Common use of Access to Certain Information Clause in Contracts

Access to Certain Information. Each of the Master Servicer and the Special Servicer shall provide or cause to be provided to the other such party, the Depositor, the Trustee and the Rating Agencies, and to the OTS, the FDIC, and any other federal or state banking or insurance regulatory authority that may exercise authority over any Certificateholder, access to any documentation regarding the Mortgage Loans and the other assets of the Trust Fund that are within its control which may be required by this Agreement or by applicable law. Such access shall be afforded without charge but only upon reasonable prior written request and during normal business hours at the offices of the Master Servicer or the Special Servicer, as the case may be, designated by it.

Each of the Master Servicer and the Special Servicer shall provide or cause afford to be provided to the other such party, the Depositor, the Trustee and the Rating AgenciesDepositor and, and to the extent required by applicable regulations, to the OTS, the FDIC, FDIC and any other federal or state banking or insurance regulatory authority that may exercise authority over any Certificateholder, access to any documentation records regarding the Mortgage Loans and the other assets of the Trust Fund that are its servicing thereof within its control which may be required control, except to the extent it is prohibited from doing so by this Agreement applicable law or by contract or to the extent such information is subject to a privilege under applicable law. Such access shall be afforded without charge but only upon reasonable prior written request and during normal business hours at the offices of the Master Servicer or the Special Servicer, as the case may be, designated by it.
