Advertising Judgment. [SELECTED RESPONDENT] shall perform its advertising services and installation of the Advertising Signage in such a manner as to achieve aesthetic excellence and be compatible within the physical and operational context and safety requirements of NYCEDC’s and the City’s facilities and operations. [SELECTED RESPONDENT] shall at all times use good judgment in accepting any content material for advertising at, in, from and on the Advertising Signage and the Advertising Areas. [SELECTED RESPONDENT] shall avoid advertisements that are in direct conflict with the signage of the retail tenants in the Terminals (for example, advertisements of advertisers that are direct competitors of those retail tenants); however, an advertisement shall not be considered in “direct conflict” with the signage of that retail tenant if the advertisement is less than twenty five percent (25%) of the overall total existing advertising within the Advertising Areas and is located at a distance of at least one hundred (100) feet or more from the signage of the applicable retail tenant.
