第一章 总 则
第一条 为规范公共航空运输经营人危险品航空运输许可管理，依据《民用航空危险品运输管理规定》制定🎧程序。
第二条 🎧程序适用于持有公共航空运输企业经营许可的国内经营人（ 以下简称“ 国内经营人”） 和在外国和中国地点间进行定期航线经营或者不定期飞行的外国公共航空运输经营人（ 以下简称“ 外国经营人”） 。
第三条 国内经营人危险品航空运输许可管理由其公共航空运输企业经营许可证载明的基地机场所在地民航地区管理局负
责。
欧洲地区、独联体国家和蒙古国经营人危险品航空运输许可管理由民航华北地区管理局负责。 美洲地区、韩国、日🎧和朝鲜经营人危险品航空运输许可管理由民航华东地区管理局负责。 其他地区经营人的危险品航空运输许可管理由民航中南地区管理局负责。
第四条 经营人应当对提交材料的真实性和合法性负责。
第二章 国内经营人危险品航空运输许可程序
第五条 国内经营人申请危险品航空运输许可，应当提交下列材料：
（ 一） 国内经营人危险品航空运输许可申请书（ 见附表一） ；
（ 二） 公共航空运输企业经营许可证复印件；
（ 三） 拟从事危险品航空运输的经营范围和危险品的类别；
（ 四） 危险品航空运输手册；
（ 五） 经审查合格的危险品培训大纲；
（ 六） 符合《民用航空危险品运输管理规定》、《危险品航空运输培训管理办法》及《技术细则》培训要求的说明；
（ 七） 危险品应急响应方案；
（ 八） 符合性声明；
（ 九） 民航局要求的其他材料。
第六条 申请使用湿租航空器运输危险品，还应提交下列材料：
（ 一） 航空器出租人的危险品航空运输许可或等效文件；
（ 二） 湿租协议；
（ 三） 使用湿租的航空器运输危险品的范围和类别。
第七条 国内经营人申请危险品航空运输许可，提交的材料应符合下列要求：
（ 一） 拟从事危险品航空运输的经营范围不超出申请人公共航空运输企业经营许可证所载经营范围；
（ 二） 危险品应急响应方案应当包括机上应急和地面应急内容，可独立成册，也可编入其他应急方案或者专业手册中；
（ 三） 符合性声明为申请人满足《民用航空危险品运输管理规定》第十八条规定所有条件的xx。
第八条 申请使用湿租航空器运输危险品，提交的材料应符

合下列要求：
（ 一） 航空器出租人为国内经营人的，提供民航地区管理局颁发给航空器出租人的危险品航空运输许可；航空器出租人为外国经营人的，提供航空器出租人所在国民航主管部门颁发的危险品航空运输许可或等效文件；
（ 二） 湿租协议中明确人员危险品培训要求、危险品运输管理、操作程序、应急方案和危险品运输安全责任等内容。
第九条 申请材料齐全、符合法定形式的，民航地区管理局应受理其申请，并向申请人出具《 公共航空运输经营人危险品航空运输许可申请受理通知书》（ 见附表二） 。
申请资料不齐全或者不符合法定形式的，民航地区管理局应当场或者在五日内一次性通知申请人需要补充的全部材料，逾期不通知的，自收到申请材料之日起即为受理。
民航地区管理局不予受理申请时，应书面告知申请人。
第十条 民航地区管理局应当自受理危险品航空运输许可的申请之日起二十日内完成审查并做出是否许可的决定。 需要进行专家评审的，民航地区管理局应当将所需的评审时间书面告知申请人，评审时间不计入作出许可的期限内。
第十一条 危险品航空运输许可申请审查包括对申请人的危险品航空运输手册、危险品培训大纲以及危险品应急响应方案等文件内容的完整性、合法性、针对性和可操作性等方面的审查，以
及对申请人是否按照危险品航空运输手册建立了危险品航空运输

管理和操作程序、应急方案，是否配备了合适的和足够的人员并按照危险品培训大纲完成培训并合格等要求的审查。 通过审查，综合评定申请人是否有能力实施危险品航空运输。
第十二条 民航地区管理局做出准予许可决定的，应当向申请人颁发《国内经营人危险品航空运输许可》（ 见附表三） 。
民航地区管理局作出不予许可决定的，应当自作出决定之日起十日内书面通知申请人，说明理由，告知申请人依法享有申请行政复议或提起行政诉讼的权利， 并出具《 民用航空不予行政许可决定书》（ 见附表四） 。
第三章 外国经营人危险品航空运输许可程序
第十三条 申请在外国地点和中国地点间的定期航线上运输危险品的外国经营人应当在预计开始运输危险品之日六十日前，提交下列材料：
（ 一） 《 外国经营人危险品航空运输许可申请书》 （ 见附表五） ；
（ 二） 外国经营人所在国民航主管部门颁发的危险品航空运输许可或者等效文件；
（ 三） 拟实施危险品航空运输的经营范围和危险品的类别；
（ 四） 外国经营人所在国民航主管部门批准的危险品航空运输手册或者等效文件；
（ 五） 外国经营人所在国民航主管部门批准的危险品培训大

