Additional Limitations on General Partner. Notwithstanding any provision to the contrary contained herein, in the event that Buffett is named, or threatened to be named, as an individual defendant in any administrative, civil, criminal, governmental or arbitrable action (each such action, a "Proceeding"), no such pending or threatened Proceeding shall be settled, adjusted or otherwise compromised without the consent of Buffett in his sole discretion. So long as the Limited Partner is the Manager, the foregoing limitation on settlements shall be included in any insurance coverages purchased on behalf of the Partnership.
