Common use of Affordable Care Act (ACA) Reopener Clause in Contracts

Affordable Care Act (ACA) Reopener. During the term of the agreement, the County may reopen the agreement to meet and confer over the excise tax scheduled to be imposed on health care premiums under the Federal Affordable Care Act. The purpose of the re-opener will be to include plans that would help employees avoid the excise tax, but it is not intended to eliminate the HMO option currently offered. The intent of the reopener is not to increase the County contribution to offset the excise tax for employees.
