ADJUSTMENT IN THE DESIGN. BUILDER’S FEE Adjustment in the Design-Builder’s fee shall be made as follows: 7.4.1 for changes in the Work as provided in Article 9, the Design-Builder’s fee shall be adjusted as follows: 7.4.2 for delays in the Work not caused by the Design-Builder, except as provided in Article 10 of Book 2, there will be an equitable adjustment in the Design-Builder’s Fee to compensate the Design-Builder for increased expenses; and This document is provided as a DRAFT and is not intended to be considered FINAL. The Commission explicitly reserves the right to modify this document and provide a revised Sample to Phase II Proposers. 7.4.3 if the Design-Builder is placed in charge of managing the replacement of an insured or uninsured loss, the Design-Builder shall be paid an additional fee in the same proportion that the Design-Builder’s Fee bears to the estimated Cost of the Work for the replacement, provided that such loss was not due to any error or omission by the Design-Builder, or any party for which the Design-Builder may be liable.
