Common use of Acceptance Not Waiver Clause in Contracts

Acceptance Not Waiver. The City's approval of drawings, designs, plans, specifications, reports and incidental work or materials furnished hereunder shall not in any way relieve Professional of responsibility for the technical accuracy of the Services. The City's approval or acceptance of, or payment for, any Services shall not be construed or operate as a waiver of any rights under this Agreement or of any cause of action arising out of the performance of this Agreement.

The City's CITY’S approval of drawings, designs, plans, specifications, reports reports, and incidental work or materials furnished hereunder shall not in any way relieve Professional of Contractor from responsibility for the technical accuracy of the Serviceswork. The City's CITY’S approval or acceptance of, or payment for, any Services services shall not be construed or to operate as a waiver of any of the CITY’S rights under this Agreement or any of any cause of action its legal rights under statute and common law arising out of the performance of this Agreement.
