Where: (a) at the Commencement Date, Equipment, and any structures related to that Equipment, that are owned or leased by the Customer are on Transpower property; and (b) Transpower and the Customer do not have a written agreement in place in relation to access and occupation for such Equipment and structures; and (c) such Equipment and structures are not “Existing Works” as defined in the Act, then the Customer's rights of access to and over Transpower's property will be in accordance with the terms set out in Schedule 6 (Access and Occupation).
