Common use of Additional Capital Expenditures Clause in Contracts

Additional Capital Expenditures. In addition to the Capital Expenditures ------------------------------- permitted under paragraph (a) above, the Borrower and its Subsidiaries may make additional Capital Expenditures during any fiscal quarter in such amounts as would be permitted under Section 8.09(e)(ii) (in the case of a payment of principal of Affiliate Subordinated Indebtedness, as if such Capital Expenditure constituted a payment in respect of Supplemental Capital thereunder).
