Common use of Accounting of PHI Disclosure Clause in Contracts

Accounting of PHI Disclosure. (a) The Subcontractor shall document and keep a record of any disclosure of PHI and information related to such disclosures as would be required for Covered Entity to respond to a request by an individual for an accounting of disclosures of PHI in accordance 45 CFR § 164.528. (b) The Subcontractor shall provide the Business Associate, an applicable Covered Entity or an individual with information collected in accordance with subparagraph (a) of this Section 3.7 to permit the Business Associate and such Covered Entity to respond to a request by an individual for an accounting of disclosures of PHI in accordance with 45 CFR § 164.528. (c) The Subcontractor shall maintain this disclosure record for six (6) years from the termination of this Agreement.

(bii) The Subcontractor shall provide the Business Associate, an applicable Covered Entity or an individual with information collected in accordance with subparagraph (ai) of this Section 3.7 to permit the Business Associate and such Covered Entity to respond to a request by an individual for an accounting of disclosures of PHI in accordance with 45 CFR § §164.528. (ciii) The Subcontractor shall maintain this disclosure record for six (6) years from the termination of this AgreementBAA.
