Common use of Abandonment or Default Clause in Contracts

Abandonment or Default. Abandon means to relinquish or renounce the Agreement for any reason other than for a force majeure event. If Successful Respondent abandons the Agreement, DIR reserves the right to cancel the Agreement without notice and either re-solicit and re-award the Agreement, or take such further action, or no action, in the best interest of the State. The abandoning Successful Respondent will not be considered in the re-solicitation and may not be considered in future solicitations for the same type of Services unless the specifications or scope of work significantly changes.
