Administrative Protection. Section 1: The parties acknowledge that indemnification and defense of public employees is governed by G.L. Chapter 258. Section 2: If an employee is attacked or otherwise molested in performance of her/her duties he/she shall be entitled to reasonable investigative support from the City. Consequent prosecution, if any, shall be handled by the District Attorney.

All City of Newburyport employees have the right to work in an environment free from harassment and violence. If an employee feels that they have been sexually harassed, harassed on the basis of national origin, race, color, sex, gender identity/expression, age, military service, religion, sexual orientation, disability or that an act of violence towards the employee has occurred, the employee shall immediately contact their supervisor. If someone in the employee's immediate chain of command is the alleged harasser, the employee shall immediately contact the Mayor's Office. All complaints of harassment will be taken seriously and promptly investigated. The City will preserve the confidentially of harassment complainants and witnesses as much as possible consistent with a thorough investigation. When necessary, the City may opt to hire an attorney to conduct a legal finding of fact. If a finding of fact has found an employee to be guilty of harassment, said employee shall be disciplined including demotion, transfer, suspension without pay, or termination.

H the administrator elects to take legal action, the Board may provide legal counseling to advise the administrator of hislher rights and obligations and render reasonable assistance to the administrator and judicial authorities. 2. L An administrator that is laid off and paid unemployment compensation during the summer immediately following the lay-off and is subsequently recalled to an administrative position by the time that he/she would have returned to work will be paid according to an annual salary rate, such that hislher unemployment compensation plus said annual salary rate will be equal to the rate of salary he/she would have earned for the school year had he/she not been laid off.
