PUBLIC AGREEMENT

ABOUT PARTICIPATION IN GAMBLING

ТОВАРИСТВО З ОБМЕЖЕНОЮ ВІДПОВІДАЛЬНІСТЮ «ГЕЙМДЕВ»,

код ЄДРПОУ юридичної особи: 43397203, зареєстроване в Єдиному державному реєстрі юридичних осіб, фізичних осіб підприємців та громадських формувань 09.12.2019 року за номером: 10701020000085562, яке здійснює діяльність у сфері організації та проведення азартних xxxx на підставі ліцензії на провадження діяльності з організації та проведення азартних xxxx казино у мережі Інтернет Рішення № 47 Комісії з регулювання азартних xxxx та казино від 10.02.2021 року, (надалі – «Організатор»),

з однієї сторони, та

будь-яка дієздатна фізична особа, яка на момент прийняття (акцептування) цієї пропозиції досягла 21-го року, не включена до Реєстру осіб, яким обмежено доступ до гральних закладів та/або участь в азартних іграх, та за власним бажанням користується послугами з азартних xxxx на Веб-сайті Організатора xxxxxxxxx.xx (надалі –

«Гравець»), з іншої сторони, (надалі разом

— «Сторони», а кожна окремо –

«Сторона»), уклали даний Публічний договір про участь в азартній грі (надалі —

«Договір») про наступне:

any able-bodied natural person who has reached the age of 21 at the time of acceptance (acceptance) of this offer, is not included in the Register of Persons Restricted to Access to Gambling Facilities and / or Participation in Gambling, and uses gambling services at his / her own request games on the Website of the Organizer xxxxxxxxx.xx (hereinafter - the "Player"), on the other hand, (hereinafter together - "Parties" and each separately - "Party"), have entered into this Public Agreement on participation in gambling (hereinafter - "Agreement") on the following:

1. ТЕРМІНИ І ВИЗНАЧЕННЯ

1. TERMS AND DEFINITIONS

Веб-сайт – портал надання послуг Організатором, який має доменне ім’я

xxxxxxxxx.xx.

The Website - is a portal for the provision of services by the Organizer, which has the

domain name xxxxxxxxx.xx.

Акцепт - надання Гравцем повної й безумовної згоди на укладення даного Договору в повному обсязі, без підпису письмового примірника Договору

Xxxxxxxxx, шляхом здійснення ставки на Веб-сайті Організатора.

Acceptance - giving the Player full and unconditional consent to enter into this Agreement in full, without signing a written copy of the Agreement by the Parties, by placing a bet on the Website of the Organizer.

Гравець – фізична особа, яка на момент участі в азартній грі досягла 21-річного віку, є дієздатною, не перебуває у Реєстрі осіб, яким обмежено доступ до гральних закладів та/або участь в азартних іграх, та за власним бажанням бере участь в азартній

грі.

Player - an individual who at the time of participation in gambling has reached 21 years of age, is capable, is not in the Register of persons who have limited access to gambling establishments and / or participation in gambling, and voluntarily

participates in gambling .

Верифікація - заходи, що вживаються Організатором з метою перевірки (підтвердження) належності відповідній особі отриманих Організатором ідентифікаційних даних.	Verification - measures taken by the Organizer in order to verify (confirm) the identity of the relevant person received by the Organizer identification data.
Ідентифікація - заходи, що вживаються Організатором для встановлення особи шляхом отримання її ідентифікаційних даних.	Identification - measures taken by the Organizer to identify a person by obtaining his / her identification data.
Правила – Правила проведення азартних xxxx казино у мережі Інтернет та Правила організатора азартних xxxx казино у мережі Інтернет.	Rules - Rules for conducting casino gambling on the Internet and Rules for organizing casino games on the Internet.
Послуги – організація та проведення азартних xxxx казино в мережі Інтернет.	Services - organization and conduct of casino gambling on the Internet.
Відповідальна гра - базовий принцип організації та проведення азартних xxxx, що передбачає здійснення Організатором заходів до попередження та мінімізації негативних наслідків участі фізичної особи в азартній грі, а також заходів, спрямованих на організацію самообмежень і самоконтролю для Гравців. Ліцензійні умови - Ліцензійні умови провадження діяльності у сфері організації та проведення азартних xxxx казино в мережі Інтернет, затверджені постановою КМУ від 21 грудня 2020 р. № 1341. Реєстр осіб, яким обмежено доступ до гральних закладів та/або участь в азартних іграх - база даних, що містить інформацію про фізичних осіб, яким відповідно до поданих заяв або за рішенням суду обмежено відвідування гральних закладів та участь в азартних іграх.	Register of persons restricted access to gambling establishments and / or participation in gambling - a database containing information on individuals who, in accordance with the submitted applications or by court decision, are restricted from visiting gambling establishments and participating in gambling.
Забороняється брати участь в азартній грі: - засновникам (учасникам, акціонерам), керівникам організатора азартних xxxx, у яких вони є засновниками та/або займають керівні посади; - представникам засновників (учасників, акціонерів), керівників організатора азартних xxxx, у яких вони є представниками засновника та/або займають керівні посади; - особам, які можуть мати інформацію про результат азартної гри;	It is forbidden to participate in gambling: - founders (participants, shareholders), managers of the organizer of gambling, in which they are the founders and / or hold senior positions; - representatives of the founders (participants, shareholders), heads of the gambling organizer, in which they are representatives of the founder and / or hold senior positions; - persons who may have information about the outcome of gambling; - persons who have the opportunity to influence the outcome of gambling or the

