Ability to Find Clients. The Partnership’s investment returns are sensitive to the Partnership’s ability to find clients that require its services. Although the Partnership believes that there is a large demand and opportunity for its services in Canada, it is possible that the Partnership may have difficulty finding a low risk client base that is large enough to require substantially all of the capital that is raised in the Partnership. Capital that is not invested will not earn a return and this may cause the investment returns of the Partnership to differ significantly from expected returns.

Contractor may consult the “Guidance to Render Unsecured Protected Health Information Unusable, Unreadable, or Indecipherable to Unauthorized Individuals” issued by the U.S. Department of Health and Human Services to determine ways to meet this standard.

  • Warranty of Ability to Perform The Contractor warrants that, to the best of its knowledge, there is no pending or threatened action, proceeding, or investigation, or any other legal or financial condition, that would in any way prohibit, restrain, or diminish the Contractor’s ability to satisfy its Contract obligations. The Contractor warrants that neither it nor any affiliate is currently on the convicted vendor list maintained pursuant to section 287.133 of the Florida Statutes, or on any similar list maintained by any other state or the federal government. The Contractor shall immediately notify the Customer in writing if its ability to perform is compromised in any manner during the term of the Contract.
