承保风险
(风险条款)
1 本保险承保除下列第 3、4 条规定的除外责任以外,由于下列原因造成保险标的的损失或损坏:
1. 战争、内战、革命、造反、叛乱或由此引起的内乱或任何交战方之间的敌对行为;
1.2 上述 1.1 承保风险引起的捕获、扣押、扣留、拘禁或羁押和此种行为引起的后果或进行此种行为的企图;
1.3 被遗弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。
(共同海损条款)
2 本保险承保根据运输合同和/或准据法和惯例理算或确定的共同海损和救助费用,其产生是为了避免本条款项下承保风险造成的损失或与避免本条款项下承保风险造成的损失有关。
除外责任
(普通除外条款)
3 本保险概不承保:
3.1 可归咎于被保险人的蓄意恶性的损失、损害或费用;
3.2 保险标的的通常渗漏、通常重量或体积损失、或通常磨损;
3.3 保险标的包装或准备不足或不当而不能经受所保运送通常的事故所引起的损失、损害或费用,此种包装或准备是由被保险人或其雇员实施的,或是在本保险责任开始前实施的(在本款意义上,“包装”应视为包括集装箱内的积载,而被保险人的雇员不包括独立承包商);
3.4 保险标的的固有缺陷或性质引起的损失、损害或费用;
3.5 迟延造成的损失、损害或费用,即使该延迟是由承保风险引起的;
3.6 船东,承租人或船舶经营人的破产或财务违约所造成的损失,损害或费用,在船上承保标的物装载时,被保险人知道或在正常业务过程中应当知道,这种破产或财务违约可能会妨碍正常的航行;
本除外责任不适用于已将保险合同转让给根据有约束力的合同善意购买或同意购买保险标的的本合同项下的索赔方;
3.7 航程或风险的丧失、中断提出的索赔;
3.8 因使用原子或核裂变和/或聚变或其他类似反应或放射性力量或物质所制造的任何武器或装置直接或间接产生的或引起的损失、损坏或费用。
(不适航和不适运除外条款)
4.
本保险概不承保损失、损害或费用,如其起因于
4.1.1 船舶或驳船不适航或对保险标的之安全运输不适合,如果被保险人在保险标的装载其上时对此种不适航或不适合有私谋;
4.1.2 集装箱或托盘对保险标的之安全运输不适合,如果装入或装上发生在本保险责任开始之前,或者是由被保险人或其雇员实施的,而且他/她们在装载时对此种不适合有私谋;
4.2 如果保险合同已经转让给根据一个有约束力的合同已经善意购买或同意购买保险标的之根据本保险合同索赔的人,上述第 4.1.1 条规定的除外责任对其不适用;
4.3 保险人放弃载运保险标的到目的港的船舶不得违反默示适航保证或适运保证。保险期间
(运送条款)
5.
5.1 本保险
5.1.1 其责任仅始于保险标的和就其中一部分而言时的这一部分装上海船时而且
5.1.2 终止于,除下文第 5.2 和 5.3 条另有规定外,保险标的和就其中一部分而言时的这一部分在最后卸货港或地点卸离海船时,
或者
自船舶到达最后卸货港或地点当日午夜算起满 15 天时,二者以先发生者为准;
然而
以迅速通知保险人和附加的保险费为条件,此种保险
5.1.3 其责任重新开始于未在最后卸货港口或地点卸下保险标的船舶从那里开航之时,并且
5.1.4 终止于,除下列第 5.2 和 5.3 条另有规定外,保险标的和就其中一部分而言时的这一部分,在最后(或替代)卸货港或地点卸离船舶时,
或者自船舶到达最后卸货港或地点, 或到达替代港口或地点当日午夜算起满 15 天时,二者以先发生者为准;
5.2 如果在所保航程期间,海船抵达中途地或港卸下保险标的并由海船或航空器续运,或者保险标的在避难港或避难地从海船上卸下,那么除下列第 5.3 条另有规定并在必要时支付附加的保险费外,本保险继续有效,直至自海船到达该地点或港当日午夜起算届满 15 天
之时,但其后该保险标的,和就其中一部分而言时的这一部分,装上续运海船或航空器时保险责任重新开始。在上述 15 天期间,如果货物已部分被卸离,本保险继续有效,其条件是保险标的,和就其中一部分而言时的这一部分,处于该中途地点或港。如果保险标的在所述 15 天期间内被续运或保险责任按本 5.2 条规定重新开始
5.2.1 在由海船续运的情况下,本保险责任按本条款规定办理,或者
5.2.2 在由航空器续运的情况下,现行协会货物战争险(空运)(邮包除外)保险条款应被视为本保险一部分并适于空运续运。
5.3 如果运输合同的航程在本保险约定的目的地或目的港以外的地点终止,该地点或港口应被视为最后卸货点,本保险根据第 5.1.2 条终止。如果保险标的其后被重新发运到原来的或其他目的地或目的港,那么以在此种继续运输开始前通知了保险人并须受附加的保险费制约为前提条件,本保险责任重新开始于
5.3.1 保险标的,和就其中一部分而言时的这一部分,装上续运海船之时,如果保险标的已经卸下