Інші терміни та визначення, що використовуються в даному Договорі та не наведені вище, використовуються в значенні наведеному в Законі України «Про державне регулювання діяльності щодо організації та проведення азартних xxxx» та Правилах. 2. ЗАГАЛЬНІ ПОЛОЖЕННЯ 2.1. Відповідно до умов даного Договору, Організатор пропонує Гравцеві участь в азартній грі, та надає послуги з організації та проведення азартних xxxx казино у мережі Інтернет через Веб-сайт Організатора, а Гравець, реєструючись на Веб-сайті Організатора, має можливість робити ставки і здійснювати управління особистим рахунком на Веб-сайті Організатора, згідно з Правилами, затвердженими Організатором. 2.2. Гравець бере участь в азартній грі шляхом здійснення ставок в азартних іграх казино в мережі Інтернет на Веб-сайті Організатора. 2.3. Гравець, здійсненням ставки на Веб- сайті Організатора, підтверджує факт ознайомлення та згоди з усіма умовами цього Договору, та його акцептування. 2.4. Якщо Гравець не згодний з умовами Договору, він зобов’язаний відмовитись від подальшої участі в азартній грі. 2.5. Організатор підтверджує, що має право на здійснення діяльності щодо організації та проведення азартних xxxx казино у мережі Інтернет, у відповідності до вимог Закону України «Про державне регулювання діяльності щодо організації та	2. GENERAL PROVISIONS
	2.1. In accordance with the terms of this Agreement, the Organizer offers the Player gambling, and provides services for organizing and conducting gambling casinos on the Internet through the Organizer's Website, and the Player, registering on the Organizer's Website, has the opportunity to bet and manage personal account on the Organizer's Website, in accordance with the Rules approved by the Organizer.
	2.2. The player participates in gambling by placing bets in casino gambling on the Internet on the Organizer's website.
	2.3. By placing a bet on the Organizer's Website, the Player confirms the fact of acquaintance and agreement with all the terms of this Agreement, and its acceptance.
	2.4. If the Player does not agree with the terms of the Agreement, he is obliged to refuse further participation in gambling.
	2.5. The organizer confirms that he has the right to carry out activities on the organization and conduct of gambling casinos on the Internet, in accordance with the Law of Ukraine "On state regulation of activities on the organization and conduct of

2.6. Даний договір є договором приєднання у розумінні ст. 634 Цивільного

кодексу України.

2.6. This agreement is a treaty of accession within the meaning of Art. 634 of the Civil

Code of Ukraine.

2.7. Договір має юридичну силу відповідно до ст. ст. 641, 642 Цивільного кодексу України і є рівносильним письмовому Договору, підписаному

2.7. The contract has legal force in accordance with Art. Art. 641, 642 of the Civil Code of Ukraine and is equivalent to a written agreement signed by the Parties.

