Administrative Transfer Procedures. An employee who is being transferred administratively shall, upon request, be entitled to a consultation with the responsible administrator prior to the transfer in order to discuss the reasons for the transfer and to provide an opportunity for the administrator to hear and consider the employee's views on the matter. The employee may be represented by the Union at this consultation if he/she so requests. No employee shall be administratively transferred for punitive or disciplinary reasons or in reprisal for the exercise of any right provided by this Agreement or applicable law, except in cases that, as deemed by the District, keeping the employee at his/her location would be detrimental to the health, welfare or safety of the employee, administrators, students, or other employees. Also, the transfer of any employee to or from a school designated as a “low performing school” is deemed to be non- disciplinary and non-punitive in nature.
