5. ПРЕДМЕТ ДОГОВОРУ. ВИГОДОНАБУВАЧ. ЛІМІТИ ЗОБОВ’ЯЗАНЬ СТРАХОВИКА 5.1. Предметом Договору є майнові інтереси, що не суперечать закону, пов’язані із здоров’ям та працездатністю Страхувальника. 5.2. Договір вважається укладеним за добровільним страхуванням від нещасних випадків, якщо у п.1.2 - 1.4 Частини 1 Договору зазначені страхова сума, страховий тариф і страховий платіж за цим видом страхування та у п.2.9 частини 1 Договору зазначено «так». 5.3. Вигодонабувачем є Страхувальник. Страхова виплата здійснюється з урахуванням умов п. 9 Договору. 5.4. Під невідкладними/ургентними захворюваннями та станами станами Страхувальника, зазначеними у п. 2.8 частини 1 Договору, мається на увазі: 5.4.1. Інфекційні та паразитарні хвороби: • Дифтерія. Менінгококова інфекція. Ботулізм. Бруцельоз. Черевний тиф. Геморагічні лихоманки. • Вірусний гепатит (крім хронічної форми).Лептоспіроз. Дизентерія. Малярія. Лептоспіроз. • Гострі шлунково-кишкові інфекційні захворювання. Правець. • Енцефаліт гострий (сипнотифозний, кліщовий весняно-літній, некротичний, геморагічний). 5.4.2.Хвороби ендокринної системи: • Діабет (коматозний стан). • Хвороби щитовидної залози (мікседемамтозна кома, тіреотоксичний криз). • Хвороби паращитовидної залози ( гіпер- та гіпокальціємічні кризи) • Хвороби наднирникової залози (гостра наднирникова недостатність, феохромацитомний криз). • Гіпопітуітарна кома. 5.4.3.Хвороби нервової системи та органів відчуття: • Гостре порушення мозкового кровообігу. • Травми нервової системи, які потребують ургентної госпіталізації. • Коми, напади та інші критичні стани. • Гострі запальні процеси центральної та периферичної нервової системи (стан, що потребує екстреної медичної допомоги). • Гострі процеси та травми ока. • Гострі запальні процеси та травми вуха, горла, носа. 5.4.4.Хвороби системи кровообігу: • Гіпотонічна хвороба (стан, що потребує екстреної медичної допомоги). • Гострий інфаркт міокарду (гострий коронарний синдром, кардіогенний шок) • Нестабільна стенокардія (стан, що потребує екстреної медичної допомоги). • Гостре порушення серцевого ритму. • Xxxxxx серцева недостатність. Набряк легенів. • Емболія та гострий тромбоз магістральних судин. • Гіпертонічний криз. Гострі міокардити, перикардити, | 5. SUBJECT OF THE CONTRACT. BENEFICIARY. INSURER’S LIABILITY LIMITS. 5.1. The subject of the Contract shall be property interests that do not contradict the law and relate to the health and ability to work of the Policy Holder. 5.2. The Contract shall be considered concluded as to the voluntary accident insurance, if the clauses 1.2 - 1.4 of Part 1 of the Contract specify the sum insured, insurance rate and insurance premium under this type of insurance, and “YES” is specified in the cl. 2.9 of the Part 1 of the Contract. 5.3. The beneficiary shall be Policy Holder. The insurance benefit shall be made taking into account the terms of cl. 9 of the Contract. 5.4. The acute/urgent diseases and conditions of the Policy Holder, as specified in cl. 2.8 of Part 1 of the Contract, shall mean: 5.4.1. Infectious and parasitic diseases: • Diphtheria. Meningococcal disease. Botulism. Brucellosis. Typhoid. Hemorrhagic fevers. • Viral hepatitis (except for chronic form). Leptospirosis. Dysentery. Malaria. Leptospirosis. • Acute gastrointestinal infectious diseases. Tetanus. • Acute encephalitis (typhous, tick-borne spring-summer, necrotic, hemorrhagic). 5.4.2. Endocrine system diseases: • Diabetes (comatose dream). • Thyroid gland diseases (myxedematous coma, thyrotoxic crisis). • Parathyroid gland diseases (hyper- and hypocalcemic crises) • Adrenal gland diseases (acute adrenal insufficiency, pheochromocytoma crisis). • Hypopituitary coma. 5.4.3. Diseases of the nervous system and sense organs: • Acute cerebrovascular accident. • Injuries to the nervous system that require urgent hospitalization. • Xxxx, seizures and other critical conditions. • Acute inflammatory processes of the central and peripheral nervous system (condition that requires emergency medical care). • Acute processes and eye injuries. • Acute inflammatory processes and injuries of the ear, throat, nose. 5.4.4. Blood circulatory system diseases: • Hypotonic disease (condition that requires emergency medical care). • Acute myocardial infarction (acute coronary syndrome, cardiogenic shock) • Unstable angina (condition that requires emergency medical care). • Acute heart rhythm disorders. • Acute heart failure. Pulmonary edema. • Embolism and acute thrombosis of the main vessels. • Hypertensive crisis. Acute myocarditis, pericarditis, endocarditis |

Пневмоторакс. 5.4.6.Хвороби та ураження органів травлення: • Перитоніт. Перфорації шлунку та кишок. • Гострий апендицит, дивертикуліт. Защемлена кила. • Гостра кишкова непрохідність. • Гострий холецистит. Гострий панкреатит (панкреонекроз). • Шлунково-кишкова кровотеча. Тромбоз мезентеріальних судин. • Абсцеси черевної порожнини. Гостра печінкова недостатність. 5.4.7.Хвороби сечостатевої системи: • Гострі запальні процеси сечостатевої системи (стан, що потребує екстреної медичної допомоги). • Гостра ниркова недостатність. Xxxxxxx коліка, що не купується. Гостра затримка сечі. • Гостра акушерсько-гінекологічна патологія: • Гостре запалення органів жіночої сечостатевої сфери (стан, що потребує екстреної медичної допомоги). • Масивні кровотечі із статевих шляхів. • Інша акушерсько-гінекологічна патологія, що потребує невідкладного оперативного втручання або маніпуляцій. 5.4.8.Хвороби шкіри, підшкірної клітковини, м’язів, кісток, суглобів: • Гострі запальні процеси шкіри, підшкірної клітковини, м¢язів, кісток, суглобів, тощо (стан, що потребує екстреної медичної допомоги). 5.4.9.Травми: • Переломи кісток черепа. Переломи хребта та кісток тулуба; • Переломи кісток верхньої та нижньої кінцівки. • Ураження суглобів та м¢язів. Внутрішньочерепні травми. • Травми внутрішніх органів. Ураження голови, шиї і тулуба. • Ураження верхньої та нижньої кінцівки. • Ураження кровоносних судин (стан, що потребує невідкладної медичної допомоги); • Опіки, відмороження ІІ-ІІІ ст. Теплові, сонячні удари (стани що потребують екстреної допомоги). • Отруєння різної етіології (за винятком алкогольного та наркотичного). 5.4.10. Симптоми, ознаки та неточно зазначені стани: ● Кома. Ступор. Судоми. Шок будь-якої етіології. Асфіксія. Масивна кровотеча. 5.5. Ліміти зобов’язань Страховика щодо страхової виплати, зазначені у п. 2 Частини 1 Договору, в межах страхової суми з відповідного виду страхування. 5.5.1. Нещасний випадок – випадкова, раптова, короткочасна, непередбачувана, не спричинена навмисно та незалежна від волі Застрахованої особи подія, що сталась протягом строку дії Договору внаслідок впливу зовнішніх чинників, зазначених у п. 2.9 частини 1 Договору, та незалежно від будь-яких інших обставин і призвела до травматичного ушкодження чи іншого розладу здоров’я Страхувальника | 5.4.5. Respiratory diseases: • Acute obstruction of the upper airway (except as a result of suicide attempts) • Acute inflammatory processes of the respiratory system (condition that requires emergency medical care). • Bronchial asthma (asthmatic status). Pneumothorax. 