Access by Non-Members. (a) Access to the Revo Fitness Facilities is only provided to Members and you are not permitted to bring Non-Members into any Revo Fitness Facility.
(b) If we determine you have breached clause 5.2(a);
(i) you accept full responsibility and liability on your behalf and agree to indemnify, hold harmless and release Revo Fitness from and against all claims, liabilities, injury, illness, loss or damage attributed to the by you, it being agreed that this amount represents a genuine pre- estimate of the loss suffered by Revo Fitness due to the breach of your obligations in this clause 5.2(a); and
Access by Non-Members. (a) Access to the Revo Fitness Facilities is only provided to Members and you are not permitted to bring Non-Members into any Revo Fitness Facility.
(b) If we determine you have breached clause 5.2(a);
(i) you accept full responsibility and liability on your behalf and agree to indemnify, hold harmless and release Revo Fitness from and against all claims, liabilities, injury, illness, loss or damage attributed to the Non-Member or the Non-Member’s access, whether or not caused by any negligence of Revo Fitness;
(ii) you agree to pay to Revo Fitness an Additional Person Fee for each day, and for each person, granted access to the Revo Fitness Facilities by you, it being agreed that this amount represents a genuine pre- estimate of the loss suffered by Revo Fitness due to the breach of your obligations in this clause 5.2(a); and
(iii) we reserve the right to cancel your Membership in accordance with clause 3.10(b) if you breach this clause 5.2.
Access by Non-Members. (a) Access to the Revo Fitness Facilities is only provided to Members and you are not permitted to bring Non-Members into any Revo Fitness Facility.
(b) If we determine you have breached clause 5.2(a);
(i) you accept full responsibility and liability on your behalf and agree to indemnify, hold harmless and release Revo Fitness from and against all claims, liabilities, injury, illness, loss or damage attributed to the Non- Member or the Non-Member’s access, whether or not caused by any negligence of Revo Fitness;
(ii) you agree to pay to Revo Fitness an Additional Person Fee for each day, and for each person, granted access to the Revo Fitness Facilities by you, it being agreed that this amount represents a genuine pre-estimate of the loss suffered by Revo Fitness due to the breach of your obligations in this clause 5.2(a); and
(iii) we reserve the right to terminate your Membership in accordance with clause 3.8(d) if you breach this clause 5.2.
(i) You must wear appropriate clothing while using the Revo Fitness Facilities, in the discretion of the Revo Fitness staff. Work clothes, boots and casual clothes that are not sportwear are not permitted.
(ii) You must wear appropriate enclosed sport shoes at all times while using the equipment or fitness area.
(iii) If you do not wear appropriate clothing or shoes, we may ask you to leave the Revo Fitness Facilities.
Access by Non-Members. (a) Fast Twitch only grants Members, unless otherwise specified in this Agreement, access to the Club. No Member is permitted to bring a non-Member into the Club.
(b) If a Member breaches clause 28(a) of this Agreement, the Member acknowledges that:
(i) they accept responsibility and liability on their personal behalf for any injury, loss or damage attributed to the non-Member whether or not caused through the negligence of the Club;
Access by Non-Members. (a) No member is permitted to bring into or allow to remain a non-member at a venue during unstaffed hours.
(b) If a Member breaches clause 7(a) of this Agreement, the Member acknowledges that:
(i) they accept all responsibility and all liability on their personal behalf for any and all injury, loss or damage attributed to the non-member.
(ii) the act of bringing a non-member during unstaffed hours into a venue or allowing a non-member to remain at a venue during unstaffed hours constitutes automatic acceptance by the member of a new membership for the non-member.
(1) for a Member who holds a direct debit membership, this amount will be deducted from their nominated bank account.
(2) for a Member who holds a monthly or annual membership, the member will receive an invoice for this amount.
(c) Indoor Archery WA reserves the right to terminate the membership of the member who brings a non-member into or allows a non-member to remain at a venue during unstaffed hours.
Access by Non-Members. (a) Fast Twitch only grants Members, unless otherwise specified in this Agreement, access to the Club. No Member is permitted to bring a non-Member into the Club.
(b) If a Member breaches clause 28(a) of this Agreement, the Member acknowledges that:
(i) they accept responsibility and liability on their personal behalf for any injury, loss or damage attributed to the non-Member whether or not caused through the negligence of the Club;
(ii) you will be subject to clause 9 and the associated tailgate fee;
(iii) the act of bringing a non-Member into the Club on more than one occasion constitutes automatic acceptance by the Member of a new membership for the non-Member. The Joining Fee and all other fees relevant to services used, in addition to the DD Membership Fee, will be charged to the Member in the following ways:
(1) for a Member who holds a DD Membership, this amount will be deducted from their nominated bank account; and
(2) for a Member who holds a PIA Membership, the Member will receive an invoice for this amount;
(iv) payment of the amount in accordance with the clause above will entitle the non-Member to use the Club for one fortnight;
(v) in order for the non-Member to take advantage of the new membership, they will need to attend the relevant Club and comply with all of the obligations that all new Members are required to comply with pursuant to this Agreement; and
(vi) Fast Twitch reserves the right to terminate the membership of the Member who brings a non-Member into the Club.
Access by Non-Members. (a) Access to the Revo Fitness Facilities is only provided to Members and you are not permitted to bring Non-Members into any Revo Fitness Facility.
(b) If we determine you have breached clause 5.2(a);
(i) you accept full responsibility and liability on your behalf and agree to indemnify, hold harmless and release Revo Fitness from and against all claims, liabilities, injury, illness, loss or damage attributed to the NonMember or the Non-Member’s access, whether or not caused by any negligence of Revo Fitness;
(ii) you agree to pay to Revo Fitness an Additional Person Fee for each day, and for each person, granted access to the Revo Fitness Facilities by you, it being
Access by Non-Members. (a) Except for Casual Visitors, Ninja Academy only grants the Member, unless otherwise specified in this Agreement, access to the Centre. No Member is permitted to bring a non-Member into the Centre.
(b) If a Member breaches the preceding clause 11(a), the Member acknowledges that:
(i) the Member accepts responsibility and liability on their personal behalf for any injury, loss or damage attributed to the non-Member whether or not caused through any negligent act or omission of Ninja Academy;
(ii) the act of bringing a non-Member into the Centre constitutes automatic acceptance by the Member of a new membership for the non-Member which will be charged to the Member accordingly;
(iii) Ninja Academy reserves the right to terminate the membership of a Member who brings a non-Member into the Centre.
Access by Non-Members. (a) Preston Health and Fitness only grants Members, unless otherwise specified in this Agreement, access to the Club. No Member is permitted to bring a non-Member into the Club.
(b) If a Member breaches clause 7(a) of this Agreement, the Member acknowledges that:
(i) they accept responsibility and liability on their personal behalf for any injury, loss or damage attributed to the non-Member whether or not caused through the negligence of Preston Health and Fitness;
(ii) the act of bringing a non-Member into the Club constitutes automatic acceptance by the Member of an automatic fine. A fee of $150 will be charged to the member.
(1) for a Member who holds a DD Membership, this amount will be deducted from their nominated bank account; and
(2) for a Member who holds an UF Membership, the Member will receive an invoice for this amount;
Access by Non-Members a) The Shire only grants Members access to the Centre. No Member is permitted to bring a non-Member into the Centre.
b) If a Member breaches clause 7(a) of this Agreement, the Member acknowledges that:
i. they accept responsibility and liability on their personal behalf for any injury, loss or damage attributed to the non-Member whether or not caused through the negligence of the Shire;
ii. The Shire reserves the right to terminate the membership of the Member who brings a non-Member into the Centre.
