A breach of this agreement by the lessee prior to taking possession of the rental unit if the rental unit is available by the lease effective date will not absolve lessee of liability under this agreement.
a. If the rental unit is occupied and/or undergoing repairs or remodeling at the time this agreement is entered into and it becomes obvious that the rental unit will not be available by the lease effective date:
(1) Lessee may cancel this agreement with a written notice to lessor.
(2) Lessee may extend the lease effective date to the date the rental unit is available.
(3) Lessee may cancel this agreement at any time during the extension up to the date the rental unit is available with a written notice to lessor.
b. Upon lessor’s receipt of lessee’s notice to cancel this agreement as per item 4.a., lessor must promptly refund all money paid by lessee.

The Parties acknowledge and agree that the insurance requirements in this Section 9.1 may be satisfied by insurance coverage obtained by the Operating Agent under one or more of the Xxxx 0 X&X Xxxxxxxxx, xxx Xxxx 0 O&M Agreement and the Common Facilities O&M Agreement or by insurance coverage obtained by the Project Manager under one or both of the Unit Ownership Agreements.

LEASE EFFECTIVE DATE. The Lease shall be effective on the Effective Date provided in Section A.4. The Lease Term shall commence upon the Lease Term Commencement Date and shall terminate on February 28, 2024 (the “Lease Termination Date”). The term of the Lease shall be the period beginning on the Lease Term Commencement Date and ending on the Lease Termination Date (the “Lease Term”).