纲或者等效文件；
（ 六） 民航局颁发给该外国经营人的航线经营许可证的复印件；
（ 七） 符合《民用航空危险品运输管理规定》、《危险品航空运输培训管理办法》及《技术细则》有关培训要求的说明；
（ 八） 民航局要求的其他材料。
第十四条 外国经营人申请在外国地点和中国地点间的定期航线上运输危险品，拟从事危险品航空运输的经营范围不超出申请人定期航线经营许可范围。
第十五条 外国经营人在外国地点和中国地点间的定期航线上使用湿租航空器运输危险品的，应当按照🎧程序第六条和第八条要求，提交相关材料。
第十六条 外国经营人申请在外国地点和中国地点间的定期航线上运输危险品，提交的申请材料齐全、符合法定形式的，民航地区管理局应受理其申请， 并向申请人出具《 公共航空运输经营人危险品航空运输许可申请受理通知书》（ 见附表二） 。
申请资料不齐全或者不符合法定形式的，民航地区管理局应当场或者在五日内一次性通知申请人需要补充的全部材料，逾期不通知的，自收到申请材料之日起即为受理。
民航地区管理局不予受理申请时，应书面告知申请人，并说明理由。
第十七条 民航地区管理局应当自受理危险品航空运输许可

第十八条 对外国经营人在外国地点和中国地点间的定期航线上运输危险品申请的审查包括对申请人提交的危险品航空运输手册、危险品培训大纲是否符合🎧程序第十三条要求的审查，以及对申请人是否按照危险品航空运输手册建立了危险品航空运输管理和操作程序、应急方案，是否配备了合适的和足够的人员并按照危险品培训大纲完成培训并合格等要求的审查。 通过审查，综合评定申请人是否有能力实施危险品航空运输。
第十九条 民航地区管理局做出准予许可决定的，应当向申请人颁发《外国经营人危险品航空运输许可》（ 见附表六） 。
民航地区管理局作出不予许可决定的，应当自作出决定之日起十日内书面通知申请人，说明理由，告知申请人依法享有申请行政复议或提起行政诉讼的权利， 并出具《 民用航空不予行政许可决定书》（ 见附表四） 。
第二十条 申请在外国地点和中国地点间的不定期飞行时运输危险品的外国经营人，应当在预计飞行日七日前提交下列材料：

（ 五） 同中国境内地面服务代理人签订的地面服务代理协议；
（ 六） 执行不定期飞行相关人员符合《技术细则》 有关培训要求的说明；
（ 七） 民航局或者民航地区管理局要求的其他材料。
第二十一条 外国经营人申请在外国地点和中国地点间的不定期飞行时运输危险品，提交的材料应符合以下要求：
（ 一） 拟从事危险品航空运输的经营范围不超出申请人不定期飞行经营许可范围；
（ 二） 选择的中国境内地面服务代理人以及签订的地面服务代理协议应当满足《民用航空危险品运输管理规定》和《地面服务代理人危险品航空运输备案管理办法》要求。
第二十二条 外国经营人在外国地点和中国地点间的不定期飞行时使用湿租航空器运输危险品的，应当按照🎧程序第六条和第八条要求，提交相关材料。
第二十三条 外国经营人申请在外国地点和中国地点间不定期飞行时运输危险品，提交的申请材料齐全、符合法定形式的，民航地区管理局应受理其申请， 并向申请人出具《 公共航空运输经营人危险品航空运输许可申请受理通知书》（ 见附表二） 。
申请资料不齐全或者不符合法定形式的，民航地区管理局应当场或者在三日内一次性通知申请人需要补充的全部材料，逾期不通知的，自收到申请材料之日起即为受理。
民航地区管理局不予受理申请时，应书面告知申请人，并说明

第二十五条 对外国经营人在外国地点和中国地点间的不定期飞行运输危险品申请的审查包括对申请人提交的外国民航主管部门颁发的危险品航空运输许可、地面服务代理协议是否符合🎧程序第二十条和第二十一条要求的审查，以及对申请人是否按照危险品航空运输手册建立了危险品航空运输管理和操作程序、应急方案，执行不定期飞行相关人员是否按危险品培训大纲培训并合格等要求的审查。 通过审查，综合评定申请人是否有能力实施危险品航空运输。
第二十六条 民航地区管理局做出准予许可决定的，应当向申请人颁发《外经营人危险品航空运输许可》（ 见附表六） 。
民航地区管理局作出不予许可决定的，应当自作出决定之日起十日内书面通知申请人，说明理由，告知申请人依法享有申请行政复议或提起行政诉讼的权利， 并出具《 民用航空不予行政许可决定书》（ 见附表四） 。
第四章 危险品航空运输许可的期限、变更和延期
第二十七条 危险品航空运输许可的有效期最长不超过两
年，外国经营人在外国地点和中国地点间定期航线运输危险品许可有效期不超过外国经营人所在国民航主管部门颁发的危险品许

