Not an Employee Benefit Plan. In any instance in which Section 12.1 does not apply, the Employer must permit employees to establish 403(b) accounts in accordance with Department of Labor Regulations Section 2510.3-2(f) so that the Account will not be deemed to be an employee pension benefit plan for purposes of the Employee Retirement Income Security Act of 1974, as amended. The Employer will be responsi- ble for compliance with the requirements of Code Section 403(b)(12)(i), and the Custodian will have no responsibility for insuring that the Employer so complies.
