Common use of ADDITIONAL COMPENSATION FOR BATTALION CHIEFS Clause in Contracts

ADDITIONAL COMPENSATION FOR BATTALION CHIEFS. Employees in Job Code (JC) #8150SM (Battalion Chief) who are required to work during off-duty hours in accordance with subsections 14.B.1. (24-Hour Shift Compensation) and 14.B.2. (Assessment Center Compensation) below, shall be compensated at the premium compensation as specified in the respective subsection. The Union agrees that the provisions of the MOU are consistent with the FLSA, as implemented by the regulations of the Department of Labor, and that it will not file or pursue, or assist its members to file or pursue, claims or lawsuits that assert that employees, paid in accordance with the provisions of the MOU, are entitled to overtime compensation under the Act on the ground that they were not paid on a salary basis.
