Scope of Operations. The parties hereto acknowledge that the Company’s operations are within the continental United States, and that it conducts business throughout the continental United States, thus, the Company’s need for protection against unfair competition is throughout the continental United States.

Scope of Operations. A. While assigned to work with DPS, the LGEE employee will work on projects or operations in support of DPS as agreed upon by LGEE and DPS. LGEE will ensure its employee operates in accordance with DPS policies and procedures, which includes policies about physical access and network and systems access. When required, LGEE will require the LGEE employee to agree to and sign Non-disclosure Agreements, access policies, CJIS certifications, and any other documents that DPS deems necessary.
Scope of Operations. From the Final Closing Date until termination of this Agreement, in addition to the conduct of Phase III clinical trials ("TRIALS") and in accordance with the terms of the Operations Agreement (as described in Section 9 below), ICC shall operate the OncoVax Center for the manufacture of OncoVax and other oncological products as agreed to by the parties and shall provide, or arrange for the provision of, such products to cancer patients to the extent permitted by applicable law (the "OPERATIONAL PHASE"). Intracel and Lehigh agree to cooperate in coordinating publicity with the respect to the operation of the OncoVax Center during the Operational Phase.
Scope of Operations. The scope of Operations to be conducted by the Operator as contract operator of the Facilities are generally described in the Operations Manual. Notwithstanding the foregoing, in carrying out Operations hereunder, the Operator shall be responsible for conducting all operations necessary to operate the Facilities at the standards set out herein, whether or not such operations are described in the Operations Manual, other than those operations or activities which the Commission has expressly agreed to be responsible for pursuant to this Agreement. Any standards which apply to the Operation of the Facilities must be reasonable. Any change in such standards made by the Commission after this Agreement is executed shall only come into effect after notification to the Operator.

Scope of Operations. During the term of this Agreement, Contractor may contact Carrier from time to time to determine whether Carrier has any shipments that require transportation. In the event Carrier has shipments that Contractor agrees to transport, Xxxxxxx shall notify Contractor of material to be transported and of the time and location to load same, all within a reasonable time prior to the required delivery time. Thereafter, Contractor will, without delay, cause said material to be transported to the place designated by Carrier or by Carrier’s representative. This Agreement shall not be construed as an agreement by Carrier to furnish any specific amount of goods, materials, or loads for transportation by Contractor in any particular time or place. Carrier makes no guarantee of minimum payment for use of the Contractor Equipment. Likewise, Contractor shall have the right, at its discretion, to decline to transport any shipment tendered to it by Carrier, or to refuse to perform specific requests by Carrier to provide transportation. Contractor shall have the right to perform transportation services for other Carriers, but this Agreement shall be terminated at such times. Contractor shall perform transportation and related services as may be necessary to serve Carrier’s Customers to protect customers’ cargo against loss and damage. Except as provided in Appendix A, all services hereunder will be provided by the Contractor Equipment under Contractor's DMV operating authority. Contractor or another employed person with an appropriate commercial driver’s license may provide the transportation services required hereunder. Contractor shall maintain all insurance coverage required by law and Section 9 of this Agreement in full force and effect for the full term of this Agreement. In the event of a lapse in Contractor's insurance coverage, said lapse will constitute a material breach of this Agreement. Contractor warrants that the Contractor Equipment is in good state of repair, meets all safety requirements of all applicable Federal and State laws and is properly licensed and permitted for operation in the State of California, and that all licensing conditions and safety requirements that may be applicable for continued legal operation of the Contractor Equipment shall be followed. Contractor shall not obligate Carrier for payment of any expense associated with licensing of the Contractor Equipment. Scope of Operations. Party B shall grant to Party A credit facilities in accordance with the provisions hereof, subject to compliance with this Agreement and relevant individual agreements and Party A may apply to Party B to utilize such credit facilities on a revolving, accommodative, or one-off basis in connection with the handling of RMB Export Finance Operations, Letter of Guarantee Operations and other credit facility grant operations (“Individual Credit Facility Operations”). For the purpose hereof, the term “Export Finance Operations” includes the issuance of an international L/C or a domestic L/C, provision of bank guarantee for the taking delivery of goods; import xxxx advances, packing finance, export xxxx purchases, discounting of drafts accepted under usance L/C, domestic L/C buyer xxxx advances, domestic L/C seller xxxx purchases, domestic L/C negotiation and other international and domestic trade finance operations. For the purpose hereof, the term “Letter of Guarantee Operations” includes the issuance of letters of guarantee/standby L/Cs and various international and domestic letter of guarantee operations.
Scope of Operations. Subject to Article 4 herein, CONTRACTOR shall be responsible for the operations involved in arranging for and carrying out the tow of its Rig to the drilling location, the ballasting, rigging up, the complete operations of the Rig, including anchoring, and for the overall direction of the moving operations from the drilling location. CONTRACTOR shall perform Work in accordance with COMPANY's overall requirements and with Appendix D. Each well site, including the anchor pattern, shall be surveyed and marked by COMPANY so as to enable CONTRACTOR to properly position the Rig at the location and COMPANY, at CONTRACTOR's request, shall furnish CONTRACTOR with a copy of said survey. At CONTRACTOR's request, COMPANY will also provide (or reimburse CONTRACTOR as applicable) CONTRACTOR with soil and sea bottom condition surveys, soil borings, pipeline surveys, side-scan or Mezotech surveys at each location adequate to satisfy CONTRACTOR's marine surveyor. In the event of delay in the commencement of drilling due to such obstructions, impediments and/or hazards, or due to moves of the Rig in order to achieve adequate and proper seabed anchor support, or any other delay due to denial of access to the location for any cause not within the control of CONTRACTOR, CONTRACTOR shall be paid at the Standby Rate during the entire period of such delay, plus the costs of any boats required by CONTRACTOR to move or re-position the Rig. Notwithstanding any other provisions of this Contract to the contrary, should there be any obstructions within the anchorage area at COMPANY's drilling location and these obstructions damage the Rig or the Rig damages these obstructions then, unless caused by CONTRACTOR's negligence or willful misconduct; (i) to the extent such damage is not covered by CONTRACTOR's insurance, COMPANY shall reimburse CONTRACTOR for such damage to the Rig, and (ii) COMPANY shall indemnify, defend and hold CONTRACTOR harmless from and against any damage to or destruction of said obstructions.