5.4.6. Digestive system diseases and lesions: • Peritonitis. Gastric and intestine perforations. • Acute appendicitis, diverticulitis. A pinched hernia. • Acute intestinal obstruction. • Acute cholecystitis. Acute pancreatitis (pancreatic necrosis). • Gastrointestinal bleeding. Thrombosis of mesenteric vessels. • Abscesses of the abdominal cavity. Acute liver failure. 5.4.7. Genitourinary system diseases: • Acute inflammatory processes of the genitourinary system (condition that requires emergency medical care). • Acute renal failure. Resistant renal colic. Acute urinary retention. • Acute obstetric and gynecological pathology: • Acute inflammation of the female genitourinary system (condition that requires emergency medical care). • Massive bleeding from the genital tract. • Other obstetric and gynecological pathology that requires immediate surgery or operations. 5.4.8. Diseases of the skin, subcutaneous tissue, muscles, bones, and joints: • Acute inflammatory processes of the skin, subcutaneous tissue, muscles, bones, joints, etc. (condition that requires emergency medical care). 5.4.9. Injuries: • Fractures of the skull bones. Fractures of the spine and bones of the trunk; • Fractures of the bones of the upper and lower extremities. • Lesion of joints and muscles. Intracranial injuries. • Injuries to internal organs. Lesion of the head, neck and trunk. • Lesion of the upper and lower extremities. • Lesion of the blood vessels (condition that requires emergency medical care); • Xxxxx, II-III degree frostbite. Heat, sun strokes (condition that requires emergency medical care). • Poisoning of various etiologies (except for alcohol and drugs). 5.4.10. Symptoms, signs and ill-defined conditions: ● Coma. Stupefaction. Convulsions. Shock of any etiology. Asphyxia. Major bleeding. 5.5. The limits of the Insurer's liabilities for insurance payment, specified in cl. 2 of Part 1 of the Contract, are within the sum insured for the relevant type of insurance. 5.5.1. Accident is an accidental, sudden, short-term, unpredictable, unintentionally caused and beyond the will of the Insured person event that occurred during the term of the Contract due to external factors specified in cl. 2.9 of Part 1 of the Contract, and regardless of any other circumstances and resulted in traumatic injury or other health disorder of the Policy Holder. |
6. ПЕРЕЛІК СТРАХОВИХ ВИПАДКІВ 6.1. Страховим випадком з добровільного медичного страхування є факт звернення Страхувальника: 6.1.1. Xxxxxxxxxxx, у зв’язку з: 6.1.1.1. Гострим захворюванням, загостренням хронічного захворювання, травмою, отруєнням, іншим розладом здоров’я, для надання невідкладної медичної допомоги за програмою «Амбулаторно-поліклінічне лікування» (згідно з пунктом 2.4 частини 1 Договору); 6.1.1.2. Гострим захворюванням, загостренням хронічного захворювання, травмою, отруєнням, іншим розладом здоров’я, для виклику екстреної або невідкладної медичної допомоги за програмою «Швидка медична допомога» при станах та захворюваннях, що загрожують життю та здоров’ю Страхувальника (згідно з пунктом 2.5 частини 1 Договору); 6.1.1.3. Травмою, опіком, обмороженням, укусом кліща, інших комах, тварин для отримання необхідної медичної допомоги в умовах чергового травмпункту за програмою «Амбулаторно- поліклінічне лікування» - послуги травмпункту (згідно з пунктом 2.6 частини 1 Договору); 6.1.1.4. Невідкладне лікування захворювань стоматологічного профілю за програмою «Стоматологія» (згідно з пунктом 2.7 частини 1 Договору); «Стаціонарне лікування», «Швидка медична допомога» (згідно з пунктом 2.4, 2.5, 2.8 частини 1 Договору); 6.1.1.6. Необхідністю отримання діагностичної та (або) лікувальної допомоги при розладі здоров’я (стану) Страхувальника, із переліку, зазначеного у п. 5.3 Договору, що потребує надання медичних послуг за програмою «Стаціонарне лікування» (згідно з пунктом 2.8 частини 1 Договору); 6.1.2. За отриманням консультативної та іншої допомоги, пов'язаної з наданням медико-санітарної допомоги (згідно з пунктами 2.1-2.3 частини 1 Договору), а саме з метою: 6.1.2.1. Консультування з екстрених медичних питань (зокрема травми, температура, отруєння, погане самопочуття, укуси кліщів, інших комах, тварин, невідомі симптоми), консультування з питань першої долікарської допомоги; 6.1.2.2. Отримання інформації про лікувальні заклади України, зокрема: їх профіль, спеціалісти, адреса, контактний телефон, режим роботи, орієнтовна вартість послуги (за інформацією медичного закладу); 6.1.2.3. Пошуку необхідного профільного медичного закладу та спеціаліста на території України; та запису на консультацію до лікаря в необхідному медичному закладі. 6.2. Подія, зазначена в п. 6.1.1.5 Договору, визнається страховими випадками, з урахуванням інших умов Договору, якщо: 6.2.1. Наявне лабораторне підтвердження інфікування вірусом COVID 19 Страхувальника, що мало місце та вперше виявлено (вперше встановлено діагноз захворювання) під час строку дії та у місці дії Договору; 6.2.2. Отримання медичних послуг Застрахованою особою в результаті хвороби (захворювання) на COVID-19 підтверджене документами компетентних органів (медичних установ, тощо). 6.3. Страховим випадком з добровільного страхування від нещасних випадків є травматичне ушкодження чи інший розлад здоров’я Застрахованої особи, передбачені Таблицею страхових виплат внаслідок нещасного випадку, що є додатком до Договору. 6.4. Події, зазначені в п. 6.1 і 6.3 Договору, визнаються | connection with: 6.1.1.1. Immediate treatment of dental diseases under the program “Dentistry” (in accordance with cl. 2.7 of Part 1 of the Contract); 6.1.1.5. Health disorder caused by coming down of the Policy Holder with COVID-19, for diagnostic assistance in order to detect infecting the Policy Holder with COVID-19, and (or) medical care that requires medical services under the programs “Outpatient treatment”, “Inpatient treatment”, “Ambulance” (according to cl. 2.4, 2.5, 2.8 of Part 1 of the Contract); 6.1.1.6. The need to receive diagnostic and (or) medical care for the health (condition) of the Policy Holder from the list specified in cl. 5.3 of the Contract, which requires the provision of medical services under the program “Inpatient treatment” (according to cl. 2.8 of Part 1 of the Contract); 6.1.2. For advisory and other assistance related to the provision of health care (in accordance with cl. 2.1-2.3 of Part 1 of the Contract), namely to: 6.1.2.1. Consult on emergency medical issues (including injuries, fever, poisoning, malaise, bites of tick, other insects, animals, unknown symptoms), consult on pre-hospital first aid; 6.1.2.2. Receive information about the medical institutions of Ukraine, in particular: their specialization, specialists, address, contact phone number, hours of operation, approximate cost of the service (according to the medical institution information); 6.1.2.3. Search for the necessary specialized medical institution and xxxxxxxxxx on the territory of Ukraine; and an appointment for a doctor's consultation at the required health care facility. 6.2. The event specified in cl. 6.1.1.5 of the Contract shall be recognized as insured event, taking into account other conditions of the Contract, if: 6.2.1. There is a laboratory confirmation of infecting the Policy Holder with COVID-19 virus, which took place and was first detected (first diagnosed) during the term and in the location of the Contract; 6.2.2. Receipt of medical services by the Insured Person as a result of illness (disease) with COVID-19 is confirmed by documents of competent authorities (medical institutions, etc.). 6.3. The insured event of voluntary accident insurance shall be a traumatic injury or other health disorder of the Insured Person, as provided for by the Table of insurance benefits due to an accident, which is an Annex to the Contract. 5.4. The events specified in cl. 6.1 and 6.3 of the Contract shall be |

