Achievement of the Lease Effective Date or the Deemed Lease Effective Date. Notwithstanding any provision to the contrary contained herein, the Parties' rights and obligations under Articles 6, 7, 9, 10, 12, 13, 14 and 15 and Sections 8.3, 8.4, 8.5, 17.2, 17.3(a) and 20.1(b) shall not become effective until the Lease Effective Date or the Deemed Lease Effective Date shall have occurred in accordance with the terms and conditions of this Facility Lease. Each Party shall use commercially reasonable efforts to satisfy their respective conditions precedent to the Lease Effective Date as set forth in Schedule 5.1.
