Common use of Affiliated Agreements Clause in Contracts

Affiliated Agreements. Except as set forth on Schedule 5.16, there are no existing or proposed agreements, arrangements, understandings or transactions between either Borrower Entity, on the one hand, and such Borrower Entity’s officers, directors, stockholders, other equity holders, employees, or Affiliates or any members of their respective families, on the other hand.

Affiliated Agreements. Except as set forth on Schedule 5.165.16 and with respect to the Administration Agreement and the Advisory Agreement, there are no existing or proposed agreements, arrangements, understandings or transactions between either Borrower EntityBorrower, on the one hand, and such Borrower EntityBorrower’s investors, officers, directors, stockholders, other equity holders, employees, or Affiliates or any members of their respective families, on the other hand.

Affiliated Agreements. Except with respect to the Tier II Purchase and Sale Agreement and the other Loan Documents and as set forth on Schedule 5.165.15, (i) there are no existing or proposed agreements, arrangements, understandings or transactions between either Borrower EntityBorrower, on the one hand, and such Borrower EntityBorrower’s members, managers, managing members, investors, officers, directors, stockholders, other equity holders, employees, or Borrower’s Affiliates or any members of their respective families, on the other hand.

Affiliated Agreements. Except (x) as set forth on Schedule 5.16, (y) with respect to the Administration Agreement and the Advisory Agreement, and (z) as otherwise permitted pursuant to the terms and provisions of Section 7.5, there are no existing or proposed agreements, arrangements, understandings or transactions between either Borrower EntityBorrower, on the one hand, and such Borrower EntityBorrower’s investors, officers, directors, stockholders, other equity holders, employees, or Affiliates or any members of their respective families, on the other hand.