3. ПРАВА ТА ОБОВ’ЯЗКИ ОРГАНІЗАТОРА

3.1. Організатор зобов’язаний:

3.1.1. виконувати умови даного Договору, Правил, а також дотримуватись вимог Закону України «Про державне регулювання діяльності щодо організації та проведення азартних xxxx», Закону України

«Про запобігання та протидію легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення», ліцензійних умов, що регулюють провадження виду господарської діяльності Організатора у сфері організації та проведення азартних xxxx, а також інших нормативно-правових актів України;

3.1.2. надати Гравцю Послуги належної якості на Веб-сайті;

3.1.3. не вчиняти дії, що можуть мати вплив на результати азартних xxxx;

3.1.4. встановлювати та використовувати гральне обладнання, що виключає можливість несанкціонованого втручання у його діяльність або створення умов для заздалегідь визначеного результату азартної гри;

3.1.5. інформувати Гравця на Веб-сайті про Послуги та умови їх надання;

3.1.6. розміщувати на Веб-сайті всю необхідну інформацію, яка передбачена законодавством для діяльності Організатора;

3.1.7. своєчасно та в повному обсязі здійснювати виплату (видачу) виграшу (призу), відповідно до правил проведення азартних xxxx упродовж строку, встановленого Законом України «Про

3. RIGHTS AND RESPONSIBILITIES OF THE ORGANIZER

3.1. The organizer is obliged to:

3.1.1. comply with the terms of this Agreement, the Rules, as well as comply with the Law of Ukraine "On State Regulation of Gambling", the Law of Ukraine "On Prevention and Counteraction to Legalization (Laundering) of Proceeds from Crime, Terrorist Financing and Financing of Proliferation of Weapons destruction ", licensing conditions governing the conduct of economic activities of the Organizer in the field of organization and conduct of gambling, as well as other regulations of Ukraine;

3.1.2. provide the Player with the Quality Services on the Website;

3.1.3. not to take actions that may affect the results of gambling;

3.1.4. install and use gambling equipment that eliminates the possibility of unauthorized interference in its activities or creating conditions for a predetermined outcome of gambling;

3.1.5. inform the Player on the Website about the Services and the terms of their provision;

3.1.6. to place on the Website all the necessary information required by law for the activities of the Organizer;

3.1.7. timely and in full to pay (issue) winnings (prizes), in accordance with the rules of gambling during the period established by the Law of Ukraine "On state regulation of activities for the organization and conduct of gambling", except as provided by the Law of Ukraine "On Prevention and counteracting the legalization (laundering) of proceeds from crime, terrorist financing and

3.1.8. відмовити Гравцю у наданні Послуг, який перебуває у Реєстрі осіб, яким обмежено доступ до гральних закладів та/або участь в азартних іграх;

3.1.9. вживати заходів для запобігання порушенню законодавства Гравцями;

3.1.10. утримуватися від надання Гравцям будь-яких бонусних виплат, подарунків та/або надання товарів (послуг) у будь-якій формі, використання інших видів заохочення, надання яких прямо чи опосередковано обумовлено настанням факту програшу Гравця у відповідній азартній грі;

3.1.11. розглядати скарги Гравця та інших осіб, у тому числі в електронній формі, надавати на них відповіді у строки, визначені Правилами;

3.1.12. вживати заходів для боротьби з ігровою залежністю (лудоманією).

3.2. Організатор має право:

3.2.1. запитувати у Гравця додаткові документи відповідно до Правил;

3.2.2. збільшити мінімальний вік Гравця для участі в азартній грі;

3.2.3. відмовити у здійсненні виплат виграшів (призів) особі, яка не є Гравцем та/або яка не має права отримання такого виграшу;

3.2.4. в односторонньому порядку призупинити надання Послуг за цим Договором у випадку порушення Гравцем умов цього Договору, Правил та/або вимог Закону України «Про державне регулювання діяльності щодо організації та проведення азартних xxxx»;

3.2.5. самостійно змінити та/або доповнити умови цього Договору, Правила, без особистого повідомлення Гравця. При цьому Організатор гарантує та підтверджує, що розміщена на його Веб- сайті поточна редакція тексту цього

3.1.11. consider complaints of the Player and other persons, including in electronic form, provide answers to them within the time limits specified in the Rules;

3.1.12. take measures to combat gambling addiction (addiction).