7. ПРАВА ТА ОБОВ'ЯЗКИ СТОРІН І ВІДПОВІДАЛЬНІСТЬ ЗА НЕВИКОНАННЯ АБО НЕНАЛЕЖНЕ ВИКОНАННЯ УМОВ ДОГОВОРУ 7.1. Страхувальник має право: 7.1.1.Ознайомитись з Правилами та умовами страхування. 7.1.2.Отримати дублікат Договору у випадку втрати оригіналу. 7.1.3.Ініціювати внесення змін та (або) доповнень до умов Договору, під час дії Договору страхування, дострокове припинення дії Договору страхування у порядку, визначеному Договором. 7.1.4.Інші права передбачені Правилами та законодавством України. 7.1.5.Отримати страхову виплату у разі настання страхового випадку відповідно до умов Договору. 7.1.6. Інші права передбачені Правилами та законодавством України. 7.2. Страхувальник зобов’язаний: 7.2.1.Своєчасно сплатити страховий платіж у розмірі, та в порядку визначеному Договором. 7.2.2.При укладанні Договору надати Страховику достовірну інформацію про всі відомі йому обставини, що мають істотне значення для оцінки ступеня страхового ризику, і надалі у письмовій формі інформувати його про будь-яку зміну ступеня ризику протягом 5 робочих днів з дня такої зміни. 7.2.3.Не передавати Договір іншим особам, які не застраховані за цим Договором, для отримання останніми медичних послуг. У разі його втрати невідкладно надати Страховику письмову заяву про втрату для отримання дублікату Договору. 7.2.4.При укладанні Договору повідомити Страховика про інші діючі договори страхування щодо предмету Договору. 7.2.5.Не розголошувати третім особам будь-яку інформацію, що стосується обставин цього Договору, якщо тільки це не відповідає вимогам законодавства України; 7.2.6.Достовірно інформувати медичний заклад, Страховика (Асистанс) про стан свого здоров’я та існуючі ризики щодо його погіршення та інші обставини, що впливають на зміну ступеню ризику. 7.2.7.У разі настання події, що може бути визнана страховим випадком, діяти відповідно до п. 8 Договору та Правил. 7.2.8.Надати Страховику всю інформацію і докази, які Страховик вимагатиме стосовно причин, обставин, наслідків події, що може бути визнана страховим випадком. Усі медичні документи та результати досліджень, а також інші записи, які можуть мати відношення до предмету цього Договору, мають бути доступні для перевірки Страховиком в будь-який час; 7.2.9.Для прийняття рішення про виплату або відмову у страховій виплаті надати Страховику всі необхідні документи, в порядку та на умовах, визначених Договором, Правилами, а також на вимогу Страховика інші (додаткові) документи для встановлення факту, причин, обставин настання події, що має ознаки страхового випадку. 7.2.10. Виконувати інші обов’язки передбачені Договором, Правилами та законодавством України. 7.3. Страховик має право: | 7. RIGHTS AND OBLIGATIONS OF THE PARTIES AND RESPONSIBILITY FOR FAILURE TO FULFILL OR IMPROPER FULFILLMENT OF THE CONTRACT 7.1.The Policy Holder shall have the right: 0.0.0.Xx get acquainted with the Terms and Conditions of Insurance. 0.0.0.Xx get a duplicate of the Contract in case of loss of the original. 0.0.0.Xx initiate amendments and (or) additions to the terms of the Contract during the validity of the Insurance Contract, early termination of the Insurance Contract in the manner prescribed by the Contract. 7.1.4.Other rights provided for by the Rules and legislation of Ukraine. 0.0.0.Xx receive an insurance benefit in case of insured event in accordance with the terms of the Contract. 7.1.6.Other rights provided for by the Rules and legislation of Ukraine. 7.2. The Policy Holder shall: 7.2.1. Pay the insurance premium in proper time and in the amount and in the manner prescribed by the Contract. 7.2.2. When concluding the Contract, the Policy Holder shall provide the Insurer with reliable information on all circumstances known to him/her that are essential for assessing the degree of insurance risk, and then inform in writing of any change in the degree of risk within 5 business days from the date of such change. 7.2.3. Not transfer the Contract to other persons who are not insured hereunder, for receipt of the medical services by the latter. In case of its loss, the Policy Holder shall immediately notify the Insurer of the loss in order to obtain a duplicate of the Contract. 7.2.4. When concluding the Contract, the Policy Holder shall inform the Insurer about other valid insurance contracts regarding the subject of the Contract. 7.2.5. Not to disclose to third parties any information relating to the circumstances of this Contract, unless it meets the requirements of the legislation of Ukraine. 7.2.6. Reliably inform the medical institution, the Insurer (Assistance) about the state of health and the existing risks of its deterioration and other circumstances that affect the change in the degree of risk. 7.2.7. Act in accordance with cl. 8 of the Contract and the Rules in case of an event that can be recognized as an insured event. 7.2.8. Provide the Insurer with all information and evidence that the Insurer will require regarding the causes, circumstances, consequences of an event that may be recognized as an insured event. All medical documents and test results, as well as other records that may be relevant to the subject of this Contract, must be available for inspection by the Insurer at any time; 7.2.9. To make a decision on payment or refusal of payment of the insurance benefit, the Policy Holder shall provide the Insurer with all necessary documents, in the manner and under the conditions specified in the Contract, Rules, as well as other (additional) documents at the request of the Insurer to establish the fact, causes, circumstances of the event with signs of insured event. 7.2.10. Fulfill other obligations provided for by the Contract, Rules and legislation of Ukraine. 7.3. The Insurer shall have the right: |
