Hunt Taiwan Film Competition – Copyright License Agreement
本人 （以下稱為授權人）參與由屏科大國際事務處（以下稱為被授權人）主辦之「夯台玩影片競賽活動」，授權人保證參賽作品為授權人自己拍攝並取得音樂與取得被攝者之肖像之合法授權。授權人同意簽署本著作財產權授權同意書（以下稱本授權書），將作品無償且非專屬授權予被授權人，授權內容如下:
I, (hereafter referred to as the “Licensor”), am a willing participant in the “Hunt Taiwan Film Competition” (hereafter referred to as the “Competition”) organized by the NPUST Office of International Affairs (hereafter referred to as the “Licensee”). As such, I hereby declare that my video submission (hereafter referred to as “Submission”) is an original work created by the Licensor, and the music file(s) in the video were obtained from a legal source, and that the person(s) shown in the Submission have also provided the Licensor with rights of portrait in such cases where related rules apply. By signing this document, I, the Licensor, agree to the rules and clauses laid out in this Copyright License Agreement (hereafter referred to as the “Agreement”), and fully grant non-exclusive licensing of the Submission to the Licensee without any claim to compensation.
Terms and Conditions:
第一條 授權標
授權人同意將其攝影並享有著作財產權之 永久非專屬授權予被授權人於全世界各地區基於非營利目的使用。被授權人就本著作有為重製、編輯、改作、發行、散布、出版、出租、公開傳輸、公開播送、公開展示及其他一切著作財產權利用行為之權利，均無需另予通知。
1. Object of License
Regarding the Submission , the Licensor agrees to grant the Licensee non-exclusive perpetual copyright licensing for non-for profit purposes and domestic and overseas promotional activities. The Licensee is also granted unlimited rights to reproduce, edit, modify and/or adapt the Submission and to use it for publication, distribution, leasing, public broadcast, public transmission, and/or public exhibition, in any and all forms, with no need to provide prior notice to the Licensor. The
Licensor also grants the Licensee the ability to sublicense the Submission, non- exclusively, to a third party within the scope of the abovementioned.
第二條 授權期間
授權人同意自報名日起，同意本授權書受權期限為永久，授權人絕無異議。
2. Term of the Agreement:
By signing this Agreement, the Licensor recognizes that upon the day of submission, all copyrights, as mentioned above, will be permanently granted to the Licensee.
第三條 權力瑕疵擔保及協助訴訟義務
3. Warranty against Defects and Litigation Obligations:
一、授權人保證確實擁有本著作之著作權或其他相關合法權利，得授與本授權書所約定之非專屬授權，並擔保本著作及本授權書之授權絕無違反著作權或其他法規之情事，如有違法而致授權人遭受損害時，被授權人得像授權人請求全部之損害賠償，授權人願負一切法律責任。
(1) The Licensor hereby declares that at the time of the signing of this Agreement, he/she is the lawful owner of the copyrights and other relevant legal rights to the Submission, andtherefore can legally grant the non-exclusive licensing rights of the Submission to the Licensee. The Licensor also guarantees that the Submission in no way violates the Copyright Act or other applicable laws, and that if any violations to these result in any injuries and/or damages to the Licensee, the Licensor will accept full legal responsibility and be held fully liable forthe injuries and/or damages caused to the Licensee.
二、授權人如因本授權書標的，遭致第三人主張侵害著作權及其他相關權利時，應於知悉後以書面通知授權人，授權人負全力協助處理解決之義務，以確保被授權人之權益。如最後經法院確定判決或經授權人同意之和解、調解，被授權人應賠償該第三人時，授權人應負被授權人因此所受之一切損害（包括但不限於於訴費用、律師費用等。）
(2) In the case that a dispute arises with the Licensee in which a third party claims that the Licensor’s Submission damages or infringes on his/her copyrights or other relevant legal rights, the Licensee shall inform the Licensor in writing. It will then be the Licensor’s responsibility to assist in settling the dispute to safeguard the rights
and interests of the Licensee. If said claim eventually results in a court verdict and the Licensee is deemed liable and therefore must pay damages to said third party, the Licensor shall be held responsible and pay the Licensee for all damages related to the court case, including, but not limited, to litigation expenses, retainer fees, and damage costs.
以上，恐口說無憑，授權人特簽署本授權書已表同意。
