ADJUSTMENT IN THE CONSTRUCTION MANAGER. S FEE Adjustment in the Construction Manager's Fee shall be made as follows: 7.4.1 for changes in the Work as provided in Article 9, the Construction Manager's Fee shall be adjusted as follows: 7.4.1.1 If the changes in the aggregate increase the total GMP by six percent (6%) or less, there shall be no adjustment in the Construction Manager’s Fee. 7.4.1.2 If the changes in the aggregate increase the total GMP by more than six percent (6)%, there shall be no change to the fee for the first six percent (6%) and the fee for any and all other changes in the Work in excess of one hundred six percent (106%) of the total GMP shall be calculated at the rate included in subsection 1.2.1 multiplied by the estimated cost of such work and shall be agreed upon between the Construction Manager and the Owner as a fixed fee for the effect of the change. 7.4.1.3 If there is a material reduction in the scope of the work greater than fifteen percent (15%) of the Fixed Limit Cost of Construction the Owner shall be entitled to an equitable reduction in the Construction Manager’s fee calculated at the rate included in subsection 1.2.1. 7.4.2 for delays in the Work not caused by the Construction Manager, except as provided in Section 6.3, there shall be an equitable adjustment in the Construction Manager's Fee to compensate the Construction Manager for increased expenses; and 7.4.3 if the Construction Manager is placed in charge of managing the replacement of an insured or uninsured loss, the Construction Manager shall be paid an additional fee in the same proportion that the Construction Manager's Fee bears to the estimated Cost of the Work for the replacement.
