ACCEPTANCE OF FINAL PAYMENT CONSTITUTES RELEASE. Contractor’s or Contractor’s successors’ acceptance of final payment under this Agreement, shall constitute a full and complete release of Owner from any and all Claims, demands, and causes of action whatsoever which Contractor or Contractor’s successors have or may have against Owner under the provisions of this Agreement except those previously made in writing and identified by Contractor as unsettled at the time of the final request for payment.

Contractor’s or Contractor’s successors’ The acceptance of final payment under this Agreement, shall constitute a full and complete release of Owner from any and all Claims, demands, and causes of action whatsoever which by the Contractor or Contractor’s successors have or may have against Owner under the provisions of this Agreement except those previously made in writing and identified by Contractor as unsettled at the time of the final request payment shall be and shall operate as a release to the Owner of all claims and of all liability to the Contractor for all things done or furnished in connection with this Work and for every act and neglect of the Owner and others relating to or arising out of this Work, excepting the Contractor's claims for interest upon the final payment if this payment be improperly delayed. No payment, however, final or otherwise, shall operate to release the Contractor or his sureties from any obligations under this Contract or the Performance Bond.
