Section 9.10.2. 5 For the period from September 1 through February 28, any employee who is not absent from work 6 for any time for sick leave, and/or leave without pay, except for a worker’s compensation claim, 7 discretionary leave or FMLA leave, shall receive an award in accordance with the table in 8 Section 9.11.5 below. Payment shall be made on the March pay warrant.

Section 9.10.2. 10 In the event the District reduces an employee’s hours of employment by thirty-one (31) or more 11 minutes of regular daily assigned time, the impacted employee shall have the right to bump, 12 within five (5) working days, any junior employee in their general job classification with 13 substantially the same number of hours. For the purpose of this section the following will 14 apply.
Section 9.10.2. 23 The returning employee will not necessarily be assigned to the identical position occupied 24 before the leave of absence. However, provided a vacancy exists for which the employee is 25 qualified, the employee shall be reinstated to a position equivalent in duties and salary to that 26 held at the time the request for leave of absence was approved.

Section 9.10.2. 21 Positions shall be posted separate from any other District business and shall include all relevant 22 information to the job such as hours of work, duties which will be performed, etc. 24 Section 9.10.3. 25 Positions which are thirty (30) consecutive scheduled workdays or longer shall be posted 26 according to the normal procedure.

An employee hired to fill a vacancy created by a 4 leave of absence will be hired for the period of time during which the leave is effective. Section 9.10.2. 28 Employees shall be eligible to receive Washington Paid Family and Medical Leave (PFML) under 29 the Washington State Paid Family and Medical Insurance Act. The District shall pay the statutory 30 employer wage premium and the employee shall pay the statutory individual wage premiums to 31 fund this leave. Section 9.10.2. ‌ 14 Requests for unpaid leave may be denied by administration to ensure smooth operating 15 conditions and continuity for students who rely on employees being present. If unpaid leave is 16 not approved and the employee does not report for their shift, disciplinary action may result 17 pursuant to Article XII of this agreement.