7.3.1.Перевіряти надану Страхувальником інформацію та вимагати від Страхувальника повного розкриття всіх фактів, які стосуються предмету Договору, отримати від Страхувальника всю інформацію та документи (у разі необхідності) для укладання Договору та оцінки ступеня страхового ризику. 7.3.2.Відмовити у страховій виплаті повністю або частково, на умовах, передбачених Договором та/або Правилами та/або законодавством. 7.4. Страховик зобов’язаний: 7.4.1.Ознайомити Страхувальника з Правилами та умовами страхування. 7.4.2.Протягом 2-х (двох) робочих днів, як тільки стане відомо про настання страхового випадку, вжити заходів щодо оформлення всіх необхідних документів для своєчасного здійснення страхової виплати. 7.4.3.При настанні страхового випадку та за наявності законних підстав здійснити страхову виплату у передбачений Договором строк. 7.4.4.Не розголошувати відомостей про Xxxxxxxxxxxxxx та його майнове становище, крім випадків, встановлених законом. 7.4.5.Страховик несе майнову відповідальність за несвоєчасне здійснення страхової виплати шляхом сплати Страхувальнику пені в розмірі 0,01% від простроченої суми за кожен день простроченн | 7.3.1. Acquaint the Policy Holder with the Terms and conditions of insurance. 7.4.2. Within 2 (two) business days, as soon as it becomes known about the occurrence of the insured event, the Insurer shall take measures to prepare all the necessary documents for timely payment of the insurance benefit. 7.4.3. In case of occurrence of the insured event and subject to available legal grounds, the Insurer shall pay an insurance benefit within the period prescribed by the Contract. 7.4.4. Not disclose information about the Policy Holder and his/her property status, except as provided by law. 7.5. The Insurer shall be financially liable for late payment of the insurance benefit by paying the Policy Holder a penalty in the amount of 0.01% of the overdue amount for each day of delay. |
8. ДІЇ СТРАХУВАЛЬНИКА ПРИ НАСТАННІ СТРАХОВОГО ВИПАДКУ 8.1. У разі настання події, що може бути визнана страховим випадком Страхувальник зобов'язаний: 8.1.1. З добровільного медичного страхування згідно з п. 6.1.1 Договору, - повідомити Xxxxxxxxxx (Асистанс) про самостійне звернення до медичного закладу та отримання діагностичної чи лікувальної допомоги негайно, як тільки це стане можливим, але не пізніше, ніж протягом 24 годин з моменту її отримання. Таке повідомлення може бути передане за телефоном в робочі дні з 9.00 до 18.00 - x000 000 00 00; в інший час - x000 000 000 000 будь-якою особою, що діятиме від імені Xxxxxxxxxxxxxx: її родичами, працівниками медичного закладу тощо. Страхувальник зобов’язаний звернутися до Страховика (Xxxxxxxx), повідомити лікарю-координатору Xxxxxxxxxx (Xxxxxxxx) своє прізвище, ім’я та по батькові, номер Договору, причину звернення (скарги), контактний телефон. Якщо Страхувальник не мав змоги, у зв’язку із станом здоров’я (непритомний стан, знаходження у відділенні інтенсивної терапії, відсутність поряд осіб, які мають змогу це зробити від імені Xxxxxxxxxxxxxx), повідомити Страховика у визначені цим пунктом строки про настання події, вона повинна підтвердити це документально; 8.1.2. У разі настання, що може бути визнана страховим випадком з добровільного страхування від нещасних випадків: 8.1.2.1. Письмово (за формою, встановленою Страховиком) повідомити Страховика про подію, яку може бути визнано страховим випадком протягом 2 (двох) робочих днів з моменту її настання; 8.1.2.2. Перевищення зазначеного строку щодо повідомлення Страховика про настання події яку, може бути визнано страховим випадком, є припустимим у випадку, коли Xxxxxxxxxxxxx не мав фізичної можливості вчасно направити це повідомлення, зокрема, внаслідок завдання шкоди здоров'ю під час настання страхової події, що має бути підтверджено відповідним документом закладу охорони здоров’я; | 8. ACTIONS OF THE INSURER IN CASE OF INSURED EVENT 8.1. In case of event that may be recognized as an insured event, the Policy Holder shall: 8.1.1. For voluntary medical insurance in accordance with cl. 6.1.1 of the Contract, - notify the Insurer (Assistance) about individual application to the medical institution and receipt of diagnostic or medical care immediately as soon as possible, but not later than within 24 hours from the moment of its receipt. Such a notice can be sent by phone on working days from 9.00 am to 18.00 pm - x000 000 00 00; at other time - x000 000 000 000 by any person acting on behalf of the Policy Holder: his/her relatives, employees of the medical institution, etc. The Policy Holder shall apply to the Insurer (Assistance), inform the coordinating doctor of the Insurer (Assistance) of his/her surname, name and patronymic, Contract number, reason for application (complaint), contact telephone number. If the Policy Xxxxxx was unable, due to health condition (unconsciousness, stay in the intensive care unit, absence of persons who can do it on behalf of the Policy Holder), to notify the Insurer about the event within the period specified in this clause, he/she must give documentary evidence; 8.1.2. In case of event that may be recognized as an insured event of voluntary accident insurance: 8.1.2.1. The Policy Holder shall inform the Insurer about the event which can be recognized as an insured event, in writing (in the form prescribed by the Insurer) within 2 (two) working days from the moment of its occurrence; 8.1.2.2. Exceeding the specified period for notification of the Insurer about the occurrence of an event which can be considered an insured event, is permissible if the Policy Holder was physically unable to send such notice in proper time, in particular, due to damage to health during the insured event, which must be confirmed by the relevant document of the health care institution; |
8.1.3. Повідомити (надати) Страховику всю інформацію, що має відношення до події, що може бути визнана страховим випадком, та документи, передбачені пунктом 9.5 Договору; вжити заходів для збору і передавання Страховикові всіх необхідних документів для визначення розміру заподіяної шкоди та прийняття рішення про здійснення страхової виплати або відмову здійснити страхову виплату; 8.1.4. Попередити працівників медичної установи (лікаря) про факт страхування, та можливість звернення Страховика із запитами для отримання додаткової інформації необхідної для з’ясування обставин та причин настання страхового випадку та надати письмовий дозвіл Застрахованої особи на надання такої інформації Страховикові. 8.1.5. Надати можливість Xxxxxxxxxxxx або його представникові здійснити огляд Застрахованої особи, якій завдано шкоду внаслідок настання страхового випадку, для оформлення необхідних документів про заподіяння шкоди. 8.2. У разі настання події, що може бути визнана страховим випадком з добровільного медичного страхування, а саме необхідності отримання консультативної допомоги, пов'язаної з наданням медико-санітарної допомоги, Страхувальник зобов’язаний звернутись за телефоном, передбаченим у п. 2 частини 1 Договору. | 8.1.3. The Policy Holder shall notify the employees of the health care institution (doctor) about the fact of insurance, and the possibility of contacting the Insurer with requests for additional information necessary to clarify the circumstances and causes of the insured event, and provide written permission of the Insured Person to provide such information to the Insurer. 8.1.5. The Policy Holder shall enable the Insurer or its representative to inspect the Insured Person who has suffered damage as a result of the insured event, in order to draw up the necessary documents on the damage. 8.2. In case of an event that can be recognized as an insured event of voluntary health insurance, namely the need to obtain advice related to the provision of health care, the Policy Holder shall make a call by the telephone number provided for in cl. 2 of Part 1 of the Contract. |