5.3.2 海船从上述被视作最终卸货地或卸货港驶离时,如果保险标的没有被卸下;其后本保险根据第 5.1.4 条终止。
5.4 本保险扩展保险标的或其一部分位于转运到或转运自海船的驳船上期间的漂浮或水下水雷和被抛弃的鱼雷风险,但除另经保险人特别同意外,决不超过卸离海船后 60 天。
5.5 以迅速通知保险人和按保险人的要求支付附加保险费的制约为条件,在绕航或因船东或承租人根据运输合同赋予的自由权产生的航海变更期间,本保险在这些条款规定的范围内继续有效。
(第五条所指“到达”系指船舶在港口当局地区界限内抛锚,系泊或以其他方式固定在一个泊位或地点。若无此种泊位或地点可用,当船舶首次抛锚,系泊或以其他方式固定在预定的卸货港口或地点或预定港/地点之外时,应被认为已经到达。“海船”系指载运保险标的从一个港口或地点到另一个港口或地点的船舶,如果该航程包含有该船舶运送的海上航段。)
(航程改变条款)
6.
6.1 如果在本保险责任开始后,被保险人改变了目的地,被保险人应将此情况迅速通知保险人,以便双方重新约定保险费率和条款。
6.2 如果保险标的开始了本保险期待的运送(根据第 5.1 条),但是被保险人或其雇员不知道海船行驶另一目的地,本保险责任仍应视为从开始此种运送时开始。
7 本合同中任何与第 3.7,3.8 或 5 条不符的内容都视为无效。索赔
(保险利益条款)
8.
8.1 在发生损失时,被保险人必须对保险标的具有保险利益,才能获得本保险单项下的赔偿
8.2 除上述 8.1 条款另有规定除外,被保险人有权取得本保险承保期间发生的承保损失的赔偿,尽管该损失发生在本保险合同订立前,除非当时被保险人知晓该损失而保险不知晓。
(增加价值条款)
9.
9.1 如果保险标的由被保险人办理了增加价值保险,保险标的之保险价值就应视为增加至承保损失的本保险和所有增加价值保险的保险金额的总和,本保险的责任按照本保险的保险金额占全部保险金额的总和的比例计算。
索赔时被保险人须向保险人提供所有其他保险的保险金额的证据。
9.2 如果本保险是增加价值保险,应适用于下述条款:保险标的之保险价值应视为等于由被保险人对保险标的办理的承保损失的原始保险和所有增加价值保险的保险金额的总和,本保险的责任按照本保险的保险金额占全部保险金额的总和的比例计算。
索赔时被保险人须向保险人提供所有其他保险的保险金额的证据。保险受益
10 本保险
10.1
承保被保险人,包括作为以他的名义或代表他订立保险合同的人或作为受让人索赔保险赔偿的人。
10.2
不扩展至或以其他方式使承运人或其他受托人受益。减少损失

11 当发生本保险承保的损失时,被保险人、及其雇员和代理人有义务
11.1 采取合理措施,避免或减少这种损失,并
11.2 保证适当地保留和行使对承运人、受托人或其他第三者追偿的权利,保险人除负责赔偿承保责任的任何损失外,还应补偿被保险人为履行上述义务产生的任何适当和合理的费用。

12. 被保险人或保险人为施救、保护或恢复保险标的所采取的措施,不应视为放弃或接受委付的表示,或视为损害任何一方的权利。
避免迟延

13. 本保险的条件之一是被保险人在所有其力所能及的情况下合理迅速地行动。法律和惯例

14. 本保险受英国法和惯例调整。
注意:根据第 5 条规定要求继续承保的,或根据第 6 条规定通知目的地变更的,被保险人有义务立即通知保险人,此种权利取决于被保险人业已履行这项义务。
INSTITUTE WAR CLAUSES (CARGO)
RISKS COVERED
Risks
1. This insurance covers, except as excluded by the provisions of Clauses 3 and 4 below, loss of or damage to the subject-matter insured caused by
1.1 war civil war revolution rebellion insurrection, or civil strife xxxxxxx xxxxxxxxx, or any hostile act by or against a belligerent power
1.2 capture seizure arrest restraint or detainment, arising from risks covered under 1.1 above, and the consequences thereof or any attempt thereat
1.3 derelict mines torpedoes bombs or other derelict weapons of war.
