Affiliates’ Confidential Information is Covered; Confidentiality Obligation Survives Termination. For purposes of this Employment Agreement, the term “affiliate” of BNC Bancorp includes Bank of North Carolina and any entity that directly, or indirectly through one or more intermediaries, controls, is controlled by, or is under common control with Bank of North Carolina. The rights and obligations set forth in this Article 8 shall survive termination of this Employment Agreement.
