EVALUATION OF CONSULTANT. The CONSULTANT shall be evaluated against its ability to meet the Performance Measures specified in Appendix C. Neither ALAMEDA CTC’s review, acceptance, nor payment for any of the services required under the AGREEMENT shall be construed to operate as a waiver of any rights under the AGREEMENT or of any cause of action arising out of the performance of the AGREEMENT, and the CONSULTANT shall be and remain liable to ALAMEDA CTC in accordance with applicable law for all damages to ALAMEDA CTC caused by the CONSULTANT’s negligent performance of any of the services furnished under the AGREEMENT.

EXHIBIT A SCOPE OF WORK General Requirements The Scope of Work for the State Route 227 (SR-227) and Los Ranchos Road Intersection Operational Improvements Project has been developed by Xxxx Engineering Company (XXXX) based upon the Request for Proposal (RFP) PS-1497, visits to the project site, RICK’s understanding of the concerns of the public based on the County’s previous public outreach efforts, and coordination with the County of San Xxxx Obispo. The project is funded through the San Xxxx Obispo Council of Governments (SLOCOG) with Regional State Highway Account (RSHA) funds and through the Federal Highway Administration’s Congestion Mitigation and Air Quality (CMAQ) program. The majority of this project is within Caltrans right of way. It has been determined that the project is eligible for processing as a Permit Engineering Evaluation Report (PEER) in accordance with Caltrans Project Development Procedures Manual. All documents, reports, plans, specifications, drawings, and estimates are subject to review and approval by the County and Caltrans. XXXX will prepare plans, specifications, and estimates in English units in accordance with applicable state laws, Caltrans’ Encroachment Permit requirements, and in line with the criteria contained in the latest editions of the following: • Caltrans Highway Design Manual • Caltrans Standard Plans and Specifications • Caltrans Standard Special Provisions • California Manual on Uniform Traffic Control Devices • Caltrans Plans Preparation Manual • Caltrans CADD User Manual • NCHRP Report 672 Roundabouts: An Informational Guide • Traffic Operations Policy Directive 13-02 All deliverables will be provided in pdf format as well as hard copy per County and Caltrans practice. Plans will be plotted directly from AutoCAD to pdf, so that pdf files are of a high quality. Electronic files (MS Word, MS Excel, AutoCAD Civil 3D format, MS Project, etc.) with all supporting files will also be provided to the County. Plans will be prepared and provided in AutoCAD Civil 3D.
