Common use of Action Against Exchanges Clause in Contracts

Action Against Exchanges. You may in your absolute discretion take any actions whatsoever against any Exchange, Clearing House and/or any other person in respect of any failure by such Exchange, Clearing House and/or other person to make any payment or to deliver any amount of any Commodity in respect of any Futures/Options Contract referred to in Clause 5.1, provided that if any such action is taken by you, I/we shall fully indemnify you on demand in respect of all costs and expenses incurred by you in connection with the taking of such actions.