可的有效期。 出现下列情形之一的，危险品航空运输许可失效：
（ 一） 经营人书面声明放弃；
（ 二） 许可依法被撤销或者吊销；
（ 三） 许可有效期届满后未申请延期。
第二十八条 经营人向地区管理局提出放弃危险品航空运输许可的，由民航地区管理局注销该危险品航空运输许可并出具
《民用航空注销行政许可决定书》（ 见附表七） 。
第二十九条 出现下列情形之一的，民航地区管理局应当依法撤销危险品航空运输许可：
（ 一） 行政机关工作人员滥用职权、玩忽职守做出准予许可决
定；
（ 二） 超越法定职权做出准予许可决定；
（ 三） 违反法定程序做出准予行政许可决定；
（ 四） 对不具备申请资格或者不符合法定条件的申请人准予
行政许可；
（ 五） 被许可人以欺骗、贿赂等不正当手段取得行政许可；
（ 六） 经营人因运营条件发生变化，不再具备安全生产条件；
（ 七） 依法可以撤销行政许可的其他情形。
第三十条 民航局或民航地区管理局依法作出撤销危险品航空运输许可决定的，应出具《民用航空撤销行政许可决定书》（ 见附表八） 。 民航局或民航地区管理局作出撤销许可决定的， 民航地区管理局应注销危险品航空运输许可并出具《民用航空注销行

政许可决定书》（ 见附表七） 。
第三十一条 经营人在其危险品航空运输许可有效期届满后未申请延期的，该许可自动失效，民航地区管理局应对其危险品航空运输许可进行注销，出具《民用航空注销行政许可决定书》（ 见附表七） 。
第三十二条 经营人要求变更危险品运输的经营范围、危险品运输的类别以及湿租航空器运输情况等许可事项的，应当向民航地区管理局提出申请，并提交相关材料。 符合要求的，民航地区管理局应当依法办理变更手续。
第三十三条 危险品航空运输许可持有人申请许可有效期延期的，应当在许可有效期届满前三十日向民航地区管理局提出申请，并提交申请书及发生变更的材料。
第三十四条 民航地区管理局将经营人危险品航空运输许可颁发、失效、变更、延续、注销的情况在相关网站予以公布。
第五章 附 则
第三十五条 香港特别行政区、澳门特别行政区和台湾地区的经营人危险品航空运输许可管理，参照🎧规定有关外国经营人的规定执行。
香港特别行政区、澳门特别行政区经营人的危险品航空运输
许可管理由民航中南地区管理局负责，台湾地区经营人的危险品航空运输许可管理由民航华东地区管理局负责。

第三十六条 🎧程序中的期限以工作日计算，不含法定节假
日。
第三十七条 民航地区管理局办理危险品航空运输许可时，
应当记录许可信息，保存许可材料。
第三十八条 🎧规定要求提交的申请材料，如使用的是中文或者英文以外的其他文字，应当附带准确的中文或者英文译🎧。
第三十九条 🎧程序自 ２０１６ 年 ８ 月 １ 日起施行。 ２０１４ 年 ３月 ７ 日发布的《公共航空运输经营人危险品航空运输许可管理程序》（ ＡＰ－ ２７６－ＴＲ－ ２０１４－ ０１） 同时废止。

The operator’s ground handling agents located in China and the ground handling agreement of dangerous goods transport by air between operator and its ground handling agents shall meet the requirements of Regulation on Transport of Dangerous Goods by Air and Measures on Recording of Ground Handling Agent of Dangerous Goods Air Transport.
（二）自签订危险品地面服务代理协议之日起七日内将协议报民航地区管理局备案；
The operator shall have the ground handling agreement recorded by CAAC regional administration within 7 days after the agreement is signed.
（三）按照《民用航空危险品运输管理规定》、《技术细则》、申请危
险品航空运输许可时提交的危险品航空运输手册以及经审查合格的危险品培训大纲，实施危险品航空运输、危险品培训、信息报告和应急处置；
The operator shall comply with the provisions of Regulation on Transport of Dangerous Goods by Air, Technical Instructions, operator’s dangerous goods air transport manual and approved dangerous goods training program when conduct of dangerous goods air transporting, dangerous goods training, information reporting and emergency response.
（四）按照要求报送危险品航空运输数据。
The operator shall report the data of dangerous goods transported by air as required.