3.2. The organizer has the right to:

3.2.1. request additional documents from the Player in accordance with the Rules;

3.2.2. increase the minimum age of the Player to gamble;

3.2.3. refuse to pay prizes (prizes) to a person who is not a Player and / or who is not entitled to receive such prizes;

3.2.4. unilaterally suspend the provision of Services under this Agreement in case the Player violates the terms of this Agreement, the Rules and / or requirements of the Law of Ukraine "On state regulation of activities related to the organization and conduct of gambling";

3.2.5. independently change and / or supplement the terms of this Agreement, the Rules, without personal notice to the Player. In this case, the Organizer guarantees and confirms that the current version of the text of this Agreement, appendices to it, the Rules, posted on its Website, is valid;

Договору, додатків до нього, Правил, є дійсною;

3.2.6. зберігати та обробляти інформацію, що вводиться Гравцем при реєстрації, проходження ним (Гравцем) верифікації та ідентифікації на Веб-сайті.

4. ПРАВА ТА ОБОВ’ЯЗКИ ГРАВЦЯ

4.1. Гравець зобов’язаний:

4.1.1. дотримуватися вимог та обов’язків, передбачених законодавством про азартні ігри, Законом України «Про запобігання та протидію легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення», цивільним законодавством, Правилами;

4.1.2. ознайомитись з Правилами та самостійно відстежувати їх можливі зміни;

4.1.3. ознайомлюватись з інформацією про послуги, які розміщені на Веб-сайті Організатора;

4.1.4. на вимогу Організатора пред’явити документ, що підтверджує особу Гравця або інший документ відповідно до Правил.

4.2. Гравець має право:

4.2.1. здійснити реєстрацію на Веб-сайті Організатора та управляти особистим рахунком відповідно до Правил;

4.2.2. вимагати від Організатора надання якісних Послуг відповідно до умов цього Договору, Правил та чинного законодавства України;

4.2.3. обмежити свою участь в азартній грі в мережі Інтернет відповідно до чинного законодавства;

4.2.4. Здійснювати інші права, передбачені Законом України «Про державне регулювання діяльності щодо організації та проведення азартних xxxx» та Правилами.

4. PLAYER'S RIGHTS AND OBLIGATIONS

4.1. The player must:

4.1.1. comply with the requirements and obligations provided by the legislation on gambling, the Law of Ukraine "On Prevention and Counteraction to Legalization (Laundering) of Proceeds from Crime, Terrorist Financing and Financing of Proliferation of Weapons of Mass Destruction", civil law, Rules;

4.1.2. get acquainted with the Rules and independently monitor their possible changes;

4.1.3. to get acquainted with the information about the services posted on the Organizer's Website;

4.1.4. at the request of the Organizer to present a document confirming the identity of the Player or another document in accordance with the Rules.

4.2. The player has the right to:

4.2.1. register on the Organizer's Website and manage a personal account in accordance with the Rules;

4.2.2. require the Organizer to provide quality Services in accordance with the terms of this Agreement, the Rules and current legislation of Ukraine;

4.2.3. limit your participation in gambling on the Internet in accordance with applicable law;

4.2.4. Exercise other rights provided by the Law of Ukraine "On state regulation of activities related to the organization and conduct of gambling" and the Rules.

5. ПОРЯДОК РОЗРАХУНКІВ 5. PROCEDURE OF CALCULATIONS

5.1. Взаєморозрахунки здійснюються відповідно до Правил.

5.2. Організатор не несе відповідальності за коректність платежів

5.2. The Organizer is not responsible for the correctness of the Player's payments and

5.3. Підтвердженням оплати, яка була здійсненна Гравцем, вважається фактичне надходження коштів на рахунки Організатора.

5.4. Проведення розрахунків по особистому рахунку Гравця може бути обмежене чи призупинене фінансовою установою, відповідно до чинного законодавства.

5.5. Оплата ставок, повернення коштів, внесення коштів Гравцями для участі в азартних іграх через мережу Інтернет, виплата виграшів здійснюються у безготівковій формі через онлайн-систему на Веб-сайті з урахуванням положень чинного законодавства, в тому числі Закону України «Про запобігання та протидію легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення».

5.6. У разі будь-яких технічних неполадок та/або помилок в системі Організатора, виплата Гравцеві здійснюється в порядку, передбаченому Правилами.

5.7. Гравцю забороняється грати у кредит або із розстроченням платежу, або з наступною оплатою, крім оплати ставки кредитними або дебетовими картками за наявності авторизації платежу.

5.8. При отриманні виплати виграшу (призу) або ставки, що підлягає поверненню, Гравець має пройти верифікацію та ідентифікацію в порядку, визначеному Правилами.

