Common use of Acceptance Not Waiver Clause in Contracts

Acceptance Not Waiver. The City's and/or Service Provider’s approval or acceptance of, or payment for any of the services under this Agreement shall not be construed to operate as a waiver of any rights provided to the parties under this Agreement or any cause of action arising out of this Agreement. The failure to invoke remedies with respect to any particular act or omission constituting a breach shall not be regarded as a waiver with respect to any other or successive act or omission constituting a breach.
