承保范围:
1. 本保险承保下列 4,5,6,7 各条规定除外责任以外的一切风险所造成的保险标的物灭失或损坏。
2. 本保险承保共同海损和救助费用。其理算或确定应根据运输契约和(或)有关法律和惯例办理。该项共同海损和救助费用的产生,应为避免任何原因所造成的或与之有关的损失所引起的,但下列 4,5,6,7 各条或本保险其他条款规定的不保责任除外。
3. 本保险负责赔偿被保险人根据运输契约订有“船舶互撞责任”条款规定,由被保险人应付的比例责任,视作本保险单项下应予补偿的损失。如果船东根据上述条款提出任何索赔要求,被保险人同意通知保险人,保险人有权自负费用为被保险人就此项索赔进行辩护。
除外责任
4. 本保险在任何情况下不负赔偿的责任
4.1 被保险人故意不法行为所造成的损失或费用
4.2 保险标的物的自然渗漏,重量或容量的自然损耗,或自然磨损
4.3 由于保险标的物包装不固或包装不当或装配不当造成的损失或费用。(本条所称的“包装”,包括用集装箱或大型海运箱装载的,但该项装载以本保险开始生效前完成或由被保险人或其受雇人完成的为限)。
4.4 由于保险标的物的本质缺陷或特性造成的损失和费用。
4.5 直接由延迟引起的损失和费用,即使延迟是由于承保风险所引起(上述第 2 条可以赔付的费用除外)。
4.6 由于船舶所有人、经理人、租船人或经营人破产或不履行债务造成的损失或费用。
4.7 由于使用任何原子或核子裂变和(或)聚变或其他类似反应或放射性作用或放射性物质的战争武器造成的损失或费用。
5.
5.1 本保险在任何情况下不负责被保险人或其雇员在货物装船时已知情的船舶或驳船的不适航,以及船舶、驳船、运输工具、集装箱或大型海运箱不适于安全运输保险标的物所引起的损失或费用。
5.2 保险人放弃提出关于船舶违反适航适货默示保证的权利,但保险人或其雇员知道该不适航或不适货除外。
6. 本保险在任何情况下不负下列原因造成的损失和费用
6.1 战争、内乱、革命、叛乱、造反或由此引起的内乱,或交战国或针对交战国的任何敌对行为。
6.2 捕获、拘留、扣留、禁制、扣押(海盗行为除外)以及这种行为的后果或这方面的企图。
6.3 遗弃的水雷、鱼雷、炸弹或其他遗弃的战争武器。
7. 本保险在任何情况下不保下列原因造成的损失和费用
7.1 直接由罢工者、被迫停工工人或参与工潮、暴动或民众骚乱人员
7.2 间接由罢工、被迫停工、工潮、暴动或民众骚乱
7.3 任何恐怖主义者或者任何人出于政治目的采取的行动。
期限
8.
8.1 本保险责任自货物运离保险单所载明的起运地仓库或储存处开始运输起生效,包括正常运输过程,直至运到下述地点时终止
8.1.1 保险单所载明的目的地收货人或其他最后仓库或储存处所,
8.1.2 在保险单所载明的目的地之前或目的地任何其他仓库或储存处所,由被保险人选择用作,
8.1.2.1.在正常运输过程之外储存货物,或
8.1.2.2.分配或分派货物,或者:
8.1.3 被保险货物在最后卸载港全部卸离海轮后满 60 天为止以上各项以先发生为准。
8.2 如货物在本保险责任终止前于最后卸载港卸离海轮,须转运到非保险xxx的其他目的地时,保险责任仍按上述规定终止,但以该项货物开始转运时止。
8.3 在被保险人无法控制的运输延迟、任何绕道、被迫卸货、重新装载、转运以及船东或租船人运用运输契约赋予的权限所做的任何航海上的变更的情况下,本保险仍继续有效(但需按照上述有关保险终止期限和下述第 9 条的规定办理)。
9. 如由于被保险人无法控制的情况,致使运输契约在非保险xxx的目的地的港口或处所终止,或者运输在按上述第 8 条规定交货前终止,本保险亦应终止,除非被保险人立即通知保险人并提出续保要求,并在必要时加缴保险费的情况下,本保险继续有效
9.1 直至货物在该港口或处所出售和交货,或,除非有特别约定,在被保险货物抵达该港口或处所后,满 60 天为止,以先发生为准,
或
9.2 如果货物在上述 60 天期限内(或任何约定的延长期限内),继续运往保险单所载明的目的地或任何其他目的地时,保险责任仍按上述第 8 条的规定终止。
10.当本保险责任开始后,被保险人变更目的地,应立即通知保险人,经另行商定保险费和条件,本保险仍然有效。
理赔
11.
