Acquisition and Lease of Assets. On the Document Closing Date, Lessee, in its capacity as Supervisory Agent, and Lessor entered into the Original Supervisory Agreement. Pursuant to the Supervisory Agreement, Lessee shall supervise the Acquisition of the Equipment and the Construction of the Facilities. On the Document Closing Date, Lessor and Lessee also entered into the Original Lease. Pursuant to the Lease, Lessor shall lease to Lessee on each Applicable Base Term Commencement Date, and Lessee shall lease from Lessor, commencing on each such date the Assets for the Term.
