Common use of Abandoned Cargo Clause in Contracts

Abandoned Cargo. Notwithstanding the Operator’s other rights under this Tariff, the Operator, at its sole discretion, may assess a charge against the Users responsible for the Abandoned Cargo as provided in Subsection 11.5 for the costs and expenses incurred by the Operator in administrating its rights under Subsections 11.5 and 11.7 of this Tariff. The Operator Charge for this service: (a) if performed by contractors hired by the Operator, shall be the invoiced cost for such removal (including all required permits, inspections or other governmental fees) plus a fee as provided in the Operator Charges;