General Average
2. This insurance covers general average and salvage charges, adjusted or determined according to the contract of carriage and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from a risk covered under these Clauses.
EXCLUSIONS
3. In no case shall this insurance cover
3.1 loss damage or expense attributable to wilful misconduct of the Assured
3.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured
3.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured to withstand the ordinary incidents of the insured transit where such packing or preparation is carried out by the Assured or their employees or prior to the attachment of this insurance (for the purpose of these Clauses "packing" shall be deemed to include stowage in a container and "employees" shall not include independent contractors)
3.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured
3.5 loss damage or expense caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)
3.6 loss damage or expense caused by insolvency or financial default of the owners managers charterers or operators of the vessel where, at the time of loading of the
subject-matter insured on board the vessel, the Assured are aware, or in the ordinary course of business should be aware, that such insolvency or financial default could prevent the normal prosecution of the voyage
This exclusion shall not apply where the contract of insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract
3.7 any claim based upon loss of or frustration of the voyage or adventure
3.8 loss damage or expense directly or indirectly caused by or arising from any hostile use of any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
4. 4.1 In no case shall this insurance cover loss damage or expense arising from
4.1.1 unseaworthiness of vessel or craft or unfitness of vessel or craft for the safe carriage of the subject-matter insured, where the Assured are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein
4.1.2 unfitness of container or conveyance for the safe carriage of the subject-matter insured, where loading therein or thereon is carried out
prior to attachment of this insurance or
by the Assured or their employees and they are privy to such unfitness at the time of loading.
4.2 Exclusion 4.1.1 above shall not apply where the contract of insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract.
4.3 The Insurers waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination.
DURATION
Transit Clause
5. 5.1 This insurance
5.1.1 attaches only as the subject-matter insured and as to any part as that part is loaded on an oversea vessel
and
5.1.2 terminates, subject to 5.2 and 5.3 below, either as the subject-matter insured and as to any part as that part is discharged from an oversea vessel at the final port or place of discharge,
or
on expiry of 15 days counting from midnight of the day of arrival of the vessel at the final port or place of discharge,
whichever shall first occur; nevertheless,
subject to prompt notice to the Insurers and to an additional premium, such insurance
5.1.3 reattaches when, without having discharged the subject-matter insured at the final port or place of discharge, the vessel sails therefrom,
and
5.1.4 terminates, subject to 5.2 and 5.3 below, either as the subject-matter insured and as to any part as that part is thereafter discharged from the vessel at the final (or substituted) port or place of discharge,
or
on expiry of 15 days counting from midnight of the day of re-arrival of the vessel at the final port or place of discharge or arrival of the vessel at a substituted port or place of discharge,
whichever shall first occur.
5.2 If during the insured voyage the oversea vessel arrives at an intermediate port or place to discharge the subject-matter insured for on-carriage by oversea vessel or by aircraft, or the subject-matter insured is discharged from the vessel at a port or place of refuge, then, subject to 5.3 below and to an additional premium if required, this insurance continues until the expiry of 15 days counting from midnight of the day of arrival of the vessel at such port or place, but thereafter reattaches as the subject-matter insured and as to any part as that part is loaded on an on-carrying oversea vessel or aircraft. During the period of 15 days the insurance remains in force after discharge only whilst the subject-matter insured and as to any part as that part is at such port or place. If the subject-matter insured is oncarried within the said period of 15 days or if the insurance reattaches as provided in this Clause 5.2
5.2.1 where the on-carriage is by oversea vessel this insurance continues subject to the terms of these Clauses,
or
5.2.2 where the on-carriage is by aircraft, the current Institute War Clauses (Air Cargo) (excluding sendings by Post) shall be deemed to form part of the contract of insurance and shall apply to the on-carriage by air.