9. ПОРЯДОК ТА УМОВИ ЗДІЙСНЕННЯ СТРАХОВОЇ ВИПЛАТИ 9.1. У разі настання страхового випадку за добровільним медичним страхуванням згідно з п. 6.1.1 Договору, страхова виплата здійснюється Страховиком в межах страхової суми та лімітів зобов’язань Страховика, передбачених у розділах 1 і 2 Частини 1 Договору, та з урахуванням інших умов Договору, в розмірі вартості послуг отриманих Страхувальником медичних послуг: 9.1.1. Через Асистанс, медичним закладам, юридичним особам, фізичним особам – підприємцям, що надали медичні послуги Страхувальнику; 9.2. У разі настання страхового випадку за добровільним страхуванням від нещасних випадків, страхова виплата здійснюється Страховиком Страхувальнику в розмірі частки страхової суми, зазначеної у розділі 1 Частини 1 Договору з добровільного страхування від нещасних випадків, згідно з Таблицею страхових виплат для конкретної травми, що є додатком до Договору, на підставі наступних документів. 9.3. У разі настання страхового випадку за добровільним медичним страхуванням, а саме отримання консультативної допомоги, страхова виплата здійснюється Страховиком в межах страхової суми, передбаченої у розділі 1 Частини 1 Договору з добровільного медичного страхування, у розмірі вартості послуг, наданих Xxxxxxxxxx Xxxxxxxxxx, шляхом оплати їх вартості Асистансу. 9.4. Загальний розмір суми здійснених страхових виплат при настанні страхових випадків протягом строку дії Договору за кожним видом страхування не може перевищувати страхову суму та ліміти зобов’язань Страховика, встановлені за відповідним видом страхування (програмою страхування). 9.5. Страхова виплата згідно з пунктами 9.1.2 і 9.2 Договору здійснюється на підставі наступних документів: 9.5.1.1. Заяви на отримання страхової виплати (за формою, | 9. PROCEDURE AND CONDITIONS OF INSURANCE BENEFIT PAYMENT 9.1. In case of insured event under voluntary medical insurance according to the cl. 6.1.1 of the Contract, the insurance benefit shall be paid by the Insurer to the extent of the insurance amount provided for in Sections 1 and 2 of Part 1 of the Contract and subject to other terms of the Contract, in the amount of the cost of medical services received by the Policy Holder: 9.1.1.Through the Assistance – to the medical institutions, legal entities and individual entrepreneurs, which rendered medical services to the Policy Holder; 9.1.2. Directly to the Policy Holder, who paid for the received medical services on his/her own. In this case, the insurance benefit shall be paid on the basis of the documents stipulated by cl. 8.5 of the Contract. 9.2. In case of an insured event under voluntary accident insurance, the insurance benefit shall be paid by the Insurer to the Policy Holder in the amount of the share of sum insured as specified in Section 1 of Part 1 of the Voluntary Accident Insurance Contract, according to the Table of insurance benefits for a specific injury, which is an annex to the Contract, based on the following documents. 9.3. In case of an insured event under voluntary accident insurance, namely receipt of advices, the insurance benefit shall be paid by the Insurer to the extent of the insurance amount provided for in Section 1 of Part 1 of the Voluntary Medical Insurance Contract, in the amount of services provided by the Insurer's Assistance, by their payment to the Assistance. 9.4. The total amount of insurance benefits paid in case of insured events during the term of the Contract for each type of insurance may not exceed the sum insured and the limits of the Insurer's obligations set for the relevant type of insurance (insurance program). 9.5. In accordance with cl. 9.1.2 and 9.2 of the Contract, the insurance benefit shall be paid on the basis of the following documents: 9.5.1.1. встановленою Страховиком); 9.5.1.2. Копії Договору; 9.5.1.3. Копії паспорта особи, що отримує страхову виплату; 9.5.1.4. Довідки РНОКПП одержувача страхової виплати; 9.5.1.5. У разі настання страхового випадку за добровільним медичним страхуванням: 9.5.1.5.1. Рахунків медичних закладів з докладним розшифруванням кошторису наданих медичних послуг; 9.5.1.5.2. Виписки з карти амбулаторного або стаціонарного хворого з обов’язковим зазначенням X.X.X. Страхувальника, дати звернення за допомогою до медичного закладу, дати надання медичних послуг, тривалості лікування, анамнезу (історії виникнення) захворювання, діагнозу, обсягу медичних послуг; 9.5.1.5.3. Рецептів або інших медичних документів, що підтверджують призначення медичних препаратів; 9.5.1.5.5. Копії лабораторного підтвердження інфікування Застрахованої особи вірусом COVID 19, у разі настання події, передбаченої пункті 6.1.1.5 Договору; 9.5.1.6. У разі настання страхового випадку за добровільним страхуванням від нещасних випадків: 9.5.1.6.1. Акту про нещасний випадок, якщо він був складений; 9.5.1.6.2. Документу відповідного компетентного державного органу (МВС тощо) про факт та обставини настання нещасного випадку, якщо представника зазначеного компетентного органу було викликано на місце події; 9.5.1.6.3. Виписки з карти амбулаторного або стаціонарного хворого, підписану відповідальною особою та завіреної печаткою медичного закладу або довідки лікувально- профілактичного закладу встановленої форми, в якій повинні бути зазначені місце та час настання нещасного випадку, дата та час звернення до медичного закладу, діагноз і характер травми, опис події, що призвела до настання нещасного випадку; 9.5.1.6.4. Висновку про наявність алкогольного, токсичного або наркотичного сп’яніння у Страхувальника в момент страхового випадку (якщо Страхувальника було направлено на таке освідчення працівниками відповідного органу МВС або іншого компетентного державного органу); 9.5.1.6.5. Копії постанови (рішення) суду, якщо внаслідок настання страхового випадку відкрите провадження у справі в судовому порядку; 9.5.1.6.6. У всіх випадках, коли в розслідуванні обставин, що спричинили завдання збитку, брали участь органи МВС, прокуратури й інші правоохоронні органи: витягу з Єдиного реєстру досудових розслідувань, документ про закриття кримінального провадження чи зупинення досудового розслідування або рішення (вирок) суду у разі їх наявності; 9.5.1.7. Інших документів на письмовий запит Xxxxxxxxxx. 9.6. Враховуючи особливості конкретного страхового випадку, за письмовою згодою Страховика може бути зменшено перелік документів, що підтверджують настання страхового випадку. 9.7. Страхові здійснюються в межах страхової суми за Договором з урахуванням раніше здійснених страхових виплат. 