Common use of Access to Subscriber Information Clause in Contracts

Access to Subscriber Information. (a) Except to the extent prohibited by Law or confidentiality policies of general applicability of SBC or its Affiliates that have been communicated in writing to Prodigy and Operating Partnership, SBC will furnish Prodigy and Operating Partnership with such information concerning Legacy Subscribers that are managed by Prodigy and Operating Partnership as Prodigy and Operating Partnership may reasonably request. Except to the extent prohibited by Law or confidentiality policies of general applicability of Prodigy or Operating Partnership or any of their Affiliates that have been communicated in writing to SBC, each of Prodigy and Operating Partnership will furnish SBC with such information concerning SBC Subscribers and Legacy Subscribers SBC or its Affiliates may reasonably request. (b) Neither Prodigy nor Operating Partnership may directly or indirectly utilize any Subscriber information in connection with Marketing any Telecommunications Service, Value Added Data Service, or electronic yellow or white pages unless such action complies with the requirements of Section 3.5; provided, however, that in no event may Prodigy or Operating Partnership directly or indirectly utilize any Subscriber information in connection with Marketing any Telecommunications Service, Valued Added Data Service, electronic yellow or white pages of a SBC Designated Entity.

(b) Except as provided in Section 4.2(b), no Party may directly or indirectly utilize any Subscriber information in connection with the Marketing or Delivery of any Retail ISP Service other than the Prodigy Service. Neither Prodigy nor Operating Partnership may directly or indirectly utilize any Subscriber information in connection with Marketing any Telecommunications Service, Value Added Data Service, or electronic yellow or white pages unless such action complies with the requirements of Section 3.52.8; provided, however, that in no event may Prodigy or Operating Partnership directly or indirectly utilize any Subscriber information in connection with Marketing any Telecommunications Service, Valued Added Data Service, electronic yellow or white pages of a SBC Designated Entity.