5.3 If the voyage in the contract of carriage is terminated at a port or place other than the destination agreed therein, such port or place shall be deemed the final port of discharge and this insurance terminates in accordance with 5.1.2. If the subject-matter insured is subsequently reshipped to the original or any other destination, then provided notice is given to the Insurers before the commencement of such further transit and subject to an additional premium, this insurance reattaches
5.3.1 in the case of the subject-matter insured having been discharged, as the subject-matter insured and as to any part as that part is loaded on the on-carrying vessel for the voyage;
5.3.2 in the case of the subject-matter not having been discharged, when the vessel sails from such deemed final port of discharge;
thereafter this insurance terminates in accordance with 5.1.4.
5.4 The insurance against the risks of mines and derelict torpedoes, floating or submerged, is extended whilst the subject-matter insured or any part thereof is on craft whilst in transit to or from the oversea vessel, but in no case beyond the expiry of 60 days after discharge from the oversea vessel unless otherwise specially agreed by the Insurers.
5.5 Subject to prompt notice to Insurers, and to an additional premium if required, this insurance shall remain in force within the provisions of these Clauses during any deviation, or any variation of the adventure arising from the exercise of a liberty granted to carriers under the contract of carriage.

"xxxxxxx" shall be deemed to mean that the vessel is anchored, moored or otherwise secured at a berth or place within the Harbour Authority area. If such a berth or place is not available, arrival is deemed to have occurred when the vessel first anchors, moors or otherwise secures either at or off the intended port or place of discharge
"oversea vessel" shall be deemed to mean a vessel carrying the subject-matter from one port or place to another where such voyage involves a sea passage by that vessel)
Change of Voyage
6. 6.1 Where, after attachment of this insurance, the destination is changed by the Assured, this must be notified promptly to Insurers for rates and terms to be agreed. Should a loss occur
prior to such agreement being obtained cover may be provided but only if cover would have been available at a reasonable commercial market rate on reasonable market terms.
6.2 Where the subject-matter insured commences the transit contemplated by this insurance (in accordance with Clause 5.1), but, without the knowledge of the Assured or their employees the ship sails for another destination, this insurance will nevertheless be deemed to have attached at commencement of such transit.
7. Anything contained in this contract which is inconsistent with Clauses 3.7, 3.8 or 5 shall, to the extent of such inconsistency, be null and void.
CLAIMS
Insurable Interest
8. 8.1 In order to recover under this insurance the Assured must have an insurable interest in the subject- matter insured at the time of the loss.
8.2 Subject to Clause 8.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Insurers were not.
Increased Value
9. 9.1 If any Increased Value insurance is effected by the Assured on the subject-matter insured under this insurance the agreed value of the subject-matter insured shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering the loss, and liability under this insurance shall be in such proportion as the sum insured under this insurance bears to such total amount insured.
In the event of claim the Assured shall provide the Insurers with evidence of the amounts insured under all other insurances.
9.2 Where this insurance is on Increased Value the following clause shall apply:
The agreed value of the subject-matter insured shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the subject-matter insured by the Assured, and liability under this insurance shall be in such proportion as the sum insured under this insurance bears to such total amount insured.
In the event of claim the Assured shall provide the Insurers with evidence of the amounts insured under all other insurances.
BENEFIT OF INSURANCE
10. This insurance
10.1 covers the Assured which includes the person claiming indemnity either as the person by or on whose behalf the contract of insurance was effected or as an assignee,
10.2 shall not extend to or otherwise benefit the carrier or other bailee.
MINIMISING LOSSES
Duty of Assured
11. It is the duty of the Assured and their employees and agents in respect of loss recoverable hereunder
11.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss,
and
11.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised
and the Insurers will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.
Waiver
12. Measures taken by the Assured or the Insurers with the object of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.
AVOIDANCE OF DELAY
13. It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.
LAW AND PRACTICE
14. This insurance is subject to English law and practice.
NOTE:- Where a reattachment of cover is requested under Clause 5, or a change of destination is notified under Clause 6, there is an obligation to give prompt notice to the Insurers and the right to such cover is dependent upon compliance with this obligation.