9.8. Страховик приймає до розгляду тільки оригінали документів, зазначених в п. 9.5.1.5.1 - 9.5.1.5.4 Договору, або належним чином завірені їх копії. | by the Insurer); 9.5.1.2. Prescriptions or other medical documents confirming the appointment of drugs; 9.5.1.5.4. Receipts for tax purposes and relevant sales receipts from medical and pharmacy institutions with a detailed itemization of the costs of rendered medical services and medicines 9.5.1.5.5. Copies of laboratory confirmation of infection of the Insured person with COVID-19 virus, in case of event provided for in cl. 6.1.1.5 of the Contract; 9.5.1.6. In case of an insured event under voluntary accident insurance: 9.5.1.6.1. Accident report, if it was drawn up; 9.5.1.6.2. A document of the relevant competent public body (MIA, etc.) as to the fact and circumstances of the accident, if a representative of the mentioned competent body was called to the scene; 9.5.1.6.3. Extracts from the outpatient's card or hospital record, signed by the responsible person and certified by the seal of the medical institution, or certificate of treatment and prevention institution in the prescribed form, which must specify the place and time of the accident, date and time of application for medical institution, diagnosis and nature of injury, a description of the event that resulted in the accident; 9.5.1.6.4. Conclusion on the alcohol, toxic or drug intoxication of the Policy Holder at the moment of the insured event (if the Policy Holder is referred for such certification by employees of the relevant body of the Ministry of Internal Affairs or another competent public body); 9.5.1.6.5. Copy of the court decision (decree), if as a result of the insured event the proceedings in the case are initiated in court; 9.5.1.6.6. In all cases where the investigation of the circumstances that caused the damage was carried out by the Ministry of Internal Affairs, the Prosecutor's Office and other law enforcement agencies: an extract from the Unified Register of Pre-trial Investigations, a document on termination of the criminal proceedings or suspension of the pre-trial investigation or court decision (sentence), if any; 9.5.1.7. Other documents at the written request of the Insurer. 9.6. Taking into account the specifics of a particular insured event, with the written consent of the Insurer, the list of documents confirming the occurrence of the insured event may be reduced. 9.7. Insurance benefits shall be paid to the extent of the sum insured under the Contract, taking into account previously paid insurance benefits. 9.8. The Insurer shall accept for consideration only the originals of the documents specified in cl. 9.5.1.5.1 - 9.5.1.5.4 of the Contract, |
9.9. Строк прийняття Страховиком рішення про здійснення або відмову у страховій виплаті: 9.9.1.Рішення про здійснення страхової виплати або про відмову у страховій виплаті приймається Страховиком протягом 15 (п’ятнадцяти) робочих днів з моменту отримання всіх необхідних документів. 9.9.2.Рішення про відмову у здійсненні страхової виплати письмово повідомляється Страхувальнику з обґрунтуванням причин відмови протягом 15 (п’ятнадцяти) робочих днів з дня прийняття такого рішення. 9.10. Страхова виплата здійснюється протягом 15 (п’ятнадцяти) робочих днів з дня прийняття Страховиком рішення про таку виплату. 10. ПРИЧИНИ ВІДМОВИ У СТРАХОВІЙ ВИПЛАТІ 10.1. Підставою для відмови Страховика у здійсненні страхових виплат є: 10.1.1. Навмисні дії Страхувальника, спрямовані на настання страхового випадку. Зазначена норма не поширюється на дії, пов'язані з виконанням ними громадянського чи службового обов'язку, в стані необхідної оборони (без перевищення її меж) або захисту майна, життя, здоров'я, честі, гідності та ділової репутації. Кваліфікація дій Страхувальника встановлюється відповідно до чинного законодавства України; 10.1.2. Вчинення Страхувальником умисного злочину, що призвів до страхового випадку; 10.1.3. Подання Страхувальником свідомо неправдивих відомостей про предмет Договору або про факт, причини, обставини, характер події, що має ознаки страхового випадку; 10.1.4. Несвоєчасне повідомлення Страхувальником про настання страхового випадку без поважних на це причин або створення Страховикові перешкод у визначенні обставин, причин, характеру та наслідків страхового випадку. 10.1.5. Невиконання чи неналежне виконання Страхувальником, обов’язків згідно з умовами Договору, Правилами, а також невиконання чи неналежне виконання умов Договору, Правил, вимог законодавства; 10.1.6. Отримання медичної допомоги, не передбаченої умовами Договору; 10.1.7. Випадки, передбачені у розділі 11 Договору; 10.1.8. Інші випадки, передбачені законом. | 10. REASONS FOR REFUSAL OF INSURANCE BENEFIT 10.1. The ground for the Insurer's refusal to pay insurance benefit shall be: 10.1.1. Deliberate actions of the Policy Holder aimed at the occurrence of the insured event. This provision shall not apply to the actions related to the fulfillment of their civil or official duties, in case of necessary defense (without exceeding its limits) or protection of property, life, health, honor, dignity and business reputation. The qualification of actions of the Policy Holder shall be established in accordance with the current legislation of Ukraine; 10.1.2. Commitment of an intentional crime resulted in occurrence of the insured event; 10.1.3. Submission of knowingly false information about the subject of the Contract or about the fact, reasons, circumstances, nature of the event that has the characteristics of an insured event by the Policy Holder; 10.1.4. Untimely notification by the Policy Holder about the occurrence of the insured event without valid reasons or creation of obstacles to the Insurer in determining the circumstances, causes, nature and consequences of the insured event. 10.1.5. Failure to fulfill or improper fulfillment of the obligations under the terms of the Contract, the Rules, as well as failure to fulfill or improper fulfillment of the terms of the Contract, the Rules, the requirements of the legislation by the Policy Holder; 10.1.6. Receipt of medical care not stipulated by the terms of the Contract; 10.1.7. The cases provided for in Section 11 of the Contract; 10.1.8. Other cases provided for by the law. |
11. ВИКЛЮЧЕННЯ ТА ОБМЕЖЕННЯ СТРАХУВАННЯ 11.1. За цим Договором не можуть бути застрахованими особи, які на дату укладення Договору є: недієздатними за станом здоров’я, ВІЛ-інфікованими та хворими на СНІД, вік яких на дату укладання становить до 18 років чи старше 35 років. 11.2. Xxxxxxxxx не відшкодовує з добровільного медичного страхування: 11.2.1. Вартість медичних послуг на діагностику інфікування Страхувальника COVID-19, якщо за результатами діагностики у Страхувальника COVID-19 не виявлено. 11.2.2. Вартість медичних послуг, що не передбачені цим Договором та(або) отримані поза межами місця дії Договору. 11.2.3. Витрати на лікування СНІД та ВІЛ-інфекції; наркоманії, токсикоманії, алкоголізму в т.ч. станів, захворювань, травм, опіків та отруєнь, отриманих внаслідок цих станів. 11.2.4. Витрати на лікування захворювань, за якими встановлена група інвалідності (1,2,3), інвалідності з дитинства та їх ускладнення; вроджені аномалії та вади розвитку. 11.2.5. Витрати на лікування станів та захворювань, які | 11. EXCLUSION AND LIMITATION OF INSURANCE 11.1. The cost of medical services not provided for in this Contract and (or) received outside the scope of the Agreement. 11.2.3. Expenses for treatment of AIDS and HIV; drug addiction, substance abuse, alcoholism, including conditions, diseases, injuries, xxxxx and poisoningsresulting from these conditions. 11.2.4. Expenses for treatment of diseases for which the group of disability (1,2, or 3) is established, disability from childhood and their complications; congenital anomalies and malformations. 11.2.5. Expenses for treatment of conditions and diseases that are |
