Common use of Acts and Omissions Clause in Contracts

Acts and Omissions. Except as otherwise provided in this Article, it is the intent of the Parties that liability for acts or omissions of a Party prior to the Effective Date shall remain with a Party and not be transferred, assigned, or assumed by the Authority. The Authority shall only be liable for its own acts or omissions that occur after the Effective Date and the Redesign District shall not be liable for any acts or omissions of the Authority.
