SAFEGUARD AGAINST FRAUD. 11.1 The Supplier shall take all reasonable steps, in accordance with Good Industry Practice, to prevent any fraudulent activity (including Fraud) by the Supplier and the Supplier’s Staff (which for the purposes of this Clause 11 (Safeguard Against Fraud) shall include its shareholders holding in excess of the fifty (50) percent of the entire issued share capital of the Supplier and directors). 11.2 The Supplier shall notify the Authority immediately if it has reason to suspect that any Fraud has occurred, is occurring or is likely to occur save where complying with this provision would cause the Supplier or its employees to commit an offence under the Proceeds of Crime Act 2002 or the Terrorism Act 2000. 11.3 If the Supplier or the Supplier’s Staff commits Fraud in relation to this Framework Agreement, a Call-Off Contract or any other contract with the Crown (including the Authority), the Authority may: 11.3.1 terminate this Framework Agreement with immediate effect by giving the Supplier notice in writing, and recover from the Supplier the amount of any loss suffered by the Authority resulting from such termination, including the cost reasonably incurred by the Authority of making other arrangements for the supply of the Services and any additional expenditure incurred by the Authority throughout the remainder of the Term; or 11.3.2 recover in full from the Supplier and the Supplier shall on demand indemnify in full and hold the Authority harmless from and against any other loss sustained by the Authority in consequence of any breach of this Clause 11 (Safeguard Against Fraud).

The Supplier shall notify the Authority immediately if it has reason to suspect that any Fraud has occurred, is occurring or is likely to occur save where complying with this provision would cause the Supplier or its employees to commit an offence under the Proceeds of Crime Act 2002 or the Terrorism Act 2000. 10.3. If the Supplier or the Staff commits Fraud in relation to this Framework Agreement, a Call Off Agreement or any other contract with the Government (including the Authority), the Authority may: 10.3.1. terminate this Framework Agreement; and/or 10.3.2. recover in full from the Supplier and the Supplier shall on demand pay to the Authority all Losses sustained by the Authority in consequence of any breach by the Supplier of this Clause 10.
SAFEGUARD AGAINST FRAUD. 11.1 The Supplier shall take all reasonable steps, in accordance with Good Industry Practice, to prevent any fraudulent activity (including Fraud) by the Supplier and Supplier Staff (including its shareholders holding in excess of 50% of the entire issued share capital of the Supplier, members, directors). 11.2 The Supplier shall notify the Authority immediately if it has reason to suspect that any Fraud has occurred, is occurring or is likely to occur save where complying with this provision would cause the Supplier or its employees to commit an offence under the Proceeds of Crime Xxx 0000 or the Terrorism Xxx 0000. 11.3 If any person referred to in Clause 11.1 above commits Fraud in relation to this Framework Agreement, a Call-Off Agreement or any other contract with the Crown (including the Authority), the Authority may: 11.3.1 terminate this Framework Agreement with immediate effect by giving the Supplier notice in writing, and recover from the Supplier the amount of any loss suffered by the Authority resulting from the termination, including the cost reasonably incurred by the Authority of making other arrangements for the supply of the Available Goods and Services and any additional expenditure incurred by the Authority throughout the remainder of the Term; or 11.3.2 recover in full from the Supplier and the Supplier shall on demand indemnify the Authority in full from and against any other loss sustained by the Authority in consequence of any breach of this Clause 11.
SAFEGUARD AGAINST FRAUD. 11.1 The Authority places the utmost importance on the need to prevent fraud and irregularity in the provision of the Services. The Provider shall use its best endeavours to safeguard the Authority and any Other Contracting Body's funding of the Framework Agreement and/or any Call-Off Contract against Fraud generally and, in particular, Fraud on the part of the Provider or its Staff. The Provider shall pay the utmost regard to safeguarding public funds against misleading claims and shall notify the Authority or the relevant other Contracting Body immediately if it has reason to suspect that any Fraud has occurred or is occurring or is likely to occur. 11.2 Notwithstanding the general obligation in Clause 11.1 the Provider shall and shall procure that any Sub-Contractor shall: a) Have an established system that enables Provider and Sub-Contractor staff to report inappropriate behaviour by colleagues in respect of contract performance claims; b) Ensure that Provider or Sub-Contractors performance management systems do not encourage individual staff to make false claims regarding achievement of contract performance targets; c) Ensure a segregation of duties within the Provider’s or Sub-Contractor’s operation between those employees directly involved in delivering the service/goods performance and those reporting achievement of contract performance to the Authority; d) Ensure that an audit system is implemented to provide periodic checks, as a minimum at six (6) monthly intervals, to ensure effective and accurate recording and reporting of contract performance.

SAFEGUARD AGAINST FRAUD. The Contractor shall safeguard COI’s funding of the Framework Agreement and any Contract against Fraud generally and, in particular, Fraud on the part of the Contractor or its Staff. The Contractor shall notify COI immediately if it has reason to suspect that any Fraud has occurred or is occurring or is likely to occur.
SAFEGUARD AGAINST FRAUD. 26.1 The Supplier shall take all reasonable steps, in accordance with Good Industry Practice, to prevent any Fraud by the Supplier and/or its Personnel. 26.2 The Supplier shall immediately notify the Authority in writing if it has reason to suspect that any Fraud has occurred, is occurring or is likely to occur, save where complying with this provision would cause the Supplier and/or its Personnel to commit an offence under the Proceeds of Crime Act 2002 or the Terrorism Act 2000. 26.3 If the Supplier and/or the Supplier's Personnel commit Fraud, then without prejudice to the Authority's other rights or remedies: 26.3.1 the Authority shall be entitled to terminate the Contract by serving on the Supplier notice in writing with effect from the date specified in that notice; and 26.3.2 the Supplier shall on demand indemnify and keep indemnified and hold harmless each Commissioning Body from and against all Losses which each Commissioning Body may suffer or incur as a result of or in connection with any breach of Clause 26.
SAFEGUARD AGAINST FRAUD. The Contractor shall safeguard the I-Flair Members' and any Other Contracting Body’s funding of the Framework Agreement and any Call-Off Contract against Fraud generally and, in particular, Fraud on the part of the Contractor or its Staff. The Contractor shall notify the relevant I-Flair Member or the relevant Other Contracting Body immediately if it has reason to suspect that any Fraud has occurred or is occurring or is likely to occur.