викликані свідомим спричиненням собі шкоди (в тому числі спроби самогубства), або пов’язані з відмовою від лікування, недотриманням призначень медичного персоналу або лікувального режиму, самолікуванням. 11.2.6. Витрати на благодійні внески, лікування в умовах планового стаціонару, планове лікування в умовах поліклініки, медичні маніпуляції на дому, крім невідкладної (екстреної) медичної допомоги. 11.3. Не визнається страховим випадком подія, що сталась внаслідок інфікування Страхувальника COVID-19, що було діагностовано до початку строку дії Договору страхування. 11.4. До страхових випадків з добровільного страхування від нещасних випадків не відносяться та виплати не здійснюються, якщо страховий випадок стався внаслідок: 11.4.1. Керування Страхувальником будь-яким транспортним засобом: 11.4.1.1. На керування яким Страхувальник не мав права, або за відсутності у Страхувальника посвідчення водія на право керування транспортним засобом відповідної категорії; 11.4.1.2. У стані алкогольного, наркотичного або токсичного сп’яніння чи під впливом медикаментів, під час вживання яких заборонено керування транспортним засобом; 11.4.2. Подій, що сталися в результаті психічного розладу або втрати свідомості Страхувальника внаслідок обставин, які викликані сп’янінням, крововиливом в мозок, епілептичним припадком або іншими конвульсіями, що охоплюють все тіло Страхувальника; 11.4.3. Отруєння, порушення свідомості або погіршення психічного сприйняття Страхувальника під дією алкоголю, наркотичних речовин, токсичних препаратів, або іншими речовинами, які вживалися з метою сп’яніння, виключаючи випадки, коли вживання Страхувальником такої речовини сталося в результаті протиправних дій третіх осіб; 11.4.4. Навмисного заподіяння Страхувальником собі тілесних ушкоджень, самогубства, замаху на самогубство або їхніх наслідків за виключенням випадків, коли вона була доведена до такого стану протиправними діями третіх осіб. При цьому, зазначені дії Застрахованої особи визнаються такими тільки на підставі рішення компетентних органів, що доводять вчинене; 11.4.5. Професійного або непрофесійного заняття спортом Застрахованою особою, участі в будь-яких спортивних змаганнях або тренування (підготовленні) до таких змагань тощо; 11.5. Не визнаються страховими випадками та страхова виплата не здійснюється за подіями, що прямо або опосередковано пов’язані настали під час або є наслідком: 11.5.1. Будь-яких військових дій, а також маневрів або інших військових заходів; 11.5.2. Вторгнення, дій іноземних держав (при оголошенні війни або без оголошення війни), воєнних/збройних конфліктів, дії незаконних збройних формувань, повалення/захоплення влади або спроби таких дій, мародерства, агресії іншої держави або заходів щодо її подолання, вторгнення військ іншої держави або несанкціонованого перетину кордону військами іншої держави, або будь-яких інших дій за політичними, економічними, соціальними мотивами; 11.5.3. Дії знарядь війни, зброї; 11.5.4. Громадянської війни, громадських заворушень, терористичних актів, терористичної або антитерористичної діяльності, вуличних заворушень усякого роду, масових заворушень або страйків, заколотів, локаутів, повстань, революцій, узурпації влади, цивільних безладь, військового, воєнного або надзвичайного стану; | caused by deliberate self-harm (including suicide attempts), or those associated with the refusal of treatment, non-compliance with the prescriptions of medical staff or treatment regimen, self- treatment. 11.2.6. Expenses for charitable contributions, treatment in the conditions of a scheduled hospital mode, planned treatment in the conditions of a polyclinic, home-based medical manipulations, except for emergency (urgent) medical care. 11.3. An event that occurred as a result of infectioning of the Policy Holder with COVID-19, which was diagnosed before the commencement of the Insurance Contract, shall not be recognized as an insured event. 11.4. The following events are not insured events under the voluntary accident insurance and no payments are made if the insured event occurred as a result of: 11.4.1. Motor vehicle driving by the Policy Holder: 11.4.1.1. To drive which the Policy Holder did not have the right, or in the absence of the driver's license of the Policy Holder to drive a vehicle of the appropriate category; 11.4.1.2. In a state of alcohol, drug or toxic intoxication or under the influence of drugs, the use of which is prohibited when driving a vehicle; 11.4.2. Events that occurred as a result of a mental disorder or loss of consciousness of the Policy Holder due to circumstances caused by intoxication, cerebral hemorrhage, epileptic seizures or other convulsions that cover the entire body of the Policy Holder; 11.4.3. Poisoning, disturbance of consciousness or deterioration of mental perception of the Policy Holder under the affect of alcohol, drugs, toxic drugs, or other substances used for the purpose of intoxication, except when the Policy Holder’s consumption of such substance occurred as a result of illegal actions of third parties; 11.4.4. Deliberate infliction of bodily injuries, suicide, suicide attempt or their consequences by the Policy Holder, except for the cases when he/she was brought to such a state by illegal actions of third parties. In this case, mentioned actions of the Insured Person are recognized as such only on the basis of the decision of the competent authorities which proves the committed actions; 11.4.5. Professional or non-professional sports by the Policy Holder, participation in any sports competitions or training (preparation) for such competitions, etc.; 11.5. Insured events are not recognized and the insurance benefits are not paid for events that are directly or indirectly related to, occurred in the course or as a result of: 11.5.1. Any military actions, as well as maneuvers or other military measures; 11.5.2. Invasion, actions of foreign states (with or without declaration of war), military/armed conflicts, actions of illegal armed groups, overthrow/seizure of power or attempted actions, looting, aggression of another state or measures to overcome it, invasion of troops of another state or unauthorized crossing of the border by the troops of another state, or any other action for political, economic, social reasons; 11.5.3. Actions of implements of war, weapons; 11.5.4. Civil wars, civil unrests, terrorist acts, terrorist or anti- terrorist activities, street riots of all kinds, mass riots or strikes, rebellion, lockouts, uprisings, revolutions, usurpation of power, civil unrest, defense situation, military or state of emergency; |