11.1 在发生损失时,被保险人必须对保险标的具有可保利益,才能获得本保险单项下的赔偿。
11.2 被保险人有权按照上述 11.1 条的规定,对在本保险期限内发生的承保损失获得赔偿,即使损失发生在保险契约之前。但在缔约时被保险人已经知道损失发生,而被保险人并不知晓者除外。
12.由于承保的风险造成运输航程在非保险单所载明的港口或处所终止,被保险人为将保险标的卸下、存仓和转运至保险单所载明的目的地所支出的运费及其他任何正当和合理的额外费用,均由保险人负责赔偿。
第 12 条不适用于共同海损或救助费用,并须按照上述 4、5、6、7 各条所载除外责任的规定办理,还不包括由于被保险人或其雇员的过失、疏忽、破产或不履行债务而引起的费用。
13.本保险不负责推定全损除非保险标的的实际全损似已不可避免,或者由于恢复、整理以及运送保险标的到保险目的地的费用超过其本身价值,并在保险标的被合理委付情况下,得按推定全损赔偿。
14.
14.1 如果被保险人对本保险单项下承保的货物办理任何增值保险,则货物
的约定价值应视为增至本保险的保险金额加上所有承保该项损失的增值保险保额的总和。本保险的责任按照本保险金额与总保险金额的比例计算。
被保险人提出索赔时,应向保险人提供其所有保险单所保金额的证件。
14.2 当本保险承保承保增值保险时,则适用下述条款:
货物的约定价值应视为等于原有的保险单项下的总保险额和被保险人对该项损失投保所有增值保险保额的总和。本保险应按其保险金额中的比例,承担赔偿责任。
被保险人提出索赔时,应向保险人提供其所有保险单所保金额的证件。
保险受益
15.承运人或其他受托人不得享受本保险的权益。减少损失
16.当发生本保险承保的损失时,被保险人及其雇员和代理人有义务
16.1 为避免或减少损失而应采取合理措施
16.2 保证适当保留和行使对承运人、受托人或其他第三者追偿的权力
保险人除负责赔偿承保责任内的任何损失外,还应对被保险人因履行这些义务而支出的任何适当或合理费用给予补偿。
17.被保险人或保险人为施救、保护或恢复保险标的所采取的措施,不应视为放弃或接受委付的表示,或视为影响任何一方的权益。
防止延误
18.本保险条件之一是被保险人应在任何力所能及的情况下,尽快合理地处置所发生的事情。
法律和惯例
19.本保险适用英国法律和惯例
附注:当被保险人获知发生本保险“可能承保”的事件时,必须立即通知保险人,其对本保险的权利取决于是否履行上述义务。
CATHAY INSURANCE COMPANY LIMITED INSTITUTE CARGO CLAUSES (A)
RISKS COVERED
1 This insurance covers all risks of loss of or damage to the subject-matter insured except as provided in Clauses 4, 5, 6 and 7 below.
2 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 or elsewhere in this insurance.
3 This insurance is extended to indemnity the Assured against such proportion of liability under the contract of affreightment “Both to Blame Collision” Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim.
EXCLUSIONS
4 In no case shall this insurance cover
4.1 loss damage or expense attributable to wilful misconduct of the Assured
4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured
4.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured (for the purpose of this Clause
4.3 “packing” shall be deemed to include stowage in a container or liftvan but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)
4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured
4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)
4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel
4.7 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
5 5.1 In no case shall this insurance cover loss damage or expense arising from
unseaworthiness of vessel or craft,
unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject-matter insured,
where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein.
5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness.
6 In no case shall this insurance cover loss damage or expense caused by
6.1 war civil war revolution rebellion insurrection, or civil strife xxxxxxx xxxxxxxxx, or any hostile act by or against a belligerent power
6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat
6.3 derelict mines torpedoes bombs or other derelict weapons of war.
7 In no case shall this insurance cover loss damage or expense
7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions
7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions
7.3 caused by any terrorist or any person acting from a political motive.
DURATION
8 8.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either
8.1.1 on delivery to the Consignees’ or other final warehouse or place of storage at the destination named herein,
8.1.2 on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either
8.1.2.1 for storage other than in the ordinary course of transit or
8.1.2.2 for allocation or distribution, or
8.1.3 on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the overseas vessel at the final port of discharge,
whichever shall first occur.
8.2 If, after discharge overside from the oversea vessel at the final port of discharge, but prior to the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, nce, shall not extend beyond the commencement of transit to such other destination.
8.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.
9 If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either
9.1 until the goods are sold and delivered at such port or place, or unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur,
or
9.2 if the goods are forwarded within the said period of 60 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.
10 Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.
CLAIM
11 11.1 In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss.
11.2 Subject to 11.1 above, the Assured shall be entitled to cover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.
12 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject-matter is covered under this insurance, the Underwriters will reimburse
the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.
This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 4, 5, 6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.
13 No claim for Constructive Total Loss shall be recoverable hereunder unless the subject-matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to the destination to which it is insured would exceed its value on arrival.
14 14.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
14.2 Where this insurance is on Increased Value the following clause shall apply:
The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.
BENEFIT OF INSURANCE
15 This insurance shall not inure to the benefit of the carrier or other bailee.
MINIMISING LOSSES
16 It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder
16.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss,
and
16.2 to ensure that all rights against carriers, bailees or other third parties are
properly preserved and exercised
and the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.
17 Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.
AVOIDANCE OF DELAY
18 It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.
LAW AND PRACTICE
19 This insurance is subject to English law and practice.
NOTE:- It is necessary for the Assured when they become aware of an event which is “held covered” under this insurance to give prompt notice to the Underwriters and the right to such cover is dependent upon compliance with this obligation.
