Common use of Access to Work and Notification of Excavation Clause in Contracts

Access to Work and Notification of Excavation. Design-Builder shall provide Owner, Owner’s Design-Build Consultant, and Owner’s Representative access to the Work in progress wherever located. Before commencing any excavation, Design-Builder shall notify Owner and shall provide notice of the scheduled commencement of excavation to all Owners of underground facilities or utilities, through locator services. The term “excavation” for purposes of the preceding sentence means an operation in which earth, rock, or other material on or below the ground is moved or otherwise displaced by any means, except the tilling of soil less than twelve (12) inches in depth for landscape purposes.