11.5.5. Страйків, державних переворотів, актів тероризму, військової диктатури; вилучення, примусового вилучення, мобілізації, реквізиції, арешту, конфіскації, націоналізації, реквізиції та інших подібних заходів політичного характеру, які здійснені згідно з розпорядженням військової чи цивільної влади та політичних організацій в країні Страхувальника або за розпорядженням існуючого де-юре та де-факто уряду чи будь- якого органу влади або за вимогою представників військової чи цивільної влади 11.6. Дія страхового захисту не поширюється на події, що трапилися під час перебування Застрахованої особи у місцях тимчасового затримання, арешту, тримання під вартою, ув’язнення, а також під час арешту, затримання та інших оперативних слідчих дій, визначених Кримінально- процесуальним кодексом України, крім випадків, коли таке затримання, арешт, ув’язнення визнані незаконними. 11.7.Не є страховим випадком з добровільного страхування від нещасних випадків: 11.7.1. Розлад здоров’я, інший ніж передбачений таблицею страхових виплат; 11.7.2. Інвалідність, смерть Застрахованої особи внаслідок нещасного випадку; 11.7.3. Загострення хронічного захворювання, раптове захворювання, інфекційні захворювання, харчова токсикоінфекція (за винятком правцю, сказу, кліщового енцефаліту та інших хвороб, що передаються через укуси тварин і комах). 11.7.4. Не визнаються страховими випадками з добровільного страхування від нещасних випадків події, що сталися внаслідок неправильних медичних маніпуляцій (невідповідного медичного втручання та (або) процедур та (або) дій з боку медичного персоналу). | 11.5.5. The insurance protection shall not apply to events that occurred during the Policy Holder’s stay in places of temporary detention, arrest, detention, imprisonment, as well as during the arrest, detention and other operational investigative actions specified by the Criminal Procedure Code of Ukraine, except in cases when such detention, arrest, imprisonment is recognized as illegal. 11.7. The following events are not insured events under the voluntary accident insurance: 11.7.1. Health disorders other than those provided for in the insurance benefit table; 11.7.2. Disability, death of the Insured person as a result of an accident; 11.7.3. Exacerbation of chronic disease, sudden illness, infectious diseases, food poisoning (except for tetanus, rabies, tick-borne encephalitis and other diseases transmitted through animal and insect bites). 11.7.4. The events caused by improper medical manipulations (inappropriate medical intervention and (or) procedures and (or) actions by medical staff) shall not be recognized as insured events under the voluntary accident insurance. |
12. ПОРЯДОК ЗМІНИ І ПРИПИНЕННЯ ДIЇ ДОГОВОРУ 12.1. Дія Договору припиняється та Xxxxxxx втрачає чинність за згодою Xxxxxx, а також у разі: 12.1.1. Закінчення строку дії; 12.1.2. Виконання Xxxxxxxxxxx зобов’язань перед Страхувальником у повному обсязі; 12.1.3. Несплати Страхувальником страхових платежів у встановлені Договором строки; 12.1.4. Смерті Страхувальника – фізичної особи чи втрати ним дієздатності, за винятком випадків, передбачених статтями 22 і 24 Закону України «Про страхування»; 12.1.5. Ліквідації Страховика у порядку, встановленому законодавством України; 12.1.6. Прийняття судового рішення про визнання Договору недійсним; 12.1.7. В інших випадках, передбачених законодавством України. 12.2. Договір припиняє дію з моменту, коли Xxxxxxxxxxxxx стає особою, яка відповідно до умов п. 11.3 Договору не може бути застрахованою особою. 12.3. Дія Договору може бути достроково припинена за вимогою Страхувальника або Страховика. Про намір достроково припинити дію Договору будь-яка Сторона зобов’язана повідомити іншу не пізніше ніж за 30 днів до дати припинення дії Договору. 12.3.1. У разі дострокового припинення дії Договору за вимогою Страхувальника Xxxxxxxxx повертає йому страхові платежі за період, що залишився до закінчення дії Договору з відрахуванням нормативних витрат на ведення справи, визначених при розрахунку страхового тарифу, фактичних страхових виплат, що були здійснені за цим Договором. Якщо | 12. AMENDMENTS AND TERMINATION OF THE CONTRACT 12.1. The Contract shall be terminated and the Contract expires with the consent of the Parties, as well as in the case of: 12.1.1. Expiration; 12.1.2. Fulfillment of the obligations by the Insurer to the Policy Holder in full; 12.1.3. Failure to the Policy Holder to pay insurance premium within the terms established by the Contract; 12.1.4. Death of the Policy Holder - an individual, or loss of legal capacity, except as provided by Articles 22 and 24 of the Law of Ukraine “On Insurance”; 12.1.5. Liquidation of the Insurer in the manner prescribed by the legislation of Ukraine; 12.1.6. Court decision on invalidation of the Contract; 12.1.7. In other cases provided for by the legislation of Ukraine. 12.2. The Contract shall terminate from the moment when the Policy Holder becomes a person who cannot be an insured person in accordance with the terms of clause 11.3 of the Contract. 12.3. The Contract may be early terminated at the request of the Policy Holder or the Insurer. Either Party shall notify the other one of the intention to early terminate the Contract no later than 30 days prior to the date of termination of the Contract. 12.3.1. In case of early termination of the Contract at the request of the Policy Holder, the Insurer shall reimburse the insurance premiums for the period remaining before the expiration of the Contract, less the predetermined costs of the case maintenance defined in the calculation of the insurance rate, the actual insurance benefits paid under this Contract. вимога Xxxxxxxxxxxxxx обумовлена порушенням Страховиком умов Договору, то останній повертає Страхувальнику сплачені ним страхові платежі повністю. При цьому порушення строків здійснення страхової виплати не вважається таким порушенням умов Договору, в зв’язку з яким при достроковому припиненні його дії Страхувальнику повертаються сплачені страхові платежі повністю. 12.3.2. При достроковому припиненні дії Договору за вимогою Страховика Страхувальнику повертаються повністю сплачені страхові платежі. Якщо вимога Страховика зумовлена невиконанням Страхувальником умов Договору, то Xxxxxxxxx повертає Страхувальнику страхові платежі за період, що залишився до закінчення дії Договору з вирахуванням витрат на ведення справи, визначених при розрахунку страхового тарифу, фактичних страхових виплат, що були здійснені за цим Договором. 12.4. Під час дії Договору Xxxxxxx мають право вносити в нього зміни та доповнення за взаємною згодою. 13. МІСЦЕ ДІЇ ДОГОВОРУ 13.1. Місце (територія) дії Договору - Україна, крім тимчасово окупованих територій та населених пунктів, на території яких органи державної влади тимчасово не здійснюють свої повноваження, та переліку населених пунктів, що розташовані на лінії зіткнення, визначених відповідно до чинного законодавства. | 13. 14. IНШІ УМОВИ 14.1. Усі повідомлення за Договором між Xxxxxxxxx будуть вважатися зробленими належним чином, якщо вони здійснені у письмовій формі та надіслані рекомендованим листом, кур'єром, телеграфом, електронною поштою або вручені особисто за зазначеними адресами Xxxxxx. Датою отримання таких повідомлень буде вважатися дата їх особистого вручення, дата отримання електронного листа або дата поштового штемпеля відділу зв'язку одержувача. 14.2. Норматив витрат на ведення справи зазначений в Правилах (максимальний). 14.3. Умови, не обумовлені Договором, регулюються Правилами та законодавством України. 14.4. Договір укладено в двох примірниках українською мовою, які мають однакову юридичну силу - по одному для кожної зі Сторін. | 14. MISCELLANEOUS 14.1. The date of receipt of such notices shall be the date of their personal delivery, the date of receipt of the e- mail or the date of the postmark of the recipient's communications office. 14.2. The standard cost for case maintenance is specified in the Rules (maximum value). 14.3. Conditions not stipulated by the Contract shall be regulated by the Rules and legislation of Ukraine. 14.4.