5.9. Забороняється виплата виграшу (призу), його еквівалента або повернення ставки будь-яким третім особам, у тому числі особам, на користь яких Xxxxxxx пропонує здійснити виплату виграшу (призу), його еквівалента або повернення ставки. Це обмеження не поширюється на випадки звернення щодо повернення ставок, зроблених особою, яка не досягла 21-річного віку, недієздатною особою або особою, цивільна дієздатність якої обмежена, якщо особа, яка звертається за

5.4. Payments to the Player's personal account may be restricted or suspended by the financial institution in accordance with applicable law.

5.5. Payment of bets, refunds, deposits by Players to participate in gambling via the Internet, payment of winnings are made in non-cash form through the online system on the Website and including applicable law, including including the Law of Ukraine "On Prevention and Counteraction to Legalization (Laundering) of Proceeds from Crime, Financing of Terrorism and Financing of the Proliferation of Weapons of Mass Destruction".

5.6. In case of any technical problems and / or errors in the Organizer's system, payment to the Player is made in the manner prescribed by the Rules.

5.7. The player is prohibited from playing on credit either with installment payment or with subsequent payment, except for payment of the bet by credit or debit cards in the presence of payment authorization.

5.8. Upon receipt of the payout (prize) or refundable bet, the Player must be verified and identified in the manner prescribed by the Rules.

5.9. It is prohibited to pay the prize (prize), its equivalent or return the bet to any third party, including persons in whose favor the Player offers to pay the prize (prize), its equivalent or return the bet. This restriction does not apply to refunds made by a person under the age of 21, an incapacitated person or a person with limited civil capacity if the person applying for a refund is his legal representative.

5.10. The term of payment of the prize (prize) or refund of the bet is determined by the rules of the Organizer, but should not exceed 3 (three) working days from the date of determining the recipient of the payment of the prize (prize) or the rate to be refunded.

5.11. The Organizer has the right to increase the term of payment (issuance) of the prize (prize) to 30 (thirty) days from the date of the

6. ПОРЯДОК ОТРИМАННЯ ПОСЛУГ

6.1. Правила розміщені на Веб-сайті Організатора.

6.2. Кожна гра, яка розміщена на Веб- сайті Організатора азартних xxxx може містити свої особливі умови участі у ній, які відображаються в меню відповідної азартної гри. Гравець, перед здійсненням ставки в азартній грі зобов’язаний ознайомитись із правилами та умовами такої азартної гри. Здійснення Xxxxxxx ставки у відповідній грі є підтвердженням того, що він ознайомився із Правилами та Договором і згодний з ними.

6.3. Всі питання, що виникли в процесі участі в азартній грі, а також щодо порядку участі в азартній грі, Xxxxxxx може з'ясувати звернувшись до служби підтримки Веб-сайту.

6. PROCEDURE FOR RECEIVING SERVICES

6.1. The rules are posted on the Organizer's website.

6.2. Each game posted on the Gambling Organizer's Website may have its own special conditions of participation, which are displayed in the menu of the respective gambling game. Before placing a bet in gambling, the player is obliged to read the rules and conditions of such gambling. The Player's bet in the relevant game is a confirmation that he has read and agrees with the Rules and the Agreement.

6.3. All questions that have arisen in the process of participation in gambling, as well as the procedure for participation in gambling, the Player can find out by contacting the support service of the Website.

7. ІНТЕЛЕКТУАЛЬНА ВЛАСНІСТЬ

7.1. Всі права інтелектуальної власності на використання Веб-сайту належать Організатору, а на контент, що розміщений на Веб-сайті - його законним правовласникам.

7. INTELLECTUAL PROPERTY

7.1. All intellectual property rights for the use of the Website belong to the Organizer, and for the content posted on the Website - to its legal owners.

7.2. 8. ВІДПОВІДАЛЬНІСТЬ СТОРІН ТА ВИРІШЕННЯ СПОРІВ

8.2. Усі спори, що виникають з цього Договору або пов'язані із ним, вирішуються шляхом переговорів між Сторонами.

8.4. Гравець несе відповідальність за достовірність наданих документів та інформації відповідно до чинного законодавства України.

8.5. Претензії Гравця розглядаються у порядку та строки, що визначені Правилами.

8. RESPONSIBILITY OF THE PARTIES AND SETTLEMENT OF

DISPUTES

9.6. Поширення персональних даних без згоди Гравця дозволяється у випадках, визначених законодавством.
