Ability to Pay. Parent will have available to it as of the Closing sufficient cash to pay the aggregate Merger Consideration to the Exchange Agent for the benefit of the shareholders of the Company.
Ability to Pay. The benefits negotiated for the contract for the FY 2022-2026, will be available from the DISTRICT’S forty percent (40%). These benefits as described for this contract, are contingent upon new monies being available in any given Fiscal Year.
Ability to Pay. To determine ability to pay, the Court shall use the Affidavit of Indigence (Form Four) and inquire on the topics set forth in the attached Compliance Hearing Ability to Pay Inquiry and Determinations (Form Five), as well as any other factors considered by the Court to be relevant. Any determinations that the Court makes regarding ability to pay or willfulness of nonpayment shall be guided by the Bench Card, and applicable law. If a defendant is represented, the Court shall provide the defendant with adequate time to privately confer with defense counsel on the issue of ability to pay prior to the Court’s ability-to-pay inquiry. During the hearing, the Court shall carefully consider the defendant’s responses to each question before making any determination regarding ability to pay and whether nonpayment was willful. If a defendant is unable to provide the information requested by the Court during an ability-to-pay inquiry, the Court shall consider allowing the defendant (and, if applicable, counsel) additional time to gather information to respond to the Court’s questions. The Court shall find that a defendant is unable to pay LFOs when, in consideration of the totality of the circumstances, it finds that the payment of LFOs would impose substantial hardship on the defendant or the defendant’s dependents, including children and elderly parents. There shall be a rebuttable presumption that a person is unable to pay LFOs upon a finding of at least one of the following factors:
Ability to Pay. ARTISTdirect represents and warrants that it has the ability to pay to Yahoo all fees set forth in this Agreement.

Ability to Pay. In the event of an unanticipated catastrophic decline in revenues or an increase in expenditures, defined as a single event which changes revenues or expenditures by twenty percent or more in a single fiscal year, City and Union agree to meet and confer regarding methods to weather the event by means of including, but not limited to, layoffs, deferral of implementation of one or more provisions of the contract, increased revenue generation, etc.

9.2.1. Engineer and Captain Xxxxxxxxxx shall receive one hundred eighty dollars ($180.00) per pay period. Engineer and Captain Xxxxxxxxxx shall receive an additional eighty cents ($0.80) per hour when assigned as the primary Paramedic and will be considered the lead position over the other employees in emergency medical arena. Beginning October 1, 2024, Engineer and Captain Xxxxxxxxxx shall receive an additional five dollars ($5.00) per hour when assigned as the primary Paramedic and will be considered the lead position over the other employees in emergency medical arena
9.3.1. The Fallbrook Firefighters’ ASSOCIATION and the North County Fire Protection DISTRICT agree that changes to the Policies 910.04 Acting Engineer, 910.05 Acting Captain and 910.06 Acting Chief Officer are necessary to ensure that actors maintain a high level of skill in those positions. Therefore, the DISTRICT in conjunction with regular promotional testing, will conduct a skill evaluation examination as outlined in eligibility maintenance in the listed policies.
9.3.2. To be eligible for the wage scale step(s) designated as, “Certified,” an EMPLOYEE shall provide documentation verifying completion of all requirements as specified in Article 21, Section 8 for the desired classification.
9.3.3. To be eligible for the wage scale step(s) designated as, “Acting,” an EMPLOYEE shall pass the promotional examination or pass an interim examination administered by the DISTRICT for the desired classification.
9.3.4. An EMPLOYEE who successfully passes an interim examination shall take and pass the next promotional examination or lose their Acting status.
