalent of cargo (goods) value expressed as a sum of money (per kg gross) in the point or during cargo acceptance before transportation.

1.3. Constantly Guarded Parking is a safe area for freight vehicle parking in the securely fenced territory, round-the-clock security, round- the-clock operating video control system, motor transport entry and exit control system.

1.6. Third Parties are legal entities or individuals that are not the Insured and its representative, are not entitled to handle cargo accepted for transportation and do not have labour or contractual relations with the Insured.

1.7. Special Franchise is an amount by which the amount of loss is reduced when determining the amount of insurance indemnity in case of loss or damage of high-risk cargo.

1.18.5. Угода про міжнародні перевезення швидкопсувних харчових продуктів та про спеціальні транспортні засоби, які призначені для цих перевезень (УПШ) 1970 р.;

5.1. Страхувальник має право: 5.1. The Insured is entitled to do the following:

5.1.1. отримувати від Страховика будь-яку інформацію, що стосується умов Договору;

5.1.1. receive any data related to the terms of the Contract from the Insurer;

5.1.2. ініціювати зміни та доповнення до Договору; 5.1.2. initiate amendments to the Contract;

5.1.3. подавати заяву на виплату страхового відшкодування; 5.1.3. submit an application to pay the insurance indemnity;

5.1.4. оскаржити відмову Страховика у виплаті страхового відшкодування або розмір виплаченого страхового відшкодування;

5.1.5. вести претензійно-позовну роботу із залученням представника Страховика;

5.1.4. appeal against the Insurer's refusal to pay insurance indemnity or against the amount of paid insurance indemnity;

5.1.5. review claims engaging the Insurer's representative;

5.1.6. ініціювати дострокове припинення дії Договору; 5.1.6. initiate early termination of the Contract;

5.1.7. change transport vehicles specified in the register of transport vehicles in Appendix 1 to Contract during carriage notifying the Insurer thereof in advance.

5.2. Страховик має право: 5.2. The Insurer is entitled to do the following:

5.2.3. визначати свою позицію щодо заявлених Страхувальнику претензій;

5.2.4. відмовити у виплаті страхового відшкодування з підстав, встановлених Договором та чинним законодавством;

5.2.6. після виплати страхового відшкодування застосувати право зворотної вимоги (регресу) до третьої сторони, відповідальної за заподіяння збитків;

5.2.7. направити своїх представників для огляду пошкодженого або зіпсованого вантажу та участі у визначенні розміру збитків;

5.2.1. request and obtain data and documents from the Insured required to recognize an event as an insured event and calculate the loss amount;

5.2.3. define own position in relation to claims filed to the Insured;

5.2.4. refuse to pay the insurance indemnity on the grounds established herein and applicable laws;

5.2.5. demand from the Insured to return the paid insurance indemnity (its part) if it is found that the Insured was not entitled to receive it or if losses related to the insured event were indemnified by third parties;

5.2.6. when the insurance indemnity is paid, apply the right of contribution (regress) to the third party responsible for losses;

5.2.7. send its representatives to inspect the damaged or deteriorated cargo and participate in defining loss amounts;

5.2.8. if the Insured shall be provided with written instructions for establishing the event circumstances bearing signs of insured event, determining the loss amount, rights of third parties to receive the loss indemnity, and the procedure for receiving the insurance indemnity;
